FOR JUNE 13, 2006
Comment: The Iowa City Housing Authority, under its Tenant-to-
Ownership Program, proposes to sell 2667 Indigo Court to a public
housing program tenant. The amount of the sale will be the appraised
value of the home, which is $107,000. The family has participated in the
public housing program since 1993 and has graduated from the Family
Self-Sufficiency Program. The head of household has worked full-time at
the University of Iowa during the family's entire tenancy. The family has
received a written commitment for a mortgage from a local bank in the
amount of $80,250. The City will provide a second mortgage for the
remaining $26,750. This sale will provide the opportunity for a low-income
family to obtain ownership of their own home.

PURCHASE AGREEMENT BETWEEN THE CITY OF IOWA CITY AND
WESTSIDE AUTOMOTIVE L.L.C. FOR AN UNDEVELOPED .95 ACRE
PARCEL OF PROPERTY LOCATED ON THE NORTH SIDE OF
HIGHWAY 1 WEST BETWEEN THE MORMON TREK BOULEVARD
AND DANE ROAD INTERSECTIONS, AND TO DISPOSE OF SAID
PARCEL ACCORDANCE HEREWITH, AND SETTING A PUBLIC
HEARING FOR JUNE 13, 2006.
Comment: The above-referenced .95 acre parcel of undeveloped property
was previously purchased as a remnant along with adjacent property
needed for the Iowa City Airport runway protection zone. Said parcel is
not necessary for Iowa City Airport purposes, City Staff has negotiated a
purchase agreement with Westside Automotive L.L.C. for its sale, and the
purchase agreement requires City Council approval. The Iowa City
Airport Commission has approved of said purchase agreement. A map
depicting the location of the parcel is attached to the purchase
agreement. This resolution declares the City's intention to approve of the
purchase agreement. A memorandum from Randy Hartwig, Chairman of
the Airport Commission, is in the Council packet. Draft minutes from the
Airport Commission meeting discussing this is included in the Council
Information Packet.

CONSIDER A RESOLUTION OF INTENT TO ENTER INTO A LEASE
AGREEMENT FOR THE LEASE OF THE BUILDING LOCATED AT
2401 SCOTT BOULEVARD TO IOWA VALLEY HABITAT FOR
HUMANITY AND SETTING PUBLIC HEARING ON SAID LEASE FOR
JUNE 13, 2006.
Comment: City Staff is negotiating a Lease Agreement to lease the
currently existing building located at 2401 Scott Boulevard to Iowa
Valley Habitat for Humanity for their Restore project. The balance of the
site would be used by the City for construction and operation of a
recycling facility. This lease is contingent upon City Council approval
and completion of the City's acquisition of the property. This resolution
declares the City Council's intent to enter into said lease and sets a
public hearing on the proposed lease for June 13, 2006.

CONSIDER A RESOLUTION APPROVING AN EARLY OCCUPANCY
AGREEMENT FOR IOWA VALLEY HABITAT FOR HUMANITY AND
THE BUILDING LOCATED AT 2401 SCOTT BOULEVARD
Comment: The City is in the process of purchasing a 3.7 acre parcel of
property located at 2401 Scott Boulevard for construction and operation
of a recycling facility, and City Staff is negotiating a lease agreement
with Iowa Valley Habitat for Humanity for the lease of the currently
existing building located on the balance of the site, for operation of their
Restore Project. Said lease will require City Council approval and public
hearing for consideration of the lease is to be set for June 13, 2006.
Iowa Valley Habitat for Humanity has requested permission to access the
building prior to June 13, 2006, to clean the building, in anticipation of
approval of the lease agreement on that date and their subsequent
possession of the building. This resolution authorizes the Director of
Public Works to enter into an early occupancy agreement with Iowa
Valley Habitat for Humanity for 2401 Scott Boulevard, upon terms and
conditions approved by the Director of Public Works and the City
Attorney's Office.

CONSIDER A RESOLUTION APPROVING THE DESIGN OF NEW
EXTERIOR DOORS FOR THE MAHARISHI ENLIGHTENMENT
CENTER ON THE CLINTON STREET ELEVATION OF OLD CAPITOL
TOWN CENTER AT 201 S. CLINTON STREET.
Comment: Neumann Monson Architects has requested design approval
of new exterior doors for the Maharishi Enlightenment Center at Old
Capitol Town Center, 201 S. Clinton Street. Since this is an Urban
Renewal parcel, approval by the Design Review Committee and City
Council is required.
CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN
AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIEN
REGARDING A MORTGAGE FOR THE PROPERTY LOCATED AT
131 FRIENDSHIP STREET, IOWA CITY, IOWA.
Comment: The owner of the property located at 131 Friendship Street
received assistance through the City of Iowa City's Housing
Rehabilitation Program. The loan has been paid off; thus the lien needs
to be released.
CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO
EXECUTE AND THE CITY CLERK TO ATTEST TO A
SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA
CITY AND IOWA STATE BANK & TRUST, CO., IOWA CITY, IOWA
FOR PROPERTY LOCATED AT 3035 STANFORD AVENUE, IOWA
CITY, IOWA.
Comment: Iowa State Bank & Trust, Co. has requested that the City
approve a Subordination Agreement for 3035 Stanford Avenue. On
September 20, 2005, the owners of the property received a loan from
the City of Iowa City's HOME Investment Partnership Funds Program.
The property has enough equity to cover the City's lien position.
CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE
IOWA RIVER DAM RENOVATION PROJECT.
Comment: The project has been completed in substantial accordance
with the plans and specifications. The Engineer's Report and
Performance and Payment bonds are on file with the City Clerk.

