PROCLAMATIONS. a) Parks & Recreation Month - July Hayek: (reads proclamation) Karr: Here to accept the proclamation is Parks & Recreation Director Mike Moran. (applause) Moran: Just a few, uh, things, uh, the National Recreation and Parks Association and us will be collaborating on several events in July. You'll get a calendar, uh, towards the end of this week, and the culminating event'll be a flash mob event in the ped mall, so if I have to tell you anything else I'd have to kill ya so ... PLANNING AND ZONING MATTERS. c) CONSIDER AN ORDINANCE AMENDING CITY CODE TITLE 14, CHAPTER 4, ENTITLED USE REGULATIONS, ARTICLE D, TEMPORARY USES, ADDING PROVISIONS TO ALLOW FOOTBALL GAME DAY COMMERCIAL USES AS A TEMPORARY USE ALONG MELROSE AVENUE AND AMENDING CHAPTER 9, ENTITLED DEFINITIONS, TO ADD THE DEFINITION OF TAILGATING. (SECOND CONSIDERATION) Hayek: This is second consideration and staff has, uh, recommended expedited action. Wilburn: I move that the rule requiring that ordinances must be considered and voted on for passage at two Council meetings prior to the meeting at which it is to be voted, um, suspended; that second consideration and vote be waived; and the ordinance be voted on for final passage at this time. Champion: Second. Hayek: Motion to collapse from Wilburn, seconded by Champion. Discussion? Wright: I would just like to add that I think this is going to be an issue that's going to require a fair amount of dialogue as time goes on. I think that we're setting up to have ... good conversations between the City, the University, the neighborhood, the vendors to try to keep this going, urn ... make this work and, firstly, I'm looking at this year as ... as sort of the trial run, see how well it will go. Hayek: Is there someone from the public, or anyone from the public, who wants to address us during discussion? Okay. Walker: I'm Jean Walker, and I live on Lucon Drive, 335. And, um, I had sent you an email about having some amendments to the regulations, and uh, I would really appreciate if you could tell me with each of the amendments whether you think that they can be added to the regulations or not. Um, I want to say that I've talked also to people in University Heights and how they deal with game days and the trash, etc., and they manage to get the trash cleared up by 9:00 the next morning. So I know that, uh, you have, uh, taken to the idea of having a comprehensive review of game days, and that will come up with that, but I'd like, um, to see what your thoughts are on having to clean up by 9:00 on Sunday morning, and uh, one of my neighbors in, was saying that she would like trash cans and porta - potties on both sides of Melrose, and to ban the turkey legs. Um, now we do ask that the shish -ka -bob sticks be banned because of such a danger to the animals, and uh, we know that the food can be prepared in a different way. It can be cooked on the shish -ka -bobs and then slid off the stick into a little dish and the sticks can be responsibly disposed of by the vendor. So I think that might be possible to ... to do that. Um... and then I still want a review of moving the vendors to University property before they renew their contract with their current vendors. Page 3 request for the neighborhood that they cancel ... ask the University to discuss that, before the contract is renewed. And, uh, if you have any questions about the amendments, um, I'm happy to answer them. Thank you. Hayek: Well, thanks, and because you're here, and the Council can't get into a back and forth with ... with the audience... Walker: Yes. Hayek: ...but, um, you've been an outspoken individual on this issue, and so you know, during our work session about an hour ago, we heard from Doug Boothroy who discussed with us the multiple points raised in your July 291h, um, proposal, and... why don't I just repeat to you where ... where we are with that, and if anybody thinks I've misstated something, let me know. Um, Ms. Walker, you raised seven specific points and um... according to Mr. Boothroy, and I think there was concurrence with the Council, um, the, uh, items 4, 5, 6 and 7 are ... are being handled, or are being done. Uh, um... so that answers those items. Um, as to item 2, which is, uh, the University supply of porta - potties and trash cans, a group has been formed on that, uh, and ... and that discussion is ongoing, and then as to items 1 and 3, uh, those items were not things that the staff, uh, recommended that Council pursue, and I don't think there's interest on the part of Council at this time to pursue those. Walker: Okay. Thank you. Wright: I would just add to that, in terms of the shish -ka -bob sticks, my hope is that the additional trash cans will take care of a lot of that litter, and that's why I'm saying this is our trial