Champion: Thank you for coming. Ray: Thanks again, Mayor, Members ofthe Council. It's always a pleasure to come to Iowa City. Your staff, housing staff, does an excellent and commendable job. I came early today and Steve Long in the back was kind enough to show me some of your most recent projects in Iowa City, and I appreciated it. I don't get here that often and he took some of his own time to do that and that was a nice touch I thought. As the Mayor said, this is the 38th anniversary of the enactment of the Fair Housing Act. Thirty-eight years has been a long time. We've come a long way and we certainly have a further way to come. Our theme this year for the overall, I won't call it campaign. Our celebration of Fair Housing is that: fair housing. It's not an option - it's the law. And that's our theme this year and we're stressing that to communities like yours, and I'd just like to say thanks again for taking the time to do the proclamation. I appreciate it. I guess we'll start with you and maybe you could tell us... .got hung up there! Urn, the reasons that you were nominated. We really like to highlight your contributions to the City, so this is a chance for all the adults to hear the good work that you've been doing. Would you like to hold this? Here you go. Hi, my name is Ida Sisourath. I'm 12 years old and I'm a 6th grader at Grant Wood Elementary, and my teacher is Mr. Glen. I have been at Grant Wood since kindergarten. Before and after school, I have Safety Patrol and during school, I have Conflict Managers. I am in after-school programs, such as basketball, volleyball, and the Youth Leadership Program. I'm also a Senator in the classroom Congress. I would like to thank you, Mr. Glen, for being a great 5th and 6th grade teacher and to thank him very much for nominating me to get this award. He is the greatest teacher I've ever had, including the other teachers too. Thank you very much for this award. (applause) Hello, my name is Tanner Hayslett. I am a 6th grader at Grant Wood and my teacher is Mr. Glen. I have been a student at Grant Wood since my first day of kindergarten. It is an honor to be chosen for this award. Some of the things I am involved in inside and outside of school are Jazzy Jumpers, President of my classroom, Youth Leadership Program, Iowa Skippers, and basketball. I would also like to say thank you to Mr. Glen for nominating me for this award and being a great teacher and positive role model. (applause) That's why I'm always extra proud ofthe Grant Wood students. I had an opportunity to, I think when you were in 3rd grade, to do Junior Achievement and I could tell back then that you all were go-getters and ready to start contributing to your community. So, once again, we're really proud of you and your accomplishment. You have done a lot and we look forward to good things out of you all. I'm going to read off the award here. Wilburn: This is for items that are not on tonight's agenda; it's an opportunity for the public to approach the Council and mention an item. Please state your name and limit your comments to five minutes. Is there anyone here for public comment? Full: Hi there. I'm Jerry Full. I'm not currently a citizen ofIowa City. I live about two miles south ofIowa City. Reason I stopped by is a point of information for you folks. We look...the neighborhood on top ofIndian Lookout, if you're aware of that, it's Oakcrest Hill Road. We woke up about two weeks ago to find out we have 2,000 head of hogs going in about a half mile directly west of some of us, northwest...I'm sorry, directly west of some of us. Some of us are to the southeast, some of us are to the northeast. We didn't have a clue this was going in. The day I found out about it I drove over there. There were about ten concrete trucks backed up to the site. It's over the top of a hill and across 218 south, and I'm not here to complain to you guys or think you need to do something about it or anything like that. I am loath to go after people's property rights. That's one of the reasons I live in the country, but there is...the City Council has no effect on this. If you have problems with this, you can't do anything about it. The County Board of Supervisors can't do anything about this. The State requires that this particular operator file a plan to deal with the manure, a plan to deal.. .design.. .how he's going to build his building, but they don't really tell him how to do it. There's virtually no regulation on this. I had to pay $280 for a permit with the County to build a spring porch last year; nice place. He's paying about $320, I may be off a little bit there, to build a 15,000 to 20,000 square foot facility that is going to crank out nearly a million gallons, something like 800,000 gallons, of manure a year, and then he's going to inject it into the ground in the area. The reason I'm talking to you folks is that I worry about, if we don't raise a lot of cane about this, you're going to see more of them, because from all of the reading I'm doing, I assure you I didn't know anything about hogs two weeks ago, and I know a little bit more about them, but everything I'm reading is, where there is no resistance to these things, you're going to see six more, and then you're going to see two more, and then you're going to see the first one that came in expand. They