CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR OCTOBER 11, 2010 TO APPROVE A PURCHASE AGREEMENT BETWEEN THE CITY OF IOWA CITY AND VAN METER INDUSTRIAL, INC. FOR LOT 10 OF THE NORTH AIRPORT DEVELOPMENT SUBDIVISION AND TO CONSIDER A PROPOSAL TO CONVEY SAID PROPERTY. Comment: The North Airport Development Subdivision includes commercial lots, which have been marketed for sale to the general public. The City has negotiated a purchase agreement with Van Meter Industrial, Inc. which requires City Council approval. This resolution sets a public hearing on the purchase agreement for October 11. Council previously held a public hearing and approved the purchase agreement, but there was an error in the legal description that requires a new public hearing. f) Resolutions. r~_ 4..oG 1. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A SANITARY SEWER CONSTRUCTION EASEMENT AND DEDICATION AGREEMENT FOR AUDITOR'S PARCEL 2001051. Comment: Donald Cochran desires to connect the residential structure (the McCollister house) located at 2460 S. Gilbert to an existing sanitary sewer system across a portion of Sand Hill Park along Gilbert Street. This agreement allows for Cochran to have a temporary easement for the installation of the sanitary sewer main and dedicate the improvements to the City. CONSIDER A RESOLUTION AUTHORIZING APPLICATIONS FOR FUNDING ASSISTANCE FROM THE IOWA DEPARTMENT OF TRANSPORTATION (IDOT) FOR DEVELOPMENT OF A RECREATION TRAIL AND BRIDGE ACROSS THE IOWA RIVER Comment: This resolution will enable City staff to apply for grants totaling up to $1,300,000 from two Iowa Department of Transportation funding sources, namely the "Federal Recreation Trails Program" and the "Statewide Transportation Enhancement Program". If awarded funds from either program, such funds will be used to develop a 10-foot trail and bridge across the Iowa River from Rocky Shore Drive to Peninsula Park. This project would increase access to multiple recreation activities and enhance the quality of life of residents and visitors of Iowa City. g) Correspondence. 1. (Items "a,c" will proceed as outlined in the City Attorney's memo of 2/28/07 entitled "Rezonings, Due process and Ex pane communications.") a) CONSIDER A MOTION SETTING A PUBLIC HEARING FOR OCTOBER 11, ON AN ORDINANCE CONDITIONALLY REZONING APPROXIMATELY 60.32 ACRES OF LAND FROM INTERIM DEVELOPMENT-RESEARCH PARK (ID-RP), TO OVERLAY PLANNED DEVELOPMENT -OFFICE RESEARCH PARK (OPD-ORP); AND APPROXIMATELY 56.48 ACRES OF LAND FROM INTERIM DEVELOPMENT-RESEARCH PARK (ID-RP) TO OVERLAY PLANNED DEVELOPMENT-RESEARCH DEVELOPMENT PARK (OPD-RDP); AND APPROXIMATELY 24.49 ACRES OF LAND FROM INTERIM DEVELOPMENT-RESEARCH PARK (ID-RP) TO OVERLAY PLANNED DEVELOPMENT-MIXED USE (OPD-MU) FOR PROPERTY LOCATED NORTHWEST OF THE INTERCHANGE OF STATE HIGHWAY 1 WITH INTERSTATE 80. (REZ10-00004) Comment: At its April 15 meeting, by a vote of 6-0 (Koppes absent), the Planning and Zoning Commission recommended approval of this rezoning for Moss Green. Staff recommended approval in reports dated April 1 and 9. Approval will allow this property to be developed with for a mix of office, residential and research development uses. The City Council held a public hearing on this matter on May 10, 2010. However, subsequent to this hearing, but before adoption of the proposed rezoning, additional wetlands were identified on the site, so the item was deferred indefinitely by the City Council pending appropriate revisions to the sensitive areas development plan, preliminary planned development plan and plat. The applicant has made substantive revisions and have submitted the new plans and plat for review and approval. Staff recommended approval of these revisions in a memo dated September 10, 2010. It is anticipated that the Planning and Zoning Commission will make a recommendation prior to the hearing date on October 11. Action: ~// b) CONSIDER A MOTION SETTING A PUBLIC HEARING FOR OCTOBER 11 ON AN ORDINANCE AMENDING TITLE 14, CHAPTER 5, ARTICLE J. FLOODPLAIN MANAGEMENT STANDARDS TO REGULATE THE 100 AND 500 YEAR FLOODPLAIN AND ASSOCIATED CHANGES TO 14- 9F FLOOD PLAIN MANAGEMENT DEFINITIONS, 14-4B-2 VARIANCES AND 14-8B-5 FLOOD PLAIN DEVELOPMENT PERMIT. Comment: At its September 2 meeting, by a vote of 5-1 (Payne voting no, Koppes absent), the Planning and Zoning Commission recommended approval of these amendments. (REZ10-00007/SUB10-00004) Comment: At its September 2 meeting, by a vote of 6-0 (Koppes absent), the Planning and Zoning Commission recommended approval of this rezoning. Staff recommended approval in a report dated August 5. Approval will allow this property to be developed with the Iowa City Industrial Campus, a 9-lot, 173- acre industrial subdivision located along 420th Street, west of Taft Avenue. (SUB10-00009/SUB10-00010) Comment: At its September 2 meeting, by a vote of 5-0 (Busard and Koppes absent), the Planning and Zoning Commission recommended approval. Staff recommended approval in a report dated September 2. Approval will allow the creation of Meadowlark Hill 2"d Addition, a 2-lot 36.32 acre subdivision located on Dane Road and Mormon Trek Boulevard in Iowa City's extraterritorial review area. No development will be allowed until the property is annexed into the city. Action: W r'h !o _ a ~ e) CONSIDER A RESOLUTION AUTHORIZING THE CITY TO FILE AN APPLICATION FOR AN IOWA SMART PLANNING LOCAL COMPREHENSIVE PLANNING GRANT TO CONDUCT A COMPREHENSIVE PLAN UPDATE. Comment: The state has made funding available to help cities update their comprehensive plans to comply with the recently adopted Iowa Smart Planning Legislation. This resolution authorizes the City to apply for grant funding for up to $50,000. If the grant is awarded the City will provide the required match with staff time and funds budgeted for land use planning. CONSIDER AN ORDINANCE AMENDING TITLE 16 OF THE CITY CODE, ~.