Comment: The Resolution sets the date for a Public Hearing to
amend Section 8 Administrative Plan to include the new Section 8
Homeownership Plan. The Administrative Plan is a HUD required
administrative document which is used in the operations of the
Section 8 program. Public Hearing to be held May 21,2002.

MAY BE ACQUIRED FOR THE PROJECT.
Comment: The City of Iowa City must acquire right-of-way, fee
title, permanent easements and temporary construction easements
to construct the Dane Road Trunk Sanitary Sewer Project. State
law requires the City to give notice to agricultural property owners
whose properties may be affected. This notice will notify all
potentially affected property owners of their opportunity to present
their views on the project and proposed acquisition of property
rights at the public hearing. This notice protects the City's right to
condemn if necessary. This project includes construction of a
sanitary sewer system to serve the south Mormon Trek Boulevard
area and the development west of Highway 218.

Comment: Iowa City IHA Senior Housing Limited Partnership has
requested that the City approve a Release, Disclaimer and
Reaffirmation Agreement in order to clear up title issues. On
November 24, 1999, the owner of the property received a loan
from the City of Iowa City for the amount of $275,000 for the
acquisition of land and construction expenses for affordable senior
rental housing.

Comment: The owner of the property located at 1109 DeForest
Street received assistance through the City's Housing
Rehabilitation Program totaling $3,488. The financing was in the
form of two conditional occupancy loans and a declining balance
loan. The loans have been paid off; thus the lien can now be
released.

Comment: This Resolution accepts payment of a $300.00 civil
penalty, authorized by Iowa Code section 453A.22(2), from Hartig
Drug Company, 70'1 Mormon Trek BIvd, Iowa City. Section
453A.22(2) provides that a $300.00 civil penalty will be assessed
to a retail cigarette permit holder when and if that permit holder's
employee is convicted of or pleads guilty to selling or providing
tobacco to a minor. By making this payment and signing the
appropriate waiver, Hartig Drug Company waives its statutory right
to have a hearing on whether the civil penalty should be assessed.

ITEM NO. 7. PLANNING AND ZONING MATrERS.
a. Public hearing on an ordinance to amend Section 14-6K-2 of the
Zoning Ordinance, Floodplain Management, in order to remove the
requirement for fill beyond the area of a structure, update various
definitions and references, and to acknowledge the new Flood
Insurance Rate Map (FIRM).
Comment: These amendments will remove the requirement that yard
areas surrounding a structure be filled when construction occurs in the
flood plain. These amendments will also update definitions to make
them consistent with State and Federal regulations as well as make
reference to the updated Flood Insurance Rate Map. At its April 4,
2002 meeting, by a vote of 7-0, the Planning and Zoning Commission
recommended approval of these amendments. Staff recommended
approval in a memo dated March 20, 2002.

b. Consider an ordinance amending the Neighborhood Commercial, CN-
1, zone to broaden the uses allowed and to revise the dimensional
requirements and design provisions. (Second Consideration)
Comment: At its March 7 meeting, by a vote of 7-0 the Planning and
Zoning Commission recommended approval. This amendment is part
of the code rewrite. Its provisions implement the policies of the
Comprehensive Plan and allows more retail and offices uses in CN-1
zones.

c. Consider an ordinance amending the Zoning Code, Adicle O, Sign
Regulations, to permit podable signs in the Central Business Se~ice,
CB-2, Central Business Supped, CB-5, and Central Business, CB-10,
zones. (Second Consideration)
Comment: This amendment will allow small potable signs on private
properly and on the public sidewalk when associated with outdoor
cafes in the downtown zones. At its March 7 meeting, by a vote of 7-0
the Planning and Zoning Commission recommended approval.

Adopt)
Comment: If approved this rezoning will allow a one acre lot to be
subdivided into residential lots of a minimum of 8000 Square feet in
area. Covenants may restrict the subdivision of some of the propeAy
included in this rezoning. At its March 7 meeting, by a vote of 6-1
(Anciaux voted no), the Planning and Zoning Commission
recommended approval subject to a Conditional Zoning Agreement
regarding sewer easements and limitations on curb cuts on Rohret
Road. Staff recommended approval in a repoA dated Februaw 21.

