CONSIDER A RESOLUTION SETTING PUBLIC HEARING FOR tl - 3t T OCTOBER 18, 2011, ON A PROPOSAL TO CONVEY A SINGLE FAMILY HOME LOCATED AT 1208 EAST BURLINGTON STREET. Comment: The grant for the UniverCity Neighborhood Partnership Program allows the City to purchase twenty -six rental units located in designated neighborhoods surrounding the University, rehabilitate them with up to $50,000 in grant funds, and then sell them to income - eligible buyers. Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 1208 East Burlington Street. The amount of the sale will be $150,000 (this is what the City paid to purchase the home) plus the "carrying costs, " - which cue which are all costs incurred by the City to acquire the home, maintain it and sell it, including abstracting and recording fees, interest on the loan to purchase the home, mowing and snow removal, utilities, real estate taxes, and any costs in excess of $50,000 to repair and rehabilitate the home. CONSIDER A MOTION SETTING A PUBLIC HEARING FOR NOVEMBER 1, 2011, ON AN ORDINANCE CREATING A SELF - SUPPORTING MUNICIPAL IMPROVEMENT DISTRICT ( SSMID) ACCORDING TO IOWA CODE CHAPTER 386 FOR DOWNTOWN IOWA CITY. Comment: A petition was filed by property owners in the CB -10 zone (downtown) and business support zone of CB -2 of the Northside Marketplace on August 25, 2011 requesting the establishment of a SSMID according to the provisions of Iowa Code Chapter 386. The petition met the technical requirements of Iowa Code and was forwarded to the Planning and Zoning Commission for their evaluation. A copy of the report from the Planning and Zoning Commission is included in this packet for your review. CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE 420TH STREET IMPROVEMENTS PROJECT. Comment: Due to a revision of the final cost of this project, this resolution rescinds the previous acceptance on August 2, 2011 (Resolution #11 -243) and recommends acceptance of the project with this revised final cost. The project has been completed in substantial accordance with the plans and specifications. The Engineer's Report and Performance and Payment bonds are on file with the City Clerk. 2. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING A MORTGAGE FOR THE PROPERTY LOCATED AT 2705 WHISPERING MEADOWS, IOWA CITY, IOWA. Comment: The Iowa Valley Habitat for Humanity owns the property located at 2705 Whispering Meadows and received assistance through the City of Iowa City's Community Development Block Grant (CDBG) funds. The CDBG assistance is secured by a mortgage on this property and Habitat is conveying this property to a family. Because the family has executed a mortgage in favor of the City to secure the CDBG assistance, the City can release this lot. 3. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING A MORTGAGE FOR THE PROPERTY LOCATED AT 1107 CLARK COURT, IOWA CITY, IOWA. Comment: The owner of the property received assistance through the City of Iowa City GRIP (General Rehab and Improvement Program). The loan has been paid off; thus the lien needs to be released. Staff recommended approval in a memo dated September 1, 2011. Approval of this plan will establish the vision for future development in this sub -area of the Riverfront Crossings District and is the first phase of the planning effort in the Riverfront Crossings District. Comment: The grant for the UniverCity Neighborhood Partnership Program allows the City to purchase twenty -six rental units located in designated neighborhoods surrounding the University, rehabilitate them with up to $50,000 in grant funds, and then sell them to income - eligible buyers. Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 336 Douglass Court. The amount of the sale will be $105,000 (this is what the City paid to purchase the home) plus "carrying costs" of approximately $8,600. "Carrying costs" are all the costs incurred by the City to acquire the home, maintain it and sell it, including abstracting and recording fees, interest on the loan to purchase the home, mowing and snow removal, utilities, real estate taxes, and any costs in excess of $50,000 to repair and rehabilitate the home. a. DETERMINING THE RIVERFRONT CROSSINGS URBAN RENEWAL AREA OF THE CITY TO HAVE CONDITIONS OF BLIGHT AND THAT THE REHABILITATION, CONSERVATION, REDEVELOPMENT, DEVELOPMENT, OR A COMBINATION THEREOF, OF SUCH AREA IS NECESSARY IN THE INTEREST OF THE PUBLIC HEALTH, SAFETY OR WELFARE OF THE RESIDENTS OF THE CITY; DESIGNATING SUCH AREA AS APPROPRIATE FOR AN URBAN RENEWAL PROJECT; AND ADOPTING THE RIVERFRONT CROSSINGS URBAN RENEWAL PLAN THEREFOR. Comment: The proposed Riverfront Crossings Urban Renewal Plan has been prepared for approximately 44 acres. The proposed plan, as required by state law, has been reviewed for its conformity with the Comprehensive Plan for Iowa City by the Planning and Zoning Commission, who voted to recommend the plan at their regular meeting on September 15, 2011. The required consultation with the other taxing entities in the county will be held Sept. 30, 2011. Adopting the proposed plan is the first step in establishing a tax increment financing district for the urban renewal area. This public hearing should be continued to October 18 to allow the required public comment period to lapse prior to action, and a report provided on the consultation. a. PUBLIC HEARING Action: b. CONSIDER AN ORDINANCE AMENDING CITY CODE TITLE 17, ENTITLED "BUILDING AND HOUSING," CHAPTER 12, ENTITLED "APPEALS," TO ELIMINATE THE COMPOSITION REQUIREMENTS OF THE BOARD OF APPEALS. (FIRST CONSIDERATION) Comment: The current City Code sets for the composition of the Board of Appeals. Staff recommends that this provision be deleted and that the composition of the Board be set forth in the bylaws, making it consistent with how other boards and commissions composition is established. CONSIDER AN ORDINANCE AMENDING TITLE 9, ENTITLED "MOTOR VEHICLES AND TRAFFIC," CHAPTER 3, ENTITLED "RULES OF THE ROAD," SECTION 6, ENTITLED "SPEED RESTRICTIONS," SUBSECTION B, ENTITLED "EXCEPTIONS ". (FIRST CONSIDERATION) Comment: This ordinance amendment has been revised following additional input from the Iowa Department of Transportation; both termini of this new 35 mile per hour zone are different than previously proposed. Based on a speed study of the North Dodge Street corridor, the City Engineer and Iowa Department of Transportation recommend establishing the speed limit at 35 miles per hour from a point 300 feet north of Prairie du Chien to a point 315 feet north of Conklin Lane. This ordinance amendment replaces another considered at the September 20, 2011 City Council meeting that proposed establishing the speed limit at 35 miles per hour from the intersection of Prairie du Chien to a point 175 feet north of Conklin Lane. CONSIDER AN ORDINANCE PROVIDING THAT GENERAL PROPERTY TAXES LEVIED AND COLLECTED EACH YEAR ON ALL PROPERTY LOCATED WITHIN THE TOWNCREST URBAN RENEWAL AREA, IN THE CITY OF IOWA CITY, COUNTY OF JOHNSON, STATE OF IOWA, BY AND FOR THE BENEFIT OF THE STATE OF IOWA, CITY OF IOWA CITY, COUNTY OF JOHNSON, IOWA CITY COMMUNITY SCHOOL DISTRICT AND OTHER TAXING DISTRICTS, BE PAID TO A SPECIAL FUND FOR PAYMENT OF PRINCIPAL AND INTEREST ON LOANS, REBATES, GRANTS, MONIES ADVANCED TO AND INDEBTEDNESS, INCLUDING BONDS ISSUED OR TO BE ISSUED, INCURRED BY SAID CITY IN CONNECTION WITH SAID URBAN RENEWAL REDEVELOPMENT PROJECT. (SECOND CONSIDERATION) Comment: Adopting a TIF ordinance is the second step in establishing a tax increment financing (TIF) district. Adoption of the Towncrest Urban Renewal Plan was the first step, and as such, was approved by the Planning and Zoning Commission as being in conformity with the general plan for development of the City as a whole. Additionally, the required consultation with the other taxing entities in the county was also held. The TIF ordinance allows for new taxes derived from the development of taxable property in the Urban Renewal Project Area to be divided and used for loans, rebates, grants, advances, indebtedness, or bonds payable for projects approved by City Council. ITEM 12. CONSIDER A MOTION GRANTING A 45 -DAY EXTENSION TO THE POLICE CITIZENS REVIEW BOARD FOR THE FILING OF THE PUBLIC REPORT WITH THE CITY COUNCIL ON COMPLAINT #11 -01. Comment: Ordinance 97 -3792 establishes the Police Citizens Review Board and sets forth mechanisms for complaints. The Ordinance also provides the City Council to grant extensions of the 45 -day reporting requirement for good cause.
