3d(4) (Revised) Comment: This biennial project involves the asphalt resurfacing and
chipsealing of various streets throughout Iowa City. The estimated cost for this
project is $779,000 and will be funded with Iowa DOT 3R funds, Road Use Tax
Proceeds, Water Revenue, Wastewater Operations, and GO Bonds.

PROPOSAL TO CONVEY A SINGLE FAMILY HOME LOCATED AT 408 FAIRCHILD
STREET.
Comment: The grant for the UniverCity Neighborhood Partnership Program allows the
City to purchase twenty-five rental units located in designated neighborhoods
surrounding the University, rehabilitate them with up to $50,000 in grant funds, and
then sell them to income-eligible buyers. Under the UniverCity Neighborhood
Partnership Program, the City proposes to sell 408 Fairchild Street. The amount of the
sale will be $155,000 (this is what the City paid to purchase the home) plus the "carrying
costs, which are which are all costs incurred by the City to acquire the home, maintain
it and sell it, including abstracting and recording fees, interest on the loan to purchase
the home, mowing and snow removal, utilities, real estate taxes, and any costs in
excess of $50,000 to repair and rehabilitate the home.

Comment: The City of Iowa City must acquire right-of-way, fee title,
permanent easements and/or temporary construction easements to construct
the 2011 Landfill Buffer and Groundwater Monitoring Project. State law
requires the city to give notice to agricultural property owners whose
properties may be affected. This notice will notify all potentially affected
property owners of the opportunity to present their views on the project and
proposed acquisition of property rights at the public hearing. The notice
protects the City's right to condemn if necessary. This project includes landfill
buffer, constructing additional monitoring wells, possible groundwater and
leachate management systems and possible landfill cell construction at the
Iowa City Landfill and Recycling Facility.

Comment: This project will connect the Iowa River Corridor Trail between
Quarry Road and Waterworks Park. The project will provide users with a
dedicated wide sidewalk along Dubuque Street and across the Iowa River.
The estimated cost of the project is $1,007,037 and is to be funded by
Surface Transportation Program (STP) funds, City of Iowa City General
Obligation bond proceeds, and Johnson County.

THE ARTS, INC. TO ALLOW THE TEMPORARY AND LIMITED SALE,
CONSUMPTION, AND POSSESSION OF BEER DURING ARTS FEST AND
JAZZ FEST WITHIN A SPECIFIED AREA ON A CITY STREET.
Comment: Section 4-5-3 of the City Code allows for the sale and
consumption of alcohol in a city park, on a right-of-way, or other public ground,
excluding public buildings, pursuant to written agreement. The agreement,
which is attached to the resolution, allows Summer of the Arts, Inc. to sell beer
in a fenced off area on Iowa Avenue during Arts Fest and on N. Clinton Street
during Jazz Fest. The exact locations and dimensions of the sites are attached
as exhibits to the proposed agreement. The agreement is substantially similar
to the one executed last year with two exceptions. The size of the beverage
garden for Jazz Fest (Exhibit B to the agreement) is larger than last year (2010:
35' x 110'; 2011: 35' x 200'). Additionally, the location of the Arts Fest garden is
on the north rather than the south side of Iowa Avenue.

Comment: Section 4-5-3 of the City Code allows for the sale and consumption
of alcohol in a city park, on a right-of-way, or other public ground, excluding
public buildings, pursuant to written agreement. Staff has approved the
agreement, which is attached to the resolution, that allows Riverside Theatre to
sell beer and wine and for attendees to consume beer and wine from June 16
through July 10, 2011 in a specified area in and around Riverside Festival
Stage in City Park. The terms in the agreement are the same as last year with
the exception of the dates.

Comment: This ordinance provides for a rate increase to the stormwater utility fee as
approved in the FY2011 budget. The flat rate for an Equivalent Residential Unit (ERU)
will increase from $2.00 to $2.50, and the multiplying rate for non-residential properties

AND ACKNOWLEDGEMENT FORM" TO INCLUDE INFORMATION ABOUT IOWA
LAW RE: SECURITY DEPOSITS. (SECOND CONSIDERATION)
Comment: Elliott Higgins, the 2010-11 student government liaison to the Iowa City
City Council has proposed that the Informational Disclosure and Acknowledgement
Form the owner and tenants are required to sign pursuant to City Code Section 17-5-
14 include information concerning the Iowa law on rental deposits, specifically the need
to document the condition of the premises at the beginning and end of the tenancy and
the requirement that the tenant provide a mailing address or delivery instructions for a
return of the rental deposit to the landlord. This ordinance will amend the Code to
require that the form include such information. Staff recommends expedited action.

