WHEREAS, the City is the owner and holder of certain Mortgage which at this time is in the amount of $50.000, and was executed by Jennifer E. At some point after 1984, the western half of Lot 19 was added to Lot 20, creating a larger Lot 20 and a smaller Lot 19. The subject application is requesting a re-subdivision to create a new lot (Lot 1 of EPS First Addition), consisting of the portion of Lot 20 that was formerly a part of Lot 19. Lot 1, which currently is used for parking, would be developed in the future. An office building is currently located on the western portion of Lot 20, and parking facilities are located on Lot 19 and the eastern portion of Lot 20. The Attorney's Office is reviewing the legal papers. It is anticipated that these plans and documents will be approved by staff prior to City Council consideration of the final plat. The applicant has indicated that they have chosen not to use the "Good Neighbor Policy" and have not had discussions with neighborhood representatives. ANALYSIS: Street Design: There are no streets planned. There are two access points on the property from Northgate Drive, one on the eastern side of Lot 19 and one on the eastern side of Lot 20. No curb cuts are planned for direct access onto Lot 1. Access to the Lot 1 would be via an ingress/egress easement over the eastern portion of Lot 20. Some of the parking for Lot 1 would also be within an easement on Lot 20. Because Lot 1 currently serves as parking for the office building on Lot 20 and there will be a parking easement on Lot 20, the site plan review process for development of Lot 1 would need to address whether the remaining parking on Lot 19 and Lot 20, would be sufficient to meet the requirements for the existing office building. Storm Water Management: Storm water management was addressed in the previous subdivision process. The Iowa City Housing Authority's current 5-Year Plan for Fiscal Years 2010 - 2015 was submitted to HUD in April 2010. The ICHA has expanded affordable housing opportunities by operating TBRA programs with HOME funds from the State of Iowa & City of Iowa City. In partnership with the local Veterans Hospital, we operate aHUD-VASH rental assistance program. The FSS program maintains an average enrollment of 150 families & 68% of those families have an escrow savings account. Through the ICHA's FSS & Homeownership programs, 128 families have become homeowners since 1998. (b) Significant Amendment and Substantial Deviation/Modification. The U.S. Depart- ment of Housing & Urban Development (HUD) distributes federal subsidies to the Iowa City Housing Authority (ICHA), which owns and manages the housing. The City of Iowa City owns eighty-one (81) low-density uniu, constructed to conform and blend into the existing neighborhood architecture. The 81 Public Housing uniu represent I/2 of I % of the total number of rental uniu in the City of Iowa City. Page 9 Annual Report - 201 I Promoting Self-Sufficiency The lack of safe, decent, and affordable housing undermines quality education, public health, and economic growth. Affordable housing is a contrib- uting factor to stabilizing families. Stable families are better equipped to take advantage of educational opportunities. Opportunities for and access to ad- vanced education and training increases employabil- ity. Sustainable employment offers opportunities to attain self-sufficiency. Economic self-sufficiency leads to a better society and strengthens the "sense of community." Through our Self-Sufficiency programs, the Housing Authority is helping low income families bridge the economic gap by building assets, improving employ- ment opportunities, and transitioning from renters of units to owners of homes. The Family Self-Sufficiency (FSS) Program: Promotes self-sufficiency and asset development by providing supportive services to participants to in- crease their employability, to increase the number of employed participants, and to encourage increased savings through an escrow savings program. FSS Homeownership: Through our FSS program, many families have used their escrow savings accounts and private mortgages to attain homeownership independent of the Housing Authority programs. Fifty-nine (59) FSS graduates have moved to homeownership; forty-seven (47) independent of the Housing Authority Homeownership programs and twelve (I 2) participated in Housing Authority Homeownership programs. Page 12 Annual Report - 201 I Promoting Homeownership HCV Homeownership Program: Eligible participants have the option of purchasing a home with their HCV assistance rather than renting. • Thirty-four (34) HCV Vouchers were used to purchase homes since January 2003; Twenty-three (23) HCV Vouchers are currently active. Tenant-to-Ownership Program (TOP): The Tenant-to-Ownership Program is funded by HUD. The TOP program offers opportunities for low to very low-income families to purchase single-family homes owned by the Housing Authority. • Twenty-six (26) homes sold and ten (I I) resold since May 1998. Affordable Dream Home Ownership Program (ADHOP): The Affordable