As directed by Title 9, Chapter 1, Section 3B of the City Code, this is to advise th.e City Council
of the following action.
Action:
Pursuant to Section 9-1-3A (10); Establish aTOW-AWAY ZONE at the east terminus of the 200
block of Harrison Street.
Comment:
This action is being taken to help alleviate a chronic parking problem that causes the alley
adjacent to 219 Harrison Street to be blocked, which results in refuse removal issues for nearby
buildings. Parking is already prohibited at this location.

Pursuant to Section 9-1-3A (5); Install (1) STOP sign on the southwest corner of the intersection
of the Terrell Mill Park / Beckwith Boathouse drive and Dubuque Street.
Comment:
This action is being taken to clarify the right of way at this intersection.

As directed by Title 9, Chapter 1, Section 3B of the City Code, this is to advise the City Council
of the following action.
Action:
Pursuant to Section 9-1-3A (10); Install NO PARKING ANY TIME signs on the north side of
Derwen Drive.
Comment:
This action is being taken at the request of Derwen Drive residents who expressed concerns
about parking congestion on home football game days. A subsequent survey indicated that
55% of responding households are in favor of removing parking on the north side of the road on
a permanent basis.

I call your attention to the dangerous and busy, three-
way intersection of Summit Street and Kirkwood Avenue.
Aside from stop signs on Summit Street, nothing indicates the
hazards of this T-intersection, particularly the dangers to
pedestrians and cyclists attempting to cross Kirkwood to
proceed north on Summit. Nor, except for the stop signs, are
there any devices or means to make passage of pedestrians
across Kirkwood safer. The stop signs, in fact, contribute to
the hazard in attempting to cross Kirkwood.
The greatest danger to pedestrians at the intersection
results from drivers attempting to turn left (east) and slip into
the heavy, rapid eastbound traffic on Kirkwood without
consideration for pedestrians. Stop signs on Kirkwood would
greatly reduce this danger
In the past, probably before completion of the new
Summit Street bridge over the railroad tracks, three-way stop
signs were in place at this intersection. One has to wonder
why they were removed when the new bridge likely led to
increased traffic moving from Summit to Kirkwood. As you
may know, three-way stops are in place at other T-
intersections on Kirkwood--at Dodge Street and Keokuk
Street--with the result that pedestrians can cross and traffic
can turn more safely. Such stop signs also would relieve the
backup of traffic on Summit, sometimes beyond Walnut
Street, a block north of Kirkwood.
During the two-plus years we have lived at this
address, one pedestrian I am aware of sustained grave head
and other injuries and another barely escaped being struck
by a car while attempting to cross Kirkwood. Both involved
left-turning vehicles attempting to slip from backed-up traffic
on Summit into easbound traffic on Kirkwood and drivers
either unaware of the pedestrians or ignoring them. It is not
unusual to see pedestrians at the intersection scrambling or
running across the intersection.
I have talked to a traffic engineer about how to improve
safety at this intersection and stop signs on Kirkwood appear
to the most feasible, effective way to reduce the hazards.
I, and others, would appreciate your considering and
acting on improving safety at this intersection.

performance as the City Manager. Alan and I attended Boys State together many years ago and both
ended up at the University of Iowa. Alan also graduated from law school at Iowa and went on to
become President of the Iowa Bar Association. He is very civic-minded and in touch with
his community. I am forwarding his response in regards to Paul Eckert.
I will be attending the interviews this afternoon as the representative for the Parks and Recreation
Commission.

Mr. Eckert will be the perfect city manager for all of Iowa City---the residents, the council,
the directors, the employees! ! I just moved to Iowa City from Sioux City and Mr. Eckert did
much to save money on the budgets, streamlining government and making it much more
responsive and to encourage economic development. My brother-in-law works for the City
of Sioux City and he loves the way Mr. Eckert conducts his duties and how he represents
the City. He was originated many employee recognition programs which has kept the
morale of employees at an all time high! He has a REAL "Open Door" policy. The choice
should be obvious once you complete your evaluations. Mr. Eckert will do you PROUD, just
as he has Sioux City. We LOVE him, and not many city manager can say that they are
loved by the large cross-section of the community. I look forward to Mr. Eckert's fairness
and willingness to listen to all sides, and his belief in being on duty 24/7 being set here in
my new home of Iowa City! One of my neighbors in Sioux City was a councilperson with
fairly liberal philosophies and she always thought the very highest of Mr. Eckert and told
me that she didn't see how anyone could be a better city manager. His wife is a wonderful
complement to him. She gets involved in many aspects of the community too and is highly
respected and loved too. Good luck in your selection! Remember: Mr. Eckert will do you all
proud and the city proud !

