Washington Street, Iowa City, Iowa, or if said meeting is cancelled, at the next meeting of the City Council thereafter as posted by the City Clerk; at which hearing the Council will consider: A resolution amending the Comprehensive Plan to adopt the Riverfront Crossings District - Sub -area Plan; and An ordinance amending Title 14, Zoning Code, paragraph 14- 413- 46 -23, to modify the standards for vehicle repair uses in the Intensive Commercial Zone when located adjacent to a residential zone; and An ordinance amending Title 14, Zoning Code, subsection 14-4C-1D, to clarify a cross - reference regarding off - street parking located on a separate lot from the use served and to delete subparagraph 14 -2C- 413-3a., an obsolete provision regarding side and rear building setbacks in commercial zones; and An ordinance amending Title 14, Zoning Code, Table 2C -2(a), section 14 -2C -6, section 14 -2C -8, and paragraph 14- 4B -4A -7, to establish dimensional and commercial site development standards in the Central Business Service (CB -2) Zone similar to standards applied in the other Central Business Zones, and to clarify and establish setback and entrance requirements, provide additional flexibility for parking location, and modify construction standards to accommodate upper floor commercial uses in mixed -use buildings in the Central Business Zones; and An ordinance amending Title 14, Zoning Code, paragraph 14- 2A -6C -4, to allow an applicant to seek a minor modification to the single family site development standard that establishes minimum driveway length; and An ordinance amending Title 14, Zoning Code, Article 4A, Use Categories, to add a new use category entitled, "Building Trade Uses," and associated amendments to allow said building trade uses in the CI -1, 1 -1, and 1 -2 zones as permitted uses and in the CC -2 zone as provisional uses and to establish approval criteria for said provisional uses in Article 14 -46. KARR, CITY CLERK �A Publish 9/14 NOTICE OF A CONSULTATION TO BE HELD BETWEEN THE CITY OF IOWA CITY, IOWA AND ALL AFFECTED TAXING ENTITIES CONCERNING THE PROPOSED RIVERFRONT CROSSINGS URBAN RENEWAL PLAN FOR THE CITY OF IOWA CITY, IOWA The City of Iowa City, Iowa will hold a consultation with all affected taxing entities, as defined in Section 403.17(1A) of the Code of Iowa, as amended, commencing at 10:00 o'clock A.M. on September 30, 2011, in the City Manager's Conference Room, City Hall, Iowa City, Iowa, concerning a proposed Riverfront Crossings Renewal Plan, a draft copy of which is on file in the office of the City Clerk. Each affected taxing entity may appoint a representative to attend the consultation. The City of Iowa City, Iowa is the local agency which, if such Plan is approved, shall undertake the urban renewal activities described in such Plan. The general scope of the urban renewal activities under consideration in the Plan is to assist qualified industries and businesses in the Urban Renewal Area through various public purpose and special financing activities outlined in the Plan. To accomplish the objectives of the Plan, and to encourage the further development of the Urban Renewal Area, the plan provides that such special financing activities may include, but not be limited to, the making of loans or grants of public funds to private entities under Chapter 15A of the Code of Iowa. The Planning and Zoning Commission reviewed and voted to recommend the plan to City Council at their meeting on September 15, 2011. By a vote of 6 to 0 ( Freerks absent), the Planning and Zoning Commission found that the Riverfront Crossings Urban Renewal Plan conforms to the Iowa City Comprehensive Plan. A detailed discussion of the Commission's review is contained in the September 15, 2011 meeting minutes (attached). Planning and Zoning Commission September 15, 2011 - Formal URBAN RENEWAL PLAN: Discussion of the Riverfront Crossings Urban Renewal Plan for approximately 45 acres of property bordered by Highway 1 on the south, Myrtle Drive on the north, the Iowa River on the east and generally Orchard street on the west. Ford stated that the Commission's job on this agenda item is to review the Riverfront Crossings Urban Renewal Plan for its conformance with the Comprehensive Plan and to submit a recommendation to City Council. The purpose of an urban renewal plan is to provide a vision and to enable the possibility of city- assisted development and public improvement projects through the use of TIF. Public projects in this case might include things such as beautification of the Riverside Drive commercial corridor, connecting the trail system along the river, and fixing conditions that impair the environmental or economic health of the community. Ford stated that an Urban Renewal Plan can be established for the purposes of economic development or slum or blight. This area was beginning to show the signs of blight before the flood of 2008 which worsened existing conditions and added new one. Blight tends to lead to the disinvestment of the area, drawing down property values and slowing the growth of the city. It can be a liability physically, economically and socially. In an analysis of the properties in the area it was revealed that there was a significant finding of blight which merits the establishment of Urban Renewal Plan for blight purposes. Ford stated that there are slides to show the type of condition meriting the blight designation and the language from the Iowa code that is used to describe blight in this case. One of the conditions is defective