i t - 1. CONSIDER A RESOLUTION SETTING PUBLIC HEARING FOR
OCTOBER 4, 2011, ON A PROPOSAL TO CONVEY A SINGLE FAMILY
HOME LOCATED AT 336 DOUGLASS COURT.
Comment: The grant for the UniverCity Neighborhood Partnership Program
allows the City to purchase twenty -six rental units located in designated
neighborhoods surrounding the University, rehabilitate them with up to
$50,000 in grant funds, and then sell them to income - eligible buyers. Under
the UniverCity Neighborhood Partnership Program, the City proposes to sell
336 Douglass Court. The amount of the sale will be $105,000 (this is what
the City paid to purchase the home) plus the "carrying costs," which are
which are all costs incurred by the City to acquire the home, maintain it and
sell it, including abstracting and recording fees, interest on the loan to
purchase the home, mowing and snow removal, utilities, real estate taxes,
and any costs in excess of $50,000 to repair and rehabilitate the home.
e) Resolutions.

Comment: The project has been completed in substantial accordance with
the plans and specifications. The Engineer's Report and Performance and

Comment: University of Iowa Community Credit Union has requested that

Drive. In 2000, the owner of the property received funding from the City of
Iowa City for a Housing Rehabilitation project. The property has enough
equity to cover the City's lien position.

A) CONSIDER A MOTION SETTING A PUBLIC HEARING FOR OCTOBER 4, 2011
ON A RESOLUTION AMENDING THE COMPREHENSIVE PLAN TO ADOPT
THE RIVERFRONT CROSSINGS DISTRICT - SUB -AREA PLAN.
Comment: After a public hearing held on September 1, 2011, on a vote of 6 -0
(Freerks absent) the Planning and Zoning Commission recommended amending
the Comprehensive Plan to adopt the Riverfront Crossings District — Sub -Area
Plan. Staff recommended approval in a memo dated September 1, 2011. Approval
of this plan will establish the vision for future development in this sub -area of the
Riverfront Crossings District and is the first phase of the planning effort in the
Riverfront Crossings District.

ITEM 6K (Addition) CONSIDER A RESOLUTION APPROVING THE FINAL PLAT OF STONE BRIDGE
ESTATES PART 7, IOWA CITY, IOWA. (SUB01 1 -00011)
Comment: The preliminary plat for Stone Bridge Estates Parts 6 -9 was approved by the City
Council in 2009. A resolution extending the term of effectiveness was approved on June 21,
2011. Staff recommends approval of the final plat subject to approval of legal papers and
construction drawings. It is anticipated that legal papers and construction drawings will be
approved prior to the September 20 City Council meeting. Approval will allow the development
of Stone Bridge Estates Part 7, a 27 -lot, 8.56 -acre residential subdivision located north of Court
Street along extensions of Colchester and Arlington Drives.
ITEM 7. (Revised $ estimate amount) Comment: The project will elevate exterior electrical equipment,
floodproof the well house building, and elevate electrical equipment inside the well house
building for three of the City's water supply well facilities within the Water Works Prairie Park.
The estimated construction cost is $428,000 and will be funded with Hazard Mitigation Grant
Program proceeds and Water revenues.

ON AN ORDINANCE AMENDING TITLE 14, ZONING CODE, PARAGRAPH 14-
4B- 4B -23, TO MODIFY THE STANDARDS FOR VEHICLE REPAIR USES IN THE
INTENSIVE COMMERCIAL ZONE WHEN LOCATED ADJACENT TO A
RESIDENTIAL ZONE.
Comment: At their meeting on July 7, 2011, on a vote of 5 -0 (Plahutnik and Payne
absent), the Planning and Zoning Commission recommended approval of this
zoning code amendment. Staff recommended approval in a memo dated July 7,
2011. Approval of this amendment will reduce the number of nonconforming auto
repair shops in the CI -1 Zone by establishing restrictions on outdoor work activities
and noise standards for any indoor work activities during night -time hours in lieu of
the current 100 -foot separation requirement between auto repair uses in the CI -1
Zone and residential zones.

zoning code amendments. Staff recommended approval in a memo dated July 7,
2011. Approval of these amendments will improve and clarify regulations that apply
in the downtown area by allowing more flexibility in locating parking in relation to
storefront uses, and by requiring the second floor of mixed -use buildings to be
constructed in a manner that will be more attractive for commercial uses,
particularly office uses, for which there has been a documented and unmet
demand.