Dream Home Ownership Program is operated, managed and funded solely by the ICHA. It offers opportunities for income eligible families to pur- chase newly constructed or newer homes. • Sixteen (16) homes (eight "Universal Design" homes) were built and sold since May 1999. Two (2) "Universal Design" homes are currently on the market. One (I) additional TOP/ADHOP home is available through resale. Down Payment Assistance Program -Grant Award $ 187,500: Funded with Fiscal Year 2009 HOME funds. First-Time homebuyers with a household income of <80% of the Area Median Income (AMI) may be eligible for a forgivable loan for down payment assistance. At the date of this publication: • 17 families purchased homes; Funds expended = $165,600 • I family with obligated funds = $10,000 • Remaining unobligated funds = $I 1,900 • Families with household income 60-80% of AMI = 10 Families with household income <60% of AMI = 7 Page 13 Annual Report - 201 I Executive Summary The Federal Department of Housing and Urban Development (HUD) funds Housing Authorities on a Calendar Year (CY) basis. Funding for Calendar Year 201 I: Our CY 201 I funds are made available to HUD through the Federal Fiscal Year (FY) funding cycle which began on October I, 2010. Congress has not complet- ed the negotiations on the FY 201 I budget and the Federal Government is oper- ating via a series of Continuing Resolutions (CR). As of this report, the United States Senate announced that it will accept a Unit- ed States House of Representatives-proposed extension to the current FY 201 I Budget CR. This CR will expire on Friday, March 18, 201 I . We are entering the 6th month of FY 201 I without a final bill signed by President Obama. Under this scenario, funding for the programs administered by the Iowa City Housing Au- thority remains at our CY 2010 levels. According to the National Affordable Housing and Rehabilitation Officials (NAHRO), "no one is speculating on a Conlin- uing Resolution (CR) through the end of September at FY 2010 levels, the course of the debate and the negotiations ahead of us is still uncertain so the best advice at this writing is to simply stay tuned". The President's FY 201 I budget proposal included a total of $41.6 billion in funding for Department of Housing and Urban Development, down from the $43.58 billion provided through the FY 2010 HUD appropriations bill. Howev- er, the administration's FY 201 I proposal projecu that FHA and Ginnie Mae receipts in the amount of $6.9 billion will be available to the Department to augment appropriated funding. Including projected receipu, the administration projects $48.47 billion in total discretionary budget authority for HUD for FY 20t I, up from $46.92 billion for FY 2010. The increase is notable given the Administration's proposal to freeze domestic spending accounts beginning in fiscal 201 I for a period of three years. It is also true however that several pro- grams including the Public Housing Capital fund, Section 202 and the Fair Hous- ing Initiatives Program (FHIP) were among the accounts which were reduced in order to level fund or slightly increase other key accounts in the HUD budget request. In February 201 I, the United States House of Representatives introduced House Resolution 1 (H.R. I ), which would establish funding levels for the remainder of FY 201 I. The cuts called for in H.R. I, cuts estimated at or near $100 billion will, if ultimately adopted in law, have a devastating impact on housing and com- munity development (HCD) programs. Page 14 Annual Report-201 I H.R. I would: • cut 60% from the CDBG program, • cut over a 40% cut from the Public Housing Capital fund and, • cut over 20% cut to Section 8 voucher program administrative fees. Funding for Calendar Year 2012: On February 14, 201 1, President Obama released his budget for FY 2012. The President's FY 2012 budget proposes a total of $43 billion in net budget authori- ty for HUD, down slightly from the $43.5 billion provided through the FY 2010 HUD appropriations bill and essentially equal to the administration's top-line request for FY 201 1. Conclusion: The Housing Authority is following NAHRO's advice to "simply stay tuned"! We monitor all alerts from NAHRO and the Center for Budget and Policy Pri- orities. The State of Iowa Chapter of NAHRO is keeping the State of Iowa Sena- tors and Representatives apprised on the impact the proposed budgets have on the citizens receiving assistance and services from Iowa Housing Authorities. Calendar Year End Report: The ICHA achieved "High Performer" status for both the Housing Choice Voucher (HCV) and Public Housing programs for FY10. For CY09 the ICHA attained ayear-end lease-up rate of 98% for both the HCV program and Public Housing programs, and utilized 95% of our budget authority for the HCV pro- gram. In addition to the HCV and Public Housing Programs, The Iowa City Housing Authority is providing Tenant-Based-Rental Assistance to 38 elderly and/or disa- bled families with State of Iowa and City of Iowa City HOME Investment Funds; and, 25 formerly homeless