Resolutions: ITEM 4d(1) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE 07� CITY CLERK TO ATTEST TO A SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA CITY AND MIDWESTONE BANK, IOWA CITY, IOWA FOR PROPERTY LOCATED AT 415 N GOVERNOR STREET, IOWA CITY, IOWA. Comment: MidWestOne Bank has requested that the City approve a Subordination Agreement for property at 415 N Governor Street. The owners of the property received funding from the City of Iowa City for Housing Rehabilitation project. The subordination will not change the City's current position, that is, it will remain in second position and inferior to the owner's primary lender. ITEM 4d(2) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE A;--d3 CITY CLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING A MORTGAGE FOR THE PROPERTY LOCATED AT1015 DIANA STREET, IOWA CITY, IOWA. Comment: The owner of the property located at 1015 Diana Street received assistance through the City of Iowa City's Housing Rehabilitation Program. The terms of the loan have been satisfied; thus the lien needs to be released. ITEM 4d(3) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE /d_olit CITY CLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING A MORTGAGE FOR THE PROPERTY LOCATED AT 630 WHITING AVENUE, IOWA CITY, IOWA. Comment: The owners of the property located at 630 Whiting Avenue received assistance through the City of Iowa City's Housing Rehabilitation Program. Setting Public Hearings: ITEM 4e(1) CONSIDER A RESOLUTION SETTING PUBLIC HEARING FOR FEBRUARY 21, La a� 2012, ON A PROPOSAL TO CONVEY A SINGLE FAMILY HOME LOCATED AT 658 SOUTH LUCAS STREET. Comment: The grant for the UniverCity Neighborhood Partnership Program allows the City to purchase twenty -six rental units located in designated neighborhoods surrounding the University, rehabilitate them with up to $50,000 in grant funds, and then sell them to income - eligible buyers. Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 658 South Lucas Street. The amount of the sale will be $162,500 (this is what the City paid to purchase the home) plus the "carrying costs," which are which are all costs incurred by the City to acquire the home, maintain it and sell it, including abstracting and recording fees, interest on the loan to purchase the home, mowing and snow removal, utilities, real estate taxes, and any costs in excess of $50,000 to repair and rehabilitate the home. January 24, 2012 City of Iowa City Page 4 ITEM 4e(2) CONSIDER A RESOLUTION OF INTENT TO CONSIDER THE PROPOSED /02-30 CONVEYANCE OF LAND EAST OF STURGIS CORNER DRIVE AND WEST OF THE IOWA RIVER TO RAVI LODGING, INC., AND SETTING A PUBLIC HEARING FOR FEBRUARY 21, 2012. Comment: The City currently owns an approximate 1.09 acre parcel of land east of Sturgis Corner Drive and West of the Iowa River, located within the Riverfront Crossings Urban Renewal Area. Ravi Lodging has offered fair market value, as determined by an appraisal, for this land and intends to use it for development of a hotel. The City intends to retain a public access trail and temporary construction easement along the Iowa River, as well as a drainage and storm sewer easement over the subject land. ITEM 4e(3) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON FEBRUARY 21, /d -31 2012, ON AN ORDINANCE AMENDING CITY CODE SECTION 3 -4 -3, POTABLE WATER USE AND SERVICE FEES AND DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING. Comment: This Ordinance corrects an inadvertent error that was made in July of 2010 when changes were made to the Water Service Fees. In addition, this Ordinance will also amend City code to reflect the current fee and policy of the City with regard to the extension of water mains. ITEM 4e(4) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON FEBRUARY 21, 2012, REGARDING THE INTENT TO ENTER INTO A LEASE WITH THE IOWA VALLEY HABITAT FOR HUMANITY AT THE EAST SIDE RECYCLING CENTER. Comment: The Recycling Coordinator has worked with the City Attorney's Office to draft a 10 -year lease for the Habitat and Restore offices and retail space at the East Side Recycling Center. This lease contemplates that amendments be made by Council, other than rent increases, which are contemplated to be made by the City Manager, and modifications to