fund three affordable rental housing projects is being set for April 19, 2011. A
30-day public comment period started on March 18, 2011.

Comment: This project will construct a 10-foot wide recreational trail from
Napoleon Park to the Terry Trueblood Recreation Area. The project also
includes trail connections to existing sidewalks along McCollister Boulevard, a
river lookout area, and other associated improvements. The estimated
construction cost is $380,000 and will be funded with an Iowa DOT State Rec
Trails Program grant and General Obligation bond proceeds.

Comment: In the Hazard Mitigation Grant Program (HMGP) agreement for
the project to protect 3 well heads at the water treatment plant, the
designated authorized representative for the City is Dale E. Helling. The
State of Iowa is requesting that the City designate Thomas M. Markus as the
authorized representative.

Comment: This Resolution accepts a waiver of right to hearing and payment
of a $300 civil penalty, as set out in Iowa Code section 453A.22(2), by HWZ,
LLC, d/b/a RJ'Z Express, 2 Escort Lane. Section 453A.22(2) provides that,
after a hearing, a $300.00 civil penalty will be assessed to a retail cigarette
permit holder when and if that permit holder's employee violates Iowa Code
section 453A.2(1) by selling or providing tobacco to a minor. An employee of
RJ'Z Express has violated Section 453A.2(1). By signing the appropriate
waiver and paying the $300 civil penalty, RJ'Z Express waives its statutory
right to have a hearing on whether the civil penalty should be assessed.

5. CONSIDER A RESOLUTION ACCEPTING THE DEDICATION OF AND
AUTHORIZING THE MAYOR TO ENTER INTO A PUBLIC ACCESS
EASEMENT AGREEMENT FOR A PORTION OF OUTLOT 5, ORIGINAL
TOWN, IOWA CITY, JOHNSON COUNTY, IOWA.
Comment: In examining a proposed lot line shift for the subject properties, it
was determined that the City did not have title to or easement rights across
this portion of an alleyway. The property owner, DASH, L.L.C., has agreed to
dedicate a public access easement to ensure that the alleyway continues to
be used as such. Staff recommends approval of this dedication.

Comment: Marc Moen, as landowner, and Graze Iowa City LLC, d/b/a as
Graze, seek a renewal of a license agreement for temporary use of public
right-of-way at 115 College Street, Iowa City, Iowa for a sidewalk cafe. City
staff and Design Review have reviewed the plans and specifications and
required submittals and recommend approval of said agreement.

Comment: This hearing is the time designated for the Council to consider whether to

section 453A.22(2) against Five Stars Food Mart, LLC, 1911 Keokuk Street. Section
453A.22(2) provides that, after a hearing, a $300.00 civil penalty will be assessed to a
retail cigarette permit holder when and if that permit holder's employee violates Iowa
Code section 453A.2(1) by selling or providing tobacco to a minor. As a part of the
hearing, the Council will be provided with information establishing an employee of
permit holder Five Stars Food Mart violated Iowa Code section 453A.2(1). The permit
holder's representative will then have the opportunity to provide the Council with
information s/he deems appropriate. The Council will then decide whether to assess
the requested civil penalty and, if it decides to do so, will adopt an appropriate
Resolution. The hearing will not provide the opportunity for public comment.

CITY AND IOWA NETWORK SERVICES, INC. TO USE CERTAIN PUBLIC RIGHTS-
OF-WAY FOR THE INSTALLATION, OPERATION AND MAINTENANCE OF A
FIBER OPTIC NETWORK.
Comment: This agreement will allow Iowa Network Services to install, operate, and
maintain a buried conduit containing fiber optic cable within City of Iowa City public
rights-of-ways. The installation will be located at various locations throughout Iowa
City.

AGREEMENT BETWEEN THE CITY OF IOWA CITY AND JOHNSON COUNTY

PEDESTRIAN TRAIL PROJECT.
Comment: This Agreement defines responsibilities between the City of Iowa City
and Johnson County for the Butler Bridge Pedestrian Trail Project. The project will
connect the Iowa River Corridor Trail between Quarry Road and Waterworks Park, and
provide pedestrians with a dedicated wide sidewalk along Dubuque Street and across
the Iowa River.

ITEM 13. CONSIDER A RESOLUTION AUTHORIZING AGREEMENT BETWEEN THE CITY
OF IOWA CITY AND THE POLICE LABOR RELATIONS ORGANIZATION OF IOWA
~ I - i 1 D CITY TO BE EFFECTIVE JULY 1, 2011 -JUNE 30, 2012.
Comment: This is a one-year agreement which includes a 1.35% across-the-board
wage increase effective June 26, 2011 and a dollar amount equal to a 1.5% across-
the-board wage increase for all officers to be used to modify the pay plan by adding a
Step 6 for officers with ten years of service effective December 25, 2011. The
agreement also includes a $20 monthly increase in single health insurance premium

Comment: This resolution sets a public hearing for 7:00 pm on April 19, 2011 to
receive public comment regarding the issuance of up to $7,640,000 General Obligation
Capital Loan Notes (for an Essential Corporate Purpose) and authorizes the City Clerk
to publish the notice of hearing. Note proceeds will be used to pay costs of the
construction, reconstruction, and repair of improvements to public ways, sidewalks,
overpasses, pedestrian underpasses and overpasses, bridges and streets; the
opening, widening, extending, grading and draining of the right-of-way of streets,
highways, avenues and public grounds and the removal and replacement of dead or
diseased trees thereon; the reconstruction, extension and improvement of the existing
Municipal Airport; the acquisition, installation and repair of traffic control devices; the

to refund outstanding general obligation indebtedness, including General Obligation
Bonds, Series 2002, dated May 1, 2002. The 2002 bond issue originally financed the
Library expansion. By refunding the 2002 bond issue early, the City will save

competitive bidding system. The PARITY electronic bidding system has been
determined to provide reasonable security and to maintain the integrity of the
competitive bidding process, and to facilitate the delivery of bids by interested parties
in connection with the offering at public sale. See staff memorandum included with