Mr. Eckert is amazing. How many city managers can you say are actually loved. I am a
recently retired city employee in Sioux City. Although I looked forward to retiring to spend
more time with my wife and to travel, I must say that I greatly miss my doing my job at
city hall because Mr. Eckert made each of us feel like a vital member of the team and was
there encouraging us on. We worked hard, but what a great feeling of accomplishment we
got daily working for Mr. Eckert.
He developed lots of morale incentive programs too to recognize hard work.
Now that I will soon be moving to Texas and leaving Sioux City, I would like to see Mr.

My relationship with the Eckert family is unique, as my employment at the Ronald
McDonald House of Iowa City has introduced me to Paul, Julie, and their three children.
While I cannot speak on behalf of Paul's professional experience and qualifications, Iwould
like to briefly share my experience getting to know Paul on a personal level.
More than anything, Mr. Eckert is a stand-up individual and a good guy. During perhaps the
most difficult and stressful time in his life coping with his child's cancer treatments, Paul
carried a smile on his face and made an effort to meet all of our staff members at the
Ronald McDonald House. Customer service and satisfaction is of utmost importance to Paul,
as he often remarked how pleased he was with our operation.
During his multiple stays at the Ronald McDonald House, Paul mentioned how he would
love to live in Iowa City if the opportunity ever presented itself for employment. He is
familiar with the community and genuinely understands the important role services such as
the University of Iowa Children's Hospitals provide to Iowa City.

Regarding Paul Eckert:
Paul Eckert is the best candidate for the position of city manager. His dealings with the
small colleges of Sioux City and his seven year stint as an adjunct professor are invaluable
experiences that will allow him to be effective in communicating with the University of
Iowa. His extensive volunteering experience demonstrates that he is a compassionate
citizen who is not afraid of getting involved with the community. The Homeless Sleep-out
Event he discussed could potentially be directly applicable to Iowa City, as we have a fairly
large homeless community. Finally, and perhaps most importantly, he is very approachable
and his kindness is unmistakable.

Thomas Markus's greatest asset is his extensive experience working as City Manager.
Unfortunately, this experience floes not include working directly with a university or

A dynamic city with enviable vitality needs a city manager with the same traits---dynamic
and with vitality. I clearly have seen those traits, PLUS so many other perfect traits which
we need in a city manager at this juncture in time. He has strong leadership qualities which
have initiated many cutting-edge projects and solutions in Sioux City and in California. His
financial background would provide the ultimate expertise since we are in a period of time
where we cannnot waste public funds. We need wise use of our financial tax base. The
citizens demand it.
I would caution against placing too much consideration into your directors' possible
hesitations about someone who will make some changes for efficiencies and streamlining.
It's common to fear the future and to want to maintain the status quo as a security blanket.
Private industry makes consolidations and budget-trimming actions in a business-like
manner. Governments should do the same.
With due respect to the other two gentlemen, who are close to my own age of 61, someone
like Mr. Paul Eckert is more likely to create and to carry out newer ideas and more in step
with new methods. For too long now, the city of Iowa City staff, needs and would do best
with a leader who is dynamic, just like our new Iowa City School Superintendent.