follow the path ofleast resistance. If you have neighbors, you complain, occasionally go to court, there has been some court cases in the paper of neighborhoods, and a lot of.. . I'm talking to a lot of State Legislators and they're starting to get tired of hearing about this. I think there may be some movement, because.. .my phone lit up after, the day after Press-Citizen published a small article about us being unhappy about this, and my phone lit up from people all over the state, about fighting these in their neighborhoods. There are places for these things. You can argue about whether or not this is a good farming practice. Maybe there's one house there and they can come to an agreement. We've got 18 houses there, and it's a very mixed neighborhood. One of our neighbors got a plat map out, found 250 homes within a mile and a half. Now this includes a large trailer park, so it's...I mean, 250 homes in a mile and a half area seems like a lot of homes, but when you put in a high density area like that, a lot of people potentially are impacted. It's possible that I may be overreacting to this. I don't know. But if you got, if you get another one three miles.. .or another half mile closer to Iowa City, Mormon Trek's cutting south and...is that going to impact the growth down the road? I think it's possible. I think that's about all I have. If you have any questions, I would be glad to answer them the best I can. Thanks for your comments. Thank you. Anyone else who'd like to address the Council on an item that does not appear on tonight's agenda? My name is Sara Maiers and I'm a member of the Senior Center Commission and I just want to make a short little report to you on the activities of the Senior Center. The one thing that we have done recently is to make three new standing committees and so you'll be hearing more from us on the Committee for Fundraising, Promotion, Community Relations, and Outreach. Something that Linda Kopping announced at our last meeting was that there are three Senior Center volunteers who have received the Governor Volunteer Award. They are Don Coffman, Elsie Foerstner, and Richard Tiegs. They will be recognized in May at a ceremony in Des Moines by the Governor, and we just want to say that everybody at the Senior Center is very proud of these outstanding volunteers. Also, the VI School of Social Work is forming a practicum partnership program with the Senior Center through a grant from the John A. Hartford Foundation. The Senior Center is one of the field sites for services for older adults. The Center will receive four student support, by four students three days per week for ten weeks in the next school year. We really appreciate that and everybody is looking forward to that. Also, the Iowa City Senior Center Fund Inc. has elected their new officers. Jay Honohan is the President, Betty Kelly Vice President, Jo Hensch Secretary, and Linda Kopping is the Treasurer. So we're very happy that this is proceeding very well. Any questions? Thank you. Thank you. My name is Anne Hesse and I am here tonight as President of Project GREEN. Our Vice President, A.K. Traw, is also in the Council Chambers. We would both like to thank you for giving us this time on your agenda that we may speak very briefly about Project GREEN's commitment to the Iowa City community. Project GREEN's major public landscaping project in 2006 is the $90,000 landscaping of the final segment ofthe north Dubuque Street entryway to Iowa City. This segment will build upon and tie together the two previous landscapes, implemented by Project GREEN, between 2000 and 2004, creating a pleasant and welcoming natural parkway approach to the central community. The implementation of the landscape portion ofthis project begins mid-May and the anticipated completion date is July 30 ofthis summer. Project GREEN hired landscape architect Laura Hawks of R.D.G. Design to develop a low-maintenance landscape design which would include native trees and shrubs providing four-season interest and adaptability to the varying eco-systems of this corridor. Throughout the plarrning and design process, she consulted with the City engineers and inspectors, as well as the City Forester. She also applied for grants, assisting Project GREEN with the landscape costs of this project. MidAmerican energy contributed $20,000 through its "Trees, Please" tree planting program, and the Iowa Department of Transportation contributed an additional $4,000 through its "Keep Iowa Beautiful" program. The implemented landscape design will integrate and soften the hardscape and infrastructure constructed under the oversite of the City's engineering division. That was completed in the fall of2005. The area includes the right-of-way along both the east and west sides of north Dubuque Street, from Taft Speedway to approximately 500 feet north of the Foster Road and Dubuque Street intersection. Since the initial implementation of the north Dubuque Street landscape design in 1978 by co-founder of Project GREEN, Gretchen Hershberger, through the completion of this summer's project, Project GREEN will have landscaped and refurbished this major entrywayat six different times, investing oVer $250,000 on this entryway alone. Project GREEN funds for 2006 and 07 will be allocated in this manner: the $90,000 for the entryway of north