~_4.~~ ~ ENTITLED "PUBLIC WORKS," CHAPTER 1, ENTITLED, "STREETS, SIDEWALKS AND PUBLIC RIGHT OF WAY," TO ESTABLISH A PERMIT PROCESS FOR PLACEMENT OF PIANOS ON THE PUBLIC RIGHT OF WAY. (SECOND CONSIDERATION) Comment: In July, the Public Works Director approved two agreements for the temporary use of right of way (ROW) to allow placement of a piano on City Plaza (a/k/a the Ped Mall) and another one at 10 E. Washington Street. The agreements expire on October 1, 2010. In addition to both parties wishing to continue to have their pianos on the ROW, the City has received more requests for pianos to be placed on the ROW. This ordinance establishes a permitting process that will allow for the City to respond more quickly to requests for pianos and take less staff time than temporary use of ROW agreements. The ordinance was amended to change the date the permit would run to November 30 matching current sidewalk cafe regulations. CONSIDER AN ORDINANCE AMENDING TITLE 5, ENTITLED "BUSINESS AND LICENSE REGULATIONS," CHAPTER 2, ENTITLED "TAXICABS" TO CLARIFY AIRPORT SHUTTLES CAN OPERATE WITHOUT A TAXIMETER. (FIRST CONSIDERATION) Comment: Airport shuttles operate solely on a route that begins or ends at Eastern Iowa Airport or Quad Cities Airport for a set destination fare. Comment: This contract will complete all construction and bidding documents for reconstruction of the North Side marketplace streetscape between Jefferson Street and Bloomington Street, including extension of the Literary Walk into the area. CONSIDER A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY i >/-.¢ (3 OF IOWA CITY AND THE ARTIST OF SIMPLE FLIGHT FOR THE PURCHASE OF SAID SCULPTURE AND AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST THE AGREEMENT Comment: The sculpture currently on temporary display on the Peninsula Showcase Pad has been found to be very popular with the public and acquisition of this sculpture to remain on permanent display has been approved by the Public Art Advisory Committee. The purchase price for the sculpture is $5000. Funds are available in the FY10 Public Art budget. ~ ~~~~. Action: ITEM 14. CONSIDER A RESOLUTION ACCEPTING ZOYA, A SCULPTURE CREATED BY ~~~ ~ ~ VALERY KOVALEV AS A GIFT FROM KHRISTOFOR AGASSANDIAN TO THE CITY OF IOWA CITY, IOWA. .~ Comment: Khristofor Agassandian, who has recently moved from Iowa City is interested in donating a sculpture created by Valery Kovalev to the City of Iowa City. This sculpture would be relocated from its current location at 1225 Muscatine Avenue to Willow Creek Park. ~,~ PX~a- Action: r ITEM 15. CONSIDER A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE THE HAZARD MITIGATION GRANT PROGRAM (HMGP) GRANT AGREEMENT fQ-~ ~11~ AND COMMITTING THE LOCAL MATCH FUNDS FOR THE HICKORY HILL PARK TORNADO ROOM PROJECT. Comment: FEMA has awarded the City a grant through the Hazard Mitigation Grant Program (HMGP) to construct a tornado safe room at Hickory Hill Park. The project consists of a combination restroom/safe room building to protect up to 61 persons. The HMGP provides 75% of the funding, and the State has agreed to provide 10% of the funding leaving the City to cover 15% of the cost. The project budget is $186,692, 15% of which is $28,004. This resolution commits the City to providing the 15% local match and authorizes the City Manager to sign the grant agreement. ,~ ~ i/ 7. Comment: The Transportation Services Department currently has a vacant Maintenance Worker II -Parking Systems -Night position. An evaluation of the duties performed by the night maintenance staff within the Transportation Services Department showed no difference in the duties performed between staff members. As a result, it has been determined that the Transportation Services Department would be best served with the removal of one Maintenance Worker II -Parking Systems -Night position, Grade 4 and the addition of one Maintenance Worker I -Parking Systems position, Grade 2. This change will result in an annual savings of $2,150.00. Action: ITEM 17. CONSIDER A RESOLUTION AUTHORIZING RETENTION OF HALL & ASSOCIATES FOR LEGAL REPRESENTATION IN THE MATTER OF IOWA a - ~- ~ ~ LEAGUE OF CITIES V. ENVIRONMENTAL PROTECTION AGENCY. Comment: The Iowa League of Cities, through their attorneys at Hall & Associates, recently filed a lawsuit against the EPA as a result of the EPA's rule reinterpretations of federal regulations affecting cities with significant wet weather collection issues. The City of Iowa City, having combined sewers and combined sewer overflows, is a city with significant wet weather collection issues and is thus affected by the rule reinterpretations. It is recommended that the City Council authorize retention of Hall & Associates to represent the City's interest in the matter and authorize the Mayor to sign a Joint Litigation Agreement, an engagement letter and/or other agreement as is necessary to secure such joint representation with Hall & Associates, and authorize the City Attorney and Finance Department to make payments in accordance with any agreement or engagement letter, with the total of all fees and expenses not to exceed $25,000.