run this fall to see how well this works. AMENDING TITLE 3, ENTITLED "FINANCES, TAXATION AND FEES" AND TITLE 9, ENTITLED "MOTOR VEHICLES AND TRAFFIC" OF THE IOWA CITY CODE OF ORDINANCES TO ESTABLISH DOWNTOWN MOPED PARKING PERMIT REQUIREMENTS AND FEES. a) PUBLIC HEARING Hayek: This is a public hearing. (bangs gavel) Public hearing is open. Patel: Good evening, Mr. Mayor, Honorable Council. My name is Raj Patel. I'm the University of Iowa Student Liaison to the City Council. And I really like this idea of moped designated parking throughout downtown. It gets mopeds off the sidewalks, and encourages these fuel- efficient, economical vehicles. But I do agree with Connie and I think that we should make this parking free of charge. And that's all I have to say. Thank you. Hayek: Thanks, Raj. And for the public's edification, we had, uh, we've heard from staff earlier this evening on the details of the proposal. Would anyone else like to address the Council during public hearing? Okay. Champion: Well, I'm going to support this, um, cause I think we're long overdue on some moped, scooter parking. I ... I do ... I would like to see it free, but there's not Council support for that, so I'm going to support it as it's written and we'll see what happens. I'd like to have the parking be free and I was actually persuaded by ... the discussion when it was mentioned that, uh, the University does charge for similar type of parking, and I know first -hand that students don't always differentiate between what the ... what the University territory is and what downtown territory is, and this might end up being a little bit less confusing. And it's ... what did we say, it'll be less than $5.00 a month? Hayek: Less than $4.00! Wright: Less than $4.00 a month. Bailey: My objectives when we first started talking about this, uh, to get the mopeds off the sidewalks, as Raj mentioned, and also to clear up the bike racks, because I know we have a lot of overcrowding at particular bike racks, and as a bicyclist on occasion, I ... I think that that's a problem. Um ... the idea of free parking is appealing to me, but then when we started outlining the potential cost to the City, I think that and the consistency with the University, it does make sense. I think we've got some hidden costs that we haven't accounted for as a community, and I think we have to be aware of that and our parking division is an enterprise division and has to sort of pay its own way, so I think it's important to go ahead and do it this way, and then as this unfolds, once again, I mean, we can see how well it works and make sure that there's no confusion with the University. I think the point is well taken, Mike, that many don't understand where the campus begins and the City ends or vice versa. Wright: (mumbled) Dickens: I'll be supporting it as well. I came in not wanting to change it, but I think after... after our discussion that, uh, there is not room to put more on the sidewalks, as far as adding more bike racks (mumbled) add some bike racks because it sounds like we do need more just for bicyclists. So, after talking with staff and listening to them, that there is going to be plenty of (mumbled) to park. We don't want to discourage people from using mopeds because that's a ... I think it's only going to grow so we've got to keep an eye on this and may have to expand it. Hayek: Yeah, I was looking for a free approach as well, but compared to what other, uh, jurisdictions charge, including the University of Iowa, and, uh, the reasonableness of this, and the fact that we as Regenia said, uh, will lose dollars by ... by using a few parking metered spots, uh, to ... to expand the, uh, footprint of ... of parking for, uh, moped and moped -like vehicles. I think it makes sense. I think at under $4.00 a month it's a ... eminently reasonable. And A ... I think it makes sense and we can see how it goes, and ... and it does address the primary concern, which is safety, which is what the business community and, uh, pedestrians and bicyclists have brought to our attention. Page 7 Champion: One question I wanted to ask, I forgot to ask when we were talking about this earlier, is ... is there a fine if you don't have a permit? What is that fine? Is it illegal parking? O'Brien: It would be a prohibited zone, same as it would if, for example, someone parked in the City Hall parking lot and didn't have a permit, it's a $15.00 fine. Yeah, if you don't have a permit to park there. Bailey: But as you pointed out... Wright: 'I'm sorry, go ahead. Bailey: Go ahead, Mike. Wright: There is non - permitted parking available (mumbled) O'Brien: Absolutely, they can utilize the meters. If it's someone who isn't a habitual user, but comes downtown, they could park in a facilities as well as on- street