NOTICE OF PUBLIC HEARING
Notice is hereby given that a public hearing
will be held by the City Council of Iowa City,
Iowa, at 7:00 p.m. on October 4, 2011, in Harvat
Hall, 410 E. Washington Street, Iowa City, Iowa,
or if said meeting is cancelled, at the next
meeting of the City Council thereafter as posted
by the City Clerk; at which hearing the Council
will consider:
A resolution amending the Comprehensive
Plan to adopt the Riverfront Crossings
District - Sub -area Plan; and
An ordinance amending Title 14, Zoning
Code, paragraph 14- 413- 46 -23, to modify the
standards for vehicle repair uses in the
Intensive Commercial Zone when located
adjacent to a residential zone; and
An ordinance amending Title 14, Zoning
Code, subsection 14-4C-1D, to clarify a
cross - reference regarding off - street parking
located on a separate lot from the use
served and to delete subparagraph 14 -2C-
413-3a., an obsolete provision regarding side
and rear building setbacks in commercial
zones; and
An ordinance amending Title 14, Zoning
Code, Table 2C -2(a), section 14 -2C -6,
section 14 -2C -8, and paragraph 14- 4B -4A -7,
to establish dimensional and commercial
site development standards in the Central
Business Service (CB -2) Zone similar to
standards applied in the other Central
Business Zones, and to clarify and establish
setback and entrance requirements, provide
additional flexibility for parking location, and
modify construction standards to
accommodate upper floor commercial uses
in mixed -use buildings in the Central
Business Zones; and
An ordinance amending Title 14, Zoning
Code, paragraph 14- 2A -6C -4, to allow an
applicant to seek a minor modification to the
single family site development standard that
establishes minimum driveway length; and
An ordinance amending Title 14, Zoning
Code, Article 4A, Use Categories, to add a
new use category entitled, "Building Trade
Uses," and associated amendments to allow
said building trade uses in the CI -1, 1 -1, and
1 -2 zones as permitted uses and in the CC -2
zone as provisional uses and to establish
approval criteria for said provisional uses in
Article 14 -46.

Clerk, City Hall, Iowa City, Iowa. Persons

NOTICE OF A CONSULTATION TO BE HELD BETWEEN THE
CITY OF IOWA CITY, IOWA AND ALL AFFECTED TAXING
ENTITIES CONCERNING THE PROPOSED RIVERFRONT
CROSSINGS URBAN RENEWAL PLAN FOR THE CITY OF
IOWA CITY, IOWA
The City of Iowa City, Iowa will hold a consultation with all affected taxing entities, as
defined in Section 403.17(1A) of the Code of Iowa, as amended, commencing at 10:00 o'clock
A.M. on September 30, 2011, in the City Manager's Conference Room, City Hall, Iowa City,
Iowa, concerning a proposed Riverfront Crossings Renewal Plan, a draft copy of which is on file
in the office of the City Clerk.
Each affected taxing entity may appoint a representative to attend the consultation. The
consultation may include a discussion of the estimated growth in valuation of taxable property
included in the proposed Urban Renewal Area, the fiscal impact of the division of revenue on
the affected taxing entities, the estimated impact on the provision of services by each of the
affected taxing entities in the proposed Urban Renewal Area, and the duration of any bond
issuance included in said Plan.
The designated representative of any affected taxing entity may make written
recommendations for modification to the proposed division of revenue no later than seven days
following the date of the consultation. Wendy Ford, Economic Development Coordinator, as the
designated representative of the City of Iowa City, shall submit a written response to the
affected taxing entity, no later than seven days prior to the public hearing on the proposed
Riverfront Crossings Urban Renewal Plan, addressing any recommendations made by that
entity for modification to the proposed division of revenue.
This notice is given by order of the City Council of the City of Iowa City, Iowa, as
provided by Section 403.5 of the Code of Iowa, as amended.

A PROPOSED RIVERFRONT CROSSINGS URBAN RENEWAL
PLAN FOR A PROPOSED URBAN AREA IN THE CITY OF IOWA
CITY, IOWA
The City Council of the City of Iowa City, Iowa will hold a public hearing before itself at
its meeting on October 4, 2011 which commences at 7:00 P.M. in the Emma J. Harvat Hall, City
Hall, Iowa City, Iowa to consider adoption of a proposed Riverfront Crossings Urban Renewal
Plan (the "Plan ") concerning a proposed Urban Renewal Area in Iowa City, Iowa legally
described as follows:
Beginning at a point on the southeast corner of Sturgis Corner Addition Part Il;
Thence southerly to the centerline of U.S. Highway 6;
Thence westerly along said centerline to its intersection with S. Riverside Drive;
Thence continuing westerly along the centerline of State Highway 1 to a point where it
intersects with the centerline of Orchard Street extended;
Thence northerly along the centerline of Orchard Street to the centerline of the Iowa
Interstate Railroad;
Thence easterly along said railroad centerline to a point that is 190', more or less, west
of the point of intersection of the railroad and the centerline of State Highway1 /Riverside
Drive;
Thence northerly to the north right -of -way line of said railroad;
Thence north 118' to the south right -of -way line of S. Riverside Court;
Thence north 12.5' to the centerline of S. Riverside Court;
Thence west along said centerline to where it intersects with the extension of the west
boundary of property described as follows:

