CONSIDER A RESOLUTION APPROVING THE ACCEPTANCE OF THE DEDICATION OF OUTLOTS "A" AND "B" OF FIRST AND ROCHESTER, PART FOUR, IOWA CITY, JOHNSON COUNTY, IOWA, AS PUBLIC OPEN SPACE. Comment: Pursuant to Council's approval of the Final Plat of First and Rochester, Part Four, and the associated Subdivider's Agreement, the Developer was to dedicate Outlots A and B after it completed the necessary improvements to the subdivision, restored any disturbed area of the Outlot to its pre- construction condition, established erosion control and completed development on 90% of the lots abutting the outlots. The Parks and Recreation and Public Works Departments have inspected these outlots and agree that they are suitable for the City to accept dedication at this time. �1.3 2. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING A MORTGAGE FOR THE PROPERTY LOCATED AT 227 N. DUBUQUE STREET, IOWA CITY, IOWA. Comment: The owners of the property located at 227 N. Dubuque Street received assistance through the City of Iowa City's Community Development Block Grant funds. CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON AMENDING THE FY2012 OPERATING BUDGET. Comment: This resolution sets a public hearing for November 22, 2011, to amend the FY2012 Operating Budget. Information will be available to the public on November 10, 2011. 2. CONSIDER A RESOLUTION SETTING PUBLIC HEARING FOR NOVEMBER 22, 2011, ON A PROPOSAL TO CONVEY LOT 17 IN THE NORTH AIRPORT SUBDIVISION. Comment: Affordable Auto, LLC wishes to enter into a 25 -year ground lease with the Iowa City Airport Commission for lot 17 in the North Airport Subdivision (a /k/a Aviation Commerce Park). Affordable Auto, LLC further wishes to enter into an agreement with the City for an option to purchase Lot 17 during the 25 years. The proposed purchase price is the current listing price of $230,000 that will increase every year based on the annual average of the CPI for all urban consumers. 3. CONSIDER A RESOLUTION SETTING PUBLIC HEARING FOR NOVEMBER 22, 2011, ON A PROPOSAL TO CONVEY A SINGLE FAMILY HOME LOCATED AT 1025 EAST BLOOMINGTON STREET. Comment: The grant for the UniverCity Neighborhood Partnership Program allows the City to purchase twenty -six rental units located in designated neighborhoods surrounding the University, rehabilitate them with up to $50,000 in grant funds, and then sell them to income - eligible buyers. Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 1025 East Bloomington Street. The amount of the sale will be $145,000 (this is what the City paid to purchase the home) plus the "carrying costs," which are which are all costs incurred by the City to acquire the home, maintain it and sell it, including abstracting and recording fees, interest on the loan to purchase the home, mowing and snow removal, utilities, real estate taxes, and any costs in excess of $50,000 to repair and rehabilitate the home. f) Motions: 1. C) Comment: At its October 6 meeting, by a vote of 5 -2 (Koppes and Plahutnik no), the Planning and Zoning Commission recommended approval of the proposed amendment. (REZ11- 00013) (SECOND CONSIDERATION) Comment: At its September 15 meeting, by a vote of 6 -0 (Freerks absent), the Planning and Zoning Commission recommended approval of this rezoning. Staff recommended approval in a report dated September 15. Approval will allow five additional ground floor residential units in lieu of commercial space and remove the requirement to build 20 garage spaces shown on the original approved plan. Action: AMENDING TITLE 3, "FINANCE, TAXATION AND FEES" OF THE CITY CODE TO ADD A NEW CHAPTER ESTABLISHING THE IOWA CITY DOWNTOWN SELF - SUPPORTIED MUNICIPAL IMPROVEMENT DISTRICT ( SSMID) PURSUANT TO THE PROVISIONS OF CHAPTER 386, CODE OF IOWA; AND PROVIDING FOR THE ESTABLISHMENT OF AN OPERATION FUND AND THE LEVY OF AN ANNUAL TAX IN CONNECTION THEREWITH. Comment: A petition to create a SSMID was received on August 25, 2011 and it met the statutory requirements for the City Council to forward the petition to the Planning and Zoning Commission for their review. A SSMID is a self- imposed additional taxing district that will levy a tax on the properties within the specified district. The duration for the SSMID is 4 years and the requested levy is $2 per $1000 of valuation. The funds will be used for developing and managing business retention and attraction, creating and running special events, and expansion of the Park & Shop /Bus & Shop program. CONSIDER A RESOLUTION RESCINDING THE 2005 PERSONNEL POLICIES AND THE 1981 AFFIRMATIVE ACTION POLICY AND ESTABLISHING AMENDED PERSONNEL POLICIES. Comment: The existing Personnel Policies have been updated to reflect legislative changes, provide affirmative methods to eliminate barriers to employment and meet present day needs. In conjunction with the Personnel Policies update and based upon a legal review of recent court decisions which favor equal employment opportunity policies rather than status -based employment programs that consider demographic characteristics as a favorable point in employment decisions, staff recommends rescission of the 2005 Personnel Policies and of the 1981 Affirmative Action policy and adoption of amended Personnel Policies. CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CONTRACT FOR CONSTRUCTION OF THE WATER WORKS PRAIRIE PARK FLOOD MITIGATION PROJECT. (deferred from October meeting) Comment: Bids for this project were opened on Thursday, October 13, 2011, and the following bids were received: Advanced Electrical Services, Inc. Iowa City, IA $ 448,000.00 Calacci Construction Co. Iowa City, IA $ 470,100.00 Wendler Construction Amana, IA $ 482,150.00 Woodruff Construction Fort Dodge, IA $ 524,657.00 Tricon General Construction Dubuque, IA $ 470,100.00 Engineer's Estimate $ 428,000.00 Public Works and Engineering recommend award of the contract to Advanced Electrical Services, Inc. of Iowa City, Iowa. The project will be funded with Hazard Mitigation Grant Program proceeds and Water revenues. Action: ITEM 12. CONSIDER A RESOLUTION APPROVING A CONTRACT WITH JOHNSON II- 35 COUNTY FOR LIBRARY SERVICES TO RURAL RESIDENTS. s a 5e,ot� Comment: Johnson County currently contracts with multiple public libraries to provide library services to rural residents. The County has recently reviewed and proposed changes to the contract. The County payment is based on use that rural residents make of the Iowa City Public Library, as measured by circulation figures. The Library Director recommends approval of the contract.