Boulevard near its intersection with Dodge Street. (REZ01-

Comment: At its February 7 meeting, by a vote of 6-0, the Planning
and Zoning Commission recommended approval of the proposed
rezoning and preliminary plat. Approval will allow the construction of
20 single-family homes. The sensitive areas plan minimizes the
development of slopes on this property. Staff recommended approval
in a report dated January 3.

Comment: The proposed urban renewal plan would make available the
use of tax increment financing for projects in the area more commonly
referred to as the Procter & Gamble site and the Goodwill sites. At its
March 21, 2002, meeting the Council Economic Development Committee,
by a 3-0 vote recommended that the Council adopt the plan. Included in
the Council packet are memos regarding the consultation with the affected
taxing entities and the Planning & Zoning Commission's recommendation.
The Plan was included in Council's April 2 Agenda packet. Council will
consider the Plan at their May 21 Formal meeting.

Comment: This project will construct a trail and landscape the area within
the South Sycamore Greenspace. This project will add approximately 3
miles of hard surface trails and a sidewalk along the west side of
Sycamore Street. The estimated construction cost is $752,000 and will be
funded with General Obligation bonds.

ITEM NO. '14. CONSIDER AN ORDINANCE AMENDING TITLE 10, ENTITLED "USE
OF PUBLIC WAYS AND PROPERTY," BY ADDING CHAPTER 10,
ENTITLED "CHUTES AND VAULTS WITHIN THE PUBLIC RIGHT-OF-
WAY" TO ESTABLISH A SYSTEM TO REGULATE THE USE OF
CHUTES AND VAULTS IN THE PUBLIC RIGHT-OF-WAY. (SECOND
CONSIDERATION)
Comment: Private parties currently use the chutes and vaults located in
the City's right-of-ways for commercial and private reasons including
storing property, accessing buildings, and transferring goods. The
primary purpose of the ordinance is to address the City's liability that is
associated with the private use of the public right-of-way. Under the
ordinance, in order for a person to use a chute or a vault, the person will
need to execute a written agreement with the City. Such a "right-of-way
agreement" is how the City presently regulates other private uses of the
public right-of-way. The agreement will require the private party to
assume the risk of using the right-of-way, to indemnify the City for claims,
and to provide general liability and casualty insurance. Due to a conflict of
interest the Mayor and Mayor Pro tem have on this matter, Council Member
Pfab was elected temporary Mayor Pro tem at the April 16 Council meeting
to preside over discussions.

ITEM NO. 15. CONSIDER AN ORDINANCE AMENDING TITLE 3, ENTITLED "CITY
og- ff-ol 'g FINANCES, TAXATION AND FEES," CHAPTER 4, ENTITLED
"SCHEDULE OF FEES, RATES, CHARGES BONDS, FINES AND
PENALTIES," ARTICLE 5, ENTITLED "SOLID WASTE DISPOSAL," OF
THE CITY CODE TO INCREASE CERTAIN SOLID WASTE CHARGES.

Comment: This ordinance increases charges for appliance collection, per
item collected from $18.00 to $20.00; solid waste collection from $8.20
minimum to $9.00 minimum; and curbside recycling, per unit from $2.80 to
$3.10. The per dwelling unit and 2 rooming units per month charge will
increase to $12.10 ($9.00 + $3.10). These increases are necessary to
recover costs associated with solid waste collection.

CITY MANAGER AS THE AUTHORIZED CHIEF EXECUTIVE OFFICER
Comment: At their April 16, 2002 meeting, the Iowa City Housing and
Community Development Commission unanimously recommended
approval of the FY03 Annual Action Plan which contains the allocations of
CDBG and HOME funds. In addition, the City Council held a public
hearing on April 16, 2002 to receive public input regarding the proposed
FY03 Annual Action Plan. A copy of the FY03 Annual Action Plan was
provided to the Council in the April 16 packet. To receive federal fiscal
year 2002 funding, this document must be submitted to the U.S.
Department of Housing and Urban Development (HUD) by May 15, 2002.

Comment'. This agreement provides for an 80% STP and 20% local
funding split. The maximum STP contribution is $687,800. This
agreement is for engineering design services and construction costs. The
local share of this project is $222,000 and will be funded with GO Bonds
and Road Use Taxes.