Iowa City, Iowa.
The City of Iowa City, Iowa is the local agency which, if such Plan is approved, shall
undertake the urban renewal activities described in such Plan.
The general scope of the urban renewal activities under consideration in the Plan is to
assist qualified industries and businesses in the Urban Renewal Area through various public
purpose and special financing activities outlined in the Plan. To accomplish the objectives of
the Plan, and to encourage the further development of the Urban Renewal Area, the plan
provides that such special financing activities may include, but not be limited to, the making of
loans or grants of public funds to private entities under Chapter 15A of the Code of Iowa. The
City also may install, construct and reconstruct streets, parking facilities, open space areas and
other substantial public improvement, and may acquire and make land available for
development or redevelopment by private enterprise as authorized by law. The Plan provides
that the City may issue bonds or use available funds for such purposes and that tax increment
reimbursement of such costs will be sought if and to the extent incurred by the City. The Plan
initially proposes specific public infrastructure or site improvement to be undertaken by the City,
but provided that the Plan may be amended from time to time to respond to development
opportunities.
Any person or organization desired to be heard shall be afforded an opportunity to be
heard at such hearing.

Re: Riverfront Crossings Urban Renewal Plan Public Hearing
At the September 6, 2011 Council meeting, Council passed a Resolution of Necessity, setting
into play the process to approve the proposed Riverfront Crossings Urban Renewal Plan and
setting a public hearing on the Plan for October 4, 2011.
The Planning and Zoning Commission reviewed and voted to recommend the plan to City
Council at their meeting on September 15, 2011. The report and recommendation from the
Chair of the Planning and Zoning Commission, along with the minutes of their meeting follow
this memo.
The requisite tax consultation is planned for Friday, September 30, and a report on the outcome
of that meeting will be forthcoming.

Re: Planning and Zoning Commission Review of the Riverfront Crossings Urban
Renewal Area
At its regular meeting of September 15, 2011, the Planning and Zoning Commission reviewed
the Riverfront Crossings Urban Renewal Area Plan for its conformity with the Iowa City
Comprehensive Plan. By a vote of 6 to 0 ( Freerks absent), the Planning and Zoning
Commission found that the Riverfront Crossings Urban Renewal Plan conforms to the Iowa City
Comprehensive Plan. A detailed discussion of the Commission's review is contained in the
September 15, 2011 meeting minutes (attached).

URBAN RENEWAL PLAN:
Discussion of the Riverfront Crossings Urban Renewal Plan for approximately 45 acres
of property bordered by Highway 1 on the south, Myrtle Drive on the north, the Iowa
River on the east and generally Orchard street on the west.
Ford stated that the Commission's job on this agenda item is to review the Riverfront Crossings
Urban Renewal Plan for its conformance with the Comprehensive Plan and to submit a
recommendation to City Council. The purpose of an urban renewal plan is to provide a vision
and to enable the possibility of city- assisted development and public improvement projects
through the use of TIF. Public projects in this case might include things such as beautification
of the Riverside Drive commercial corridor, connecting the trail system along the river, and fixing
conditions that impair the environmental or economic health of the community.
Ford stated that an Urban Renewal Plan can be established for the purposes of economic
development or slum or blight. This area was beginning to show the signs of blight before the
flood of 2008 which worsened existing conditions and added new one. Blight tends to lead to
the disinvestment of the area, drawing down property values and slowing the growth of the city.
It can be a liability physically, economically and socially. In an analysis of the properties in the
area it was revealed that there was a significant finding of blight which merits the establishment
of Urban Renewal Plan for blight purposes.
Ford stated that there are slides to show the type of condition meriting the blight designation
and the language from the Iowa code that is used to describe blight in this case. One of the
conditions is defective or ineffective street layout. Ford pointed out on the slide the various
street layout issues. Another condition in the definition of blight is a faulty layout in relation to
the size, adequacy, accessibility, or usefulness of a lot.
Ford stated the plan appears to be in conformity with both the 2002 Southwest District Plan and
the Comprehensive Plan.
Payne asked why this area is to be included in the Riverfront Crossings area and why was it this
area that was picked to do first over other areas on the other side of the river. Miklo answered
the first question by stating that when the first round of the Riverfront Crossing Plan was done
staff was focusing on the east side of the river. During that process, members of the public,
counselors, and commissioners stated that if you fix up that side and leave the other side as it
was it would not be a good thing, so staff has broadened the Riverfront Crossings to the west
side of the river.
Eastham stated the railroad trestle across Riverfront is an unsightly landmark. His personal
preference would be to at some point approve the appearance of that trestle. It was mentioned
in the Miller Orchard Neighborhood Improvement plan as well. Ford stated that is privately
owned property and if they were a willing partner in wanting to improve that the city would
entertain ideas to partner on an improvement.
Koppes opened the public hearing.

Payne moved to approve the Riverfront Crossings Renewal Plan for approximately 45
acres of property bordered by Highway 1 on the south, Myrtle Drive on the north, the
Iowa River on the east and generally Orchard Street on the west.

