ITEM 6. AUTHORIZING CONVEYANCE OF A SINGLE FAMILY HOME LOCATED AT 1551
DICKENSON LANE.
Comment: In 1998, the City gave a HOME /CDBG loan to Swenson & Associates to buy
three lots to build three homes, including a home at 1551 Dickenson Lane. Swenson &
Associates were unable to finish the project and deeded all three lots back to the City in
lieu of foreclosure in 2000. One month later Swenson & Associates deeded 1551
Dickenson Lane to Susan Goodwin with City approval, which meant that the City's deed
is a "stray deed." Due to an oversight, the City and Susan Goodwin never addressed
the "stray deed" back in 2000. Susan Goodwin is selling the home, and the buyer's
attorney is requesting that the City issue a warranty deed to the buyer to address the
question of the "stray deed." Because the conveyance is solely to address a stray deed
the buyer will not be paying the City any money.

CONSIDER A RESOLUTION ALLOCATING THE HUMAN SERVICES AID TO

Comment: The City has budgeted funds in the FY12 Budget for Human Services Aid to

recommendation, we were notified of cuts to the CDBG program, over budgeting the
general fund allocation, and that Lifeskills (a mental health human services agency)

Comment: The City has the authority under Iowa Code §364.136 to assess the
nuisance abatement costs in the same manner as a property tax. This resolution
allows the City Clerk to certify to the Johnson County Treasurer the abatement cost to
be assessed against the property. This assessment is being pursued only after the City
took many steps to resolve the matter. The City notified the home owners to abate the
nuisance (for example, to remove snow from the sidewalk) and after the home owner
did not take action to abate the nuisance, the City abated the nuisance and billed the
owner. After being billed at least twice, these owners still have not paid the abatement
costs. The City has sent a letter to the home owner giving them notice that this
resolution would be on the agenda, a copy of which is attached to the resolution. No
interest will be charged if the owner pays within 30 days of the first required
publication. Attached as an exhibit to the resolution is a list of the properties that will

Comment: The City Manager has recommended this change as a cost saving
measure. The creation of the Assistant to the City Manager position will provide for
future internal growth opportunity for the assistant position and may provide a logical
succession plan for an internal candidate for future City Manager openings. These