the tenant's obligations to manage of the property, which are contemplated to be reviewed annually and modified by the Director of Public Works. ITEM 4e(5) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON FEBRUARY 21, /41,33 2012, REGARDING THE INTENT TO ENTER INTO A LEASE WITH THE FRIENDS OF HISTORIC PRESERVATION (SALVAGE BARN) AT THE EAST SIDE RECYCLING CENTER. Comment: At its December 15 meeting, by a vote of 7 -0, the Planning and Zoning Commission recommended approval of this Comprehensive Plan amendment. Approval will modify the boundary of the Northside Marketplace shown in the Central District plan and clarify that these historic properties are not planned for redevelopment. 1. (REZ11- 00018) Comment: At its December 1 meeting, by a vote of 0 -5 (Payne abstained), the Planning and Zoning Commission recommended denial of this rezoning. In a staff report dated November 17 staff recommended approval subject to a Conditional Zoning Agreement that ensures that design of the building will be consistent with the submitted drawings and that it contains an appropriate mix of apartment sizes as reflected in the number of bedrooms and associated living spaces to ensure a quality living environment as determined by the Commission and the Council. Approval will allow this property to be developed with a 15 -unit apartment building. 1. PUBLIC HEARING Action: 2. Comment: At its November 14 meeting, by a vote of 5 -0 (Eastham absent), the Planning and Zoning Commission recommended approval of this rezoning. If there is an indication that the Council will not accept the Commission's recommendation an opportunity for a joint meeting with the Council and the Commission is required. Staff recommended approval in a report dated November 14. Approval will allow this property to keep horses. Comment: The grant for the UniverCity Neighborhood Partnership Program allows the City to purchase twenty -six rental units located in designated neighborhoods surrounding the University, rehabilitate them with up to $50,000 in grant funds, and then sell them to income - eligible buyers. Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 317 Douglass Court. The amount of the sale will be $88,000 (this is what the City paid to purchase the home) plus "carrying costs" of approximately $2,300. "Carrying costs" are all the costs incurred by the City to acquire the home, maintain it and sell it, including abstracting and recording fees, interest on the loan to purchase the home, mowing and snow removal, utilities, real estate taxes, and any costs in excess of $50,000 to repair and rehabilitate the home. APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE WASTEWATER TREATMENT FACILITIES CONSOLIDATION PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH NOTICE TO BIDDERS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project will expand the South Wastewater Treatment Facility allowing the flood prone North Wastewater Facility to be eliminated. The North Wastewater Facility site will eventually be converted to parkland as part of the Riverfront Crossings District. The expansion of the South Facility will also provide additional capacity for growth and better position the City for potential future water quality regulations. Operational efficiencies will also be realized. The estimated construction cost of this facility is $39.7M and will be funded with a $22M grant from the US Economic Development Agency (EDA), $4.5M from a Community Development Block Grant, a $2M I -Jobs Grant and $11.2M from Local Option Sales Tax Revenue. a. Comment: This project will install a new traffic signal at the intersection of the Highway 218 southbound ramps and Melrose Avenue. The estimated construction cost of this project is $111,000 and will be funded with U -STEP Grant proceeds and General Obligation Bond proceeds. a. APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE NORTH MARKET SQUARE PARK PAVILION PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH NOTICE TO BIDDERS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project involves the installation of a new park pavilion at North Market Square Park and includes the installation of the pavilion along with new infrastructure such as sidewalk pavement, pavilion foundations, and