The Council will hold a public hearing on April 2 on the proposed CN-1 amendments. The actual ordinance will not be approved until the Council has had three readings of the ordinance. If for some reason the ordinance is not approved by the City Council, the first floor of your proposed building would have to be comply with the current ordinance. Based on the square footage of your proposed building, this would allow approximately 1100 square feet of office use. The remainder of the building would have to be used for one of retail, personal service or other permitted uses allowed in the CN-1 zone. As a consequence of these meetings we have developed this proposal submitted by Steve and Dee. We as student leaders would strongly encourage you to seriously consider this proposal and allow us to further investigate the idea of student members serving in an advisory capacity on the selected Boards and Commissions. We feel not only would this be a great learning experience for members of our Student Body but, it would also greatly benefit Iowa City by giving students a more direct role in the community. This more direct role would give the students on the committees and the student body as a whole a stronger vested interest in Iowa City itself. To: council@iowa-city.org Subject: A few issues Hello, My name is Simon Willard. I work downtown at Pizza On Dubuque. I have a few issues I would like to bring to the attention of the council if they have not already. -the first is what I see as a public safety issue concerning the traffic light at the corner of Gilbert and Iowa. there is no delay between the time at which the light turns red one way and green the other. Whereas every other light in the entire city allows a few seconds between yellow and red, and a few seconds between red and the opposing green to insure intersection clearance. -Not having the delay between the red and green allows for vehicles to still be crossing the intersection when the opposing lanes have their green. This is compounded by the fact that the Iowa Ave. lanes are staggared and traffic on Gilbert have almost twice the distance to clear both lanes of the intersection. SO, someone could be on Gilbert, passing through a yellow light (not running a red) and end up in the intersection for a few seconds while Iowa has a green. THIS IS DANGEROUS!!! I have watched for months and months witnessing this phenomenon, thinking that it would be fixed, but it has not. PLEASE RECTIFY THIS SITUATION!!!! -the second is not so much a public safety concern as it is maybe an public image thing. -it concerns the new metal plates of artwork imbedded in the sidewalks of Iowa Ave. Mainly one in particular. It is the compass one that is right in front of the offices in the new parking ramp. If you look at the compass you will notice something very wrong with it. It is very silly and elementary. I don't know how many hands this plate had to go through- from the person who designed it, to the person who made it, to the persons who packaged it, and finally those who put it in. You would have think someone would have noticed this major flaw. It is quite embarrassing for the City to have it there the way it is. Part of the quote is "...and the east and west long to trade places,..." The switch of the east and west demarcations on the compass were intended to playfully illustrate this line. The portion of your correspondence to the City Council pertaining to the traffic signal at the intersection of Gilbert St and Iowa Ave was forwarded to me for response. There is a 1.5 second all-md clearance interval at this intersection in both directions. The all-red interval is a safety mechanism in the signal phasing. However, we try to keep the all-md interval as short as possible because it negatively affects the efficiency of the intersection; traffic cannot move in either direction during the all-red phase. The locations where you see the extended all-red phase am places where we have addressed a high collision rate that is correctable by extending the all-red phase. This is not a factor at the Gilbert/iowa intersection. The Gilbert/Iowa intersection is not a high collision location. During 2001 there were only 2 right-angle collisions, and they were both left turning vehicles that failed to yield to oncoming traffic. Thank you for your correspondence. As some of you may or may not know, it has been a long and expensive process attempting to get permits to use the basement of our building at 13 S. Linn St. This started two years ago as a change of use debate which we won at the State Appeals Board. This city then challenged this ruling by arguing that the State of Iowa does not have jurisdiction over the City of Iowa City and appealed this decision to District Court. District Court recently ruled in our favor - both that the State of Iowa does have jurisdiction over Iowa City concerning this issue and that there was not a change in use. Now the Building Inspection office wants the City of Iowa City to challenge this ruling to the State Supreme Court. We appreciate the position the City of Iowa City has taken, but understand, we did not win this on a technicality. Our case is extremely strong and to have this decision overturned at the Supreme Court level is very, very unlikely. We feel that appealing this decision will only cost both ourselves and the City of Iowa City more in legal fees and unnecessary delays. It should also be noted that the City Attorney's office does not recon~end proceeding with this appeal. I believe this issue will be discussed at your next work session which will be March 18th and would appreciate it if you chose not to proceed with this appeal. I would enjoy the chance to meet with any of you to discuss this issue in more detail if necessary. I love this city and would prefer not to pursue legal recourse. Thank you for your time. Iowa Code § 476,25 establishes a state-wide system of exclusive electric service areas, Only one electric utility is authorized to serve any particular area in the state. Investor owned electric utilities are required by § 476.8 "to furnish reasonably adequate service and facilities" within their service areas, The Board has adopted administrative