Comment: State legislation mandates municipalities amend their annual budgets by May 31. This resolution sets a public hearing for amendments on May 7. I~-.~ MAY 7 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE NORTHSIDE MARKETPLACE STREETSCAPE PROJECT, PHASE I, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project is the first of two phases of streetscape improvements in the Northside Marketplace area. This project will include various decorative streetscape elements as well as minor paving, crosswalk and storm sewer work. Phase 1 will focus on Linn Street and Market Street. Oo~,-/~ ~ (3) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON MAY 7 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE SOUTH SYCAMORE REGIONAL GREENSPACE LANDSCAPE AND TRAIL PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project will construct a trail and landscape the area within the South Sycamore Greenspace. This project will add approximately 3 miles of hard surface trails and a sidewalk along the west side of Sycamore Street. f. Resolutions. (1) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO I¥~O SIGN AND THE CITY CLERK TO ATTEST A DECLARATION OF COVENANT FOR ACCESS, ELECTRIC AND SIGN EASEMENTS FOR AUDITOR'S PARCEL 2002-003. Comment: The owners of certain property abutting Highway 1 in north Iowa City have requested the approval of an Auditor's Parcel dividing the property into two discrete parcels. Due to the desire to minimize access points off of Highway 1, as a condition of approving the Auditor's Parcel, the City has required that the property owners enter into a covenant for the two discrete parcels to share an access point and drive. This Resolution authorizes the City's execution of the Declaration of Covenant for Access, Electric and Sign Easements so that the City may enforce said access covenant and said covenant cannot be amended without City participation. Comment: The owners of the property located at 1704 F Street received assistance through the City's Housing Rehabilitation Program totaling $3,430. The financing was in the form of a Iow interest loan. Comment: This Resolution accepts payment of a $300.00 civil penalty, authorized by Iowa Code section 453A.22(2), from L & M Mighty Shop, Inc., 504 E. Burlington St., Iowa City. Section 453A.22(2) provides that a $300.00 civil penalty will be assessed to a retail cigarette permit holder when and if that permit holder's employee is convicted of or pleads guilty to selling or providing tobacco to a minor. Section 453A.22(2) provides that a $300.00 civil penalty will be assessed to a retail cigarette permit holder when and if that permit holder's employee is convicted of or pleads guilty to selling or providing tobacco to a minor. It also authorizes a 30- day suspension of the retail cigarette permit if there is a second such violation within a two-year period. By signing the appropriate waiver and surrendering its retail cigarette permit for a thirty (30) day period, Osco Drug Store waives its statutory right to have a hearing on whether the civil penalty should be assessed. Consider a motion setting a public hearing for May 7 on an ordinance to amend Section 14-6K-2 of the Zoning Ordinance, Floodplain Management, in order to remove the requirement for fill beyond the area of a structure, update various definitions and references, and to acknowledge the new Flood Insurance Rate Map (FIRM). Comment: These amendments will remove the requirement that yard areas surrounding a structure be filled when construction occurs in the flood plain. These amendments will also update definitions to make them consistent with State and Federal regulations as well as make reference to the updated Flood Insurance Rate Map. At its April 4, 2002 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of these amendments. Staff recommended approval in a memo dated March 20, 2002. Consider a resolution amending the Comprehensive Plan, South District Map to show the general alignment of a future east-west arterial street and to amend the text of the plan to refer to the alignment. Comment: At its February 21 meeting, by a vote of 5-1 (Hansen voted no), the Planning and Zoning Commission recommended approval of these amendments to the Comprehensive Plan. The amendments will depict the location of a future east/west arterial street to be built between Gilbert Street and Scott Boulevard generally located south of the current City limits. Comment: The proposed amendments would allow large apartment complexes in new neighborhoods and would identify an 18-acre multifamily zone on South Gilbert Street. At its February 21 meeting, by a vote of 4-2 (Chait and Shannon voted no), the Planning and Zoning Commission recommended denial of the proposed amendments. Consider an ordinance amending the Neighborhood Commercial, CN- 1, zone to broaden the uses allowed and to revise the dimensional requirements and design provisions. (First Consideration) Comment: At its March 7 meeting, by a vote of 7-0 the Planning and Zoning Commission recommended approval. This amendment is part of the code rewrite. Its provisions implement the policies of the Comprehensive Plan and allows more retail and offices uses in CN-1 zones. Action: g. Consider an ordinance amending the Zoning Code, Article O, Sign Regulations, to