The Amendment allocates CDBG funds to be received from anticipated program income from a CDBG Disaster Recovery project. Aniston Village LP, a Low Income Housing Tax Credit Project, in Iowa City was awarded $2.9 million in Iowa CDBG Disaster Recovery Housing Funds through the Iowa Department of Economic Development to finance the construction of 22 homes for affordable rental housing. When Aniston Village LP secures permanent financing this spring, a portion of the construction loan ($2.7 million) will be repaid to the City and receipted as program income to be used in the City's regular CDBG entitlement program. The City conducted amid-year allocation round to allocate up to $2.6 million to CDBG eligible activities. Fifteen applications for public facilities and ten applications for housing activities were submitted. The Housing and Community Development Commission (HCDC) reviewed these proposals on November 10 & 18, 2010. HCDC recommended the funding of six public facility projects for a total of $1,395,000 and three housing activities for $1,205,000. City Council approved the public facility projects in January 2011, but did not approve the housing projects at that time because the Affordable Housing Location Model had not been approved. A draft copy of the FY11 Annual Action Plan Amendment #3 is attached. You can also find this amendment at www.icgov.org/actionplan. Page 2 of the Amendment identifies the projects and there is a memo from HCDC beginning on page 9 that explains their rationale for funding. If needed, amendments or changes fo this plan may be considered at the April 19, 2011 meeting. At the time of allocation, Community Development staff recommended financial terms and compliance periods for Isis Investments LLC and Shelter House. HCDC directed staff to negotiate financial terms with Southgate Development for the Wetherby Condominium project. Staff met with Southgate Development to review their project costs, rental proforma and to discuss financial terms. Staff recommends that the funds be awarded to rehabilitate at least 45 of the units for affordable rental housing and that $300,000 be awarded as a grant due to the cost of exterior security improvements and general exterior upgrades that benefit the entire area. Staff also recommends that the remaining $600,000 be awarded in the form of a loan with the following terms: Interest rate during the construction period at 0%. Interest rate during the period starting at month 1 (following the construction period) and ending at month 60 at 0%. Interest rate payable during the period starting at month 61 and ending at month 120 at 3%. The loan will mature and be paid in full on the earlier of (i) the end of the 120 month period or (ii) upon sale. The payment at maturity will be equal to the greater of (i) 10% of the fair market value as determined by appraisal or (ii) 10% of the net sales price. This payment will be capped at $888,000, based on $600,000 loan amount increasing at a compounded rate of 4% April 13, 2011 Page 2 per year and repayment of the 10-year maturity. A sale of the property at the end of year five, for example, would cap the City's repayment at $730,000. The recommended compliance period for this project is 5 years. The compliance period will be released (and the loan paid in full) if the property is sold to a third party prior to the end of 5 years. At your April 19 meeting, we are asking that you consider approval of the FY11 Annual Action Plan Amendment #3 as recommended by HCDC. Commissioners felt that this funding process was an exceptionally unique opportunity and started the process with the general focus of trying to make a big impact as opposed to spreading smaller amounts of funding into a greater number of projects. There were many good applicants, several of whom applied and received substantial funding in the last regular funding cycle. Commissioners felt that some of the unfunded applications were projects that the commission would have the opportunity to recommend funding in future funding cycles. Applications that were especially innovative or targeted on Council priorities got special consideration. For example revitalizing the Towncrest and Broadway neighborhoods got special consideration. Consideration was also given to the number of projects City Staff could effectively manage. Below are the requests and the recommended allocations with brief explanations of the commissions rationale for funding. II. Shive-Hattery, Inc. was hired to design the project, final plans and specs were delivered in April 2011, and the public hearing was set on April 5, 2011. The Iowa River Trail currently terminates on the south end at Napoleon Park. Considering existing and planned developments at the Terry Trueblood Recreation Area, there is a desire to extend the existing Iowa River Trail system to connect to the Terry Trueblood Recreation Area. As part of the design for the McCollister Boulevard Bridge over the Iowa River, an underpass was incorporated on the east side of the Iowa River for this trail. A portion of the proposed trail will also utilize the existing Napoleon Lane gravel roadbed. In addition, the proposed trail has been designed to accommodate the future location of the animal shelter. An alignment was selected that takes advantage of the existing features within the project area. The proposed trail will follow the existing ridge on the north end of the project, behind the existing pump station. The trail then transitions to the existing gravel roadbed and continues under McCollister Boulevard Bridge. As part of the project, the proposed trail will tie into the existing sidewalks on the north and south sides of McCollister Boulevard, as well as the existing trail network at the Terry Trueblood Recreation Area. A small river lookout area is also provided as part of the project. History/background: This application is filed annually in order to provide a list of projects that we wish to receive State and/or Federal Transit assistance. The memorandum details the projects that we will be seeking funding, totaling $18,853,050 in Federal Capital Assistance and $1,369,907 in Federal Operating Assistance. There is no guarantee of funding, however, in order to be considered for funding, the project must be listed in the application. The list of projects includes funding requests for transit service, vehicles, equipment and facilities. The most substantial funding request is for the replacement of the Transit facility estimated at $20,000,000, of which $16,000,000 would be Federal funds. In addition, this list of projects will be included in the FY2012 IDOT Consolidated Transit Funding Application and in the FY2012 - 2015 MPOJC Transportation Improvement Program. Discussion of Solution: In reviewing the list of projects, keep in mind that we may not seek funding for all of the projects listed in this proposal. The majority of the capital funding opportunities are funded as 80% Federal and 20% Local, excluding rolling stock which is funded with 83% Federal funds and 17% Local funds. Operating expenses for JARC funds are funded at 50% Federal and 50% Local. If all capital projects were approved, the City of Iowa City would be responsible for roughly $4.6 million while the FTA would fund roughly $18.9 million. Recommendation: It is my recommendation that we approve this resolution as is in order to make the listed projects available for Federal Transit Administration funding.