rules to implement that general requirement. Under 199 lAC 20.5, an electric plant must be constructed, installed, maintained, and operated in accordance with accepted good engineering practice to assure reasonable continuity of service, uniformity of service quality, and safety. The rule requires electric utilities to comply with various state and national codes and standards. The rule further requires ~ufficient generating capacity as well as transmission and distribution facilities to provide reliable service. Standards concerning voltage requirements and interruptions of service are contained in 199 lAC 20.7, In addition rule 20.8 addresses safety in the provision of electric service_ All of these statutory and rule requirements as to the provision of adequate service have the force of law and are effective throughout a utility's service area. iowa Code § 476,5 prohibits unreasonable prejudice or disadvantage as to rates or services to any person. Although, under Iowa law, a franchise agreement with MidAmerican is not a necessity, if you should determine that renewing a franchise agreement with this monopoly is required, we see no reason why such an extension should go beyond 2006, at which date the rate freeze set forth in proceedings before the Iowa Utilities Board will terminate. Until responses to a Request for Proposals issued by the City have been received by one or more vendors, we cannot state with certainty how ~nuch an initial feasibility study will cost. However, based on the best evidence we have been able to obtain, we do not expect the cost to exceed $75,000. Moreover, there are a number of communities and political subdivisions in Iowa that reportedly have demonstrated a present interest in exploring the possibilities of establishing publicly-owned electric utilities. We urge you to explore the possibility of pooling funds with one or more other entities to share the costs of this initial phase of exploration. We take this opportunity to re-state our position, as a matter of record, and urge your consideration of the following points: 1. We support a feasibility study that would gather the facts and enable the City to make an intelligent decision on behalf of its residents and businesses as to whether or not a municipally-owned electric utility should be established. The funds for the study, rather than being characterized as small or medium, ought to be characterized as appropriate and as necessary to make an intelligent decision. 2. We support a franchise extending to the end of year 2005 because that is when the rate freeze established under Iowa Utilities Board proceedings will expire. Beyond that date, if Iowa City has signed a long-term franchise agreement, there will be no local control over local utility rates--even if, by that time, other less costly alternatives have arisen in the marketplace. Having signed off on a long-term franchise, Iowa City citizens and businesses will be placed at the whim of the market and one sole provider. We believe It would be much more prudent if the City of Io~va City were to keep all of its options open until more information can be obtained and until MidAmerican Energy's position on future rate increases has been fully disclosed, 3. A franchise for the duration of eight years with a two-year opener may financially bind Iowa City to MidAmericau not only for ten years but well beyond. Indeed, even if the City, within ten years of signing the proposed franchise agreement, were to opt for a municipally-owned utility, MidAmerican might welI argue at that later date, before the Iowa Utilities Board, that the two projected power plants that are now being constructed were planned with Iowa City's "native load" customers in mind and that Iowa City's municipal utility must, therefore, pay for the "stranded costs" resulting from the City's lost customer base. The utility company would, in such case, then ask that Iowa City ratepayers pay twice for the same electrons--once to the municipal utility and once to MidAmerican. We are also concerned with an eight-to-ten-year franchise for the following reason: According to MidAmerican's proposal, the 8-year "opener," if exercised by the City, would allow 2 more years of franchise operation by the utility company. In effect, this position will be understood to endorse a 10-year extension of MidAmerican's franchise. We see no basis--in policy or in fact--for such an extension. Ironically, any information obtained in a feasibility study would have no value in a decade's time,he City would be required to perform the same study, most likely at a greater cost, just to obtain the same data! 5. We respectfully ask that you consider the appointment ora citizens' committee to assist you in bringing to light all the issues involved. Until we have more facts, no one can say whether establishing a municipally-owned utility will be economically in the best interest of the City of Iowa City. Therefore, let's not put the proverbial cart before the horse. First, let's allocate a sufficient amount of funds to conduct a feasibility study by a qualified expert. Then, based on that study, determine whether--and for how long, if at all--to extend MidAmerican Energy Company's franchise with the City of Iowa City. Given the California experiment, the Enron situation, and the uncertain course of events that will follow up to year 2006 when the MidAmerican rate freeze expires, we believe our position, urging a gathering of the facts and a calculated look at possible alternatives, is wise, reasonable, and serves the interest of all lowa City residents and businesses. Please, keep in mind the success of other communities with municipally-owned utilities such as Muscatine, Ames, and many others. For my internship I have taken on the project of dealing with the local litter problem in our town. Our town is a college town and furthermore, the college has a reputation of being a party school (so you can imagine the litter problem). To do this I am staking with a web search on how other cities have dealt or are dealing with their litter problems. Noting that your city is also a University city, I thought I would send an inquiry. We have two area's of our town that are