Veterans' with funding from the Department of Housing and Urban Development and the Veterans Administration. These fami- lies are counted in our statistics displayed on pages 6 and 7. The partnership with the Iowa City Area Association of Realtors (ICAAR) to provide our award winning Home Buyer Education class to prospective home- owners continues. ICAAR and the Housing Authority partnered with the City of Iowa City Cable TV Division do develop and deploy an online version of the course to supplement the bi-annual live course presentation. The uses of the cash sources are based on relevant HUD notices and signed agreements between the Housing Authority and HUD. Public Housing Operations & Housing Choice Voucher (HCV) Administrative Fee Cash Reserves Under Section 9(3) of the Housing Act of 1937, Operating Funds are available to the ICHA for the operation and management of the Public Housing &HCV Programs. Operating cash is only available for the use and benefit of public hous- ing units and residents, or HCV development activities that benefit the HCV program and its participanu. Housing Assistance Payments (HAP) HUD provided funds to cover the housing subsidy paid to owners/landlords directly by the ICHA on behalf of the participating family. The family pays the difference between the actual rent charged by the landlord and the amount sub- sidized by the program. Under certain circumstances, if authorized by the PHA, a family may use iu voucher to purchase a modest home. Housing Authority Capitol Fund Grants HUD provides funds to the ICHA to improve the physical condition, upgrade the management and operation, and carry out other activities for Public Housing developments. Capital Funds are calculated and allocated by an established for- mula. Affordable Dream Homeownership Program (ADHOP) On September 3, 1993, the ICHA entered into a Section 5(h) Agreement with HUD. The purpose of this program is to create affordable home ownership oppor- tunities throughout Iowa City. This agreement authorizes the ICHA to sell Public Housing units and use the sales proceeds to construct or purchase homes for reha- bilitation to continue the cycle. To ensure affordabil'rcy, the ICHA provides a se- cond mortgage for the homeowners. WHEREAS, a prehistoric Indian site was discovered in the Hickory Hill Park during the 1960s; and WHEREAS, the U of I desires to conduct an excavation of a portion of Hickory Hill Park (see attached map) to locate potential additional prehistoric Indian artifacts; and WHEREAS, the Director of Parks and Recreation recommends entering in to an agreement with the U of I to permit such excavations to be performed within this CITY-owned park. In consideration of their mutual promises herein, U of I and CITY agree as follows: 1. CITY states and covenants that they are the owner of certain real estate described on Exhibit A, attached hereto and incorporated herein, by virtue of legal and/or equitable title, that they are lawfully seized and possessed of said real estate, and that they have good and lawful right to convey this license under the terms of this agreement. . 2. CITY does hereby grant to U of I a temporary license in, over and across that portion of OWNER's property depicted and described on Exhibit A attached hereto (hereafter "Temporary License Area") for the purpose of excavating within the Temporary License Area by conducting no more than 100 auger tests with a 10" diameter hand auger and no more than ten (10) hand-dug 4'X4' squares not greater than 5' deep. 3. U of I shall have the right of ingress and egress to and from the Temporary License Area by such route within the Park as shall occasion the least practical damage and inconvenience to the public and the CITY. U of I shall repair any damage caused by this ingress and egress at its own expense. 4. The term of this Temporary License Agreement will be for May 16, 2011 through July 8, 2011, between the hours of 7 a.m. and 5:30 p.m.. The City may, however, terminate this license agreement at any time if, for any reason, the Parks and Recreation Director determines that the Temporary License Area is needed for a public use and/or the use presents a public safety threat. 5. U of I hereby acknowledges that this Temporary License Agreement conveys no ownership rights to the U of I in the items discovered during the course of said excavation work. Upon completion of the excavation work, U of I hereby agrees to provide to the CITY a complete inventory of all items discovered within the Temporary License Area. The CITY remains owner of any and all such items and hereby agrees to lend them to the U of I for a period of six (6) months following completion of the excavation. Should the U of I desire to obtain ownership to such items, the parties may agree to such a donation in a separate agreement. If no such agreement is reached, U of I agrees to return all excavated items to the CITY within six (6) months following completion of the excavation. 