CITY STEPS). Comment: A public hearing regarding an amendment to the FY11 Annual Action Plan, to use an anticipated $1,205,000 of CDBG program income to fund three affordable rental housing projects is being set for April 19, 2011. A 30-day public comment period started on March 18, 2011. ~~~ q3 2. CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON APRIL 19, 2011 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE IOWA RIVER TRAIL -NAPOLEON TO TRUEBLOOD PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON .FILE FOR PUBLIC INSPECTION. Comment: This project will construct a 10-foot wide recreational trail from Napoleon Park to the Terry Trueblood Recreation Area. The project also includes trail connections to existing sidewalks along McCollister Boulevard, a river lookout area, and other associated improvements. The estimated construction cost is $380,000 and will be funded with an Iowa DOT State Rec Trails Program grant and General Obligation bond proceeds. CONSIDER A RESOLUTION DESIGNATING THE CITY MANAGER AS THE AUTHORIZED REPRESENTATIVE FOR THE HAZARD MITIGATION GRANT PROGRAM (HMGP) WATER PLANT WELL HEAD PROTECTION PROJECT NO. DR-1763-0137-01. Comment: In the Hazard Mitigation Grant Program (HMGP) agreement for the project to protect 3 well heads at the water treatment plant, the designated authorized representative for the City is Dale E. Helling. The State of Iowa is requesting that the City designate Thomas M. Markus as the authorized representative. ~ ~ -- qg 2. CONSIDER A RESOLUTION ACCEPTING A WAIVER OF RIGHT TO HEARING AND PAYMENT OF A $300 CIVIL PENALTY FROM RJ'Z EXPRESS, PURSUANT TO IOWA CODE SECTION 453A.22(2) (2011) Comment: This Resolution accepts a waiver of right to hearing and payment of a $300 civil penalty, as set out in Iowa Code section 453A.22(2), by HWZ, LLC, d/b/a RJ'Z Express, 2 Escort Lane. Section 453A.22(2) provides that, after a hearing, a $300.00 civil penalty will be assessed to a retail cigarette permit holder when and if that permit holder's employee violates Iowa Code section 453A.2(1) by selling or providing tobacco to a minor. An employee of RJ'Z Express has violated Section 453A.2(1). By signing the appropriate waiver and paying the $300 civil penalty, RJ'Z Express waives its statutory right to have a hearing on whether the civil penalty should be assessed. ~ t - q ~ 3. CONSIDER A RESOLUTION ACCEPTING THE DEDICATION OF AND AUTHORIZING THE MAYOR TO ENTER INTO A PUBLIC ACCESS EASEMENT AGREEMENT FOR A PORTION OF OUTLOT 5, ORIGINAL TOWN, IOWA CITY, JOHNSON COUNTY, IOWA. Comment: In examining a proposed lot line shift for the subject properties, it was determined that the City did not have title to or easement rights across this portion of an alleyway. The property owner, DASH, L.L.C., has agreed to dedicate a public access easement to ensure that the alleyway continues to be used as such. Staff recommends approval of this dedication. ~ ~ ` 9~ 6. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A RENEWAL OF A LICENSE AGREEMENT FOR TEMPORARY USE OF PUBLIC RIGHT-OF-WAY BETWEEN THE CITY OF IOWA CITY, LANDOWNER MARC MOEN AND TENANT GRAZE IOWA CITY LLC, D/B/A GRAZE, FOR A SIDEWALK CAFE. Comment: Marc Moen, as landowner, and Graze Iowa City LLC, d/b/a as Graze, seek a renewal of a license agreement for temporary use of public right-of-way at 115 College Street, Iowa City, Iowa for a sidewalk cafe. City staff and Design Review have reviewed the plans and specifications and required submittals and recommend approval of said agreement. ~ ~ - t a a 7. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING AN AGREEMENT WITH HAWKEYE AREA COMMUNITY ACTION PROGRAM (HACAP), IOWA CITY, IOWA. Comment: The owner of eight (8) properties received assistance through the Community Development Block Grant (CDBG) funds in FY00. Staff recommended approval in a report dated February 17, 2011, subject to compliance with the submitted building elevations, payment of the fair share of improvements to Taft Avenue, a maintenance agreement for parking spaces located on public property, and an agreement for replacement of any trees removed in the city park due to construction of the parking spaces. Comment: This project will replace the existing WWTP blower with a more energy efficient unit for the aeration basin. The anticipated cost savings is estimated at $60,000 per year. ASSESSING A $300.00 CIVIL PENALTY AGAINST FIVE STARS FOOD MART ~/~ 10~ PURSUANT TO IOWA CODE SECTION 453A.22(2) (2011) Comment: This hearing is the time designated for the Council to consider whether to adopt a Resolution assessing the $300.00 civil penalty authorized by Iowa Code section 453A.22(2) against Five Stars Food Mart, LLC, 1911 Keokuk Street. Section 453A.22(2) provides that, after a hearing, a $300.00 civil penalty will be assessed to a retail cigarette permit holder when and if that permit holder's employee violates Iowa Code section 453A.2(1) by selling or providing tobacco to a minor. As a part of the hearing, the Council will be provided with information establishing an employee of permit holder Five Stars Food Mart violated Iowa Code section 453A.2(1). The permit holder's representative will then have the opportunity to provide the Council with information s/he deems appropriate. The Council will then decide whether to assess the requested civil penalty and, if it decides to do so, will adopt an appropriate Resolution. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY j ~ ~ ~ p ~ CLERK TO ATTEST A LICENSE AGREEMENT BETWEEN THE CITY OF IOWA CITY AND IOWA NETWORK SERVICES, INC. TO USE CERTAIN PUBLIC RIGHTS- OF-WAY FOR THE INSTALLATION, OPERATION AND MAINTENANCE OF A FIBER OPTIC NETWORK. Comment: This agreement will allow Iowa Network Services to install, operate, and maintain a buried conduit containing fiber optic cable within City of Iowa City public rights-of-ways. The installation will be located at various locations throughout Iowa City. Action: ITEM 12. CONSIDER A RESOLUTION AUTHORIZING EXECUTION OF A CHAPTER 28E AGREEMENT BETWEEN THE CITY OF IOWA CITY AND JOHNSON COUNTY 1~~~0`~--- REGARDING CERTAIN OBLIGATIONS INVOLVING THE BUTLER BRIDGE PEDESTRIAN TRAIL PROJECT. Comment: This Agreement defines responsibilities between the City of Iowa City and Johnson County for the Butler Bridge Pedestrian Trail Project. The project will connect the Iowa River Corridor Trail between Quarry Road and Waterworks Park, and provide pedestrians with a dedicated wide sidewalk along Dubuque Street and across the Iowa River. Action: ITEM 13. CONSIDER A RESOLUTION AUTHORIZING AGREEMENT BETWEEN THE CITY OF IOWA CITY AND THE POLICE LABOR RELATIONS ORGANIZATION OF IOWA ~ I - i 1 D CITY TO BE EFFECTIVE JULY 1, 2011 -JUNE 30, 2012. Comment: This is a one-year agreement which includes a 1.35% across-the-board wage increase effective June 26, 2011 and a dollar amount equal to a 1.5% across- the-board wage increase for all officers to be used to modify the pay plan by adding a Step 6 for officers with ten years of service effective December 25, 2011. The agreement also includes a $20 monthly increase in single health insurance premium contribution, a $150 increase to the health plan deductible, $150 increase to the health plan out of pocket maximum and other minor language changes.