Dubuque; $40,000 for continuing maintenance for Melrose A venue medians; north Dubuque Street entryway; Highway 6 bypass; and Iowa Avenue medians. This $40,000 is a recurring annual cost for the maintenance ofthe public projects within the City limits of Iowa City. We anticipate allocating $36,000 to the GREEN grants for schools, $9,000 will probably be needed for the second-Sunday garden forums and public education, and of course, we desire greatly to have a reserve of$75,000 for possible new projects This represents only a reasonably accurate transcription of the Iowa City City Council meeting of April 4, 2006. #5 Wilburn: Kirby: Wilburn: Kirby: Wilburn: Kirby: Wilburn: Page 8 and programs. A very brief history of our investments in the community projects. Over the past 38 years, Project GREEN has invested over $1.4 million in public landscaping projects, projects and programs from 1968, our beginnings, through this year of 2006 include the following investments and costs -- $195,826 for professional landscape designs for the Iowa City Community School District school properties, and matching funds to Parent Organizations that those designs may be completed with the investment of plant materials; $1,204,174 has completed over 30 new major City public landscaping projects and provided the continued, on- going maintenance for many of the projects; and $68,500 to promote horticultural education and enviromnental awareness through garden forums, garden tours, and biannual newsletter. In addition, it is estimated that Project GREEN volunteers have invested over 202,860 hours. At minimum wage, those hours translate into the equivalent of$I,044,729. Many additional hours have been spent in conceptualizing, building partnerships, and planning for projects, which have greatly improved the quality oflife and the enjoyment of our community for residents and visitors alike. As we have experienced escalating costs ofthe plant materials, the installation of those plant materials, and the maintenance of City public green spaces, Project GREEN encourages area corporations, small businesses, and individuals to consider the impact that Project GREEN has made upon this community, as we continue together to invest in our community's appearance and enviromnent. My name is John Kirby and I'm from Cedar Falls, and I have a picture of my burning home and I have a copy of an arson report, and the reason I bring this to you, is I want to step forward and say that I'm the injured party in this, and I feel that the City ofIowa City brought to cause that this took place. Are you wanting to give us...pass information out or, are you just wanting to state that for the record? Well, 00, I don't know. I just think that that's quite a shocking thing, I would imagine. But this is... . . . why that happened. This is community comment. It's not a dialogue with the Council. It's a chance for you to present something. We'll make sure the Council gets it. We'll accept it as correspondence, but... Kirby: Okay, as a person who's been injured, by I feel the City ofIowa City, and I show this to you. Is there any other steps that I should take? (female): Is there a complaint process or what... Dilkes: You can file a claim with the City, through the Finance Department, and that office is open 8:00 to 5:00 during the day. Kirby: Do you know anything about this, ma'am? Dilkes: Based on the information you've just stated? (unable to hear) No. Kirby: Well, I'm just saying, have you heard anything? Wilburn: Sir, I'm just inviting you, if you have some information, if you're... you're welcome to make the claim. If you would like some type of response or reply, you need to put something in writing for us and give it to us. The Council will get it and we'll take a look at it. Kirby: I have a letter that I wrote to Senator Grassley. And I could maybe give you that. Wilburn: We would accept that as correspondence. Kirby: And I. .. but I feel that that's a private matter between he and I. Wilburn: Okay. Champion: Maybe it's important to tell him that the reason we can't have a discussion with him is that this is not on our agenda, and because ofthe Open Meeting laws, we cannot have a discussion with you. Kirby: I just saw your agenda and it had something to do with H.D.D. and civil rights and I just thought this was the appropriate time to bring this up. (REZ05-00026/SUB05-00019) 1. PUBLIC HEARING Wilburn: (pounds gavel) Public hearing is open. Machesney: My name is Larry Machesney. I'm representing the Dial Corporation. Also with me tonight is Darryl Smith, Civil Engineer with V.J. Engineering. Do you want me to make some comments, or are you familiar with what the request is? Don't want to take your time, but... Wilburn: Well, we've received information in our packet about your request. It's a public hearing. You're welcome to supplement that, or provide a summary, if you wish, for our benefit and for the public. Machesney: Okay. Well, real briefly, this project was started around 1999, and as the market changes, things change for developers, things change in the senior housing business. What's driving the request tonight is the, not really to, we're not asking you to change zoning. We're not asking to reduce parking requirements. We're not asking you to allow increased density of any significance. We do want to, the