CONSIDER MOTION APPROVING FIRE STRATEGIC PLAN. Comment: The Fire Department's FY2011 - FY2016 Strategic Plan was developed by the Center for Public Safety Excellence using external and internal stakeholders. It will provide the foundation for the department's re-accreditation with the Commission on Fire Accreditation International. The Plan contains goals, objectives, and critical tasks that will guide the future delivery of community fire protection and emergency response services. Hard copies of the plan were distributed to City Council only in their meeting packet. An electronic copy of the Plan is available on-line at www.icgov.org. September 7, 2010 City of Iowa City Page 2 c) Public Hearing. ~O- 3~7 1. CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON AMENDING THE FY2011 OPERATING BUDGET. Comment: This resolution sets a public hearing for September 21, 2010, to amend the FY2011 Operating Budget. Information will be available to the public on September 10, 2010. Io_ 3gg 2. CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON SEPTEMBER 21, 2010 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE TERRY TRUEBLOOD RECREATION AREA PHASE 2 IMPROVEMENTS PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project provides for the phased development of the Terry Trueblood Recreation Area. Phase 2 improvements include the north access drive with cul-de-sac parking, boat ramp parking area, boat ramp and the marina facility with associated walkways. The estimated construction cost is $1,122,105.00 and will be funded with State Grants, General Obligation bond proceeds, and Contributions/Donations. / Q_ ~~ ~q 3. CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON OCTOBER 11, 2010 ON THE PROPOSED PARTIAL VACATION OF JJR DAVIS ADDITION FINAL PLAT AND CONVEYANCE OF THE VACATED RIGHT-OF-WAY TO DEALER PROPERTIES IC, LLC AND DIRECTING THE CITY CLERK TO PUBLISH NOTICE THEREOF. Comment: Dealer Properties IC, LLC has requested that a portion of the JJR Davis Addition Final Plat be vacated to allow for redevelopment of this land. Should the partial vacation be approved, it would result in the vacation of City View Drive. This public right-of-way was dedicated to the City but the actual improvements have never been accepted by the City or opened to the public. The applicant requests that this right-of-way be conveyed back to it. The Applicant intends to replat this land and has made an application for such plat approval. d) Correspondence. 1. PLANNING AND ZONING MATTERS. a) CONSIDER AN ORDINANCE AMENDING THE IOWA CITY ZONING CODE, CD - l~ ~ 0 y- SECTION 14-3B-1 HISTORIC DISTRICT OVERLAY ZONE; SECTION 14-8E- ~- 2, HISTORIC REVIEW; SECTION 14-8E-3, CERTIFICATE OF ECONOMIC HARDSHIP; AND SECTION 14-2B-6, MULTIFAMILY SITE DEVELOPMENT STANDARDS (SECOND CONSIDERATION) Comment: At its August 5 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval. Staff recommended approval in a memo dated July 15. The Historic Preservation Commission voted 9-0 (Thomann absent) to approve these amendments at its May 13 meeting. Approval of these amendments will streamline and clarify the review process. Staff recommends expedited action. Action: o b) CONSIDER A RESOLUTION ADOPTING REVISED IOWA CITY HISTORIC ~p._ 3~ PRESERVATION HANDBOOK Comment: At their May 13 meeting, the Historic Preservation Commission, by a vote of 9-0 (Thomann absent), recommended approval of the revised Iowa City Historic Preservation Handbook. The Commission developed the revised handbook to further clarify and streamline Historic Preservation policies, procedures, and guidelines and to implement the suggestions of the Iowa City Historic Preservation Plan. Action: ~x ~a /o r ~~~,p,~,l~ CITY OF IQ1NA CITY ~~,~~R TO: Mayor, City Council, General Public FROM: City Clerk RE: September 7, 2010, Addition ITEM 5c (ADDITION) CONSIDER A RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT OF D 8~ D BILLION ADDITION, IOWA CITY, IOWA. (SUB10- 00007/SUB10-00008) Comment: This preliminary and final plat includes the replatting of a portion of JJR Davis Addition. At its August 5 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of this preliminary and final plat, subject to the vacation and conveyance of City View Drive prior to Council approval. Pursuant to City Code, Council must take action on this application by September 11, unless the applicant waives this review deadline or the application will be deemed approved. To date, no portion of the previous plat, including City View Drive, has been vacated or conveyed. CONSIDER AN ORDINANCE