As you can see from their attached letter, they are interested in providing these light bulbs to low/moderate income families, elderly and handicapped in an effort to reduce their electricity usage and decrease their utility expenses. I intend to work with Chris and other UISG members to connect with eligible households by working with the Public Housing Authority, neighborhood associations and other local agencies who may provide a distribution resource for this program. As you can see, they have secured funding from UISG and Office of Sustainability and are asking for additional assistance through the MidAmerican Community Grant. I'm excited to work with UISG and all the students in this effort and see it as a wonderful opportunity to create positive relationships between students and neighbors. Washington Street Iowa City, Iowa 52240 Dear Marcia: The University of Iowa Student Government (UISG) and the University of Iowa Office of Sustainability, under my direction as Sustainability Initiatives Coordinator, are wishing to work with your office to distribute compact fluorescent light bulbs to low-income community members in possibly senior citizen housing developments and other low-income communities in Iowa City to help these residents reduce their energy costs. The project will hopefully provide several benefits the community; improved student/neighbor relationships, help lower income families save on their energy bills and provide for a number of positive environmental impacts. With the recent debate over local bar ordinances, UISG understands that students and community members have often felt at loggerheads over the past year. This event, proposed for February 5th, is part of an effort by UISG to bridge the gap between community members and students. UISG plans to invite dozens of UI students to help distribute the compact fluorescent light bulbs to community members. In the distribution of these light bulbs, students will have an opportunity to show that they care about the Iowa City community, as well as interact with members of the Iowa City community with whom they would normally not interact. With the financial and housing crises of 2007-2009, low-income residents of Iowa City are struggling to pay their bills. Low-income consumers in the Midwest spend an average of $964 on electricity per year, much of which comes from powering lights. A reduction in energy use will help low-income consumers save money on energy bills at a critical time, while simultaneously reducing carbon emissions related to climate change. The project will also have a major positive environmental impact. Compact fluorescent light bulbs use four times less energy than standard incandescent light bulbs, and would reduce greenhouse gas emissions per light bulb by 200 pounds over their lifetime. Although compact fluorescent light bulbs contain mercury, the emission of mercury from power plants saved by using these light bulbs outweighs the amount of mercury contained in the bulb. To reconcile the environmental concern of the mercury disposal issue, UISG will attach a paper flier, written by the UI Office of Sustainability, which describes the proper way to recycle the bulbs. UISG will fund $500 for the bulbs, which will be matched by the UI Office of Sustainability. The $1000 funded by these organizations will provide for 357 bulbs (at a cost of $3.50 a bulb) to consumers. This will combine for energy savings of $14,000 for these low-income consumers, as well as a reduction of 70,000 pounds of carbon dioxide emissions. UISG is working with local businesses to obtain light bulbs at wholesale cost, as well as donations from stores. We are interested in working with your office to help us direct this program the most effectively as well as promote it through the existing neighborhood associations in Iowa City. As we are also interested in helping residents install the light bulbs in their homes, we would like to receive guidance from your office on how to execute the installation process for residents. We would be very pleased if MidAmerican Energy would be willing to assist in funding this program through their Community Grant Program. An additional $250 in funding would provide for 72 more bulbs, saving consumers approximately $2800 in costs. Please let me know if you need additional information or have questions. I do know that in the 20 plus years I have lived in Hilltop there has never been many accidents on this stretch yet since the construction had begun of the new Shelter house and the continued parking on the East side of the street I have seen 2 accidents at the intersection of Waterfront and Southgate as well as almost been involved in 2 myself had not acted quickly. On top of that I have learned of at least two accidents that have occurred with people turning out of Hilltop Mobile Home Park. This has all occurred during good weather. I have submitted to Darian Nagle-Gamm in the past of the sand line from where the city plows in the winter... The sand lines show the street gets about 5 feet narrower in the winter. While I commend the city for addressing the parking issue on the East side of the street, when you take into account that the issue is also people pulling off of Southgate, which is a speedway... Parking on the west will be an issue, especially in the winter. Please consider no parking on both the East and West side from the drive to Southgate. I am only interested in safety. The reason I am emailing you today is because I had an idea that I would like to propose to you, with the hopes that I could get some feedback-advice-input on. My concept would be to take the areas of land that is undeveloped (areas next to 4 lane roads, and medians) and cover them with a network of Solar Panels that would generate electricity for the areas that would be interested in participating. I was also thinking, possibly we could lease the solar panels to cover utilities, and government buildings. The lease agreement could be split between the Solar Panel Company and the properties using the panels. (50% of generated electricity would go to the properties; the other 50% goes back to Solar Panel Company to be resold to Iowa City area businesses, homes) My idea would be to start around: Melrose Avenue (West of University Heights) all the way to Camp Cardinal Road. (Camp Cardinal could also be used all the way to 22nd Ave) The median area is unused, but Iowa City pays for this area to be kept up, with no production coming from these areas. (This area could be set aside to SEE if this model could work for future areas, and the electricity generated could be used for the Iowa City Waste