6. U of I covenants and agrees to remove and stockpile existing topsoil from areas to be excavated; to protect such excavations throughout the duration of this agreement; and to promptly backfill any hole or trench made by it, and repair any damages caused by U of I within the Temporary License Area. U of I does hereby agree to fill in and fine grade any holes made within the Temporary License Area, and to lay grass seed where appropriate to reestablish ground cover. In the event that U of I fails to do so before this License expires, the City may perform such work at U of I's expense. 7. U of I shall assume responsibility for and indemnify and hold CITY harmless from all claims, damages, and/or liability, arising directly from the negligent acts or omissions of the U of I, its employees, or agents in the U of I's exercise of their rights under this License Agreement to the full extent permitted by Chapter 669, Code of Iowa (2009) and the Iowa Constitution, Article VII, Section I; provided, however, that U of I shall not be responsible, indemnify, or hold harmless for damage resulting from CITY's negligence. The parties expressly agree that in the event the U of I is obligated to provide a defense to any claim hereunder, such defense, if any, shall be provided by the State of Iowa Office of the Attorney General unless otherwise agreed by the parties and the Office of the Attorney General. Any U of I employee, agent, student, or representative taking part in the excavation, or there to observe the excavation, shall sign a waiver provided by the CITY prior to being allowed on the site. Once the Temporary License Area has been restored substantially to its prior condition and except as expressly provided in this Temporary License Agreement, U of I shall have no further responsibility for maintaining the Temporary License Area. WHEREAS, the City constructed five, two-unit condominiums on Longfellow Court and Longfellow Place for sale to eligible buyers through the Affordable Dream Home Program (ADHOP); WHEREAS, the City has sold eight units; and WHEREAS, it is in the best interest of the City of Iowa City to enter into a listing agreement with Blank & McCune, The Real Estate Company, to sell the remaining two units. SCOPE OF SERVICES The Consultant agrees to perform the following services for the City: A. .1 Obtain the following Documents from the City and any other documents that the City and Consultant identify as being essential to completing the project: .a Architectural, structural, mechanical, electrical and site drawings for all facilities with private and public utilities shown for all facilities .b A copy of marked up floor plans for each facility identifying rooms (storage, reception, meeting room, break room, etc.) .c The most recent master/strategic or comprehensive plans done by each department and/or facility .d Maintenance information for all building and electrical systems from the City's maintenance staff/maintenance engineers .e A copy of the energy audit that was recently completed .f Records of site improvements including dates of when infrastructure improvements were completed such as paving and overlays, utilities, etc .2 Distribute all applicable materials and documents to the City for their review and/or analysis .3 Provide all documentation electronically to the City to insert into their Project Notebooks throughout the project (as applicable) -a- .4 Coordinate the Consultant Team with the City for all meetings, tours, site visits, interviews, public input meetings .5 Do initial assembly of up to ten (10) project binders (called Project Notebooks) for the City .6 Attend the following: .a Five (5) City Meetings in Iowa City .b Two (2) Public Input Meetings OR conduct up to two (2) Public Input Surveys OR conduct one (1) Public Input Survey and attend one (1) Public Input Meeting (as determined by both the City and Consultant) .c One (1) presentation to the City Council of the final report .d One (1) presentation to the Public of the final report (if desired by the City) .7 Will conduct Interviews with designated staff and tours* of the following facilities: .i The Airport .ii The Animal Care and Adoption Shelter .iii The Capitol Street Parking Ramp .iv Chauncey Swan Parking Ramp .v Oakland Cemetery .vi City Hall .vii The Transit and Public Works Equipment Facility .viii Court Street Transportation Center .ix The Dubuque Street Parking Ramp .x The Westside Fire Station #2 .xi The Eastside Fire Station #3 .xii Fire Station #4 .xiii Landfill and Recycling Center .xiv Eastside Recycling Center .xv The Library .xvi Mercer Park .xvii The Parks and Forestry Office .xviii The Public Works Complex Administration Building .xix The Recreation Center .xx The Senior Center .xxi Tower Place and Parking .xxii The Wastewater Treatment Plant North, South and East .xxiii The Water Treatment Facility .xxiv Water Distribution Building .7 Conduct visual only reviews/assessments of the aforementioned facilities (i.e. architectural, mechanical, electrical, plumbing, fire and life safety, lighting, technological, structural and civil in plain sight). .8 Work with Consultant Team establish a scorecard