(1) CONSIDER A MOTION SETTING A PUBLIC HEARING FOR APRIL 16 REGARDING THE PROPOSED COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) AND HOME INVESTMENT PARTNERSHIP PROGRAM (HOME) BUDGETS FOR THE FY03 ANNUAL ACTION PLAN, THAT IS A SUB-PART OF IOWA CITY'S 2001-2006 CONSOLIDATED PLAN (CITY STEPS), AS AMENDED. Comment: At their March 21, 2002, meeting the Housing and Community Development Commission made recommendations to the City Council for FY03 CDBG and HOME funding. A public hearing on the proposed CDBG\HOME allocations and Annual Action Plan is required by the U.S. Department of Housing and Urban Development (HUD). (2) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR APRIL 16 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE FIRST AVENUE CORRIDOR IMPROVEMENT PROJECT - ROCHESTER AVENUE TO D STREET, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project includes improvements to the Court Street and First Avenue intersection as well as the Rochester Avenue and First Avenue intersection. Also included is paving rehabilitation work on First Avenue between Rochester Avenue and D Street. 115 (3) CONSIDER A RESOLUTION DETERMINING THE NECESSITY AND SE'I-rING DATES OF A CONSULTATION (APRIL 15) AND A PUBLIC HEARING (MAY 7) ON A PROPOSED LOWER MUSCATINE ROAD AND HIGHWAY 6 URBAN RENEWAL PLAN FOR A PROPOSED URBAN RENEWAL AREA IN THE CITY OF IOWA CITY. Comment: The proposed urban renewal plan would make available the use of tax increment financing for projects in the area more commonly referred to as the Procter & Gamble site and the Goodwill Industries site. At its March 21, 2002, meeting, the Council Economic Development Committee, by a 3-0 vote, recommended that the City Council adopt the plan. Comment: The proposed urban renewal plan would make available the use of tax increment financing for projects in the area more commonly referred to as the BDI Industrial Park. At its March 21, 2002, meeting, the Council Economic Development Committee, by a 3-0 vote, recommended that the City Council adopt the plan. e. Resolutions. o~ /// (1) CONSIDER A RESOLUTION RATIFYING THE FILING OF AN APPLICATION WITH THE IOWA DEPARTMENT OF CULTURAL AFFAIRS FOR IOWA COMMUNITY CULTURAL GRANT FUNDS. Comment: The Public Art Advisory Committee has submitted a grant application to the Iowa Department of Cultural Affairs for the Iowa Community Cultural Grant to enable the development of a program to place public art in Iowa City's neighborhoods. The grant request is for $1[},000 with a local match of ~ The end result of the proje/~t would be the placement of public art in four Iowa City neigh)~orhoods. The grant proposals were due March 29, 2002; this/resolution ratifies the Council's support for the project. ~ ~,~ 0,~- ~la- (2) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO A'I-rEST TO THE RESALE AGREEMENT REGARDING THE PROPERTY LOCATED AT 2750 IRVING AVENUE, IOWA CITY, IOWA. Comment: On March 15, 2002, the Iowa City Housing Authority, through its Affordable Dream Home Program, provided a qualified Iow income family a $34,000 loan, which is secured by a second mortgage, to assist them in the purchase of the single-family home located at 2750 Irving Avenue. In the event that they sell the home within fifteen years, the Resale Agreement, in part, requires that the owners sell to a qualified Iow-income family and that the City receive a percentage of the appreciated value of the property. April 2, 2002 City of Iowa City Parle 4 (3) CONSIDER A RESOLUTION ACCEPTING PAYMENT OF o,~- //~ $300.00 CIVIL PENALTY AND WAIVER OF RIGHT TO HEARING FROM DELI MART, 525 HIGHWAY 1 WEST, IOWA CITY, PURSUANT TO IOWA CODE SECTION 453A.22(2) (2001). Comment: This Resolution accepts payment of a $300.00 civil penalty, authorized by Iowa Code section 453A.22(2), from Deli Mart, 525 Highway 1 West, Iowa City. Section 453A.22(2) provides that a $300.00 civil penalty will be assessed to a retail cigarette permit holder when and if that permit holder's employee is convicted of or pleads guilty to selling or providing tobacco to a minor. By making this payment and signing the appropriate waiver, Deli Mart waives its statutory right to have a hearing on ~ whether the civil penalty should be assessed. f. Public hearing on amendments to the Comprehensive Plan, South District Map to show the general alignment of a future east-west arterial street and to amend the text of the plan to refer to the alignment. Comment: At its February 21 meeting, by a vote of 5-1 (Hansen voted no), the Planning and Zoning Commission recommended approval of these amendments to the Comprehensive Plan. The amendments will depict the location of a future east/west arterial street to be built between Gilbert Street and Scott Boulevard generally located south of the current City limits. Staff recommended approval in a report dated February 14. Action: , b. Public hearing on arhendments to the Comprehensive Plan to provBe for the location of large apartment in new neighborhoods and to amend the South District Plan land use map to depict multi-family development on the east side of South Gilbert Street east