Washington St., Iowa City, IA 52240; (319) 356 -5410 RESOLUTION NO. 12 -20 RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AMENDMENT #2 TO THE NOVEMBER 2, 2009 AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND FOTH INFRASTRUCTURE AND ENVIRONMENT, LLC TO PROVIDE ENGINEERING CONSULTANT SERVICES FOR THE LOWER MUSCATINE ROAD RECONSTRUCTION PROJECT (KIRKWOOD AVE. TO 1sT AVE). WHEREAS, the City of Iowa City entered into a contract on November 2, 2009 for consulting services with Foth Infrastructure and Environment, LLC of Cedar Rapids, Iowa, to provide design services for the Lower Muscatine Road Reconstruction Project (Kirkwood Ave. to 1 st Ave.); and WHEREAS, the City of Iowa City desires to construct a parking lot on Mid - American Energy property, update the project plans to meet current Iowa Department of Transportation requirements and reflect the revised bid date; and WHEREAS, the City desires the services of Foth Infrastructure and Environment, LLC to prepare preliminary and final design plans and specifications for said facilities; and WHEREAS, the City of Iowa City has negotiated Amendment #2 to the November 2, 2009 Agreement for said consulting services with Foth Infrastructure and Environment, LLC of Cedar Rapids, Iowa, to provide said services; and WHEREAS, it is in the public interest to enter into said Consultant Agreement with Foth Infrastructure and Environment, LLC; and WHEREAS, funds for this project are available in the Lower Muscatine - Kirkwood to First Avenue account #3803. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT: The Consultant's Agreement Amendment attached hereto is in the public interest, and is approved as to form and content. Al�,__ MAYOR Approved by AM �lA4g0t__, City Attorneys Office Resolution No. 12 -20 Page 2 It was moved by Mims and seconded by Payne the Resolution be adopted, and upon roll call there were: AYES: NAYS: ABSENT: x Champion x Dickens Dobyns x Hayek x Mims x Payne x Throgmorton CONSULTANT AGREEMENT LOWER MUSCATINE ROAD IMPROVEMENTS AMENDMENT NO. 2 THIS AMENDMENT to the November 2, 2009, CONSULTANT AGREEMENT for the Lower Muscatine Road Improvements Project, by and between the City of Iowa City, a municipal corporation, hereinafter referred to as the City and Foth Infrastructure and Environment, LI C of dar Rapids, hereinafter referred to as the Consultant, is made and entered into this 177 "— of ,1 a 2012. WHEREAS, on June 21, 2011, the November 2, 2009 Consultant Agreement was amended to extend the project limits, to design additional public utility improvements (Amendment No. 1), and to extend the project schedule; and WHEREAS, the City desires to again broaden the scope of services to be performed by the Consultant to provide additional design development and plan revisions, as detailed below, in order to comply with new Iowa DOT Design Standards and Plan Preparation Requirements for accessible sidewalks and curb ramps; and WHEREAS, the City further desires to broaden the scope of services to include the design of a parking lot for MidAmerican, the construction of which was agreed to during property acquisition negotiations; and WHEREAS, Consultant is willing to perform these additional services for an increase in their fee and extension of the schedule for completion. NOW THEREFORE, it is agreed by and between the parties hereto that the parties do now agree to the following amendments to the November 2, 2009 Consultant Agreement, as amended: Attachment "A "- Scope of Services: a. Task B — Survey and Mapping Add: 1.11 Plat of Survey (MidAmerican, Parcel #20) This task consists of preparation of an additional plat of survey for the shared access drive between MidAmerican Energy and Kirkwood Community College on parcel #20. The work to be performed shall include permanent easement plat preparation with legal description, including research to determine plan of action for land subdivision and coordination with P &Z. Also included is one (1) time staking of the easement locations for purposes of right -of -way negotiations and monumentation of the recorded easement. b. Task E — Roadway Design Add: 3.5 Accessible Curb Ramps Design This task consists of additional plan development to bring the pedestrian curb ramps (75) in accordance with the new Iowa DOT Design Standards and Plan Preparation Requirements for accessible sidewalks and curb ramps, effective October 2011. The design development shall follow the Iowa DOT Design Manual, Chapter 11 C -3. This task does not require development of special work zone accessibility design or plan preparation. Add: 3.6 Design Development of MidAmerican Energy Parking Lot This task consists of additional design development for a parking lot on the MidAmerican Energy parcel. The work to be performed shall include