WHEREAS, in Resolution No. 04-120, the City Council approved a listing agreement ("Listing Agreement") among the Airport Commission, the City Council, and NAI Iowa Realty Commercial to sell and lease the property known as the Aviation Commerce Park subdivision; WHEREAS, the Listing Agreement has previously been amended nine times including most recently in Resolution No. 08-353; WHEREAS, the Listing Agreement will expire on December 31, 2009; and WHEREAS, it is in the best interest of the City of Iowa City to amend to the Listing Agreement by extending the term to December 31, 20010. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT the Mayor is authorized to sign and the City Clerk to attest to the Tenth Amendment to Listing Agreement, a copy of which is attached. Washington St., Iowa City, IA 52240 (319) 356-5247 RESOLUTION NO. 09-380 RESOLUTION AUTHORIZING STAFF TO ENTER INTO A GRANT AGREEMENT WITH IOWA DEPARTMENT OF NATURAL RESOURCES FOR THE IOWA LOW-HEAD DAM SAFETY COST-SHARE PROGRAM WHEREAS, a growing number of U.S. cities are developing water trails to improve recreation access to waterways; and WHEREAS, enhancing recreation opportunities improves the quality of life for Iowa City residents and visitors; and WHEREAS, canoe and kayak access to Peninsula Park is a planned amenity noted in the master plan for said park; and WHEREAS, the City of Iowa City was awarded $24,000 by the Low-Head Dam Safety Cost-Share Program of the Iowa Department of Natural Resources to construct a portage trail around the Iowa River Power Dam at Peninsula Park; and WHEREAS, the City of Iowa City shall approve a grant agreement between the City and the Iowa Department of Natural Resources at an official meeting to receive said funds. Location: 1136 East Washington Size: 3.92 acres Existing Land Use and Zoning: Single-family Residential (RS-5) Surrounding Land Use and Zoning: North:Residential (RS-5) South:Residential (RS-8) East:Residential (RS-5) West:Residential (RS-8) Comprehensive Plan: Potential Public Open Space Neighborhood Open Space District: City High Open Space District File Date: October 15, 2009 (Legal papers must be filed to complete application) BACKGROUND INFORMATION: The applicant has requested a re-subdivision of two properties located on East Jefferson and East Washington Streets that would result in two new lots. Lot 1, a 2.33 acre lot, would contain the existing house and maintain the required 60-foot lot width along East Washington Street and have vehicle access provided along an existing private drive (Ruliffson Drive). The second lot, designated as Outlot A (private open space) would combine a .21 acre lot fronting on Jefferson Street with 1.38 acres of land that is currently part of the Washington Street property. This outlot would have frontage along Jefferson Street. 2 ANALYSIS: Zoning and Sensitive Areas: The zoning code allows development of this property for single- family uses. The applicant is proposing two lots: Lot 1 containing the existing house, and Outlot A for private open space. If the property designated as outlot was instead proposed as a developable lot, it would be subject to the sensitive areas ordinance, which would trigger a sensitive areas site plan. However, because the lot has been designated as an outlot, it is not considered developable and is not required to go through this level of review as part of this subdivision review. However, if the owner, or a future owner, of the outlot decides to develop the open space property, a new subdivision would be required in order to change the lot designation. At that point a sensitive areas development plan would be required for the site. Both lots contain sensitive features, including wooded wetlands, floodway and floodplain. The Johnson County Soil and Water Conservation District (JCSW) has submitted a letter concerning the development potential of this property (see attached). JCSW advises that no or minimal development and/or structures be allowed in the floodplain and that the soil in this area is susceptible to erosion and not appropriate for development. The letter also notes that these woodlands may provide habitat for an endangered species-the Indiana Bat. Because the outlot is located almost entirely in the floodway, its development potential is extremely limited. Access: The proposed subdivision divides the land so that each lot has property on both sides of the Ralston Creek. The stream banks along the northern branch of the creek are quite deep and steep and therefore not easily crossable. In order for both property owners to be able to maintain their land, staff recommends access easements such that the owner of Outlot A can access land south of the creek from a portion of Lot 1 west of the private drive, and so that the owner of Lot 1 can access land north of the creek from Outlot A along Jefferson Street. The current plat does not provide such easements. The easements should also be included in the legal documents for the subdivision. Compliance with Comprehensive Plan: The Comprehensive Plan