The special circumstance which applies to this property is that the property is adjacent to a stormwater retention basin easement. No structures can be built in this easement and it will remain open space. Reducing the sideyard by 2ft which still provides for a 3ft sideyard along that mutual lot line will not affect any neighboring property. The minor modification will not be detrimental to the public health, safety, or welfare. The minor modification conforms with the intent and purpose of the Zoning Ordinance. The minor modification does not exceed the standards authorized by the Zoning Ordinance (i.e., the standard allowed is a sideyard reduction of no more than 2ft and the request is a sideyard reduction of 2ft). The minor modification does not relieve the property owner from complying with all other applicable statutes, ordinances, laws or regulations. If you have not done so already, you must complete a building permit application and submit it to the Department of Housing and Inspection Services at the Civic Center. Include two copies of plans for your project, and allow at least five working days between submission of all the necessary documentation and issuance of the building permit. A report of the findings upon which our decision was based is enclosed. That decision must be recorded in the Office of the Johnson County Recorder before the building permit may be issued. Additionally, you must exercise the minor modification within 180 days from the date of approval or the minor modification shall become null and void.
