ITEM 5d(1) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE
CITY CLERK TO ATTEST THE SECOND AMENDMENT TO THE LISTING
AGREEMENT WITH SKOGMAN REALTY FOR AVIATION COMMERCE PARK TO
EXTEND THE TERM.
Comment: The listing agreement to sell and lease the property known as Aviation
Commerce Park, aka North Airport Subdivision, executed by the Airport Commission,
the City Council, and Skogman Realty expired on December 31, 2011. This amendment
extends the term for another year. The Airport Commission approved the amendment at
its meeting on December 15, and draft minutes are in the January 5, 2012 information
packet.
ITEM 5d(2) CONSIDER A RESOLUTION AUTHORIZING THE IOWA CITY HOUSING
AUTHORITY TO RETURN A DISASTER GRANT IN THE AMOUNT OF $56,725 TO
THE FEDERAL DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT
(HUD) RECEIVED FOR THE RECONSTRUCTION OF THE PUBLIC HOUSING
UNIT LOCATED AT 608 EASTMOOR, IOWA CITY, IOWA, WHICH WAS
DAMAGED IN THE FLOOD OF 2008.
Comment: The HUD Disaster Funds were made available for the reconstruction of the
Public Housing unit located at 608 Eastmoor, Iowa City, Iowa that was damaged in the
flood of 2008. The City of Iowa City submitted and received federal Community
Development Block Grant funds, administered by the Iowa Department of Economic
Development, to buyout substantially damaged residential properties in the Parkview
Terrace neighborhood located in the 500 -year floodplain. 608 Eastmoor is located within
the Parkview Terrace neighborhood and because it is the City of Iowa City's intent not to
support any construction of new housing in the Parkview Terrace neighborhood, the
Housing Authority cannot rebuild the Public Housing unit on the 608 Eastmoor site. HUD
requires a Resolution to return the funds. Additional information in staff memorandum.

ITEM 5d(3) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE
CITY CLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING A
MORTGAGE FOR THE PROPERTY LOCATED AT 415 N GOVERNOR STREET,
IOWA CITY, IOWA.
Comment: The owner of the property located at 415 N Governor Street received
assistance through the City of Iowa City's Housing Rehabilitation Program. The loan
has been paid off; thus the lien needs to be released.
ITEM 5d(4) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE
CITY CLERK TO ATTEST TO A SUBORDINATION AGREEMENT BETWEEN THE
CITY OF IOWA CITY AND UNIVERSITY OF IOWA COMMUNITY CREDIT UNION,
IOWA CITY, IOWA FOR PROPERTY LOCATED AT 59 REGAL LANE, IOWA CITY,
IOWA.
Comment: University of Iowa Community Credit Union has requested that the City
approve a Subordination Agreement for property at 59 Regal Lane. The owner of the
property received funding from the City of Iowa City for Housing Rehabilitation project.
The subordination will not change the City's current position, that is, it will remain in
second position and inferior to the owner's primary lender.
ITEM 5d(5) CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE IOWA CITY
Id- ? POLICE STORAGE PROJECT.
Comment: The project has been completed by Tricon General Construction of Dubuque,
Iowa, in substantial accordance with the plans and specifications. The Engineer's
Report and Performance and Payment bonds are on file with the City Clerk.
Project Estimated Cost: $ 271,500.00
Project Bid Received: $ 331,900.00
Project Actual Cost: $ 364,953.84
ITEM 5d(6) CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE IOWA RIVER
TRAIL - NAPOLEON TO TRUEBLOOD PROJECT.

Comment: The project has been completed by Metro Pavers, Inc. of Iowa City, Iowa, in
substantial accordance with the plans and specifications. The Engineer's Report and
Performance and Payment bonds are on file with the City Clerk.