MINIMUM DRIVEWAY LENGTH.
Comment: At their meeting on September 1, 2011, on a vote of 6 -0 (Freerks
absent), the Planning and Zoning Commission recommended approval of this
zoning code amendment. Staff recommended approval in a memo dated
September 1, 2011. Approval of this amendment will allow an applicant to seek a
minor modification to reduce the minimum driveway length in cases where there
are topographical constraints that make compliance with this standard impractical.

Comment: At their meeting on September 1, 2011, on a vote of 6 -0 (Freerks

of 9 assisted living apartments to the existing 80 -units in Melrose Meadows
Retirement Community.

Comment: At its July 21 meeting, by a vote of 6 -0 (Plahutnik absent), the Planning
and Zoning Commission recommended approval of this amendment to the zoning
code. Staff recommended approval in a report dated July 21. Approval will allow
pet supply stores to be located in the CI -1 zone.

Comment: The preliminary plat for Rochester Ridge was approved by the City
Council on August 2, 2011, along with the final plat for Part One of the subdivision.
Part One included 18 lots and the stormwater management area for the entire
subdivision. Staff recommends approval of the final plat for Part Two subject to
approval of legal papers and construction drawings. It is anticipated that legal
papers and construction drawings will be approved prior to the September 6 City
Council meeting. Approval will allow the development of a 13 -lot, 4.57 acre
residential subdivision located at 2949 Rochester Avenue. This item was deferred
from the September 6 agenda.

removal and repair will also be completed. The estimated cost for this project is
$176,000.00 to be paid out of parking operations.

AND NECESSARY EQUIPMENT FOR THE SUM OF $500 PER MONTH FOR AN
INTITIAL FIVE YEAR TERMS WITH PROVISIONS FOR FOUR SUBSEQUENT
RENEWAL PERIODS OF FIVE YEARS EACH.
Comment: Pursuant to Iowa Code Section 364.7, before the City Council may engage in
any lease agreement exceeding a term of three (3) years, it must be proceeded by a
public hearing and authorized by resolution. Wells Fargo Company, who may be
relocating from its current property at 112 E. Dubuque St., has approached the City with
the proposal to install an ATM machine in the College Street pedestrian mall kiosk
fronting along Clinton Street for an initial term of five (5) years, with the option to renew
said lease for four (4) additional five (5) year terms upon subsequent agreement
between the City and Wells Fargo. Any subsequent renewal will also require
renegotiation of the rental rate for the five (5) year renewal period. This Resolution
authorizes the Mayor to sign and the City Clerk to attest a lease agreement with Wells
Fargo Company for the limited occupation and possession of the kiosk located in the
College Street pedestrian mall along the Clinton Street frontage for the sum of $500
per month for an initial five (5) year term with the ability of Wells Fargo to renew the
lease for four (4) subsequent five (5) year terms upon agreement of the parties.

ITEM 11. CONSIDER A MOTION AUTHORIZING THE CITY MANAGER TO SIGN A LETTER
OF SUPPORT AND COMMITMENT FOR IOWA CITY TO PARTICIPATE IN THE
LINN COUNTY / JOHNSON COUNTY SUSTAINABLE COMMUNITIES PLANNING
GRANT AND PLANNING PROCESS.
Comment: Linn County has approached Iowa City, Johnson County and the
Metropolitan Planning Organization of Johnson County to participate in an application
for a Sustainable Communities Planning grant, which is administered by the Housing
and Urban Development Administration. Linn County is proposing a $2.5 Million grant
be requested for this effort. The grant would provide funds to hire a consultant team to
develop a regional (East Central Iowa) housing, land use, transportation and livable
communities plan over a three year period. The East Central Iowa Council of
Governments would administer the grant, with support from other local governments.
This effort is not intended to supplant local government efforts; it is intended to create a
larger regional framework for local government comprehensive land use, housing and
transportation plans. A 20% local match is required for this grant; Iowa City is being
asked to commit to in -kind staff time for the local match obligation, including direct staff
time, and the coordination of time from local commissions, committees, and non-
governmental entities which would participate in the planning process.