Koppes asked for discussion.
Dyer stated that there wasn't any designation about where the flood plain would be. She asked
if any of them would have to be elevated. Ford confirmed that was correct. Hektoen stated that
there are other ordinances that guarantee buildings be flood proof or out of the 500 year flood
plain.
Payne stated that it was helpful to have a better understanding of what blight means and
wanted to reiterate that blight doesn't necessarily mean that something is unkempt or disorderly.
It can just mean poor traffic flow or something to that effect.
Eastham stated that to him the term blight as it is defined by the statute it does not apply to a
number of the businesses and properties in the proposed urban renewal area. There are a
number of businesses that are quite attractive. Miklo stated that blight is usually bad but it is
often not of the making of the property owner. Payne stated that it did not necessarily mean the
property owner. Weitzel stated that this area has always been gritty but this area from the
tornado and the flood has really contributed to the declining trends.
Koppes stated that she was excited that something is going to get done to this area. The TIF
district gives some options for business owners to redevelop and to put new businesses there.
Payne stated that it was a gateway into the city and it could use some beautification.
A vote was taken and the motion carried 6 -0, (Freerks excused).

Section I- Introduction
This Riverfront Crossings Urban Renewal Plan ( "Plan ") for the Riverfront Crossings
Urban Renewal Area ( "Urban Renewal Area" or "Area ") has been developed to help
local officials reduce blighted areas and promote economic development within Iowa
City, Iowa. The primary goal of the plan is to stimulate, through public involvement and
commitment, private investment in the revitalization of I he Riverfront Crossings Urban
Renewal Area.
The goals outlined in this Riverfront Crossings Ur an Renewal Plan include the
following, which inc l e goals detailed in the Iowa Cit Comprehensive Plan — 1997, as
amended:

In order to make developm nt sites attractive to ne and expanding businesses,
communities are frequently ailed upon to provide financ 1 incentives and programs.
Other development sites in e metro area, which already cat to commercial and office
uses, make tax increment financing available to qualifying sinesses. The City has
identified the Riverfront ossings Urban Renewal Area to be a lighted area, as defined
by Iowa Code 403.17 ( 011). It is in the interest of its citize to provide financial
incentives and program in order to encourage blight remediation and revitalization of
such areas.
Redevelopment of p t perty within the the Riverfront Crossings Urban R newal Area was
of particular inter to residents of the Miller Orchard neighborhoo due west of
Riverside Drive d ring the planning of the Miller Orchard Neighborhood P n in the Fall
of 2008 and Spring of 2009. Residents of the neighborhood expressed desire for
reinvestment in the Riverside commercial area, with better streetscapes and landscapes
and increased diversity of businesses. Commercial redevelopment of this area would
coincide with the residential neighborhood improvements occurring as part of the Miller

Orchard neighborhood plan.
The Riverfront Crossings Urban Renewal Plan is one component of broader
redevelopment efforts that will eventually encompass the east side of the Iowa River.
Those broader redevelopment efforts are planned to include significant investment in new
residential, mixed -use and commercial properties.

The Urban Renewal Area is located within the area designated by the Iowa City
Comprehensive Plan as the Southwest Planning District. The Iowa City Comprehensive
Plan designates the Urban Renewal Project Area as appropriate for general commercial
and residential uses.
This Pl '%roposed is consistent with the Iowa City Compre ensive Plan, particularly the
Southwict Plan, last amended in 2002.
Current a Zoning and Land Uses
The Area is curre ly zoned CC -2, as defined by the owa City Zoning Code. The current
land use for the prod ct area is commercial. The pr osed land uses include retail, office,
and other commercia\nRiverside mitted in the CC -2 ones. The City may amend its zoning
code to create a nn Review Distri t and /or a new, mixed -use zoning
classification approp Drive and may rezone the area to be so
designated. Any rezois area, includin the creation of a new zoning category
under the Zoning Coconsistent with e Comprehensive Plan.
Section 8- Relocation
The City does not expect there to be a re cation required of residents or businesses as
part of the proposed urban renewal prod c ; however, if any relocation is necessary, the
City will follow all applicable relocation r uirements.

acquisition and disposition provisions.
If the City of Iowa City desires to amend this Urb Renewal Plan, it may do so after
providi g public notice, holding a public hea ng on the proposed change, and
undertak' g other required actions, all in confo ance with applicable state and local
laws.
Section 11 - roperty Acquisition /Disp sition
The City may pro ide incentives for land ac isition in the Area. The City will follow
applicable procedur for the acquisition and isposition of property.
Section 12 - Effective Period
This Urban Renewal Plan w become eff ctive upon its adoption by the City Council of
Iowa City and will remain in e ect as a p an until it is repealed by the City Council. The
use of tax increment financing r enues including the amount of grants, loans, advances,
indebtedness or bonds which qual fo payment for the division of revenue provided in
Section 403.19 of the Code of Iowa) b the City for activities carried out under the Urban
Renewal Plan is not limited due to th designation of the area as blight. However, the use
of tax increment financing incenti es hall be limited as deemed appropriate by the