Project Actual Cost: $ 180,154.13
ITEM 5d(7) CONSIDER A RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE
MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A TEMPORARY
CONSTRUCTION EASEMENT AGREEMENT BY AND BETWEEN THE CITY OF
IOWA AND MOKA JAVA LLC.
Comment: This resolution authorizes Moka Java LLC to utilize a portion of the Black
Hawk Park adjacent to 207 Washington Street for the placement of scaffolding to
facilitate the replacement of windows at the building. An agreement was previously
authorized by Council for use in December 2011, but the contractor experienced delays
due to the delivery of materials and has requested that the dates be changed.

ITEM 5d(8) CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE COLLEGE
/,9-/o GREEN PARK LIGHTING REPLACEMENT PROJECT.
Comment: The Engineering Division recommends work for construction of the College
Green Park Lighting Replacement Project, as contracted for between the City and
Advanced Electrical Services of Iowa City, be accepted. The Engineer's Report and the
performance and payment bond are on file in the City Clerk's office and funds for this
project are available in the College Green Lighting Replacement Project Account #4172.
This Resolution accepts the work under the contract.
ITEM 5e. Setting Public Hearings:
ITEM 5e(1) CONSIDER A RESOLUTION SETTING PUBLIC HEARING FOR JANUARY 24, 2012,
ON A PROPOSAL TO CONVEY A SINGLE FAMILY HOME LOCATED AT 317
.--� DOUGLASS COURT.
Comment: The grant for the UniverCity Neighborhood Partnership Program allows the
City to purchase twenty -six rental units located in designated neighborhoods
surrounding the University, rehabilitate them with up to $50,000 in grant funds, and then
sell them to income - eligible buyers. Under the UniverCity Neighborhood Partnership
Program, the City proposes to sell 317 Douglass Court. The amount of the sale will be
$88,000 (this is what the City paid to purchase the home) plus the "carrying costs," which
are which are all costs incurred by the City to acquire the home, maintain it and sell it,
including abstracting and recording fees, interest on the loan to purchase the home,
mowing and snow removal, utilities, real estate taxes, and any costs in excess of
$50,000 to repair and rehabilitate the home.
ITEM 5e(2) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON JANUARY 24,
2012 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF
�a �2 COST FOR THE CONSTRUCTION OF THE WASTEWATER TREATMENT
FACILITIES CONSOLIDATION PROJECT, DIRECTING CITY CLERK TO PUBLISH
NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE
SAID PLANS ON FILE FOR PUBLIC INSPECTION.
Comment: This project will expand the South Wastewater Treatment Facility allowing the
flood prone North Wastewater Facility to be eliminated. The North Wastewater Facility
site will eventually be converted to parkland as part of the Riverfront Crossings. The
expansion of the South Facility will also provide additional capacity for growth and better
position the City for potential future water quality regulations. Operational efficiencies will
also be realized. The estimated cost of this facility is $39.7M and will be funded with a
$22,000,000 grant from the US Economic Development Agency (EDA), a $5,000,000
Community Development Block Grant and two I -Jobs Grants with a combined minimum
total of $5,495,293. The project will also be funded with Local Option Sales Tax
revenue.

COST FOR THE CONSTRUCTION OF THE HIGHWAY 218 AND MELROSE
AVENUE TRAFFIC SIGNALIZATION PROJECT, DIRECTING CITY CLERK TO
PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER
TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION.
Comment: This project will install a new traffic signal at the intersection of the Highway
218 southbound ramps and Melrose Avenue. The estimated construction cost of this
project is $111,000 and will be funded with U -STEP Grant proceeds and General
Obligation Bond proceeds.
ITEM 5e(4) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON JANUARY 24,
2012 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF
COST FOR THE CONSTRUCTION OF THE NORTH MARKET SQUARE PARK
PAVILION PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID
HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON
FILE FOR PUBLIC INSPECTION.
Comment: This project involves the installation of a new park pavilion at North Market
Square Park and includes the installation of the pavilion along with new infrastructure
such as sidewalk pavement, pavilion foundations, and lighting. The estimated cost for
this project is $102,585 and will be funded with General Obligation bond proceeds.
ITEM 5f. Motions:
ITEM 5f(1) CONSIDER A MOTION TO APPROVE DISBURSEMENTS IN THE AMOUNT OF
$12,190,909.93 FOR THE PERIOD OF NOVEMBER 1 THROUGH NOVEMBER 30,

Comment: At its December 15 meeting, by a vote of 7 -0, the Planning and Zoning Commission
recommended approval of this Comprehensive Plan amendment. Approval will modify the

historic properties are not planned for redevelopment.