AMENDING TITLE 16 OF THE CITY CODE, ENTITLED "PUBLIC WORKS," CHAPTER 1, ENTITLED, "STREETS, SIDEWALKS AND PUBLIC RIGHT OF WAY," TO ESTABLISH A PERMIT PROCESS FOR PLACEMENT OF PIANOS ON THE PUBLIC RIGHT OF WAY. (SECOND CONSIDERATION) Comment: In July, the Public Works Director approved two agreements for the temporary use of right of way (ROW) to allow placement of a piano on City Plaza (a/k/a the Ped Mall) and another one at 10 E. Washington Street. The agreements expire on October 1, 2010. In addition to both parties wishing to continue to have their pianos on the ROW, the City has received more requests for pianos to be placed on the'ROW. This ordinance establishes a permitting process that will allow for the City to respond more quickly to requests for pianos and take less staff time than temporary use of ROW agreements. CONSIDER AN ORDINANCE AMENDING TITLE 4, ALCOHOLIC BEVERAGES, CHAPTER 5, PROHIBITIONS AND RESTRICTIONS, SECTION 8, PERSONS UNDER THE LEGAL AGE IN LICENSED OR PERMITTED ESTABLISHMENTS, SUBSECTION B, TO ADD A NEW SUBPARAGRAPH 6, AND TITLE 4, ALCOHOLIC BEVERAGES, CHAPTER 5, PROHIBITIONS AND RESTRICTIONS, SECTION 8, PERSONS UNDER THE LEGAL AGE IN LICENSED OR PERMITTED ESTABLISHMENTS, SUBSECTION C, TO ADD A NEW SUBPARAGRAPH 5, TO ALLOW THE CHIEF OF POLICE TO APPROVE SPLIT-PREMISES SPECIAL EVENTS IN LIQUOR LICENSE ESTABLISHMENTS, PERMITTING ENTRY BY THOSE UNDER LEGAL AGE INTO AN ALCOHOL-FREE PORTION OF THE ESTABLISHMENT, WHILE STILL ALLOWING THE SERVICE AND POSSESSION OF ALCOHOL TO THOSE OF LEGAL AGE IN A SEPARATE ALCOHOL-PERMITTED PORTION OF THE ESTABLISHMENT. (FIRST CONSIDERATION) Comment: Allows for the chief of police to approve special events whereby the premises is split into alcohol-free and alcohol-permitted portions of the establishment. CONSIDER AN ORDINANCE AMENDING TITLE 5, ENTITLED "BUSINESS AND f O - 4'-F ~ 5 LICENSE REGULATIONS," CHAPTER 2, ENTITLED "TAXICABS," BY REPEALING SUBSECTIONS 5-2-2, "TAXICAB BUSINESS LICENSE; VEHICLE DECALS," AND 5- 2-4, "VEHICLE INSPECTION REQUIRED," IN THEIR ENTIRETY AND REPLACING THEM WITH NEW SUBSECTIONS; AND AMENDING 5-2-7 TO PROVIDE PROVISIONS FOR RATE CHANGES. (PASS AND ADOPT) Comment: This ordinance, effective with the March- 1, 2011 licensing year, requires 4 vehicles per business, 24/7 operations, a dispatching office, and a taximeter. Action: September 7, 2010 City of Iowa City Page 5 ITEM 9. CONSIDER A RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE (0- 3Q I IOWA CITY PUBLIC LIBRARY. Comment: The Iowa City Public Library has signed a contract for service with the University of Iowa to provide access to children's literature materials to students and faculty in the Department of Education and the School of Library and Information Science; and the Library desires to add .25 Librarian II and .25 Library Assistant III to support the contracted service as well as to provide additional services to Iowa City residents. Funds will come from the contract and the FY11 cost will be $29,577. Action: ITEM 10. CONSIDER A RESOLUTION APPROVING THE PUBLIC HOUSING ASSESSMENT /~ _ 39~ SYSTEM (PHAS) MANAGEMENT OPERATIONS CERTIFICATION OF THE IOWA CITY HOUSING AUTHORITY FOR FY10. Comment: The Department of Housing and Urban Development (HUD) requires every Housing Authority to certify fiscal year performance data as a means of monitoring local activity. HUD will score the Iowa City Housing Authority (ICHA) based on indicators and will identify areas of concern or performance based on these indicators. Staff memorandum included in Council packet. Action: ITEM 11. CONSIDER A RESOLUTION ADOPTING IOWA CITY'S COMMUNITY jp-- 3~'3 PARTNERSH PS PROGRAM (HOME) INVESBMENT POLIC ES AND IRESS NDENG RESOLUTION NO. 07-19. Comment: On August 19, 2010, HCDC recommended two changes to the CDBG and HOME Program Investment Policies. The first change is to make the resale/recapture provisions the same for both the CDBG and HOME programs. The second change is to increase the earned grant formula for CDBG funded public facility projects which decreases the compliance period from a maximum of 99 years to a maximum of 20 years to be consistent with the HOME program rules. The policy is attached to the resolution and the two changes are enclosed in the text boxes. The preliminary minutes from the August 19 HCDC meeting are included in the Council Information packet. Action: ITEM 12. CONSIDER A MOTION APPROVING THE APPOINTMENT OF JON SWEARINGEN AS THE ALTERNATE FROM THE UNIVERSITY OF IOWA STUDENT GOVERNMENT (UISG) TO THE CITY COUNCIL UNTIL MAY 1, 2011.