Hello,
I am writing to inform you that while I have had several memorable vacations to Iowa City, a recent
experience has left me unwilling to return. My wife and I traveled there each fall to enjoy collegiate
sporting events and to allow her to revisit her alma mater, the University of Iowa.
This year we arrived on Friday the 24'h and stayed in Coralville after touring the campus, dining and
shopping in the area. Saturday morning we traveled to Kinnick Stadium via the Hawkeye express train
and arrived early to shop and tailgate. As we approached the stadium, we stopped at the row of vendors
across the street and began browsing their wares. As we had in previous years, we brought beer to
consume while we shopped. We both decided to open one and continue shopping. While my wife
shopped a few feet from me, I waited and began to consume my first beer. As I took a drink, a group of
policemen approached me and one stated to the group "We've got a Miller Lite over here".One officer
approach me and ask me for identification which I promptly produced. My immediate suspicion was he
was checking to make sure I was of legal age to consume. He stated that Iowa City had recently adopted
a "zero tolerance" policy and that I was in violation of the law. He stated he had to write me a citation
for an open container of alcohol in a public place. I responded by telling him that just ten months prior I
had a conversation with a policeman on the same corner as we were standing while drinking the same
beer. I told him how last year the officer gave me directions and good advice on where to store my
belongings while at the game but, had never made reference to my open beer or consumption in any
way. I told him I was not there to cause trouble and would gladly "play by the rules now that I knew
them". He stated the he could not just ask me to pour it out but had to write the citation to promote
zero tolerance". He also said his lieutenant was across the street watching and if he did not write the
citation, he would be reprimanded. I asked the officer how much this citation would cost and he said
that the ticket itself was only twenty dollars but court costs and other administrative fees would bring
the total to one hundred forty seven dollars and fifty cents. He then had me sign the ticket.
As he asked me some questions about my home town of Overland Park, KS my wife saw me talking
with four policemen and approached to see what was going on. Before she could get close enough,
another one of the officers in the group stepped between us and asked for her identification. Ithen
stated to the group of officers "Come on guys I told you we didn't know the law and would follow it
from now on. Do you really need to sting our household for $255?".Their response was "Sorry sir, the
policy is zero tolerance and we cannot turn a blind eye to some and not others". I then asked them to
show a little compassion and to realize that they had taught us a lesson with the first ticket. These pleas
fell on deaf ears. They wrote her citation and joked amongst themselves as we parted company. My wife
was near tears so we walked onto try to make the best of the day. The conversations with the officers
were entirely polite and respectful from all sides. As you can easily find out using the information on the
copies of the citations attached we are law abiding people who unknowingly broke the law. We admit
we were wrong but believe the total lack of flexibility or compassion in the way the law was enforced is
exactly why few people have faith in lawmakers or law enforcement today.
Before entering the stadium that day we spoke to several students who said that this has been a
common occurrence this football season and has been well documented and publicized through local
media. Visiting from Kansas only once a year, we were not as informed and heavily penalized for our
ignorance.
If I may suggest , If you choose to change your approach on enforcement of a particular law from
high tolerance to zero tolerance you may want to post this change for at least a short period to inform
visiting travelers. I would suggest areas around the Hawkeye express and street corners in the
immediate area of its drop off point (where we were cited). Your approach of simply posting officers in
that area to write citations and generate revenue is positively offensive.
I have shared my story with many close to me as well as the local U of I alumni association in my
area. Our consensus opinion is that the law is there for good reason but should be enforced with at least
a small amount of consideration for those who do not know your city has completely reversed the
method of enforcement. We are not wealthy people and have limited disposable income to devote to
travel. Our trips to Iowa City to enjoy a football game were always a highlight of our fall season. We
have decided our money may be better spent elsewhere in coming seasons.
I am adding a partial list of the out of town income your city received during our 36 hour stay. The
checks I write for these citations will complete my lifetime budget for Iowa City, IA.

elsewhere without being fearful of what enforcement policy may have been completely changed and
the officers enforcing said law being forced to consider revenue for the city over public service.

I just wanted to voice my support of the City Council's actions. In the wake of a the D.T.A.'s
letter I wanted to send our own. My family has owned and operated The Soap Opera for 29
years in the pedestrian mall. We have first hand seen and often cleaned up after the destructive
drinking behavior in the downtown. Behavior that has continued to ramp up. This is the first
time we have seen that curbed. Since the ordinance has been in place we have had only one act
of vandalism on our building and one instance where we had to clean up vomit and urine out of
our entryway. Last year it was 2-3 times a week. For that alone I'm grateful, but if you look
across the board with the reduction of calls for service from the ambulance and the police it is
clearly a policy that was long over due. I commend the Council for having the courage to finally
do what's right. The 75% reduction in calls for sexual assaults was a particularly encouraging
statistic. It is only a start, but I laud the Council for taking that important first step.
We are also members of the D.T.A. and feel they were completely out of line and in no way
represent our views on the matter. To somehow call to task one side of the issue was a blatant
abandonment of the neutrality of the organization. Saying that somehow Mrs. Champion's
anecdotal statement was somehow deleterious to the Downtown's reputation is absurd. I have
seen far worse in my years working in the Downtown. The idea that citing evidence and
personal experience in support of an issue is both absurd and I felt clearly designed to make it
look like the business community was against 21. Some are undoubtedly, but not us. The
Downtown's reputation has been damaged by the unending misbehavior. For years that sort of
news has overshadowed the positive. That damage will only be repaired if we correct the
problem. Again I congratulate the Council for making that step. Thank you.

