Comment: University of Iowa Community Credit Union has requested that the City approve a Subordination Agreement for property at 1422 Plum Street. The owner of the property received funding from the City of Iowa City for Housing Rehabilitation project. The subordination will not change the City's current position, that is, it will remain in second position and inferior to the owner's primary lender. �� _ 3•�cj 2. CONSIDER A RESOLUTION SETTING A NEW DATE FOR RECEIPT OF BIDS FOR THE BIDDING OF THE COURT HILL TRAIL — PHASE THREE NRT- 3715(649)- -9G -52 PROJECT, AND DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: The project's bid date has been rescheduled to March 20, 2012 to allow additional details to be added to the plans and specifications as required by the IDOT. The estimated construction cost is $531,000 and will be funded 80% by an IDOT National Recreation Trail Grant up to $416,159 and the remaining local share will be funded with General Obligation bond proceeds. CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE IOWA CITY MERCER PARK AQUATIC CENTER POOL FILTER REPLACEMENT PROJECT. Comment: The project has been completed by Aqua Logic, Inc. of Waconia, Minnesota, in substantial accordance with the plans and specifications. The Engineer's Report and Performance and Payment bonds are on file with the City Clerk. Comment: The grant for the UniverCity Neighborhood Partnership Program allows the City to purchase twenty -six rental units located in designated neighborhoods surrounding the University, rehabilitate them with up to $50,000 in grant funds, and then sell them to income - eligible buyers. Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 410 Douglass Street. The amount of the sale will be $105,000. f) Motions: 1. Staff recommended approval in a report dated October 20, 2011. Approval of this rezoning will allow redevelopment of the property for multi - family dwellings. Approval will allow the development of Mackinaw Village Part 4 a 16 -lot, 3.84 -acre residential subdivision located at Mackinaw Drive and Foster Road. Action: -5 �,i G1,. ITEM 7. APPROVING A PURCHASE AGREEMENT BETWEEN THE CITY OF IOWA CITY AND IOWA VALLEY HABITAT FOR HUMANITY FOR 1443 PRAIRIE DU CHIEN ROAD AND TO CONSIDER A PROPOSAL TO CONVEY SAID PROPERTY. Comment: The City acquired 1443 Prairie Du Chien Road through the abandoned property provision under state law. The nuisance property had been empty for years. Iowa Valley Habitat for Humanity has offered to buy the property for $30,000, which is the amount the City paid to acquire the property including clean- up and other maintenance costs. AMENDING IOWA CITY'S 2011 -2015 CONSOLIDATED PLAN (A.K.A. CITY STEPS). Comment: The U.S. Department of Housing and Urban Development requires an annual public review of the CITY STEPS plan. The Housing and Community Development Commission recommended that the priority for "Transportation Services" be raised from a "medium" priority to a "high" priority. The 30 day public comment period started on November 4, 2011 and will end on December 6, 2011. No public comments have been received to date. a. APPROVING A PURCHASE AGREEMENT BETWEEN THE CITY OF IOWA CITY AND DEERY DEERY AND DEERY LLC FOR LOTS 16 AND 17 OF THE NORTH AIRPORT DEVELOPMENT SUBDIVISION WITH AN OPTION TO PURCHASE LOTS 13 -15 AND AUTHORIZING CONVEYANCE IN ACCORDANCE THEREWITH. Comment: The North Airport Development Subdivision includes commercial lots, which have been marketed for sale to the general public. The City has negotiated a purchase agreement with Deery Deery and Deery LLC which requires City Council approval. The purchase agreement provides that buyer will purchase Lot 17 for $235,000 and Lot 16 for $165,000. The offer also includes an option to purchase Lots 13, 14, and 15 for $165,000 each within 180 days. The Airport Commission recommends approval. TO DISCLAIM ANY INTEREST IN THE IOWA CITY COMMUNITY SCHOOL DISTRICT'S CENTRAL ADMINISTRATIVE OFFICE LOCATED AT 509 SOUTH DUBUQUE STREET, IOWA CITY, JOHNSON COUNTY, IOWA. i( -3'Ra Comment: The Iowa City Community School District is selling its property at 509 South Dubuque Street to the University of Iowa. This item and the public hearing being set will clear up an identified title objection arising from the transfer of responsibility and authority for operating schools from the City to the school district in 1858 as a matter of law. APPROVING PROCEEDING WITH THE ISSUANCE AND SALE OF NOT TO EXCEED $1,832,000 AGGREGATE PRINCIPAL AMOUNT OF MIDWESTERN DISASTER AREA REVENUE BONDS (EPS PROPERTIES LLC PROJECT) SERIES 2011 OF THE CITY OF IOWA CITY, IOWA, AND RELATED MATTERS. Comment: Under Iowa Code Chapter 419, a City may issue a special limited obligation revenue bond and agree to loan the proceeds of the bond to a private business for a qualifying project. The obligation of the Issuer is limited and the obligation on the bond is not an indebtedness of the Issuer within the meaning of any debt limit, nor does it constitute or give rise to a pecuniary liability of the Issuer to become a charge against its general credit or taxing powers. By participating in a Midwestern Disaster Area bond financing, the City of Iowa City provides