lighting. The estimated cost for this project is $102,585 and will be funded with General Obligation bond proceeds. a. PUBLIC HEARING Action: Ito b. CONSIDER A RESOLUTION Action: ITEM 11. CONSIDER AN ORDINANCE AMENDING TITLE 9, ENTITLED "MOTOR VEHICLES AND TRAFFIC," CHAPTER 4, ENTITLED "PARKING REGULATIONS," SECTION 1, ENTITLED "PARKING PROHIBITED IN SPECIFIED PLACES," TO PROHIBIT PARKING ADJACENT TO A CURB EXTENSION. (FIRST CONSIDERATION) COMMENT: This ordinance makes it illegal for a commercial vehicle to park adjacent to a curb extension, also known as a bump -out, bulb -out, and neckdowns. They are extensions of the sidewalk found generally at intersections. An example of a curb extension is in front of Panchero's restaurant at 32 S. Clinton Street. Section 9- 4- 11A(11) allows a commercial vehicle to stop and park in a lane of traffic if another parking space is not open within 150 feet. Section 9- 4 -1A(4) prohibits parking within 15 feet of an intersection, but often the curb extensions go beyond 15 feet from the intersection. The combination of the curb extension and commercial parking in the lane of traffic (i.e., double parking) backs up traffic and creates other safety concerns. This is especially problematic during night time hours with taxi cabs. Action: f? January 24, 2012 City of Iowa City Page 10 ITEM 12. (SECOND CONSIDERATION) CITY Comment: Pursuant to State Code the City must adopt a code of ordinances every five years. This ordinance adopts the City Code, 2012. Action: ITEM 14. CONSIDER AN ORDINANCE AMENDING TITLE 4, ALCOHOLIC BEVERAGES, CHAPTER 12, - 4,14 16 J 5, PROHIBITIONS AND RESTRICTIONS, SECTION 8, PERSONS UNDER THE LEGAL AGE IN LICENSED OR PERMITTED ESTABLISHMENTS, SUBSECTION B, TO AMEND THE REQUIREMENTS FOR NON -BAR AND ENTERTAINMENT VENUE EXCEPTIONS. (PASS AND ADOPT) Comment: These amendments will add several requirements to the "non -bar" exceptions to the Under 21 ordinance. They include the ability to require an audit, at the applicant's expense, to verify qualification, imposition of a PAULA ratio of .25, creation of a revocation and appeal procedure, requirement for sufficient staffing, and limitation to one "new business" exception every three years. CONSIDER A RESOLUTION SETTING POLICIES IMPLEMENTING IOWA CITY CODE 4 -5 -8, INCLUDING ALLOWABLE PAULA RATIO, PAULA RATIO DEFINITIONS, � CRITERIA FOR AUDITING ESTABLISHMENTS, AND INITIAL DEPOSIT AMOUNT FOR AUDITS. Comment: This Resolution adopts the Iowa City Code Implementing Standards required by the recent amendment to Iowa City Code 4- 5 -8(B). The Standards include such matters as setting the allowable PAULA ratio at .25, defining a "bar check ", setting forth factors to consider to determining whether to require an audit of an establishment, and setting the audit deposit amount at $2,500. Action: ITEM 16. CONSIDER A RESOLUTION APPROVING EXECUTION OF AN AGREEMENT BETWEEN THE CITY OF IOWA CITY AND HOWARD R. GREEN COMPANY TO PROVIDE ENGINEERING CONSULTANT SERVICES FOR LANDFILL GAS, AIR AND WATER QUALITY MONITORING AT THE IOWA CITY SANITARY LANDFILL. Comment: This agreement authorizes Howard R. Green Company to provide engineering services necessary for groundwater and surface water monitoring and annual water quality reports, operation and monitoring of the landfill gas collection system in accordance with State and Federal regulations for calendar year 2012. The total cost of engineering consultant services is $131,900. Funding will be provided by landfill revenues. Action:o�t��n ITEM 17. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST THE IOWA DEPARTMENT OF TRANSPORTATION FUNDING AGREEMENT FOR THE HIGHWAY 218 AND MELROSE AVENUE TRAFFIC SIGNALIZATION PROJECT [UST- 218 - 4(39)-- 4A -52]. Comment: This project will install a new traffic signal at the intersection of the Highway 218 southbound ramps and Melrose Avenue. The agreement provides for Iowa Department of Transportation Urban -State Traffic Engineering Program (U -STEP) funding of 55% of eligible construction costs. The total estimated construction cost for this project is $111,000, and the City's share will be funded with General Obligation Bond proceeds. CONSIDER A RESOLUTION AUTHORIZING IOWA CITY TRANSIT TO ENTER INTO A MEMORANDUM OF UNDERSTANDING WITH CORALVILLE