I hear a lot of underage students planning thier return to downtown Iowa City if the 21
Orddinance happens to be repealed. That just sparked a curiousity of how long after the
November Vote will it be before the bar go back to "being 19" again. The students on campus
seem to be under the impression that it will be an immediate effect... just wondering if that is
actually the case.

This recommendation for denial stems entirely on the requirement for a person of good moral
character as defined by Iowa Code Section 123.3(26)(a) to have financial standing.
Mike Porter is 100% owner of Sauce. A search on Iowa Courts Online located two cases where
Porter has unsatisfied judgments:
• SCSC077362 He owes $1,758.27 plus costs ($222) plus interest
• SCSC077363 He owes $4,996.53 plus costs ($222) plus interest
It has been reported to me by the City Attorney's Office that Porter has experienced additional
financial problems in the past year. These include:
• Defaulting on a loan he received from the City of Iowa City to sprinkle One Eyed
Jakes. When given notice of the default; he paid with a check, which bounced.
To date, he has not cured the default, and the City had to go to Corridor State
Bank, who secured the loan, to seek the return of the money.
• Sauce, the applicant business, filed for bankruptcy on September 23, 2010. In
that filing, Porter listed as creditors, among others, the Internal Revenue Service
and the Iowa Department of Revenue, suggesting that he owes back taxes to
both the IRS and State of Iowa.
• One of his other businesses, Vito's, declared bankruptcy in May 2010.
• On September 24, 2010, Corridor State Bank, secured a judgment against The
Summit Restaurant & Bar, Inc. (owned by Porter), One Poor Student, Inc.
(owned by Porter), and Mike Porter personally for a total of $390,046.77 plus
interest. This judgment is unsatisfied.
• While testifying under oath in a case related to The Summit in August 2010,
Porter claimed that the Summit would be going out of business by end of August,
as he wasn't able to pay his bills, if he was not granted an exception by the
Court. The court denied his request. He was 100% owner of the Summit and his
statements made under oath support the notion that he doesn't have the financial
standing to pay his bills.
Based on the totality of these facts, it is clear that neither Sauce nor Mike Porter have the
financial standing required under Iowa Code Section 123.3(26)(a).

One of his other businesses, Vitos, declared bankruptcy in May 2010
He's been sued by Corridor State Bank for failing to honor his duties as
guarantor for a loan taken out by Vitos. Sauce also guaranteed the loan.
This is pending litigation.
While testifying in the Summit Case in August 2010, Porter claimed that
the Summit would be going out of business by end of August, as he
wasn't able to pay his bills. This was stated under oath. He is 100%
owner of the Summit and his statements made under oath support the
notion that he doesn't have the financial standing to pay his bills.
Based on the totality of all of the issues, even if he paid off the small claims judgments,
there is still a failure for Porter to meet the criteria for a person of good moral character

case of renewals, or within seven (7) days of completion of the
application, including the state requirements, in the case of
applications fora new license. Renewal applications will not be
accepted more than seventy (70) days prior to expiration of the
present license. The application must be reviewed and approved or
denied by the city council. (Ord. 09-4357, 10-6-2009)
4-2-4: NOTICE AND HEARING: The city council shall provide the
licensee or permittee an opportunity to be heard prior to the
imposition of a civil penalty, suspension or revocation or disapproval of an
application for renewal. Notice may be given by personal service or first
class mail directed to the manager or contact person of the applicant as
listed on the application. Notice by personal service must be given at least
five (5) days before the hearing. Notice by first class mail is effective on
mailing and must be given at least six (6) days before the hearing. (Ord.
01-3968, 6-12-2001, eff. 8-1-2001)
4-2-5: CIVIL PENALTIES:
A. Any violation of state law, local ordinance, or the rules of the
alcoholic beverages division by any employee, agent, or servant of a
licensee or permittee shall be deemed to be the act of the licensee
or the permittee and shall subject the license or permit of said
licensee or permittee to civil penalties, including suspension or
revocation.
B. The city council may suspend a license or permit for a period not to
exceed one year, revoke the license or permit, or impose a civil
penalty not to exceed one thousand dollars ($1,000.00) per violation.
Before suspension, revocation, or imposition of a civil penalty the
license or permit holder shall be given written notice and opportunity
for a hearing in accordance with section 4-2-4 of this chapter.
C. A license or permit issued may be suspended or revoked, or a civil
penalty may be imposed on the license or permit holder by the city
council for any of the following causes:
1. Misrepresentation of any material fact in the application for such
license or permit.