and south of Napoleon Park. Comment: The proposed amendments would allow large apartment complexes in new neighborhoods and would identify an 18-acre multifamily zone on South Gilbert Street. At its February 21 meeting, by a vote of 4-2 (Chait and Shannon voted no), the Planning and Zoning Commission recommended denial of the proposed amendments. Staff recommended denial in a report dated February 7. Action: c. Public 4 acres fro Development Single Family (ID-RS) and Interim Development Multi- Family (ID-RM) to Planned Development Housing Overlay-12 (OPDH- 12) to allow 168 dwellings in 16 buildings located on the east side of Gilbert Street south of Napoleon Lane. (REZ01-00024) Comment: This rezoning would allow the construction of a 168- dwelling apartment complex with a total of 624 bedrooms. At its February 21 meeting, by a vote of 4-2 (Chait and Shannon voted no), the Planning and Zoning Commission recommended denial. Staff recommended denial in a report dated February 7. Public hearing on an ordinance rezoning 5.45 acres from Rural Residential (RR-I) and Interim Development Single Family Residential (ID-RS) to Low Density Single Family Residential (RS-5) located at the northwest corner of Rohret Road and Phoenix Drive. (REZ02-00001) Comment: If approved this rezoning will allow a one acre lot to be subdivided into residential lots of a minimum of 8000 Square feet in area. Covenants may restrict the subdivision of some of the property included in this rezoning. At its March 7 meeting, by a vote of 6-1 (Anciaux voted no), the Planning and Zoning Commission recommended approval subject to a Conditional Zoning Agreement regarding sewer easements and limitations on curb cuts on Rohret Road. Staff recommended approval in a report dated February 21. Action: ["~0 (:~ ~ e. Public hearing on an ordinance amending the Neighborhood Commercial, CN-1, zone to broaden the uses allowed and to revise the dimensional requirements and design provisions. Comment: At its March 7 meeting, by a vote of 7-0 the Planning and Zoning Commission recommended approval. This amendment is part of the code rewrite. Its provisions implement the policies of the Comprehensive Plan and allows more retail and offices uses in CN-1 zones. Action: ~ ~.g_-. f. PUBLIC HEARING ON AN ORDINANCE REGULATING AND RESTRICTING THE USE AND HEIGHT OF STRUCTURES AND OBJECTS OF NATURAL GROWTH IN THE VICINITY OF THE IOWA CITY MUNICIPAL AIRPORT BY CREATING APPROPRIATE ZONES AND ESTABLISHING BOUNDARIES THEREOF; DEFINING CERTAIN TERMS USED IN SAID ORDINANCE; REFERRING TO THE IOWA CITY MUNICIPAL AIRPORT ZONING MAP AS PART OF THE ORDINANCE; ESTABLISHING AN AIRPORT ZONING COMMISSION; ESTABLISHING AN AIRPORT ZONING BOARD OF ADJUSTMENT; PROVIDING FOR ENFORCEMENT AND IMPOSING PENALTIES. Comment: At its January 23, 2002, meeting, by a vote of 3-0 (Full and Chait absent), the Iowa City Airport Zoning Commission recommended approval of the proposed Airport Zoning Code revisions to the Iowa City City Council and the Johnson County Board of Supervisors. Public hearing continued March 19. Due to anticipated significant changes by the Planning and Zoning Commission, staff recommends closing the hearing. After Planning and Zoning Commission consideration, a new hearing will be set. Action: ITEM NO. 8. AMENDING TITLE 3, "CITY FINANCES, TAXATION AND FEES," CHAPTER 4, "SCHEDULE OF FEES, RATES, CHARGES, BONDS, FINES AND PENALTIES" OF THE CITY CODE, TO INCREASE PARKING FEES IN IOWA CITY, IOWA. Comment: Due to usage demands and the need for additional metered parking, the following locations peripheral to the Central Business District would be metered at the hourly rates as noted: 100-500 block of N. Section 453A.22(2) provides that, after a hearing, a $300.00 civil penalty will be assessed to a retail cigarette permit holder when and if that permit holder's employee is convicted of or pleads guilty to selling or providing tobacco to a minor. As a part of the hearing, the Council will be provided with information establishing an employee of permit holder North Dodge Express was convicted of or pled guilty to a charge of selling or providing tobacco to a minor. The permit holder's representative will then have the opportunity to provide the Council with information s/he deems appropriate. The Council will then decide whether to assess the requested civil penalty and, if it decides to do so, will adopt an appropriate Resolution. Comment: The City Council is considering passage and adoption of an ordinance vacating the north 182 feet of the public alley in Block 102 located between Burlington and Court Streets. The City has entered into a contract for the purchase of property on the east half of Block 102 from the Hieronymi Partnership. The contract is contingent upon the City's vacation, and execution and delivery of a written offer to convey the above alley property to the Hieronymi Partnership upon certain terms and conditions. The per dwelling unit, and 2 rooming units per month charge will increase to $12.10 ($9.00 + $3.10). These increases are necessary to recover costs associated with solid waste collection.
