Got just a few minutes so let's try to work through things as quickly as we can. First up is agenda items. 3e(5) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR JUNE 21, 2011, REGARDING THE INTENT TO ENTER INTO A LEASE AGREEMENT WITH THE UNIVERSITY OF IOWA. Karr/ Just like to note real quickly, we're going to be amending the Consent Calendar to add 3.e.5, which is setting a public hearing on the lease agreement with the Library. Deleting 3, um, 7, which was authorizing the resolution and deferring that until the 21St, after your public hearing. And then, uh, pulling Cindy Roberts' letter under correspondence, 3.g.5, to accept for the PIN grant. So we'll be adopting it as amended. Hayek/ Thanks! Um, why don't you guys come up on ... on the Gilbert Street, Item 24, uh ... could address us on that. ITEM 24. CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CONTRACT FOR CONSTRUCTION OF THE GILBERT STREET STREETSCAPE PROJECT. Boelk/ Sure. Good evening, Council! I'm Brian Boelk, Senior Civil Engineer. I just wanted to let you know you should have a memo there with regards to the Gilbert Street streetscape project, uh, which you're well aware of, and we've gone over in work sessions before. We took bids on May 26th, and as you can see, uh, all three bids did come in considerably higher than the engineer's estimate. However, they were ranged, uh, in a pretty close range, which, um, after looking at that tells us that that's the cost it's going to be at this time to get this work done. We did a little bit investigative, uh, and the consultant did as well, and it seems like the costs were mainly in the electrical. That has gone up considerably in the last one to two months, and in talking with other communities, they've seen the same thing, and with University projects. With that being known, uh, we took a look at the project and wanted to see if we could still fit it in within our budget by reducing something in the project that would, uh, handle that. And in doing so we took away the five light fixtures on the east side of Gilbert Street between Burlington and the creek, and then all the, um, circuitry that goes with that. June 7, 2011 City Council Work Session Page 2 by roughly 60...$63,000, I believe, uh, which gets us right back ... very close to within the original engineer's estimate and the budget. So, uh, at this time, uh, Engineering and Public Works still recommends that we award to the low bidder, and I should say that by making those adjustments in the contract, the low bidder still remains the same low bidder. Uh, we recommend awarding still to the low bidder by taking that out of the contract and proceeding with the project. Any questions? Champion/ My question is, what lights are there now? I think ... I don't know if this is (mumbled) to take those lights away at this point. Boelk/ Sure, no, that's a good question, um, and with ... with that is ... is the proposed 15 lights is what we had proposed for going in with the project, similar to the ones that are already along Gilbert and Burlington Street with the decorative lighting. Uh, we would still keep ten of them in the project; just take the five out along that east side. Uh, for a couple reasons. One being, it's one joint section there with the same electrical feeder line. Another is there is street lights currently along there, and then a third being, um, that ... we didn't see it as much of a ... uh, busy area with regards to the commercial area and the students and everything walking there as much as on the other side. But there are a couple streetlights there currently. Champion/ Okay. (mumbled) Boelk/ (unable to hear other person) Yes, correct, those would stay! Wright/ Will this have the effect of ... (noise on mic) Sorry! Will this have the effect of making it look like we ran out of money? (laughter) Frankly? Boelk/ Good question. I think ... I don't think as much because we'll have the whole west side will still be continuous lights, and I think will be broken up by the creek there, where, you know, we'll just have a ... really just a couple lights there in front of the Mansion and Clark's apartments' area there, where we're going to also be doing some other streetscape. So really the lighting will be going in where we're doing predominantly the rest of the streetscape area, uh, whereas this part on the east side was kind of stand alone, just lights. There was nothing else being done there, so ... I think in that ... (mumbled) it's going to be okay. Wright/ All right. Thank you! Dickens/ Are we going to have to upgrade the current lights at all, when they're doing that work or... Boelk/ No ... we ... no. For the existing streetlights there? No, that should not be an issue. Champion/ How does everybody else feel about this? I mean (mumbled) bids on all of our projects this year, and I kind of hate to see this kind of half done. Bailey/ I'd kind of like to see (mumbled) I think that was the concern, I mean, we had a really nice streetscape design, and that didn't. So ... I mean, I