OF THE FY2011 ELEVATOR MODERNIZATION PROJECT,

Comment: This project involves the modification and replacement of five
elevators in three facilities. Two traction elevators at Capitol Street
Ramp, two hydraulic elevators at Dubuque Street Ramp and one
hydraulic elevator at Robert A. Lee Recreation Center. The contractor will
be responsible for all associated mechanical, structural and electrical
work. The estimated construction cost is $788,200 and will be funded
with Parking Operations revenue and G.O. Bond proceeds.

Comment: At its December 2 meeting, by a vote of 5-2 (Plahutnik and Eastham
voting no), the Planning and Zoning Commission recommended approval of the
proposed zoning code amendment. Staff recommended approval in a memo
dated December 2, 2010. The amendment will allow the applicant, Billion
Motors, to change the sign face on the existing 50-foot freestanding sign
located on their property at 2641 Mormon Trek Boulevard near the Highway
218 interchange with U.S. Highway 1. The amendment would also apply to
other similar nonconforming signs on properties within 1000 feet of an interstate
highway right-of-way.

PIANO LOUNGE, 217 E. IOWA AVENUE.
Comment: In accordance with City Code sections 4-2-3 and 4-2-4 staff is
recommending the denial of the renewal application for the above mentioned
establishment for reasons identified in two staff memorandums from the Police
Department and Housing Inspection Services. The memos from the Police Chief and
Housing & Inspection Services providing information on the violations and
recommendation for denial is included in the Council Packet along with copies of
correspondence sent to the applicant /owner from the City Clerk's office.

ITEM 9. AUTHORIZING CONVEYANCE OF A SINGLE FAMILY HOME LOCATED AT 416
DOUGLASS COURT.
Comment: The grant for the UniverCity Neighborhood Partnership Program allows the
City to purchase twenty-five rental units located in designated neighborhoods
surrounding the University, rehabilitate them with up to $50,000 in grant funds, and
then sell them to income-eligible buyers. Under the UniverCity Neighborhood
Partnership Program, the City proposes to sell 416 Douglass Court. The amount of the

sale will be $84,500 (this is what the City paid to purchase the home) plus the carrying
costs, which are all costs incurred by the City to acquire the home, maintain it and sell
it, including abstracting and recording fees, interest on the loan to purchase the home,
mowing and snow removal, insurance, utilities, real estate taxes, and any costs in
excess of $50,000 to repair and rehabilitate the home. The carrying costs are
approximately $6,500, including $3,178 in excess rehab costs (total repair and
rehabilitation cost was $53,178).

ITEM 10. ADOPTING IOWA CITY'S FY11 ANNUAL ACTION PLAN AMENDMENT #2, WHICH
IS A SUB-PART OF IOWA CITY'S 2011-2015 CONSOLIDATED PLAN (CITY
STEPS), AUTHORIZING THE CITY MANAGER TO SUBMIT SAID PLAN AND ALL
NECESSARY CERTIFICATIONS TO THE U.S. DEPARTMENT OF HOUSING AND
URBAN DEVELOPMENT.
Comment: At their November 18, 2010 meeting, the Housing and Community
Development Commission (HCDC) discussed and recommended that City Council
approve the FY11 Annual Action Plan Amendment #2. The draft minutes of this
meeting were included in the City Council's December 16, 2010 Information Packet.
The FY11 Annual Action Plan Amendment #2 proposes to use approximately
$1,398,000 in anticipated CDBG program income to fund six public facility projects and
one public service project. A 30-day public comment period started on December 8,
2010 and ends on January 10, 2011. The Council will review HCDC's housing
recommendations for $1,205,000 in February or March. For more information see staff

Comment: This ordinance would eliminate the 100ft. separation requirement for outdoor
service areas when they are located in the CB2, CB5, and CB10 zones (downtown
zones). Under the current code, the downtown zones place no residential location
requirement on sidewalk cafes but require it of outdoor service areas which are similar to
sidewalk cafes. Elimination of the 100ft. restriction for outdoor service areas provides
equal treatment for outdoor service areas and sidewalk cafes. Staff recommends
adoption of the ordinance.

CLERK TO ATTEST AN AGREEMENT WITH SKOGMAN REALTY TO SELL AND
r~` ~~ LEASE PROPERTY IN AVIATION COMMERCE PARK.
Comment: The Airport Commission and the City Council have had a listing agreement
with NAI Iowa Realty to sell and lease the property known as Aviation Commerce Park
("ACP") since 2003. Six of the seventeen lots have been sold. The agreement, which
was extended many times, expired on December 31, 2010. Given that the listing had
not been opened up to other brokers for 8 years, the Airport Commission decided to
invite local commercial brokers to make a presentation at the December 16 meeting if
they were interested in the listing. At a meeting on December 20, the Commission
selected Skogman Realty. The proposed agreement is attached to the resolution and is
substantially the same as the agreement with NAI Iowa Realty. Minutes of the
Commission meetings on December 16 and 20 are in the information packet.

Comment: The City has worked with a developer on attracting the Press-Citizen to a
downtown office location. The Press Citizen has indicated they could not consider the
downtown location without atwo-year subsidy of parking rates. In keeping with the
goals and strategies set forth by the Iowa City Council Economic Development
Committee to expand the office use in the downtown area, the request was granted
pending Council approval. The Economic Development Committee (EDC) met Dec. 21,
2010 and recommended approval. Draft minutes of the EDC meeting are included in
the Council Information Packet. Staff correspondence included in Council packet.

Comment: The City of Iowa City must acquire right-of-way, fee title, permanent
easements and/or temporary construction easement to construct the West Side Levee
- CRANDIC Railroad to McCollister Boulevard Project. This project includes the
construction of an earthen levee from the CRANDIC Railroad to McCollister
Boulevard. This project is funded by a Community Disaster Grant, Community Block
Development Grant and General Obligation Bonds.

of the design, inspection and federal funding partner coordination will require additional
