CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN (- 3aq AND THE CITY CLERK TO ATTEST TO THE PARTIAL RELEASE OF MORTGAGE FOR THE PROPERTY LOCATED AT 3410 SHAMROCK DRIVE, IOWA CITY, IOWA. Comment: The owners bought the property in 2005 through the Tenant to Ownership Program. As part of the purchase, the City granted the owner a loan which is secured by a mortgage. The owner recently paid off the loan. There are additional restrictions (e.g., the home must be owner occupied) contained in a Resale and Occupancy Agreement, which the mortgage also secures, that remain on the property for 15 years from the date of the sale. This resolution provides for only a partial release of the City's mortgage to reflect that the loan has been paid but that the other obligations remain. 2. CONSIDER A RESOLUTION ACCEPTING THE DEDICATION OF AND i t - 33a AUTHORIZING THE MAYOR TO ENTER INTO A TEMPORARY CONSTRUCTION EASEMENT AGREEMENT AND PERMANENT STORM SEWER AND DRAINAGE EASEMENT AGREEMENT FOR LOT 28, TUDOR PARK, PART TWO, IOWA CITY, JOHNSON COUNTY, IOWA. Comment: An existing storm sewer terminates in the back of Lot 28 of Tudor Park, Part Two approximately 40' short of the downstream boundary of Tudor Park, Part Two. It is necessary to obtain a temporary construction easement in order to install and extend the storm from its current terminus and connect to the storm sewer system constructed for Boyd's Fashionable Acres. (SECOND CONSIDERATION) Comment: At their meeting on July 7, 2011, on a vote of 5 -0 (Plahutnik and Payne absent), the Planning and Zoning Commission recommended approval of this zoning code amendment. Staff recommended approval in a memo dated July 7, 2011. Approval of this amendment will reduce the number of nonconforming auto repair shops in the CI -1 Zone by establishing restrictions on outdoor work activities and noise standards for any indoor work activities during night -time hours in lieu of the current 100 -foot separation requirement between auto repair uses in the CI -1 Zone and residential zones. Approval of these amendments will distinguish these uses from more intensive Industrial Service Uses and expand the location opportunities for offices and accessory storage and fabrication facilities associated with building contractors, such as plumbers, electricians, heating and air conditioning contractors and similar that would be classified within this new category. Action: J) CONSIDER A RESOLUTION APPROVING AN AMENDMENT TO THE 1 l- 33a SUBDIVIDER'S AGREEMENT REGARDING REQUIREMENTS FOR ESCROW ACCOUNTS AND SECONDARY STREET ACCESS FOR SADDLEBROOK PART 2. Comment: At its October 6 meeting, by a vote of 7 -0, the Planning and Zoning Commission recommended approval of the proposed changes. Staff recommended approval in a memo dated September. The proposed amendment removes an escrow requirement and obligates the developer to install the remaining extension of Heinz Road prior to issuance of any building permit for any unit abutting Heinz Road. Action: ITEM 7. AUTHORIZING CONVEYANCE OF A SINGLE FAMILY HOME LOCATED AT 1208 EAST BURLINGTON STREET. Comment: The grant for the UniverCity Neighborhood Partnership Program allows the City to purchase twenty -six rental units located in designated neighborhoods surrounding the University, rehabilitate them with up to $50,000 in grant funds, and then sell them to income - eligible buyers. Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 1208 East Burlington Street. The amount of the sale will be $150,000 (this is what the City paid to purchase the home) plus "carrying costs" of approximately $4,500. "Carrying costs" are all the costs incurred by the City to acquire the home, maintain it and sell it, including abstracting and recording fees, interest on the loan to purchase the home, mowing and snow removal, utilities, real estate taxes, and any costs in excess of $50,000 to repair and rehabilitate the home. AUTHORIZING CONVEYANCE OF A SINGLE FAMILY HOME LOCATED AT 329 DOUGLASS COURT. The amount of the sale will be $60,000 (this is what the City paid to purchase the home) plus "carrying costs" of approximately $12,000. DETERMINING THE RIVERFRONT CROSSINGS URBAN RENEWAL AREA OF THE CITY TO HAVE CONDITIONS OF BLIGHT AND THAT THE REHABILITATION, CONSERVATION, REDEVELOPMENT, DEVELOPMENT, OR A COMBINATION THEREOF, OF SUCH AREA IS NECESSARY IN THE INTEREST OF THE PUBLIC HEALTH, SAFETY OR WELFARE OF THE RESIDENTS OF THE CITY; DESIGNATING SUCH AREA AS APPROPRIATE FOR AN URBAN RENEWAL PROJECT; AND ADOPTING THE RIVERFRONT CROSSINGS URBAN RENEWAL PLAN THEREFOR. Comment: The proposed Riverfront Crossings Urban Renewal Plan has been prepared for approximately 44 acres. The proposed plan, as required by state law, has been reviewed for its conformity with the Comprehensive Plan for Iowa City by the Planning and Zoning Commission, who voted to recommend the plan at their regular meeting on September 15, 2011. The required consultation with the other taxing entities in the county will be held Sept. 30, 2011. Adopting the proposed plan is the first step in establishing a tax increment financing district for the urban renewal area. This public hearing was continued to October 18 to allow the required public comment period to lapse prior to action, and a report provided on the consultation. October 18, 2011 City of Iowa City a. Action: Page 9 APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE COURT HILL TRAIL — PHASE THREE PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH NOTICE TO BIDDERS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project will extend Court Hill Trail from Scott Boulevard east through Scott Park along Ralston Creek and will connect to an existing trail located within Windsor Ridge Subdivision. The project also includes trail connections to the Dog Park, Court Street, Cumberland Lane and an 8 -foot wide sidewalk along Scott Boulevard adjacent to Scott Park. In addition, the project will include a refuge island in Scott Boulevard, three trail bridges, and other associated improvements. The estimated construction cost is $516,000. The project will be funded 80% by an IDOT National Recreation Trail Grant up to $416,159 and the remaining local share will be funded with General Obligation bond proceeds. a. Adoption of the Towncrest Urban Renewal Plan was the first step, and as such, was approved by the Planning and Zoning Commission as being in conformity with the general plan for development of the City as a whole. Additionally, the required consultation with the other taxing entities in the county was also held. The TIF ordinance allows for new taxes derived from the development of taxable property in the Urban Renewal Project Area to be divided and used for loans, rebates, grants, advances, indebtedness, or bonds payable for projects approved by City Council. (SECOND CONSIDERATION) Comment: The current City Code sets for the composition of the Board of Appeals. Staff recommends that this provision be deleted and that the composition of the Board be set forth in the bylaws, making it consistent with how other boards and commissions composition is established.
