The special circumstance which applies to this property is that the property is adjacent to a stormwater retention basin easement. No structures can be built in this easement and it will remain open space. Reducing the sideyard by 2ft which still provides for a 3ft sideyard along that mutual lot line will not affect any neighboring property. The minor modification will not be detrimental to the public health, safety, or welfare. The minor modification conforms with the intent and purpose of the Zoning Ordinance. The minor modification does not exceed the standards authorized by the Zoning Ordinance (i.e., the standard allowed is a sideyard reduction of no more than 2ft and the request is a sideyard reduction of 2ft). The minor modification does not relieve the property owner from complying with all other applicable statutes, ordinances, laws or regulations.