E, TO AMEND THE FINE AMOUNT FOR VIOLATIONS, AND SUBSECTION D, TO
AMEND THE WORDING OF THE NOTICE TO MATCH THE NEW FINE AMOUNTS,
AND TO ELIMINATE THE POSTING OF NOTICE AS AN ELEMENT OF THE
OFFENSE. (SECOND CONSIDERATION)
Comment: This Amendment will change the fine amount for Under 21 ordinance
violations from $500 for all offenses to $300 for 1St offenses, $500 for 2"d offenses, and
$625 for 3`d and subsequent offenses. The wording of the notices posted at liquor
license establishments will be changed to incorporate these new fine amounts. The
amendment will also make clear that the posting of notices at every entrance is still
required of establishments, but that underage patrons may not use the absence of
such a sign as a legal defense from this charge. The effective date will be July 1,
2011.

funding grants to neighborhood associations so they can make improvements in their
neighborhood. The Neighborhood Council has solicited, selected and recommends the
funding of ten (10) applications from the neighborhood associations and seeks the City
Council's review and approval of this recommendation. The grant applications are

Comment: The City of Iowa City Economic Development Policies will serve as the
guide for the City's engagement in economic development activities. The policy
document lays out specific goals of attracting new business, assisting existing
business and incubating startup businesses in the community, while being accountable
to the citizens and responsive to the business community. The Economic Development
Committee approved and recommended the policies for adoption at their April 19, 2011
meeting. Draft minutes are includes in Council's May 12, 2011 Information packet.

MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST A CONTRACT FOR
THE PERFORMANCE OF CONSULTING SERVICES BY AND BETWEEN THE CITY
OF IOWA CITY AND DIVARIS REAL ESTATE, INC., FOR A STRATEGIC
ASSESSMENT OF DOWNTOWN IOWA CITY AND RECOMMENDATIONS FOR THE
ENHANCEMENT OF RETAIL OPPORTUNITIES.
Comment: John Millar, of Divaris Real Estate, Inc. has developed a highly specific
analysis tool for use in communities with special populations of universities, military
installations and government functions. The analysis goes beyond the typical
demographics found in the US Census each area studied and factors in, for college
towns the hometown demographics of students populations, visiting populations and
the staff and faculty populations within the community. This strategic assessment more
clearly establishes a strong market for the retail community that might otherwise have
overlooked Iowa City's basic demographics. We intend to use the information to attract
new retail users to downtown Iowa City. The total cost of the contract is $50,000 which
will be split with the University of Iowa.

AGREEMENT BETWEEN THE CITY OF IOWA CITY AND THE UNIVERSITY OF

FOR THE ENHANCEMENT OF RETAIL OPPORTUNITIES.
Comment: The University of Iowa has a mutually strong interest in the continued
diversification of the downtown business landscape. They have assisted in many
recent efforts and are committed to cost sharing expenses in the Divaris Real Estate
Inc. study. The total cost of the contract is $50,000, for which the University is agreeing
to share in the cost, up to $25,000.

chipsealing of various streets throughout Iowa City. The estimated cost for this

3d(5) (Addition) RESOLUTION SETTING PUBLIC HEARING FOR JUNE 7, 2011, ON A
PROPOSAL TO CONVEY A SINGLE FAMILY HOME LOCATED AT 408 FAIRCHILD
STREET.
Comment: The grant for the UniverCity Neighborhood Partnership Program allows the
City to purchase twenty-five rental units located in designated neighborhoods
surrounding the University, rehabilitate them with up to $50,000 in grant funds, and
then sell them to income-eligible buyers. Under the UniverCity Neighborhood
Partnership Program, the City proposes to sell 408 Fairchild Street. The amount of the
sale will be $155,000 (this is what the City paid to purchase the home) plus the "carrying

costs, which are which are all costs incurred by the City to acquire the home, maintain
it and sell it, including abstracting and recording fees, interest on the loan to purchase
the home, mowing and snow removal, utilities, real estate taxes, and any costs in
excess of $50,000 to repair and rehabilitate the home.

raising the Iowa Interstate Railroad tracks, and constructing a railroad bridge over First