system for documenting Consultant's findings (as needed) .9 Draft, distribute and analyze the program detail questionnaires for all of the City departments/facilities and the departmental interviews prior to the interviews .10 Provide analysis of each facility as defined below: .a Determine the facility's size in SF and space dedicated to principal interior uses .b Age and shell construction -type and condition summary for each facility .c Identify the type, condition and adequacy of the mechanical and electrical systems and equipment (as needed) -3- .d Inventory the interior finishes (the materials applied to the interior architecture of the building including paints, any finishes, any flooring except concrete) .e Review environmental considerations (oil/salt storage, MSDS materials, run-off, asbestos and flood plain**) .f Note any energy efficiency opportunities (interior and exterior lighting, heating controls) .g Document the status of emergency power systems .h Identify deficiencies in the current facility ,i Project the maintenance investment required for the systems through 2020 and opinion of probable cost j Identify the remaining useful life of the existing systems (as applicable) .k Show any potential, current space usage adjustments (less or more space) in the future considering any applicable public input received .l Document current and future site usage (i.e. less or more space needed) considering public input (if input is provided) .11 Summarize interview findings by department or topic (to be determined later) identifying prominent or persistent concerns (as applicable) .12 Provide an alternative solutions and analysis for any identified problems (i.e. do nothing, remodel, relocate, build new) and identify the pros and cons of each option and the interrelationships of these options with the other program (i.e. if A then B) as applicable. For any new buildings or expansions proposed, provide the following: .a Key design considerations and payback analysis for sustainable/LEED opportunities .b The overall building dimensions .c Dimensions and space for interior uses .d The building site, appropriately sized parcel and parking requirements (for new construction options only) .13 Prioritize all program elements by the greatest need and provide an opinion of probable cost for each .14 Assemble all documentation and coordinate the final report .15 Analyze any Public Input received .16 Provide the City with a draft of the final report for review and comment .17 Revise the final report according to City comments .18 Conduct a final review of the applicable sections of the final report to ensure accuracy and clarity of the data presented B. Del iverables .1 Provide an electronic CD copy of the complete project binder used by the City including Executive Summary and Meeting Minutes and the following elements for each facility: .a Current facility review and program detail reports .b Identified Needs .c Interview findings .d Plus all of the data included for each facility in the final report detailed in the next bullet point .2 Forward two electronic CDs of the final report to the City consisting of an Executive Summary and the alternatives analysis, range of opinion of probable cost (where applicable) and prioritized program elements for each facility (as applicable). C. Exclusions. The following services are not provided by this Agreement: .1 Consultant will not retain parking garage, traffic, library, aquatic, waste, laboratory, airport or public safety experts. -4- .2 All code compliance checks (federal, state, county and city, ADA, OSHA and any other codes, ordinances and regulations). .3 Program funding analysis (including an existing funds analysis, debt service schedule development and current Capital Improvements Plan comparison and/or analysis) .4 Renderings, test fits and conceptual sketches .5 Interstitial space reviews/assessments .6 Repair recommendations (regarding significant defects or deficiencies identified) .7 Printing of the information placed into each of the City's project notebook sections and the City's copy of the final report .8 The review of interior furniture of any type including workspace systems (i.e. cubicles) and/or the inventorying of furniture, shelving, workspaces, cabinetry, office machinery, etc. E. Additional Services If desired, RDG can provide these services for the City of Iowa City's for an additional fee charged at the rates shown on the attached schedule and upon written agreement: .1 Public Input Survey .2 Code Compliance Checks .3 Repair recommendations for significant defects or deficiencies identified .4 Additional Public Input Meetings .5 Additional Presentation Meetings *Due to the specialized nature of the Technology consultant's assessment, tours for this aspect of the projecYwould be separate from the larger group tours and would need the individual(s) involved with and knowledgeable about the Technology of that particular facility. ** Flood Plain review will include noting whether the facility is in the 100 and/or 500 year flood plain. The