conceptual design development and preparation of final construction plans, including associated detailed design of grading, paving and drainage improvements in accordance with City Code. This task does not include storm water management analysis, planning and design development. iii. Add: 3.7 Review Construction Staging Notes This task consists of review and updating of the previously finalized Construction Staging Notes with regard to the new schedule and key milestone dates. This task does not include changes to the previously detailed construction staging plan sheets. iv. Add: 3.8 Review Plans for compliance with current DOT Specifications This task consists of review and updating of the previously finalized construction documents with regard to any recent changes to the Iowa DOT Construction Specifications. The work to be performed shall include responding to comments resulting from the Iowa DOT Final Plan review (Office of Local Systems and Office of Contracts) and incorporation of these updates into the construction documents. The review and updates are specifically with regard to tabulated bid items, estimate reference information, special provisions and other general reference notes. This task does not include changes to previously detailed construction plan improvements. v. Add: 3.9 Plan Revisions for PCBC Culvert (P -95) This task consists of completing PCBC Culvert plan revisions to match improvements made as part of the 1st Avenue Storm Sewer Improvements Project — Phase 1, necessary due to project scheduling changes. The work to be performed shall include updating of the storm sewer plan and profile sheet M.14, materials tabulation, estimate of quantities and geometric grading elevations. vi. Add: 3.10 Update Traffic Signal Details This task consists of completing traffic signal plan revisions to incorporate additional construction detail changes as requested by the City Traffic Engineering Division. The work to be performed shall include updating of the previously finalized plan and detail sheets. Attachment "B "- Schedule: Time is of the essence. The Project Schedule is hereby amended as follows: Final Plans January 27, 2012 Project Letting April 2012 Ill. Section IV. COMPENSATION FOR SERVICES In consideration for the above - described change in the Scope of Services, Consultant's total hourly not -to- exceed fee for performance of the Scope of Services, as amended, is $406,293, including any authorized reimbursable expenses, pursuant to the Schedule of Fees set forth in Attachment C to the November 2, 2009 Agreeemnt. This additional $52,500.00 in fees is summarized below: a. Task B - Survey and Mapping: $1,370 b. Task E — Roadway Design: $51,130 IV. All other provisions of the November 2, 2009, Consultant Agreement and the Amendment No. 1 not specifically amended herein shall remain in full force and effect. Improvements will include new street, sidewalk, lighting, storm sewer and sanitary sewer, as well as improvements to traffic signals and other related work. Foth Infrastructure and Environment, LLC was hired by the City of Iowa City in November 2009 to provide design services for the Lower Muscatine Road Reconstruction Project (Kirkwood Avenue to 1St Avenue). Due to delays in acquiring the necessary property and easement rights for the project, the bid letting date has been delayed until April 2012. During the time the project has been delayed, the Iowa Department of Transportation (laDOT) has developed additional requirements for construction plans. These requirements include additional design work for each pedestrian curb ramp included in the project, 75 in total. Additionally, the project plans need to be updated to reflect other City improvements that were constructed in the area and other items that need to be included as a result of property acquisition negotiations. Due to IaDOT requirements and other design items that have been added, the project plans for the Lower Muscatine Road Reconstruction Project (Kirkwood Avenue to 1St Avenue) require revisions prior to final submittal to the IaDOT for bid letting. In addition, the work will need to be completed quickly, as final plans must be submitted to the IaDOT by January 27th to remain on schedule for the April 2012 IaDOT bid letting. Contract Amendment #2 will include additional fees totaling $52,500, increasing the Consultant's total project hourly not -to- exceed fee to $406,293. Estimated construction cost of the Lower Muscatine Road Reconstruction Project from Kirkwood Avenue to 1st Avenue is $5,488,000. Staff recommends approving Contract Amendment #2 to Foth Infrastructure and Environment, LLC. Delay in approving this amendment would result in the project being delayed until a later bid letting date, which could result in increased bid prices.
