Dilkes/ I had a couple (mumbled) Hayek/ Sure. ITEM 12. CONSIDER AN ORDINANCE AMENDING TITLE 6, ENTITLED "PUBLIC HEALTH AND SAFETY," CHAPTER 10, ENTITLED "SMOKE FREE PLACES," TO CHANGE THE VIOLATION FROM MUNICIPAL INFRACTION TO A SIMPLE MISDEMEANOR. (FIRST CONSIDERATION) Dilkes/ Um, on number 12, which is changing the smoking, uh, violation from a municipal infraction to a simple misdemeanor...um, Ihave changed that ordinance to make it a scheduled fine of $50.00, which is consistent with the civil penalty under State Code, um...and I think it's a good idea to schedule it, rather than it was initially written as a non-scheduled, which is between $65 and $625, and the problem with that is that people don't show up for their initial appearance, a warrant goes out for their arrest, and I don't think that's what we want to do with smoking charges. Um...and then on 10 and 11, which are the split-venue and the entertainment venue, I've added...because these will be, um, moot if 21 is repealed, um, I've added a provision to both of those to provide for automatic, um, repeal if 21, uh, is repealed on November 2"d, so that we don't have to go through the administrative steps of repealing it. Yeah, and so we'll be doing first consideration on both of those, and then if you want to collapse, um, on both of `em, on the 25th, you can certainly...or 26th, you can certainly do that. And then the final one, um... is i2umber 7, which is the, um, Sauce license renewal. Um...I think it's quite clear that, um, Sauce does not have the financial standing required under the State Code, but um, we've been doing research on the bankruptcy issues and I want to take a little more time to do that, um, so I would recommend that you defer that for two weeks. Wright/ Something we had spoken about, I think at our last work session was an item for that, the fact that... (several talking) Hayek/ Roosevelt repurposing? (several talking) Wright/ Might have been. Hayek/ Have you had a meeting yet? Dickens/ No, that meeting is...Monday night, from 7:00 to 9:00. Karr/ So we could put on, uh, the Roosevelt redistricting, and you would have by the 20tH then at least one meeting. Hayek/ I think it'd be nice just to hear (both talking) Dickens/ ... as much information. I won't be there at the 20th. (mumbled) but I' 11 give you the information (mumbled) Karr/ We'd also have the School District representative there, as well, too. Hayek/ I don't know whether we want, need to hear from the County on the dwelling inspection discussions, uh... Champion/ I would like...(several talking) Hayek/ Yeah. Champion/ I would like to ask the School Board (mumbled) be prepared to answer questions about what their plans are for east side schools, since they're not going to complete the renovation at City High, and I feel like they're building inequities in the school district by building all these new buildings on the other sides of town, which are all air conditioning and starting school in the middle of summer basically now...I think we're...I think they're producing, um, inequity in our school district, and I don't like it! But I can take it up on my own with them. Hayek/ Well, ask a broad question about facilities planning or something like that. Wright/ I think it's a fair question to ask about (both talking) Bailey/ ...I mean, we don't have to frame it exactly like Connie presented it. October 11, 2010 City Council Special Work Session Page 4 Wright/ No. Champion/ Well that's why I, you know, cause I plan on going to the next School Board meeting if I don't have a meeting here or I'm in town to discuss my argument with them about what they're doing to the older schools in town, what they're not doing to the older schools in town I should say, and not using that land on the east side of town that was granted to them for a school. By not using that they kind of closed off that development, but I have some real issues with what's going on in the school district, obviously. But I don't...if the rest of you aren't concerned about it, then I should probably just take it to them myself. Bailey/ Very concerned! Wright/ I would actually like to hear that addressed (mumbled) Karr/ Facility planning? (several talking) Champion/ ...then I can't address it, because I'm not likely to be very soft about it! (laughter) Wright/ You can address it any way you want it. If we're going to have it as an agenda item it probably needs to be a little more... Champion/ Okay. Anyway, so it's worth discussing, I agree! Wright/ Yeah! Hayek/ We can, I mean obviously everyone coming