NOTICE OF PUBLIC HEARING
Notice is hereby given that a public hearing will
be held by the City Council of Iowa City, Iowa, at
7:00 p.m. on the day of Thursday, May 23, 2006,
in Emma J. Harvat Hall, 410 E. Washington
Street, Iowa City, Iowa, or if said meeting is
cancelled, at the next meeting of the City Council
thereafter as posted by the City Clerk; at which
hearing the Council will consider:
1. An ordinance rezoning 11.36 acres of
land located east of South Riverside Drive
from General Industrial (1-1) to Heavy
Industrial (1-2).
2. An ordinance rezoning properties
associated with the University of Iowa to
Institutional Public (P2). These properties
Include: 511 S. Madison SI. and 620 and
624 S. Madison SI. from Intensive
Commercial (CI-1) to P2; Lots 14 and 15
in Grand Avenue Court Addition and 320
Melrose Ave. from Medium Density
Single Family Residential (RS-8) to P2;
Lot 4 in Melrose Court Addition, 223
Lucon Dr., 609 Melrose Ave., and Oak
Park Court from Low Density Single
Family Residential (RS-5) to P2; 322 N.
Clinton SI. from Planned High Density
Multi-Family Residential (PRM) to P2; 430
and 530 N. Clinton SI. from High Density
Multi-Family Residential (RM-44) to P2;
and Old Capital Mall from Central
Business (CB-10) to P2/CB-10.
3. An ordinance rezoning properties
association with the City of Iowa City and
the Iowa City School District to
Neighborhood Public (P1) and the Iowa
National Guard to Institutional Public (P2).
These properties include: Benton Hill
Park, Whispering Meadows Wetland
Park, Outlot associated with Easthill
Subdivision, Outlot associated with
Longfellow Manor, and Outlot associated
with Walden Wood from Medium Density
Single Family Residential (RS-8) to P1;
properties associated with Glendale Park
Hunter's Run Park, Windsor Ridge Park,
Grant Wood Elementary School, and

public examination in the office of the City Cierk,

Dear Mayor Wilburn and Members of the Council:
As you know, we have requested that the City vacate the north-south alley in the block
north of the County Administration Building to facilitate our plans for a new Health And Human
Services Building. We still hope to accomplish site preparation this year and are even hopeful
that we might begin construction this fall.
In all honesty, we were quite surprised and puzzled when the Council voted to delay
action on our request. It would be easier to understand the Council's delay if there were a
question about the function of the alley or our plans. The expressed reason by Councilmember
Vanderhoef, to inquire into whether County land which would serve as a shelter site might be
available to trade for the alley, does not seem to understand the intergovernmental relationship
which we strive for and thought existed between us.
First of all, to answer Dee's question directly, we don't have any land to trade for the
alley. Ifthe council decided to change its past practice regarding intergovernmental vacations and
transfers, we could discuss paying fair market values for the alley It's important to add that, as far
as we can tell, the Council has not done that in the past-nor have we.

Here are two recent examples ofthe intergovernmental relationship we though existed:
(1) Last year you were undertaking a major project to build Camp Cardinal Road and needed land
from us. Johnson County transferred its land to you, along with a construction easement, for no
cost-and simply accepted your word that you needed our property. (2) Last month when Iowa
City suffered greatly because of a tornado and the need was great, we brought our Secondary
Roads personnel and equipment into Iowa City where they worked tirelessly for about a week to
help both your departments and citizens ofIowa City. We expected nothing I return-because
you and your citizens had a need for help.
Now we need your help--by vacating and transferring this alley.
We recognize that Shelter House is a community need and concern and as we struggled
through another tough budget year, we remained committed to that need and provided $8,721 to
Shelter House and $10,000 to the STAR program for FY 2007. However, it is unrelated to our
longstanding plan for a new Health and Human Services Building.
Thank you for taking time to visit with us since your meeting on May 2nd and for your
consideration of our vacation and transfer request.

Amend for estimated emergency protective measures, clean-up and uninsured traffic' and parks repair 'costs

Capita! project revisions affects the following Intergovernmental, Other financing sources, Public Works.
Capital Projects, Bus_ Type, and Transfers Out. Bus. Type also includes land acquisition for Recycling Center
on east side of town. General Government amended for additional costs in Accounting & City Clerk's offices
There will be no increase in tax levies to be paid in the current fiscal year named above. Any increase in
expenditures set out above will be met from the increased non-property tax revenues and cash balances not
budgeted or considered in this current budget This will provide for a balanced budget