encourages acquisition of stream banks and floodplains of Ralston Creek for incorporation into the public open space system. Because there is a deficit of public open space in the Central Planning District, and because land along the creek is desired as public open space or for trail connections, the Central District Plan identifies this area as potential public open space. Approval of this subdivision will not preclude the future purchase of this property if the Parks and Recreation Commission wishes to acquire it. Compatibility with neighborhood: Because the applicant is not proposing any new development at this time, the subdivision is considered compatible with the neighborhood. Neighborhood parkland or fees in lieu of: Based on the Neighborhood Open Space Ordinance, the dedication requirement is approximately 0.085 acres (3,703 square feet). Although Outlot A is proposed as open space, its intended use is not for the surrounding property owners or neighborhood. Because there are no public parks or trail system in this vicinity the dedication of such a small area of parkland would not be appropriate, therefore staff recommends fees in lieu of land dedication. The Parks and Recreation Commission will review the subdivision. 3 STAFF RECOMMENDATION: Staff recommends that this application be deferred until the deficiencies and discrepancies are addressed. Upon correction of deficiencies and discrepancies staff recommends approval of SUB09-00009 . DEFICIENCIES AND DISCREPANCIES: 1. Legal papers must be submitted. 2. Access easements should be in place such that the owner of Outlot A can access land south of Ralston Creek from a portion of Lot 1 west of the private drive, and so that the owner of Lot 1 can access land north of the creek from Outlot A along Jefferson Street. It is advised that no or minimal development and/or structures be allowed in the floodplain. Structures are not suitable for this particular soil type and should be limited. The Johnson County Soil Surrey indicates soils for this area are associated with small streams and drainage ways, this soil is subject to flooding (11 B Colo-Ely). There are also two soils on site that consist of excessive slopes and are subject to moderate erosion. (163C & 163D2 Fayette & Downs Silt Loam) Some other considerations: 1. USFWS may need to be contacted before any tree removal, due to potential critical habitat for the endangered species, Indiana Bat. 2. The project may have potential archaeological sites. 3. WHEREAS, the U.S. Department of Housing and Urban Development (HUD) requires the City of Iowa City, Iowa, to prepare and submit a Consolidated Plan known as CITY STEPS to plan for the coordinated use of federal, state, and local funds to assist lower income residents with housing, jobs and services; and WHEREAS, the City has held a series of public meetings on the needs of low income residents; and WHEREAS, the City has disseminated information, received public input and held at least one public hearing on the Consolidated Plan; and WHEREAS, the Consolidated Plan outlines afive-year strategy to address the City's goals for housing, jobs, and services; and WHEREAS, adoption of the Plan will make Iowa City eligible for federal and state funds administered by the U.S. Department of Housing and Urban Development; and WHEREAS, the City Council finds that the public interest will be served by the adoption of the Consolidated Plan and submission to the U.S. Department of Housing and Urban Development. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT: 1. Iowa City's Five-Year Consolidated Plan for 2011-2015, on file in the Planning and Community Development office, be and the same is hereby approved and adopted. 2. The City Manager of Iowa City is hereby authorized and directed to submit Iowa City's Five-Year Consolidated Plan for 2011-2015 to the U.S. Department of Housing and Urban Development, and is further authorized and directed to provide all the necessary certifications and technical corrections required by the U.S. Department of Housing and Urban Development in connection with said Plan. 3. WHEREAS, the UniverCity Neighborhood Partnership Program is a joint effort between the University of Iowa and the City to encourage home ownership and reinvestment in designated neighborhoods surrounding the University of Iowa; WHEREAS, the City has received a $1 million I-Jobs grant to assist in the acquisition and rehabilitation of 20 single-family homes to provide affordable housing in designated neighborhoods surrounding the University of Iowa; and WHEREAS, in Resolution No. 09-335, City Council entered into a grant agreement for these I-Jobs funds for affordable housing. The properties selected must be located in designated neighborhoods adjacent to the University of Iowa Campus. Council has previously accepted the funds and authorized the City Manager to sign the grant agreement. On the agenda is a proposed resolution authorizing the Mayor and City Manager to sign all documents necessary to acquire and rehabilitate the homes. The subsequent