extreme trouble spots with litter. Both areas are mainly student populated and the land owners are what some may call "Slum Lords". My question to you is do you have any area's like this? If so how did you, or how would you suggest, dealing with them? Is your garbage contracted through a company like BFI or is it done through city employee's? If contracted have they worked to help with the litter problem? If not what kind of problems are faced? Our garbage men are contracted through BFI. Also, I was wondering about the general population number for your city (How many residents on average)? I am wntmg you today regarding the upcommg changes to the mtersectm~frFrrs .b? Avenue and East Court Street. My family lives at 2326 East Court Street, just 3 h~ses ear, of the intersection. Next fall, we will have 3 children crossing this intersection at least twice per ~Jay as they walk to and from Hoover Elementary. This includes a kindergartener and two children with Attention Deficit Hyperactivity Disorder (ADHD). Needless to say, my wife and I are extremely concerned about the safety precautions that are being included into the new design. With that in mind, we have a few specific requests that we feel will help improve safety at the intersection. First, we need curb cuts. This is an area of concern with the intersection as it is currently designed; there are now 5 curb cuts, where as 8 would be more appropriate. The way it is now, people using wheelchairs, skates, strollers, etc. must go ~rther out into the intersection before doubling back to the sidewalk. This design is already unsafe, and will be unmanageable after the streets are widened. We hope you will incorporate 8 curb cuts into the design, so that the whole intersection becomes safer and more accessible. We are also concerned about the timing of the walk signals. We are going to be talking about an intersection the size of First and Muscatine, Burlington and Gilbert, Burlington and Clinton, etc. Speaking from experience, I know that it is very difficult to hustle my children across those intersections within the allotted time for crossing. Given that hundreds of schoolchildren will cross this intersection at least twice per day, this intersection must be handled differently than the previously mentioned examples. I hope that you will see fit to ensure adequate "walk time" at this intersection. Another safety suggestion might be either allowing the crossing guards to pause the lights, or altering the programming of the lights in some manner. While I know very little about the technology involved in traffic signals, I certainly hope that the City will be purchasing signals that can be easily reproglammed. I really feel that it may take some time to adjust practices to fit the reality of this intersection, and I should hope that we will not be constrained by our choice of equipment. Maintaining the flexibility of the signals at this intersection should be of the highest importance. I have taken the liberty of driving past Horace Mann Elementary on a couple of school mornings to see how the signals and crossing guards interface at this site. Unfortunately, I believe we cannot compare the two situations. While the traffic past Mann is significant, it is overwhelmingly in one direction. Children at the intersection of Dodge and Church have to contend with only one spot where cars can go right on red; children at our intersection will be faced with 4 of these critical spots. Perhaps the City of Iowa City and/or the Iowa City Community School District should consult with Cedar Rapids or other places where similar issues exist, and discuss the experiences these areas have had with comparable intersections. We must observe the best possible safety practices from the start, before a tragedy forces us to reexamine what we are doing. It's deporable, shameful, sickening, and unexcusable in this incredibly prosperous, brainy, and 'supposedly' proud university town. One exspects such awful conditions to exist in south Chicago or Gary Indiana where 50% of the people are below the poverty level and crime and corrupt government is the norm. But what is this fair city's excuse? I don't understand why this condition is tolerated. Look at the beautiful well-kept yards all over town where folks slave away endless hours to make thier castle the nearest place around. Then just a block away in some public place or around rental property lies the biggest pig stye of litter one can imagine! I know that sometimes concerned citizens form clean up groups to volunterily pickup the trash. I would gladly volunteer some of my time, and so would other folks, but this mess we have here is way beyond an occassional Earth Day affair. Here are two proposals I have to help remedy the situation. I keep hearing about a fair number of homeless people who settle in IowaCity. Many of these folks would never be hired to work regular type jobs for many obvious reasons, and even if they could get hired they might not last long at a job requiring 40 hours or more of work aweek, as well as having to have a phone, car, etc. Providing these people with part-time work clearing up the litter would give them money and pride in having work. This is currently being done in big eastern citys like N.Y. Homeless people are given neat looking jackets to wear that identify them as city employees and most take pride in what they do. A second solution to this horrendous problem would to have people convicted of 2nd offense crimes such as drunk driving, shop lifting, etc. to be required to do public service as part of their punishment. They would obviouly have to be supervised as well as the homeless folks would to make sure that they're actually doing the work. I suppose in these tight budget times that there wouldn't be one red cent for such a position--even a part-time one. Anyhow we can keep thinking up novel ways to make our city more attractive with new sidewalks inscribed with literay quotes, new shiny buildings, new Kiosks, but as long as the litter blows around our feet this town will continue to be an EYE SORE that will give me a 'heavy heart' and make me continue to wonder why a town that has so many resources tolerates so much filth.
