Jefferson Street. The condition applied to the approval is that three non-stacked off street parking places be supplied on the property. The special circumstance which applies to this property is that the neighborhood is an older neighborhood and the other buildings on the Evans Street frontage are set back closer than the currently required 20 ft setback. The minor modification will not be detrimental to the public health, safety, or welfare. The minor modification conforms with the intent and purpose of the Zoning Ordinance. The minor modification does not exceed the standards authorized by the Zoning Ordinance (i.e., the standard allowed is a 15% reduction of the required 20ft setback, that is 3ft, and the request is a reduction of no more than 3ft). The minor modification does not relieve the property owner from complying with all other applicable statutes, ordinances, laws or regulations.