to this will know about the new city manager hire, but we can...briefly reference that. He won't be in town yet...so...okay. Well, if anybody has any... Karr/ And I know we will be also adding, um, the future, um, a review of the future attendee list, cause I know JCCOG had discussed, uh, that and I have had that item already submitted, about adding to the existing, um, invitee list to include, um, all three school districts and eleven cities and... and so that will be an agenda item. Hayek/ Right. Okay. Anything else? Okay. There's also a DOT commission meeting tomorrow that Council Member Bailey has graciously agreed to... Bailey/ I'm going to be in Dubuque so I thought I'd just go a little earlier. So...thanks for the opportunity to go to (mumbled) earlier. Hayek/ Thanks for heading up there a little early! It just feels like we end up rushing ourselves and we end up with agenda items piled into other meetings, and I know we do this to try and accommodate schedules, but I think there's a point beyond which...we're doing ourselves and the community a disservice. And I...I'd really like to ask Council to carefully consider collapsing meetings with any frequency. (several talking) Bailey/ Are we set up... Hayek/ ...collapsing readings or doing back-to-back meetings? Wright/ Back-to-back meetings. Hayek/ Okay. Bailey/ Are we set up for easy call in and good web streaming now? Karr/ Yes. Bailey/ Okay. Then I think that that...we should avail ourselves to that when people are traveling. That would be one option. Hayek/ My sense is that, and Marian, you can confirm this, but recently this has been driven more by scheduling problems. Uh... Karr/ Council scheduling problems, yes. Hayek/ Yeah, Council scheduling (several talking) Karr/ Yeah, I don't...I don't recall that staff's ever initiated the combining of meetings. Hayek/ Sinister plot! (laughter) Karr/ We've done it ever so subtly to not realize it! (laughter) Wright/ You've done it so well we think we're doing it ourselves! That's IP2 on your October 7`" Pendin Work Session Discussion Items: Helling/ One thing that we will have to add to that probably on the 25`" is to have some initial discussion about your budget priorities, or I'm sorry! About your, uh, legislative priorities! Um, and we'll get you the information as soon as we can. We'll put it together of what you had last year to look at, uh...the Metropolitan Coalition has drafted its...its priority areas as well so you'll have that to work with, and I'd...I think a lot of the issues are going to be the same as they have been, uh, in the last year or two, but we'll get that to you to start looking at because you have your meeting with legislators on the 30`" of... Karr/ 29`" Helling/ 29`" of November. Karr/ November, so if you want to have a resolution, it'd have to be on your earlier meeting in November. Helling/ Yeah. So we'll have to move ahead with that. That generally is not a real long discussion, so I think we can probably get it in on the 25`" (mumbled) Hayek/ When we take up the brick streets, uh, issues, I know we just got some brand new data on the...on the, uh, is it Bowery extension? Um, can we make sure that the Council gets to see some comparisons between total cost for a project with that approach, and total cost for a... a redo of asphalt or whatever other surface we might do, so we just... got some apples to apples comparison? Um, I think that would help, so we understand...what the expenses are going that route versus another. So...anything else on pending work session issues? Okay. Community events. Council invitations. Okay. Meeting schedules. Community Events/Council Invitations: Wilburn/ Oh, uh, just jumping back. Item, Matt, Iowa League got an invitation to, uh, some information about the, uh, Latino conference. Uh, I'll be attending (mumbled) Saturday (mumbled) just FYI. Karr/ You will be there? Wilburn/ I will be. Wilburn/ I don't remember which one was referred to in the packet, but I'11...I'll be periodically throughout the day on...on Saturday. I'll be there. Meeting Schedules: Hayek/ And there are several invitations in our info packets, as you're all aware. If any of you wish to attend those, let Marian know so we can get people signed up. Okay. I think that's it. Karr/ Schedule? I just had one. Hayek/ Okay. Karr/ We have not done evaluations for the City Attorney or the City Clerk this year. We waited with the summer schedule, and with the City Manager search, so the question becomes how do you wish to handle this year? In the past we've done it a number of