in the metered areas. Hayek: Does the overnight prohibition not apply to this? O'Brien: Uh, the 2:00 to 6:00 would apply to everything in the 2:00 to 6:00 zone, so there would be no overnight storage allowed. Hayek: Okay. Further discussion by Council? Roll call, please. PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE COLLEGE GREEN PARK LIGHTING REPLACEMENT PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH NOTICE TO BIDDERS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. a) PUBLIC HEARING Hayek: This is a public hearing. (bangs gavel) Public hearing is open. Um, for the public's knowledge, uh, this project will replace the entire lighting system in College Green Park. Estimated cost is around $114,000 and will be funded with General Obligation Bond proceeds. Public hearing is closed. CONSIDER A RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AN AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND HDR ENGINEERING, INC. TO PROVIDE CONSULTANT SERVICES FOR THE DOWNTOWN AND RIVERFRONT CROSSINGS ELEMENTS OF THE COMPREHENSIVE PLAN. Hayek: Uh, this, uh, under this contract the engineer would provide urban design and consulting services, uh, as well as draft of a zoning code. Total cost for design consultation is estimated at $164,000. Bailey: Move adoption of the resolution. Dickens: Second. Hayek: Moved by Bailey, seconded by Dickens. Discussion? CONSIDER A RESOLUTION GRANTING THE CITY MANAGER ADMINISTRATIVE AUTHORITY TO MAKE TOWNCREST URBAN RENEWAL GRANTS FOR THE TOWNCREST FACADE RENOVATION PROGRAM AND THE PREDEVELOPMENT DESIGN ASSISTANCE PROGRAM. Hayek: This comes on a 3 to 0 vote in favor of this from the Economic Development Committee. Bailey: Move adoption of the resolution. Dickens: Second. Hayek: Moved by Bailey, seconded by Dickens. CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CONTRACT FOR CONSTRUCTION OF THE FY 2012 ASPHALT RESURFACING PROJECT. Hayek: Uh, one bid was received, uh, LL Pelling Company out of North Liberty submitted it, about $718,000. Engineers had estimated $779,000. Public Works and Engineering recommends awarding the contract to LL Pelling and this will be funded with State and local funds. Mims: Move approval of the resolution. Wilburn: Second. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A GRANT AGREEMENT WITH JOHNSON COUNTY FOR FUNDS TO SUPPORT THE IOWA CITY /JOHNSON COUNTY SENIOR CENTER. Hayek: Uh, this approves a one -year grant agreement for $70,000 from the County to assist with operational expenses. Wright: Move adoption. Mims: Second. Hayek: Moved by Wright, seconded by Mims. Discussion? Champion: So this is in lieu of the $75,000, this is not additional money. Hayek: That's correct. And it's down, uh, $5,000 from the year before. Champion: Well, I think that's kind of sad, I mean, the Senior Center isn't getting any cheaper to run! I'm not going to vote for it! Hayek: Further discussion? Roll call, please. Hayek: Previously announced two vacancies of the Airport Zoning Board of Adjustment; two vacancies on the Airport Zoning Commission; one vacancy for a mechanical professional on the Board of Appeals; one vacancy for a building design professional on the Board of Appeals; three vacancies on the Housing and Community Development Commission; one vacancy on the Parks and Recreation Commission; one vacancy for the Police Citizens Review Board; one vacancy on the Senior Center Commission; one vacancy for a student from Regina High School for the Youth Advisory Commission; and another vacancy for a student from Tate High School, uh, to serve on the Youth Advisory Commission. Uh, applications for all of these, uh, commissions must be received by 5:00 P.M. Wednesday, July 13th, and we encourage the public to take a look at these spots. Wright: I just have to say thanks to all involved for the excellent work on the Jazz Festival and the spectacular fireworks display this year. I think it was one of the best I've ever seen. Wilburn: On Tuesday, July 19th, I will be participating in the Journey of Hope with Push America and the Theta Theta Chapter of Pi Kappa Pi Fraternity here in Iowa City. Uh, it's cross - country bicycle ride to raise awareness for, uh, funding and researching for persons with disabilities. And, um, I will be ... we should arrive in Iowa City close to 11:00. Hopefully I won't slow the group down. And, um, we'll be at the Old Capitol speaking there, so ... feel free to come join the ride or just show up and hear some neat ... meet some of the riders. They are literally ...come from across the country and they're doing a great job. Hayek: Thanks, Ross. Bailey: I want to echo what Mike said. It was great to see everybody down at Jazz Festival, and thank you, Marian, for your hard work on the fireworks, um, they were amazing this year.