sales to the homebuyers will proceed through City Council as required by State law. This memorandum is to provide you with additional information about the acquisition, rehabilitation, and sale processes. The proposed program will allow the City to acquire properties with financing from local lenders: First American Bank, Hills Bank, Midwest One Bank, and the University of Iowa Community Credit Union. In total these local lenders will provide more than $3 million in financing to purchase these homes. I-jobs funds will pay for up to $50,000 in renovations per house, with one hundred percent of this money going to renovation costs-no administrative fees. Once renovations are complete, the homes will be sold as affordable housing to households that meet income guidelines and pre-qualify fora mortgage. Household incomes and employment status will be verified by City staff. Priority will be given to homebuyers who work within the designated neighborhoods or those who work in the Downtown area, North Market Square, Mercy Hospital, or the Near Southside and Riverfront Crossing development areas, or on campus (including University Hospitals or VA). Applicants who work at Mann or Longfellow Elementary Schools are also given priority. The opportunity to purchase specific homes will be determined through a lottery process. Homebuyers who are selected to purchase one of the homes rehabbed will pay the original acquisition price plus loan and carrying costs, including interest for time property is held in City ownership, recording fee for the mortgage, mowing and snow removal, utilities, real estate taxes, and insurance. This is not anticipated to exceed $3,500. The cost of renovations will NOT be passed on to homebuyers so long as the homebuyer retains ownership of the property as their primary residence for 5 years. Homebuyers will be required to sign a resale agreement to ensure that the property remains owner occupied December 9, 2009 Page 2 and affordable for a minimum of 10 years. University faculty and staff who qualify and who are selected to purchase a home through this program may also be eligible for downpayment assistance and closing costs (funding provided by the University of Iowa). In addition the UniverCity homebuyer incentives may be combined with other programs and incentives including the Federal Homebuyer Tax Credit. The next step in the process is to identify and purchase properties for the program. To qualify for the program, properties must be located within the designated UniverCity Neighborhoods (see eastside and Westside maps), must have a current rental permit, must be priced under $200,000, and must be in a condition that can be addressed within the $50,000 rehab budget. City staff will administer the program and provide recommendations and oversight on the home renovation process. Prospective properties will be screened by the City's Housing Rehabilitation staff who will provide an evaluation and budget estimate for improvements necessary to make the house saleable for single-family housing. Additional review and assistance in the property selection process will be provided by the UniverCity Neighborhood Partnership Committee, which consists of representatives of the Iowa Area Association of Realtors, the Homebuilders Association of Iowa City, the University of Iowa, designated neighborhood associations, a participating lender, the Friends of Historic Preservation, and an affordable housing agency. The committee will review recommendations from staff (including rehab estimates) and give consideration to properties that are likely to have an impact on the block and neighborhood in which they are located and properties that are likely to be desirable as owner-occupied over the long- term. Staff recommendations and committee selections will be forwarded to the City Manager, who will have the final say in approving property acquisitions. The City will purchase the properties with a loan from one of the local lenders listed above, and the City will give the lender a mortgage on the property. The lender will charge the City interest below the prime rate. Once purchased, City staff will open a competitive bidding process for contractors to complete home renovations as prioritized by City Housing Rehabilitation staff. Renovations must be completed within 8 to 12 weeks and will be inspected by staff. Staff are already beginning to identify and evaluate properties that qualify for the program. The first round of property purchases and renovations will get underway in January, with homes available for re-sale as early as March. The program has already generated a great deal of interest from realtors, landlords, renters, and neighborhood residents. We have set up a website www.icgov.orq/UniverCity to provide a description of the program and to provide information for those interested in selling properties as well as potential homebuyers and contractors. We will begin working with the University and other organizations to promote the homeownership opportunities in the coming weeks.