TRANSIT AND ELDER RVICES, INC. TO PROVIDE MATCHING FUNDS FOR A NEW FREEDOM GRANT. Comment: Iowa City Transit and Coralville Transit have partnered with Elder Services /RSVP in applying for a New Freedom grant through the Iowa Department of Transportation. The grant request is for funding of a Volunteer Transportation Coordinator with Elder Services for a program that targets those that cannot use the fixed route or paratransit(Johnson County SEATS) services for medical related appointments. The total project cost is $60,010.00. Iowa DOT agreed to fund 80% of the grant at $48,008.00. Iowa City Transit's portion of the $12,002.00 match will be $9,362.00 paid to Elder Services in quarterly payments. Coralville Transit has agreed to pay $2,640.00 of the match. Action: 9 ITEM 19. CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CONTRACT FOR JANITORIAL SERVICES FOR THE TRANSPORTATION SERVICES DEPARTMENT. Comment: RFP's for this project were opened on October 13, 2011 and the following proposals were received: ABM Janitorial Services $ 117,383.86 FBG Service Corporation $ 225,504.00 Midwest Janitorial Service $ 265,370.64 Transportation Services Department recommended award of the contract to ABM Janitorial Services. CONSIDER A RESOLUTION ADOPTING AN ASSESSMENT SCHEDULE OF UNPAID MOWING, CLEAN -UP OF PROPERTY, SNOW REMOVAL, SIDEWALK REPAIR, AND STOP BOX REPAIR CHARGES AND DIRECTING THE CLERK TO CERTIFY THE SAME TO THE JOHNSON COUNTY TREASURER FOR COLLECTION IN THE SAME MANNER AS PROPERTY TAXES. Comment: The City has the authority under Iowa Code §364.138 to assess the nuisance abatement costs in the same manner as a property tax. This resolution allows the City Clerk to certify to the Johnson County Treasurer the abatement cost to be assessed against the property. This assessment is being pursued only after the City took many steps to resolve the matter. The City notified the home owners to abate the nuisance (for example, to remove snow from the sidewalk) and after the home owner did not take action to abate the nuisance, the City abated the nuisance and billed the owner. After being billed at least twice, these owners still have not paid the abatement costs. The City has sent a letter to the home owner giving them notice that this resolution would be on the agenda, a copy of which is attached to the resolution. No interest will be charged if the owner pays within 30 days of the first required publication. Comment: Ordinance 97 -3792 establishes the Police Citizens Review Board and sets forth mechanisms for complaints. The Ordinance also provides the City Council to grant extensions of the 30 -day reporting requirement for good cause. At their meeting of January 10, 2012, the Board requested a 30 -day extension. CONSIDER A MOTION TO APPROVE A TENTATIVE AGREEMENT BETWEEN THE CITY OF IOWA CITY AND THE AMERICAN FEDERATION OF STATE, COUNTY AND MUNICIPAL EMPLOYEES LOCAL #183. Comment: This is a five -year agreement for Fiscal Years 2013, 2014, 2015, 2016, and 2017 which provides for split wage increases of 1.35% and 1.5% in FY2013, 1.25% and 1.25% in FY2014 and an across - the -board wage increase of 2.2% at the beginning of FY2015. It also provides for increases to employee contributions for family health insurance and increases to deductible and out -of- pocket maximums for both single and family health insurance policies. The agreement provides for a contract re- opener for wages and insurance only for FY2016 and FY2017. Other provisions include a modification of the contract provision regarding temporary employees to establish a 1300 hour work limitation per fiscal year per hourly employee and establishment of a 7 working -day timeframe within which employees being laid off may exercise contractual bumping rights. The second portion of the FY2013 and FY2014 splits will be applied to the 10 year officer step rather than paid across the board. The agreement also provides for increases to employee contributions for family health insurance and increases to deductible and out -of- pocket maximums for both single and family health insurance policies. Other provisions include the incorporation of the current work schedule into the collective bargaining agreement and the elimination of Step 3 in the current grievance process.
