AN ORDINANCE AMENDING SECTION 1 -9 -313 OF THE CODE OF ORDINANCES OF IOWA CITY, IOWA, ESTABLISHING THE BOUNDARIES OF THE VOTING PRECINCTS IN IOWA CITY; AND SECTION 1 -5 -1 OF THE CODE OF ORDINANCES OF IOWA CITY, IOWA, ESTABLISHING THE VOTING PRECINCTS THAT COMPRISE THE THREE CITY COUNCIL DISTRICTS IN IOWA CITY. SECTION I. PURPOSE. The purpose of this amendment is to revise the voting precincts in Iowa City to reflect changes in population exhibited in the 2010 decennial census and to reflect changes as results of the reprecincting process. SECTION II. AMENDMENT. 1. Section 1 -9 -313 of the Code of Ordinances is hereby amended by deleting said section and replacing it with the following: SECTION 1 -9 -3B. Boundaries of Precincts The area encompassed within the voting precincts shall be indicated as follows: Precinct 1: Beginning at the intersection of 1St Avenue and Court Street; east on Court Street to Friendship Street; north on Friendship Street to Washington Street; east on Washington Street to Scott Boulevard; north along Scott Boulevard to Rochester Avenue; west on Rochester Avenue to Post Road; south on Post Road to Princeton Road; northwest along Princeton Road to 1 st Avenue; south along 1 st Avenue to the point of beginning. Section 1 -5 -1 of the Code of Ordinances is hereby amended by adopting a new said section to read as follows: SECTION 1 -5 -1. City Council Districts There are hereby established in the City three (3) City Council Districts. The following "voting precincts ", as defined in Chapter 9 of this Title, shall comprise the three (3) City Council Districts: A. City Council District A: Voting precincts 2, 7, 8, 9, 10, 13, 14, 15 B. City Council District B: Voting precincts 1, 6, 12, 16, 17, 18, 23, 24 C. City Council District C: Voting precincts 3, 4, 5, 11, 19, 20, 21, 22 SECTION III. REPEALER. All ordinances and parts of ordinances in conflict t with the provisions of this Ordinance are hereby repealed. SECTION IV. SEVERABILITY. If any section, provision or part of the Ordinances shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any section provision or part thereof not adjudged invalid or unconstitutional. Karr, City Clerle Robert Miklo, Senior Planner Re: Voting precinct and council district boundaries (agenda item # 3) Introduction: At a special meeting on Tuesday July 12 you will be holding a public hearing and first consideration of an ordinance adjusting precinct and district boundaries as a result of the 2010 census. History /Background: After a federal decennial census, each city council must review its precinct and ward (if any) boundaries to see whether the existing boundaries comply with current laws. Each city with a population over 3,500 must file required paperwork, including an ordinance describing precinct boundaries, with the Secretary of State prior to September 1. In accordance with State and Administrative Codes each city council must divide their city into precincts and all precincts must meet the following standards: • population cannot exceed 3,500 • must lie within one legislative district • composed of contiguous territory • follow census block boundaries • voter convenience and electoral efficiency • include annexed territory requires no greater than 10% variance between council districts If there are joint city and county precincts, in our case Precincts 10 & 12, where a precinct is composed of both incorporated and unincorporated territory, the city and county must adopt a mutually satisfactory agreement. Combining township precincts with contiguous Iowa City precincts allows township voters to vote at a nearby location. Township voters will vote separate ballots and are not eligible to vote in City of Iowa City municipal elections. Agreements were adopted in 2001 by the City Council and Johnson County Board of Supervisors. Agreements will appear on your August 2 agenda. The proposal must be reviewed by the County Auditor and the Secretary of State's office. Cities are encouraged to submit the plans early to allow time for review and /or corrections. Plans not approved or submitted after the September 1 deadlines will be corrected by the Secretary of State's office. Discussion of Solution: This year we were able to utilize the GPS features of the census and the resources of the Johnson County Auditor's office. At our request, Auditor Tom Slockett provided us with proposals utilizing the GPS. This involvement early on provided valuable exchange of ideas and July 7, 2011 Page 2 allowed for required review by the Auditor early in the process. The Auditor's office came up with some hypothetical lines that include a public building (potential polling place) in each precinct when possible, and City staff met with the Auditor and his staff on May 31 on the first draft. City staff provided input regarding potential population growth and, as a result of that meeting another draft was developed. Because of the way legislative district lines are drawn, and the focus on equalizing precinct population size, this proposal has 24 precincts rather than the current 25. Maintaining the current 25 will unavoidably result in a larger variance in precinct size. Recommendation: After a number of conversations with the Auditor's office, City staff recommends adoption of Map 2 (attached). The pros and cons of this proposal are outlined in the attached "Focus on Voter Convenience and Neighborhood Precincts ". City staff would also like to acknowledge the collaborative efforts of the Johnson County Auditor's office in preparation of proposals, and preparation of tools.