appreciate staff looking at what ... what can be reduced so we can. Wright/ And ... I guess (mumbled) fact that it's that section between Burlington and the creek. Bailey/ (mumbled) Wright/ On the east side (both talking) might be a little less visible (mumbled) Dickens/ (mumbled) residential (mumbled) Boelk/ It is ... it would leave you open too, you know, if we came in with another phase sometime in the future that you could streetscape that area and bring in the lights at that time, as well. Fosse/ I just wanted to be clear on the procedure for tonight, if we want to go that route. Is we would award the entire project, as it has been bid, and then we would eliminate those items by change order later. Just so you understand the procedure on that. Hayek/ So we ... we pass the, assuming there's support, what's on the agenda, and then make these changes (both talking) Fosse/ Yes! Hayek/ ... subsequent (mumbled) Fosse/ That's correct! Mims/ Yeah, I'd like to see it come in on budget. I mean, I know we've gotten some good bids on other stuff, but ... we've just got so much out there and uncertainty overall in budget. CONSIDER ADOPTION OF THE CONSENT CALENDAR AS PRESENTED OR AMENDED. g) Correspondence. 6. June 7, 2011 City Council Work Session Page 4 Bailey/ I had a question about the letter in 3.g.6, about the cell phone charging downtown and why it's not, I mean, I'm just curious if anybody's gotten back to him and what the issue... Helling/ Yes, I have talked to him. Bailey/ Right! Okay, and what is the ... how does that fall in our ordinances? Helling/ Um, it...it would be under the definitions ... I ... commercial activity. Bailey/ Ah, okay! Helling/ Um ... it ... and ... or something more than simply informational. That's the ... that's the whole issue. He wanted to do a demonstration, have a piece of equipment out there and so forth, and then it starts to get into that realm of maybe it's commercial, maybe there's a product that will be for sale, you know, that type of thing, so it really goes beyond ... well beyond what we (mumbled) Bailey/ Okay. It's just helpful to have that language so if we get calls about it (both talking) Helling/ Right! Yes. Bailey/ ...we can use that. Thanks! 3. Steve Smith: "Dude" housing... growing cancer for the Near Northside Mims/ I had a question, or just ... is it something that we want to bring up for discussion at some other time on 3.g ... uh, number 3, the ... the "dude housing" letter. Um ... just that whole ... you know, what's happening in some of these near ... near neighborhoods and what can be done, what, you know, what do we want to look at, are there ways that we as a city can be proactive in ways that we're not now, um, to help maintain those. Bailey/ And I did correspond with him because the original letter came to me and ... and pointed them in the direction of our nuisance ordinance and the University program, but um ... if there are other ideas that everybody has, I think it would be helpful. Mims/ (both talking) Bailey/ ...talking about something that is currently... Markus/ Staff hasn't come up with anything so far. I think, urn ... I think it might be a good discussion, an open discussion, at some point. I think there are those concerns that exist in the neighborhoods, and probably having an open discussion might be of some benefit. I didn't have any particular solutions, but just (both talking) Markus/ Most people I've talked to have an idea about how to resolve this issue. Champion/ Well one of the rules is that you can't... Dilkes/ Well, it sounds to me like ... I mean, at least... some of the examples being given were examples of over occupancy. Champion/ Right! Bailey/ Right, and I (both talking) Dilkes/ So presumably that would be one of the enforcement (several talking) Bailey/ ...walk them through. I think a lot of our neighborhoods, or ... or maybe we need to take out the neighborhood ordinances that we passed a couple years ago and that flyer again, because I think people have forgotten what's available to them. They see problems and think, `We need new solutions,' when (both talking) Mims/ Maybe they're already there! Bailey/ Yeah, they might be already there. They're just unaware. 7. John Moreland, Jr.: Stone Bridge Preliminary Plat Mims/ Okay. Also in that correspondence, um, the Stone Bridge preliminary plat. I don't ... know the history of things like this when plats expire after two years. Are they ever extended or... Dilkes/ Yes, we do that. Mims/ Okay. So is this something that staff is responding to and will bring to us or ... what's the thought? Davidson/ Staff has no problem with you extending it, but it's up to you ultimately. Mims/ Okay. APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE FY 2012 ASPHALT RESURFACING PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH NOTICE TO BIDDERS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Bailey/ I had one (both talking) if you're looking. Um, Item number 7, we're doing some median repair, and I'm just curious because a lot of our ... Connie brought this up a couple weeks ago, a lot of our medians aren't looking very good. What does that entail? Fosse/ Uh, there's a couple areas where we have medians that are filled with asphalt. Bailey/ Right. Fosse/ Uh, on State highway routes, and those just aren't holding up well. So that asphalt will be removed and then it'll be replaced with new material there. Bailey/ So it'll... it'll still be filled in essentially. Fosse/ Yes, yes it will be. Um, one there's a, uh, recommendation from the County for, uh, someone to the Board of the Library Trustees. Is there general support for that? Champion/ Sure! Bailey/ Yeah (several responding) Hayek/ Okay. And of no less importance is our nominee to the Seats Paratransit Advisory Committee. CONSIDER AN ORDINANCE AMENDING TITLE 6, ENTITLED "PUBLIC HEALTH AND SAFETY, CHAPTER 4, ENTITLED, "NOISE CONTROL," AND TITLE 10 OF THE CITY CODE, ENTITLED "PUBLIC WAYS AND PROPERTY," CHAPTERS 1 AND 5, TO ESTABLISH A PERMIT SYSTEM FOR AMPLIFIED SOUND ON CITY PLAZA, TO ESTABLISH A PERMIT SYSTEM FOR INFORMATION TABLES ON CITY PLAZA, AND TO ALLOW CERTAIN PUBLIC ASSEMBLY/PARADE PERMITTEES TO SELL GOODS AND SERVICES AND USE AMPLIFIED SOUND. (FIRST CONSIDERATION) Bailey/ I have some questions on Item 11, but I wonder if we want to leave that to the meeting? Mims/ I was just thinking the same thing. CONSIDER A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF IOWA CITY AND JOHNSON COUNTY DOGPAC FOR JOINT MAINTENANCE OF THE THORNBERRY AND RITA'S RANCH OFF -LEASH DOG PARKS. Wright/ I was just going to bring up something related to Item 18 that I just ... I mentioned to the City Manager before we got started, um ... just that I ... I think at some point we may want to consider the fee structure that we have for the dog park. Apparently all who visit the dog park pay the same fees (both talking) Iowa City or not? Markus/ (mumbled) Wright/ Something that, uh ... Park and Rec (mumbled) again. (mumbled) City is subsidizing it. Bailey/ Right, so you think that residents should pay (both talking) Wright/ Non - residents should pay a little extra. Bailey/ Yeah, I agree! Hayek/ Anybody want to proceed ... you want to look at that? Do we need to... Bailey/ Can Parks and Rec look at that? Markus/ Do we have any legal issues with resident and non - resident rates? Dilkes/ I ... I don't know ... I haven't heard the whole conversation. Markus/ On the dog parks, there's a question of whether we should charge a different rate for non - resident use of the dog park, versus a resident? Dilkes/ No, I think we could. We do with (both talking) Moran/ ...currently now with most of our recreation programs. And it's just based on the address they give us, so we would have to go back to the address of the dog they licensed. Wright/ Certain amount of trust comes in ... comes in to play there, but... CONSIDER AN ORDINANCE AMENDING TITLE 8, POLICE REGULATIONS, CHAPTER 5, MISCELLANEOUS OFFENSES, TO ADD A NEW SECTION 12, ENTITLED "FIREWORKS." (FIRST CONSIDERATION) Wright/ This is truly a category of `I simply don't know what the case is.' We had the fireworks ordinance, number 12, Item 12. Aren't fireworks already banned under State law? Bailey/ I thought they were in Iowa, but... Dilkes/ I'm not sure! (laughter) Um ... I mean, the reason for this was because we prosecute `em under, as Municipal Infractions under City code ... um... Wright/ Okay. Dilkes/ Um ... and we want to be able to do it simply, um, I don't know if it's a question of just having a city code provision or ... I don't know. I'd have to ... check. CONSIDER A RESOLUTION AUTHORIZING THE INSTALLATION OF SPEED HUMPS ON TIPPERARY ROAD BETWEEN SHANNON DRIVE AND DUBLIN DRIVE Mims/ I just had a question on number 17, the ... the traffic calming on Tipperary Road. And I guess my question became... looking at the number of people who were surveyed and responded, it looked like there were very few houses in that section of road that are being affected, and also with the fact that we are going to take another look at our traffic calming policy, I think on a work session maybe in August the schedule looked like. Page 10 Mims/ And the fact that there were at least some correspondence against it, if there was any interest in ... deferring this until we reviewed the traffic calming policy? Davidson/ And just to clarify, um ... there were, uh, let's see, there was 100% approval from the survey respondents, four of the six households responded. And for the unoccupied lots, the survey went to the property owner, subdivision owner, um, and as, um, Susan has noted, there was correspondence opposing it, but the survey was 100% in favor. And yes, it is scheduled for August, tentatively the August meeting is when you'll be discussing the overall policy, and you've heard us say before, it is strictly your policy. You can do whatever you like with it. Mims/ (several talking) throw that out... Wright/ Four respondents and three letters of complaint, or three letters against, I should say. Champion/ I don't have