or ineffective street layout. Ford pointed out on the slide the various street layout issues. Another condition in the definition of blight is a faulty layout in relation to the size, adequacy, accessibility, or usefulness of a lot. Ford stated the plan appears to be in conformity with both the 2002 Southwest District Plan and the Comprehensive Plan. Payne asked why this area is to be included in the Riverfront Crossings area and why was it this area that was picked to do first over other areas on the other side of the river. Miklo answered the first question by stating that when the first round of the Riverfront Crossing Plan was done staff was focusing on the east side of the river. During that process, members of the public, counselors, and commissioners stated that if you fix up that side and leave the other side as it was it would not be a good thing, so staff has broadened the Riverfront Crossings to the west side of the river. Eastham stated the railroad trestle across Riverfront is an unsightly landmark. His personal preference would be to at some point approve the appearance of that trestle. It was mentioned in the Miller Orchard Neighborhood Improvement plan as well. Ford stated that is privately owned property and if they were a willing partner in wanting to improve that the city would entertain ideas to partner on an improvement. Koppes opened the public hearing. There was none. Koppes closed the public hearing. Payne moved to approve the Riverfront Crossings Renewal Plan for approximately 45 acres of property bordered by Highway 1 on the south, Myrtle Drive on the north, the Iowa River on the east and generally Orchard Street on the west. Weitzel seconded. Koppes asked for discussion. Dyer stated that there wasn't any designation about where the flood plain would be. She asked if any of them would have to be elevated. Ford confirmed that was correct. Hektoen stated that there are other ordinances that guarantee buildings be flood proof or out of the 500 year flood plain. Payne stated that it was helpful to have a better understanding of what blight means and wanted to reiterate that blight doesn't necessarily mean that something is unkempt or disorderly. It can just mean poor traffic flow or something to that effect. Eastham stated that to him the term blight as it is defined by the statute it does not apply to a number of the businesses and properties in the proposed urban renewal area. There are a number of businesses that are quite attractive. Miklo stated that blight is usually bad but it is often not of the making of the property owner. Payne stated that it did not necessarily mean the property owner. Weitzel stated that this area has always been gritty but this area from the tornado and the flood has really contributed to the declining trends. Koppes stated that she was excited that something is going to get done to this area. The TIF district gives some options for business owners to redevelop and to put new businesses there. Payne stated that it was a gateway into the city and it could use some beautification. A vote was taken and the motion carried 6 -0, (Freerks excused). In order to make developm nt sites attractive to ne and expanding businesses, communities are frequently ailed upon to provide financ 1 incentives and programs. Other development sites in e metro area, which already cat to commercial and office uses, make tax increment financing available to qualifying sinesses. The City has identified the Riverfront ossings Urban Renewal Area to be a lighted area, as defined by Iowa Code 403.17 ( 011). It is in the interest of its citize to provide financial incentives and program in order to encourage blight remediation and revitalization of such areas. Redevelopment of p t perty within the the Riverfront Crossings Urban R newal Area was of particular inter to residents of the Miller Orchard neighborhoo due west of Riverside Drive d ring the planning of the Miller Orchard Neighborhood P n in the Fall of 2008 and Spring of 2009. Residents of the neighborhood expressed desire for reinvestment in the Riverside commercial area, with better streetscapes and landscapes and increased diversity of businesses. Commercial redevelopment of this area would coincide with the residential neighborhood improvements occurring as part of the Miller 3 Orchard neighborhood plan. The Riverfront Crossings Urban Renewal Plan is one component of broader redevelopment efforts that will eventually encompass the east side of the Iowa River. Those broader redevelopment efforts are planned to include significant investment in new residential, mixed -use and commercial properties. The disinvestment that has plagued the Urban Renewal Area is circular; the decision by existing property owners to not reinvest in their property reduces the likelihood that neighboring property owners will choose to invest. Th cycle, spurred on by the flood of 2008, inadequate lot sizes, poor traffic flow and lac of site accessibility, substantially impairs or arrests the sound growth of this area, onstitutes an economic and social liability in its present condition and use. The Iowa City Comprehensive Plan designates the Urban Renewal Project Area as appropriate for general commercial and residential uses. This Pl '%roposed is consistent with the Iowa City Compre ensive Plan, particularly the Southwict Plan, last amended in 2002. Current a Zoning and Land Uses The Area is curre ly zoned CC -2, as defined by the owa City Zoning Code. The current land use for the prod ct area is commercial.