ITEM 12. CONSIDER AN ORDINANCE AMENDING TITLE 4, ALCOHOLIC
BEVERAGES, CHAPTER 3, OUTDOOR SERVICE AREAS; SEASONAL, FIVE
DAY OR FOURTEEN DAY LICENSES AND PERMITS, SECTION A,
LOCATION TO ESTABLISH NEW LOCATION STANDARDS FOR
TEMPORARY OUTDOOR SERVICE AREAS WHEN REQUESTED IN NOW
RESIDENTIAL ZONES. (SECOND CONSIDERATION)
Comment: This ordinance change would allow the City to issue permits for temporary
outdoor service areas under the same location standards that apply to more
permanent outdoor service areas approved on a year -round basis. Since so many of
the City's commercial zones contain residential apartments above commercial
storefronts, it is difficult to hold special events or festivals that include temporary
outdoor service areas under the current location restriction, which prohibits temporary
outdoor service areas that are within 100 feet of a residential use. For instance, under
the current ordinance, a permit could not be issued for a temporary outdoor service
area in the Northside Marketplace during the upcoming Octoberfest, a one -day event
being held on October 1, because there are residential apartments located above the
commercial storefronts in the area. This proposed change to the ordinance would allow
each request for a temporary outdoor service area to be considered on its own merits
based on the approval criteria in the City Code and subject to similar location
standards as more permanent outdoor service areas that are permitted on a year -
round basis. Staff requests expedited action.

Comment: Based on a speed study of the North Dodge Street corridor, the City
Engineer and Iowa Department of Transportation recommend establishing the speed
limit at 35 miles per hour between Prairie du Chien Road and a point 175 feet north of
Conklin Lane and establishing the speed limit at 45 miles per hour from a point 175
feet north of Conklin Lane to a point 600 feet south of the city limits.

Comment: Adopting a TIF ordinance is the second step in establishing a tax increment
financing (TIF) district. Adoption of the Towncrest Urban Renewal Plan was the first
step, and as such, was approved by the Planning and Zoning Commission as being in
conformity with the general plan for development of the City as a whole. Additionally,
the required consultation with the other taxing entities in the county was also held. The
TIF ordinance allows for new taxes derived from the development of taxable property
in the Urban Renewal Project Area to be divided and used for loans, rebates, grants,
advances, indebtedness, or bonds payable for projects approved by City Council.

MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AN AGREEMENT BY

PROVIDE CONSULTANT SERVICES FOR THE PUBLIC WORKS FUEL FACILITY
AND VEHICLE WASH PROJECT.
Comment: This agreement will provide for the preparation of preliminary and final
design of the Public Works Fuel Facility & Vehicle Wash Project. The project will
relocate the City's fuel storage and dispensing facilities and vehicle wash systems to
the Public Works site located on South Gilbert Street in order to enhance services and
to meet current and future fuel and wash demands. The negotiated price is not to
exceed $76,685 and will be funded with General Obligation bond proceeds.

3t5 FOR DEVELOPMENT OF A LANDSCAPED MEDIAN ON BURLINGTON STREET
FROM THE IOWA RIVER TO CAPITOL STREET.
Comment: This resolution will enable City staff to apply for grants totaling up to
$750,000 from the Iowa Department of Transportation "Statewide Transportation
Enhancement Program." If awarded, grant funds will be used to develop a landscaped
median on Burlington Street from the Iowa River to Capitol Street. This project would
increase pedestrian safety and enhance aesthetics along this key entryway to
downtown Iowa City and the University of Iowa campus. The minimum local match
requirement for this program is 30 percent of the project cost. Funds provided by the
University of Iowa can be applied to this local match requirement.