different ways. We've set aside a block of time just to do that on an off day or evening, or we've added it to the end of a work session. What is your preference? Champion/ Well I think we could do it at the end of a work session. Wright/ I'd rather see us put together...putting some time aside on a specific day. Champion/ You think so? (mumbled) They can write up their own evaluation! Either way's fine with me! Wilburn/ (mumbled) I'm just thinking, given the extra meeting times we've had, uh, with those particular staff members in general related to the City Manager search, if we could do it on a day we already have a meeting and they already have the...just to give them the, some time off (mumbled) so my preference would be to...tack it on to an existing meeting so... Wright/ Maybe do one one week, and then one another week, so (mumbled) Wilburn/ Yeah. Karr/ We can...we can do that. We typically, in the past, Council has preferred to do it in one evening and be done with it, but that's entirely up to you. Because not knowing the time it would take, then you set aside another night, but that's entirely up to you. I tell you, what we...we could take a look at, would you prefer a work session or a formal? Does it...just depend on the schedule? Karr/ Why don't we take a look at scheduling, take a look at scheduling it as a unit, and then either we can continue it if necessary, as a block; continue it as necessary if that works out. Champion/ Or we could come early, before a meeting. Bailey/ I think that's harder for the majority, I mean, from what I've seen of the time that we set for these meetings. I think that that's harder, I'm speaking for myself. I think sometimes that's more of a challenge. Wright/ It can be. Dilkes/ I think we have enough direction. You want to tack it onto a...to a meeting, and we'll just look at the schedule and see when it makes sense to do that. Hayek/ Okay. Anything else? Helling/ Can I...can I jump back to the, uh, pending list real quickly? Hayek/ Yeah. Helling/ Uh, you have economic development projects update, and that...uh, very clearly was, I think Council...when you set some priorities in your, uh, CIP discussion last year, those were the projects that you wanted to be updated on. I think it's Riverfront Crossing, um, Towncrest, um, those were the two main ones, I believe. Um... Bailey/ We also had an economic development update in the Economic Development Committee that I think that part of this we wanted to communicate to full Council and I think that's how I remember that discussion, as well. Champion/ I think (both talking) Helling/ I think what's happening is you're getting... as these things move along you're, for instance, now you have the whole Towncrest, um, development plan, um...I'm just wondering, it seems like...it was in November that you wanted an update on the projects. I think you're going to get your update, certainly on Towncrest, uh, now and I'm just wondering if rather than try to do, uh, have this on here for a discussion of... of those projects or the status of those projects in November, they progress at a different rate, maybe we could pull that off of there. You'll deal with the projects and then, uh, if there's anything that's...that's lagging, we can update you on that, uh, but... Bailey/ I would like a comprehensive economic development update similar to what the Economic Development Committee received, and if the projects are...if we're up to speed on them, I'm fine with those just being a reference. October 11, 2010 City Council Special Work Session Page 9 but... going in to the budget and setting that as a priority for this year's budget, I think that that's an important discussion to see where we are and what opportunities we might have going into the next budget cycle. Helling/ If you want to make it more comprehensive then I...I would, I think that's what we would...we would do, but my understanding is you wanted to focus on those two or three, primarily on those two or three, uh, projects, but if you want to look at everything economic development related then I think we should put together something for you. Bailey/ I would prefer to do that! Mims/ Yeah, I think that's a good idea just, I mean, we've gotten some of that in the Economic Development Committee, and I think for the whole Council as we go into budget discussions and how we're going to prioritize where our money goes, um, particularly some of the CIP stuff. I think it'd be good for everybody on Council to be on the same page with that information. Hayek/ Okay. All right.