Comment: Maps of the proposed route changes are on file for public examination in
the office of the City Clerk (City Hall), in all of Iowa City's Transit buses, at the Iowa
City Public Library and on the City website. A public meeting was also held at the
Public Library on April 18. After hearing comments Council will schedule for discussion

CONSIDER AN ORDINANCE AMENDING TITLE 8, ENTITLED "POLICE
REGULATIONS," CHAPTER 4, ENTITLED "ANIMAL CONTROL" AND TITLE 10,
ENTITLED "PUBLIC WAYS AND PROPERTY," CHAPTER 9, ENTITLED "PARKS
AND RECREATION REGULATIONS, " TO ALLOW DOGS TO BE OFF LEASH IN
THORNBERRY OFF-LEASH DOG PARK. (FIRST CONSIDERATION)
Comment: With the opening of the Thornberry Off-Leash Dog Park scheduled for June
17, two current code provisions need to be amended to allow dogs to use the park
legally. The City Code presently prohibits a person from bringing a pet into any City
park unless it is confined or on a leash. Another City Code provision prohibits a dog
from being at large. This ordinance will carve out exceptions in both of those code
provisions for dogs that have permits to use the dog park.

CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY
CLERK TO ATTEST THE FY2007 AGREEMENT BETWEEN THE CITY OF IOWA
CITY AND THE CITY OF UNIVERSITY HEIGHTS FOR THE PROVISION OF
TRANSIT SERVICE WITHIN THE CORPORATE LIMITS OF UNIVERSITY HEIGHTS
Comment: This resolution approves the FY2007 agreement for Iowa City Transit to
provide transit service within the corporate limits of University Heights. The level of
transit service provided will remain the same as in FY2006. The proposed FY2007
contract amount of $29,804 is an increase from the FY2006 amount based on the
National Consumer Price Index, and is an increase of 3.39%.

CLERK TO ATTEST A LEASE AGREEMENT FOR THE LEASE OF
APPROXIMATELY 760 SQUARE FEET OF COMMERCIAL SPACE LOCATED
WITHIN THE COURT STREET TRANSPORTATION CENTER.
Comment: This Resolution authorizes the approval of a lease between Hieronymi
Partnership, L.L.P. and the City for use of the space within the Court Street
Transportation Center for office space.

CLERK TO ATTEST A LICENSE AGREEMENT FOR TEMPORARY USE OF PUBLIC
RIGHT-OF-WAY BETWEEN THE CITY OF IOWA CITY, LANDOWNER UNIVERSITY
VIEW PARTNERS, AND TENANT DAWIT'S RESTAURANT, INC., D/B/A DAVID'S
PLACE, FOR A SIDEWALK CAFE.
Comment: University View Partners, as landowner, and Dawit's Restaurant, Inc. d/b/a
as David's Place, seek a license agreement for temporary use of public right-of-way at
100 S. Linn Street, Iowa City, Iowa for a sidewalk cafe. City staff and Design Review
have reviewed the plans and specifications and required submittals and recommend
approval of said agreement.

CONSIDER A RESOLUTION APPROVING DISTRIBUTION OF THE "PROGRAM
FOR IMPROVING NEIGHBORHOOODS" (PIN) GRANTS FUNDS.
Comment: the City Council allocated $15,000 in Fiscal Year 2007 for the purpose of
funding grants to neighborhood associations so they could make improvements in their
neighborhood. The Neighborhood Council has solicited, selected and recommends the
funding of eight (8) applications from neighborhood associations and seeks the City
Council's review and approval of this recommendation.

SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH
ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF
BIDS. (DEFERRED FROM 5/2)
Comment: Due to time constraints of the remaining construction season, the
Engineering Division recommends delaying this project until next year. A council work
session presentation on this project will be scheduled later this summer.

Comment: On April 20, 2004, Council passed Ordinance No. 04-4123 that allows for
the sale and consumption of alcohol in a city park, on a right-of-way, or other public
ground, excluding public buildings, pursuant to written agreement. Staff has approved
the agreement, which is attached to the resolution, that allows Riverside Theatre to sell
beer and wine and for attendees to consume beer and wine from June 12 through July
10, 2006 in a specified area in and around Riverside Festival Stage in City Park. The
terms in the agreement are the same as last year with the exception of the dates.