Water facility.) I MAY NOT know all the details involved in this process, or I may be completely off in my assumptions that this could be conceived. If you have ANY information that could be useful towards solving this problem, or making this a reality, please contact me and let me know if my idea can take off or if it has no chance of success. I am interested in generating income, while saving money for our community. (I understand that with the current recession, the chances that ANY city would have funds to cover this are slim, but I would love to see Iowa City become one of the more progressive cities when it comes to generating clean green energy.) Had it not been for an a-mail message from Neighborhood Services Coordinator Marcia Bollinger, we would have been unaware that the Council had scheduled the brick street policy discussion for its December 6 work session. We realize that this item has been on the Council's pending list for some time, but assumed that representatives from our neighborhood might have been involved in some of the early discussions regarding this item. Before the Council makes any policy decisions regarding this, we would like the opportunity to be part of this broader discussion, along with members of the Historic Preservation Commission (we note that no one from this group was included on this memo's distribution's list either). While we understand that there is a financial consideration to these policies, we know that the Council recognizes that this is a much broader issue that should also involve neighborhood and historic preservation perspectives. We are aware of the financial challenges that our community faces and the importance of examining of policies in light of these, but believe that the City's commitment to neighborhoods, as stated in our comprehensive plan, means that neighborhoods must be involved in these types of discussions. These include two civil penalties in 2008 for serving to underage at Jake's and Vito's. He received a 30 day suspension in 2000 at Jake's for serving to underage and another in 2009 at Vito's. One police liquor license check was done at The Summit during the review period. The business passed this check. Mr. Porter is 100% owner of the Summit Restaurant and Bar, Inc.. A search on Iowa Courts Online located two cases where Porter has outstanding unsatisfied judgments, demonstrating that Mr. Porter lacks the financial responsibility and viability required for the issuance of a liquor license under Iowa Code • SCSC077362 He owes $1,758.27 plus costs ($222) plus interest to AAA Mechanical • SCSC077363 He owes $4,996.53 plus costs ($222) plus interest to AAA Mechanical According to reports from the City Attorney's Office, Mr. Porter has experienced additional financial problems in the past year, thereby further failing to demonstrate financial responsibility and viability as required for the issuance of a liquor license under Iowa Code §123.3(26)(a). These include: • Defaulted on a loan he received from. the City of Iowa City to sprinkle One Eyed Jakes. When given notice of the default, he paid with a check, which was returned for non-sufficient funds (NSF). To date, he has not cured the default. As the City accepted a letter of credit issued by Corridor State Bank as security for the loan, the City has contacted Corridor State Bank to collect on the security and has yet to receive payment. • On September 23, 2010, another of Mr. Porter's businesses, Sauce, Inc., filed bankruptcy. In that filing, Porter lists as creditors, among others, the Internal Revenue Service and the Iowa Department of Revenue, suggesting that he owes back taxes to both the IRS and the State of Iowa. The indications that these continue to be outstanding debts, which represent ongoing and regular costs of doing business, reflect that Mr. Porter cannot demonstrate financial responsibility and the financial viability of a continuing business interest. • One of his other businesses, Vito's, declared bankruptcy in May 2010, further reflecting a lack of financial responsibility and viability. • On September 24, 2010, Corridor State Bank secured a judgment against the applicant's business, The Summit Restaurant and Bar, Inc., (owned by Porter), and Mike Porter personally, for a total of $390,046.77, plus costs and interest, in Johnson County District Court Case No. LACV 072399. This judgment remains unsatisfied and indicates further lack of financial responsibility and viability of by Mr. Porter. • While testifying under oath in a case related to the Summit in August 2010, Porter claimed that the Summit would be going out of business by end of August, 2010, as he wasn't able to pay his bills. This was stated under oath. He is 100% owner of the Summit and his statements made under oath support the notion that he doesn't have the financial standing to pay his bills. • On September 1, 2010, Mr. Porter was sued by Hawkeye Food Systems, Inc. in Johnson County small claims case No. SCSC 078017 for an alleged debt owed to Hawkeye Food Systems. • Mr. Porter and MP Investments were recently sued by Hawkeye Food Systems, Inc. in Johnson County small claims case No. SCSC 073491. • After being served a notice of default on a promissory note, on November 12, 2010, Mr. Porter was sued by Southgate Construction, L.L.C., claiming an outstanding balance of $38,585.06 plus 18% interest and costs. Notice may be given by personal service or first class mail directed to the manager or contact person of the applicant as listed on the application. Notice by personal service must be given at least five (5) days before the hearing. Notice by first class mail is effective on mailing and must be given at least six (6) day's before the hearing. Any violation .of state law, local ordinance, or the rules of the alcoholic beverages division by any employee, agent, or servant of a licensee or permittee shall be deemed to be the act of the licensee or the permittee and shall subject the license or permit of said licensee or permittee to civil penalties, including suspension or revocation. The city council may suspend a license or permit for a period not to exceed one year, revoke the license or permit, or impose a civil penalty not to exceed one thousand dollars ($1,000.00) per violation. Before suspension, revocation, or .imposition of a civil penalty the license or permit holder shall be given written notice and opportunity for a hearing in accordance with section 4-2-4 of this chapter. C. A license or permit issued may be suspended or revoked, or a civil penalty may be imposed on the license or permit holder by the city council for any of the following causes: 1.