Consultant shall perform its services consistent with the professional skill and care ordinarily provided by architects, mechanical engineers, electrical engineers, lighting designers, structural engineers, civil engineers, urban planners, landscape architects and technology consultants practicing in the same or similar locality under the same or similar circumstances. The Consultant shall perform its services as expeditiously as is consistent with such professional skill and care and the orderly progress of the Project. The parties hereto acknowledge that the City shall schedule all meetings, site tours staff interviews and public input meetings, distribute any meeting minutes, hand-outs or other documents to the stakeholders, print and distribute draft report to the stakeholders for review; print and distribute the final report to the stakeholders and other parties as the City deems necessary; conduct the public input session(s) including printing the hand-outs used; present the final report to the City Council and Public. II. TIME OF COMPLETION The Consultant shall complete the Scope of Services nine months from the notice to proceed. This schedule shall be adjusted if agreed upon by both the City and the Consultant in writing. III. GENERAL TERMS A. The Consultant shall not commit any of the following employment practices and agrees to prohibit the following practices in any subcontracts. To discharge or refuse to hire any individual because of their race, color, religion, sex, national origin, disability, age, marital status, gender identity, or sexual orientation. -5- 2. To discriminate against any individual in terms, conditions, or privileges of employment because of their race, color, religion, sex, national origin, disability, age, marital status, gender identity, or sexual orientation. B. Should the City terminate this Agreement, the Consultant shall be paid for all work and services performed and Reimbursable Expenses incurred up through the date of termination. However, such sums shall not be greater than the "lump sum" amount listed in Section IV.-The City may terminate this Agreement upon seven (7) calendar days' written notice to the Consultant. C. This Agreement shall be binding upon the successors and assigns of the parties hereto, provided that no assignment shall be made without the written consent of the other party to said Agreement. D. It is understood and agreed that the retention of the Consultant by the City for the purpose of the Project shall be as an independent contractor and shall be exclusive, but the Consultant shall have the right to employ such assistance as may be required for the performance of the Project. E. It is agreed by the City that all records and files pertaining to information needed by the Consultant for the Project shall be made available by the City upon reasonable request to the Consultant. The City agrees to furnish all reasonable assistance in the use of these records and files. F. It is further agreed that neither party to this Agreement shall perform contrary to any state, federal, or local law or any of the ordinances of the City of Iowa City, Iowa. G. At the request of the City, the Consultant shall attend meetings of the City Council relative to the Project. Any requests made by the City shall be given with reasonable written notice to the Consultant to assure attendance. H. The Consultant agrees to furnish a Municipal Facilities Space Needs Study and Master Plan Report, herea$er called the Report, upon termination of this Agreement and upon demand by the City, copies of all basic notes and sketches, charts, computations, and any other data prepared or obtained by the Consultant pursuant to this Agreement without cost, and without restrictions or limitation as to the use relative to the Project covered under this Agreement. The Consultant shall not be liable for the City's unauthorized use of the Report on other projects. I. The Consultant agrees to furnish all reports, specifications, and drawings, with the seal of a professional engineer affixed thereto or such seal as may be required by Iowa law. The City agrees compensate the Consultant for all fees and Reimbursable Expenses in a timely manner in accordance with Article IV herein, excepting, however, that failure of the Consultant to satisfactorily perform in accordance with this Agreement shall constitute grounds for the City to withhold payment of the amount sufficient to properly complete the Project in accordance with this Agreement. If the City objects to any portion of an invoice, the City shall so notify the Consultant in writing. The City shall identify in writing the specific cause of the disagreement and the amount in dispute. -6- K. Should any section of this Agreement be found invalid, it is agreed that the remaining portion shall be deemed severable from the invalid portion and continue in full force and effect. L. The original Report shall become the property of the City. The Consultant shall be allowed to keep copies for the Consultant's own filing use. Two (2) electronic copies