any problems with it. I think frankly those, whatever they call those bumps, humps, whatever they are. Wright/ Speed humps? Champion/ Right. If you ... if you aren't speeding you really don't have to slow down for them. Davidson/ There's already one speed hump just down the street over the creek, and this would add two to the ... to the loop that connects Dublin with Shannon. Hayek/ Correct me if I'm ... my memory is bad on this, but wasn't the discussion behind taking this policy up for another look more aimed at the trigger points? Champion/ Yes! Davidson/ I think it was related almost 100 %, Matt, to the collector street threshold of 3,000 vehicles a day. Uh, the ... the block, or the couple of blocks of Court Street, between Muscatine and Summit are over that threshold, and the neighborhood has been quite emphatic about you changing that threshold so that they would be eligible for, uh, traffic calming on their street. Hayek/ I'm okay proceeding with this tonight, but ... but... Bailey/ I am too ... I mean, I would hate to catch... they're meeting all the qualifications. I would hate to catch them in some kind of...in our problem (both talking) Mims/ I just thought I'd raise it. Bailey/ That's fine. Veronica Tessler: Opening new business on ped. mall. Wright/ Um, 3.g.8 in the correspondence, that was the ... issue with the small business that was trying to come in, and (mumbled) came with that. I just ... it's really an unfortunate situation, but I don't... there's... we really... there's not anything we can do, in terms of... Dilkes/ No. Wright/ Yeah. Hayek/ Short of changing the law. Dilkes/ Short of changing... Wright/ I'm really not interested in changing that proximity ordinance. That's been very useful. Bailey/ One of the things I think we do need to explore from an economic development perspective, I mean, she needs a very ... I spoke with her, and I know others spoke with her as well, she needs a very small space, and I think that there would be opportunity downtown for some of those building owners to divide their spaces, but how can we make that easy and ... and are we proceeding with something or are we discussing that, and I think that that's ... that should be something just sort of in a proactive, not to address this, but what we're seeing for people needing space downtown, and it's really much smaller spaces than are becoming available. Wright/ Some of those places are huge right now! Hayek/ You know, this ... this could be a small component of the discussion we anticipate having, um, which staff is working on now with ... with development downtown and things of that nature, and I ... I speak from personal experience when ... when, uh, the building that my partners and I own was trying to reconfigure our first floor space and preserve some office space for us. There's a ... there's a maximum square footage you can have, uh, without triggering a requirement to have a second egress and... Bailey/ ADA compliant and... Hayek/ Those are ... this would fit into that discussion. Bailey/ Uh -huh. Hayek/ So... Champion/ There has been demand for small spaces downtown as long as I've been in business, which is ... 34 or 5 years, yeah, so this is not a new problem and it's a good time to start addressing it, and I agree. Um, I've had three weeks of a lot of grandchildren at my house (laughter) and I thank goodness for the City's recreational facilities, but I was wondering about the rides at City Park, which I dearly love, I mean, they're obviously intended for small children, and yet they don't open til noon, and they all take naps! Everybody talks about opening early in the morning? Earlier? Or is it just not good? Moran/ We haven't had much discussion about that, and those hours have been established based on people attending, and that just seems to be better. The noon was the earliest because ball games and stuff start at 5:00 and so we used to get an influx of people before the games and (both talking) and then after the games as well. And then the pool schedule was set, especially this year, for later on so that we would encourage kids to go swimming at a cheaper rate, up at City Park pool after 5:00. Champion/ Okay. Page 14 Hayek/ You know, I'd love to bootstrap into that, uh, a renewed discussion on, um, yards, grass, yards, just general... we've talked about this before, but we're back into summer and there are ... plenty of front yards that are in pretty bad shape, not being attended to. We went down this road a year ago and didn't get very far. Bailey/ I guess I haven't seen a lot of front yards not attended to but... Hayek/ You think they are being, is that your... sense? Bailey/ Maybe we have different standards. (both talking) Hayek/ ...this shorter re- ordinance. Maybe I'll just cool my jets and see how that plays out. Meeting Schedules: Karr/ IP3 in your 6/2 packet proposes a change to the summer schedule by reducing the first and third in July and August to one, and then also proposes, uh, September, October, November, December schedule.