permit portable signs in .the Central Business Service, CB-2, Central Business Support, CB-5, and Central Business, CB-10, zones. (First Consideration) Comment: This amendment will allow small portable signs on private property and on the public sidewalk when associated with outdoor cafes in the downtown zones. Passage of this resolution depends on approval of Item 6b, an amendment to the Comprehensive Plan, to show the alignment of the arterial street included in this plat. At its February 21 meeting, by a vote of 6-0 the Planning and Zoning Commission recommended approval. Staff recommended approval in a report dated February 7. Deferred March 19. Action: ITEM NO. 7. PUBLIC HEARING REGARDING THE FY03 ANNUAL ACTION PLAN, THAT IS A SUB-PART OF IOWA CITY'S 2001-2006 CONSOLIDATED PLAN (CITY STEPS), AS AMENDED. Comment: At their March 21, 2002 meeting, the Housing and Community Development Commission made recommendations for the allocation of FY03 Community Development Block Grant (CDBG) and HOME Investment Padnership program (HOME) funds. These budget recommendations are contained within Section III of the FY03 Annual Action Plan that is included in this Council packet. The U.S. Department of Housing and Urban Development requires a public hearing and approval of the FY03 Annual Action Plan by the City Council. Approval of the FY03 Annual Action Plan is scheduled for May 7, April 16, 2002 City of Iowa Cit}/ Parle 10 ITEM NO. 9. A~//'~' ' / ~"~g' ' /' PROPERTY," BY ADDING CHAPTER 10, ENTITLED "CHUTES AND VAULTS WITHIN THE PUBLIC RIGHT-OF-WAY" TO ESTABLISH A SYSTEM TO REGULATE THE USE OF CHUTES AND VAULTS IN THE PUBLIC RIGHT-OF-WAY. Comment: Private parties currently use the chutes and vaults located in the City's right-of-ways for commercial and private reasons including storing property, accessing buildings, and transferring goods. The primary purpose of the ordinance is to address the City's liability that is associated with the private use of the public right-of-way. Under the ordinance, in order for a person to use a chute or a vault, the person will need to execute a written agreement with the City. Such a "right-of-way agreement" is how the City presently regulates other private uses of the public right-of-way. The agreement will require the private party to assume the risk of using the right-of-way, to indemnify the City for claims, and to provide general liability and casualty insurance. See three staff memoranda in Council packet for further information. a. CONSIDER MOTION TO APPOINT CITY CLERK AS TEMPORARY CHAIRPERSON FOR PURPOSES OF ELECTING TEMPORARY MAYOR PRO TEM Comment: As the Mayor and Mayor Pro tern have a conflict of interest on this matter, it is necessary to elect a temporary Mayor Pro tom to preside over discussions on this matter for its duration. This procedure is being done in accordance with Section 1-5-4 of the City Code. CONSIDER AN ORDINANCE AMENDING TITLE 3, "CITY FINANCES, C~o~ - ~o ~ TAXATION AND FEES," CHAPTER 4, "SCHEDULE OF FEES, RATES, CHARGES, BONDS, FINES AND PENALTIES" OF THE CITY CODE, TO INCREASE PARKING FEES IN IOWA CITY, IOWA. (SECOND CONSIDERATION) Comment: This ordinance increases charges for appliance collection, per item collected from $16.00 to $20.00; solid waste collection from $8.20 minimum to $9.00 minimum; and curbside recycling, per unit from $2.80 to $3.10. The per dwelling unit, and 2 rooming units per month charge will increase to $12.10 ($9.00 + $3.10). These increases are necessary to recover costs associated with solid waste collection. S & J Development LLP, owner of property on the west side of Iowa City adjacent to Slothower Road, has accepted an offer from the City to purchase a 3-acre parcel for $67,500. This offer is contingent upon City Council approval. This resolution approves the terms on which the City will purchase the parcel. ITEM NO. 13. CONSIDER A RESOLUTION AUTHORIZING THE ACQUISITION OF PROPERTY INTERESTS NECESSARY FOR CONSTRUCTION OF THE c>,~- l$i~ SOUTH SYCAMORE REGIONAL GREENSPACE LANDSCAPE AND TRAIL PROJECT. Comment: The City of Iowa City must acquire right-of-way, fee title, permanent easements and temporary construction easements to construct the South Sycamore Regional Greenspace Landscape and Trail Project. This resolution authorizes City staff to negotiate and the Mayor to sign these documents. This project will construct a trail and landscape the area within the South Sycamore Greenspace and will add approximately 3 · miles of hard surface trails and a sidewalk along the west side of Sycamore Street. ITEM NO. 14. CONSIDER A RESOLUTION DIRECTING SALE OF $29,100,000 OD- - / _~ / GENERAL OBLIGATION BONDS. Comment: Bids were received at 11:00 am on April 16, 2002 for the sale of $29,100,000 General Obligation Bonds. This includes $18,400,000 for the Library Expansion Project and $10,700,000 in Capital Improvement Projects. This resolution ratifies and confirms the actions of the Finance Director and City Clerk in the determination of the most favorable bid. State law requires the City to give notice to agricultural property owners whose properties may be affected. This notice will notify all potentially affected property owners of their opportunity to present their views on the project and proposed acquisition of property rights at the public hearing.