will be provided to the City on a compact disk. M. Fees paid for securing approval of authorities having jurisdiction over the Project will be paid by the City. N. Upon signing this Agreement, Consultant acknowledged that Section 362.5 of the Iowa Code prohibits a City officer or employee from having an interest in a contract with the City, and certifies that no employee or officer of the City, which includes members of the City Council and City boards and commissions, has an interest, either direct or indirect, in this Agreement, that does not fall within the exceptions to said statutory provision enumerated in Section 362.5. O. The Consultant agrees to have and maintain, for the duration of this Agreement, professional liability insurance covering the Consultant's liability for any negligent acts, errors and omissions by the Consultant in the performance of this Agreement with policy limits of $1,000,000 each claim and in the aggregate. IV. COMPENSATION FOR SERVICES Consultant shall perform the Scope of Services on an hourly basis for a fee not to exceed one hundred three thousand, eight hundred, forty-two dollars and no cents ($103,842.00), earned according to the rate scheduled attached and incorporated herein, plus Reimbursable Expenses not to exceed $6,500. Consultant shall invoice the City on a monthly basis. Reimbursable Expenses include reasonable expenses incurred by the Consultant and Consultant's employees and subconsultants in the interest of the Project for transportation, reproductions, postage and delivery, and other similar Project related expenditures. Receipts and invoices shall be provided upon request by the City. Compensation for Reimbursable Expenses shall be at a multiple of 1.00 times the expense incurred by the Consultant, the Consultant's employees, and subconsultants in the interest of the Project. V. MISCELLANEOUS A. All provisions of the Agreement shall be reconciled in accordance with the generally accepted standards of the Architecture, Engineering, Landscape Architecture and Technology Professions. B. It is further agreed that there are no other considerations or monies contingent upon or resulting from the execution of this Agreement, that it is the entire Agreement, and that no other monies or considerations have been solicited. C. The terms, covenants, conditions, and provisions of this Agreement cannot be altered, changed, modified, added to or deleted from, except in a writing signed by the parties hereto. The Project will involve the following Improvements to Linn Street: • Curb and gutter and utility replacement • Street overlay • Streetscape improvements including pcc walks, stamped integral colored pavement, benches, landscaping, bike racks and artistic features. Project includes: Miscellaneous demolition including 1,240 LF of curb, 5,809 SF of colored stamped concrete, 2,055 SY modified subbase 9,548 SF of standard PCC paving, Installation of 776 LF of water main, 586 tons of HMA overlay, markings and traffic control, 3,130 SF sod and 16 trees. Other site amenities include benches, tree grates and landscaping. All work is to be done in strict compliance with the plans and specifications prepared by Concluence of Iowa City, which has heretofore been approved by the City Council, and is on file for public examination in the Office of the City Clerk. Each proposal shall be completed on a form furnished by the City, and must be accompanied in a sealed envelope, separate from the one containing the proposal by a bid bond executed by a corporation authorized to contract as a surety in the State of Iowa, in the sum of 10% of the bid. The bid security shall be made payable to the TREASURER OF THE CITY OF IOWA CITY, IOWA, and shall be forfeited to the City of Iowa City in the event the successful bidder fails to enter into a contract within ten (10) calendar days and post bond satisfactory to the City insuring the faithful performance of the contract and maintenance of said Project, if required, pursuant to the provisions of this notice and the other contract documents. Bid bonds of ADVERTISEMENT FOR BIDS AF-1 the lowest two or more bidders may be retained for a period of not to exceed fifteen (15) calendar days until a contract is awarded, or until rejection is made. Other bid bonds will be returned after the canvass and tabulation of bids is completed and reported to the City Council. The successful bidder will be required to furnish a bond in an amount equal to one hundred percent (100%) of the contract price, said bond to be issued by a responsible surety approved by the City Council, and shall guarantee the prompt payment of all materials and labor and also protect and save harmless the City from all claims and damages of any kind caused directly or indirectly by the operation of the contract, and shall also guarantee the maintenance of the improvement for a period of five (5) year(s) from and after its completion and formal acceptance by the City. A $50.00 deposit is required for each set of plans and specifications provided to bidders or other interested persons.