developer does want to build a common area, a central dining room, central commercial kitchen, so that meals can be provided, because as they have found over the years, that those become very important to the senior campus. All buildings now would be connected via enclosed and conditioned connecting links, so that nobody has to.. .in the independent segment of the campus, nobody has to go outside to receive their meals and the number of units that we're asking for in the next phase is 57 and along with those 57 units would be this central commons area, which including, or in addition to the dining facilities, would include some other common facilities that are commonly found in new senior housing campuses. CONDITIONALLY REZONING APPROXIMATELY 1.51 ACRES OF PROPERTY LOCATED ON KOUNTRY LANE SE EAST OF SYCAMORE STREET FROM INTERIM DEVELOPMENT-MULTI- FAMILY (ID-RM) TO LOW DENSITY MULTI-FAMILY RESIDENTIAL ZONE (RM-12). (REZ06-00003) 1. PUBLIC HEARING (pounds gavel) Public hearing is open. Good evening. My name is Steve Gordon and I am here representing the owners of Sycamore Apartments and their request to rezone one and a half acres on Kountry Lane, from ID-RM to low-density multi-family RS-12. I appreciate your time this evening. The project is part of the Saddlebrook annexation that brought approximately 420 acres into the City about ten years ago. Ten acres of that 420 was a County multi-family zone. During the annexation, that 10 acres was brought in as an RM-12 and there was an additional 59 acres surrounding it zoned ID-RM. The ID-RM designation was placed on the land because at that time there was no City services in the area. In addition, during the annexation process, there was about 200 acres set aside as part of a conservation easement for the preservation and enhancement of wetlands, excuse me, and to provide ample green-space for the entire development. About five years ago, the City brought sewer and water to the area, and in addition, purchased about 70 acres for the use, for use as part of the southside storm water management facility. The purchase of the land and the construction of the stormwater management facility left about six and a half acres of the RM-12 and this one and a half acres, isolated and separated from the rest of the land that was part of the annexation. Over the last several years, we built the Sycamore Apartments on the RM-12 ground and they have provided a quality living environment at a very affordable price. We would like to complete the area with this request tonight. The site plan is designed to minimize the impact to the neighbor to the east, building I, which is one ofthe new buildings, has been moved as far to the west as possible and is 40 feet away from the lot line. That's part of the conditional zoning agreement. And is 127 feet from the home on the adjoining lot. The building also sits back off from the drive and is parallel with existing buildings A and B. It has been designed to have a two and a half story fayade to minimize its height. We've included a landscape burb between building I and the east lot line; split-rail fence to help designate that lot line, and a sidewalk which connects this project with the City trail system, which is directly to the south. All these features were part of discussions with the neighbor and the City staff. The project is surrounded on two sides by City park land, in addition to connecting directly to the City trail system, is in close proximity to the Saddlebrook green-space. We feel this project meets the Comprehensive Plan and blends in with the existing apartment community. I think you put that in the packet. Atkins: No, but thank you. It's really a big deal! Correia: Yeah, yeah, I think that's good for the City and for our Fire Department, and for the public. So, just wanted to congratulate the Fire Chief on that and just wanted to announce for folks that the Youth Advisory Commission is up and running. We've had two meetings and, at the April 18th meeting, we'll still have a chance to meet all the members and they're really energetic bunch and I'm hopeful of good things to come. We had the opportunity to go out and celebrate with Grant Wood this week on the opening of their Family Resource Center, the preschool, and the gymnasium. This was a very large cooperative effort between the City and the School District, and we put federal dollars in it from our CDBG money that you heard from the Director this week, so ] suspect he saw that project today. That was put into the Family Resource Center. We also recognized the need for recreation opportunities south of Highway 6 for those families, so the children didn't have to cross Highway 6 and the City contributed another $450,000 to oversize that gymnasium so it will be available for City recreation, as well as for school activities. So, in total, we put in $725,000 to that public project, and it's beautiful, and the kids were really excited. Also, ] want to thank the West High club for inviting me out for a job shadow and then conversation with the local government group that meets with their instructor, Terry Neuzil. These are bright, intelligent young people who are very interested in the process, policy, and legislation, and] thoroughly enjoyed my time, and ] hear several of you are going to go on Friday and do the same thing.