Comment: At its December 1 meeting, by a vote of 0 -5 (Payne abstained), the Planning and
Zoning Commission recommended denial of this rezoning. In a staff report dated November 17
staff recommended approval subject to a Conditional Zoning Agreement that ensures that design
of the building will be consistent with the submitted drawings and that it contains an appropriate
mix of apartment sizes as reflected in the number of bedrooms and associated living spaces to
ensure a quality living environment as determined by the Commission and the Council. Approval
will allow this property to be developed with a 15 -unit apartment building.

Comment: In response to the joint meeting of the Planning and Zoning Commission and City
Council, the applicant has submitted a revised plan. Two of the 2- bedroom apartments have
been replaced with 1- bedroom apartments. The northwest corner of the building has been
reduced from three floors to two floors. All of the apartments will be designed to be accessible
to persons with disabilities. The drawings attached to the Conditional Zoning Agreement
illustrate the revisions. This item was continued and deferred from the December 6 Council
meeting.

Comment: At their meeting on October 20, on a vote of 5 -0 (Payne absent) the Planning and
Zoning Commission recommended approval of the rezoning with conditions as set forth in the
staff report. Staff recommended approval in a report dated October 20, 2011. Approval of this
rezoning will allow redevelopment of the property for multi - family dwellings. This item was
deferred from the December 6 Council meeting pending a Planning & Zoning consult. The
Planning & Zoning Commission has chosen not to meet with the Council regarding this rezoning

Comment: The grant for the UniverCity Neighborhood Partnership Program allows the City to

Comment: These amendments will add several requirements to the "non -bar" exceptions to the
Under 21 ordinance. They include the ability to require an audit, at the applicant's expense, to
verify qualification, imposition of a PAULA ratio of .25, creation of a revocation and appeal
procedure, requirement for sufficient staffing, and limitation to one "new business" exception every
three years. The PAULA ratio and calculation protocol will be set by resolution.

Comment: This resolution allows the mayor to sign the Johnson County Fire Protection Mutual Aid
Agreement on behalf of the City of Iowa City. The Mutual Aid Agreement provides additional
firefighting equipment and personnel to the participants in the event of larger than usual fires, and
additional resource sharing. A draft of the agreement was provided in the Council packet for the
January 10th Special Work Session. The Fire Department strongly supports this agreement.

AND ACROSS FROM THE LONGFELLOW TRAIL AS PUBLIC PARKLAND
Comment: Jerrie and Dorothy Rogers have approached the Parks and Recreation Commission
and offered to sell a .30 acre of property abutting Ralston Creek and across from the Longfellow
Trail for public parkland. The Parks and Recreation Commission recommends the acquisition and
City staff has negotiated a purchase agreement with the owners that requires City Council
approval, a copy of which is attached to the resolution. The funds for the acquisition will come
out of Capital Improvements Project 4130, Parks Annual Improvements.

Comment: This agreement between the City of Iowa City and Neumann Monson PC., is a
contract of services to perform Phase I- programming and schematic design work. The goal of
this work is to determine the facility size, construction costs and a vision for the future Animal
Care and Adoption Facility. The fee for this contract is considered a reimbursable expense to
the City by FEMA. For economy, the Phase I fees will be separated into three parts:
• A not -to- exceed hourly Programming fee of $30,000.00, and
• A fixed Schematic design fee of $29,300.00; and
• Reimbursables expenses not to exceed $7,500