an opportunity for a business project to be realized at a lower cost of financing. Any expense of the City with respect to a bond financing is paid by the borrower, in this case, EPS Properties LLC. CONSIDER AN ORDINANCE AMENDING TITLE 3, "FINANCE, TAXATION AND FEES" OF THE CITY CODE TO ADD A NEW CHAPTER ESTABLISHING THE IOWA CITY DOWNTOWN SELF - SUPPORTIED MUNICIPAL IMPROVEMENT DISTRICT ( SSMID) PURSUANT TO THE PROVISIONS OF CHAPTER 386, CODE OF IOWA; AND PROVIDING FOR THE ESTABLISHMENT OF AN OPERATION FUND AND THE LEVY OF AN ANNUAL TAX IN CONNECTION THEREWIT (PASS AND ADOPT) C[14 . r Dic1� --X_5 A� Comment. A petition to create a SSMID was received on August 25, 2011 and it me the statutory requirements for the City Council to forward the petition to the Planning and Zoning Commission for their review. A SSMID is a self- imposed additional taxing district that will levy a tax on the properties within the specified district. The duration for the SSMID is 4 years and the requested levy is $2 per $1000 of valuation. The funds will be used for developing and managing business retention and attraction, creating and running special events, and expansion of the Park & Shop /Bus & Shop program. Funds will also be used for physical or other improvements designed to improve the image and appearance of downtown. As of November 28, signatures for a petition opposing the SSMID have been submitted representing 24.5% of the owners and 19.5% of the property value. CON IDER AN ORDINANCE AMENDING TITLE 4, ALCOHOLIC BEVERAGES, CHAPTER 5, PROHIBITIONS AND RESTRICTIONS, SECTION 8, PERSONS UNDER THE LEGAL AGE IN LICENSED OR PERMITTED ESTABLISHMENTS, SUBSECTION B, TO AMEND THE REQUIREMENTS FOR NON -BAR AND ENTERTAINMENT VENUE EXCEPTIONS. (FIRST CONSIDERATION) Comment: These amendments will add several requirements to the "non -bar' exceptions to the Under 21 ordinance. They include the ability to require an audit, at the applicant's expense, to verify qualification, imposition of a PAULA ratio of .25, creation of a revocation and appeal procedure, requirement for sufficient staffing, and limitation to one "new business" exception every three years. The PAULA ratio and calculation protocol will be set by resolution. Action: ITEM 14. CONSIDER A RESOLUTION APPROVING ECONOMIC DEVELOPMENT PROCESS AND POLICIES. Comment: Staff has prepared a document recommending a formalized set of economic development policies and procedures. The City Council Economic Development Committee reviewed it at their meetings on October 18 and November 8, 2011 and concurred to forward the recommendations to City Council for approval. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST AN AGREEMENT WITH THE IOWA DEPARTMENT OF CULTURAL AFFAIRS FOR A GRANT FROM THE IOWA GREAT PLACES PROGRAM. Comment: This is a $13,000 grant project for an interpretation panel /sign for the Literary Walk. Grant funds awarded are $9,100. The local cash match is $2,900 which is available in the Northside Marketplace capital improvements fund. Action: lU/ u'l n / At, �r s /C ITEM 16. CONSIDER A RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE 11 - 39 b MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AN AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND MMS CONSULTANTS, INC. TO PROVIDE ENGINEERING CONSULTANT SERVICES FOR THE EAST SIDE LEVEE PROJECT. Comment: This agreement provides for the preliminary and final design, and bidding and construction services for the East Side Levee Project. This project will construct a levee along the eastern side of the Iowa River from US Highway 6 south to the CRANDIC railroad bridge and will improve flood protection for critical public infrastructure and businesses in the South Gilbert Street Corridor. The negotiated contract amount is $366,750 and will be funded by a Community Development Block Grant. Action:© 7� ITEM 17. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST DONATION AGREEMENTS FOR ACCEPTANCE OF "BOOKMARK" SCULPTURES UPON THE RECOMMENDATION OF THE PUBLIC ART ADVISORY COMMITTEE. Comment: A recent public art initiative included the creation and installation of "Bookmark" sculptures in public spaces throughout the City, which sculptures were auctioned to private parties at the end of the program. Several purchasers of these sculptures wish to donate them to the City for further public display and /or use. This Resolution authorizes the Mayor to sign and the City Clerk to attest donation agreements for acceptance of "Bookmark" sculptures upon the recommendation of the public art advisory committee. CONSIDER A RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AN AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND DAVIS, BROWN, KOEHN, SHORS & ROBERTS, P.C. TO PROVIDE LOBBYING SERVICES. Comment: A Request for Proposal (RFP) was solicited for lobbying services, and seven proposals were received. An evaluation committee convened to evaluate the RFP's submitted, and final candidates were selected based on a scored point system. After conducting and evaluating candidate interviews, the evaluation committee forwarded two candidates for final selection. The City Manager made the final selection and recommendation to Council.
