Comment: This resolution corrects the bid bond amount required for the Wastewater Treatment Facilities Consolidation Project. This change will clarify the bid bond amount within the specifications and will set it to industry standard for projects of this size. ITEM 5d(13) CONSIDER A RESOLUTION AUTHORIZING THE CITY MANAGER TO SIGN A LISTING AGREEMENT WITH BLANK & MCCUNE, THE REAL ESTATE COMPANY TO SELL 928 LONGFELLOW COURT. Comment: As part of the Affordable Dream Home Program (ADHOP), the City constructed five, two -unit condominiums on Longfellow Court and Longfellow Place for sale to eligible buyers. Although the City had sold eight units without a broker, two units had remained vacant. The City had previously entered into a six -month listing agreement with Blank & McCune, The Real Estate Company, to sell the last two units, and one was sold. The previous listing agreement expired recently, and this resolution would authorize the City Manager to sign another six -month listing agreement for the remaining unit. ITEM 5d(14) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE Id- 6g CITYCLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING TWO MORTGAGES FOR THE PROPERTY LOCATED AT 1201 MARCY STREET, IOWA CITY, IOWA. Comment: The owner of the property located at 1201 Marcy Street received assistance through the City of Iowa City's GRIP (General Rehab and Improvement Program). The terms of the loans have been satisfied; thus the liens need to be released. ITEM 5d(15) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE /d- (93 CITY CLERK TO ATTEST TO A SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA CITY AND MIDWESTONE BANK, WEST LIBERTY, IOWA FOR PROPERTY LOCATED AT 1471 BURNS AVENUE, IOWA CITY, IOWA. Comment: MidWestOne Bank has requested that the City approve a Subordination Agreement for property at 1417 Burns Avenue. In 2007, the owner of the property received a loan from the City of Iowa City for housing rehabilitation. The property has enough equity to cover the City's lien position. Comment: MidWestOne Bank has requested that the City approve a Subordination Agreement for property at 2073 Sherman Drive. In 2009, the owners of the property received a forgivable loan from the City of Iowa City for single family new home construction. The property has enough equity to cover the City's lien position. Comment: MidWestOne Bank has requested that the City approve a Subordination Agreement for property at 2641 Gable Street. In 2009, the owner of the property received a forgivable loan from the City of Iowa City for single family new home construction. The property has enough equity to cover the City's lien position. ITEM 5d(18) CONSIDER A RESOLUTION APPROVING AN AMENDMENT TO LEASE WITH MERSCHMAN SEEDS, INC. AND REGENNITTER FARMS, INC. TO LEASE AN ACCESS WAY FROM MORMON TREK BLVD. TO THE NORTH /SOUTH RUNWAY. Comment: The Airport Commission leases some of the airport land for agricultural purposes to Regennitter Farms, Inc. ( "farmer "). The farmer contracts with Merschman Seeds, Inc. to permit Merschman to plant test plots between the end of the north /south runway (which is closed) and Mormon Trek Blvd. In order to facilitate the planting and viewing of the test plots, Merschman has leased an access way from Mormon Trek to the runway since 2008, which will terminate on 2/29/12. This amendment extends the lease for one year to 2/28/13. At its meeting on February 16, the Airport Commission will consider this amendment. ITEM 5e. Setting Public Hearings: ITEM 5e(1) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON MARCH 6, 2012, ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF fa-- COST FOR THE CONSTRUCTION OF THE U.S. HIGHWAY 6 AND SYCAMORE STREET INTERSECTION IMPROVEMENT PROJECT, DIRECTING THE CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project includes safety and capacity improvements to the intersection of U.S. Highway 6 and Sycamore Street intersection including pavement widening, median reconstruction, asphalt overlay though the intersection, 8' wide sidewalk installation, and installation of a new traffic signal system. The estimated construction cost of the project is $1,778,650. Funding sources will include $200,000 in a USTEP Grant from the State of Iowa, Iowa DOT 3R funds, Water revenue, and General Obligation bond proceeds February 21, 2012 City of Iowa City Page 7 ITEM 5e(2) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON MARCH 6, 2012, ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE IOWA RIVER WATER MAIN CROSSINGS PROJECT, DIRECTING THE CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project will install two new water mains under the Iowa River. The new water mains will replace existing water mains that were exposed and undermined during flooding in 2009. The estimated construction cost is approximately $290,470 and will be funded with FEMA reimbursements and Water revenues. ITEM 5e(3) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON MARCH 6, 2012, 1 a -65 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE TERRY TRUEBLOOD RECREATION AREA - PHASE 3 IMPROVEMENTS PROJECT, DIRECTING THE CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project provides for the phased development of the Terry Trueblood Recreation Area. Phase Three Improvements include the park lodge, parking, shelters, canoe and fishing jetties and a nature playground. The estimated construction cost is $3,700,000 and will be funded with State grants, General Obligation Bond proceeds and contributions /donations. ITEM 5e(4) CONSIDER A RESOLUTION RELATING TO THE ISSUANCE OF NOT TO COL % EXCEED $5,376,250 IN AGGREGATE PRINCIPAL AMOUNT OF MIDWESTERN DISASTER AREA REVENUE BONDS (IOWA CANCER CURE PROJECT) SERIES 2012, OF THE CITY OF IOWA CITY, IOWA; AND SPECIFICALLY (1) DECLARING INTENT TO REIMBURSE EXPENDITURES FROM PROCEEDS OF SAID BONDS; (2) FIXING A DATE FOR A PUBLIC HEARING ON THE PROPOSAL TO ISSUE SAID BONDS for March 20, 2012; (3) DIRECTING PUBLICATION OF NOTICE OF INTENTION TO ISSUE SAID BONDS; AND (4) AUTHORIZING THE EXECUTION OF A MEMORANDUM OF AGREEMENT. Comment: Under Iowa Code chapter 419, a city may issue a special limited obligation revenue bond and agree to loan the proceeds of the bond to a private business for a qualifying project. The obligation of the Issuer is limited and the obligation on the bond is not an indebtedness of the Issuer within the meaning of any debt limit, nor does it constitute or give rise to a pecuniary liability of the Issuer or become a charge against its general credit or taxing powers. By participating in a Midwestern Disaster Area bond financing, the City of Iowa City provides an opportunity for a business project to be realized at a lower cost of financing. Any expense of the City with respect to a bond financing is paid by the borrower, in this case, Iowa Cancer Cure LLC. The building will be occupied by Iowa City Cancer Treatment Center, LLC in the Northgate Corporate Park. February 21, 2012 City of Iowa City Page 8 ITEM 5e(5) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON MARCH 6, 2012 /2 171 TO DISCUSS THE PROPOSED OPERATING BUDGET FOR THE FISCAL YEAR JULY 1, 2012 THROUGH JUNE 30, 2013, THE PROPOSED THREE -YEAR FINANCIAL PLAN FOR FY2013 - 2015, AND ALSO THE MULTI -YEAR CAPITAL IMPROVEMENTS PROGRAM THROUGH FISCAL YEAR 2016. Comment: This resolution sets a public hearing on March 6, 2012 to discuss the FY2013 Proposed Operating Budget, the three -year Financial Plan for FY2013 — FY2015 and multi -year Capital Improvements Program (CIP) through Fiscal Year 2016. Detailed information on the budget will be available for public inspection on February 24, 2012. Comment: This lease agreement is for the seasonal rental of two buildings located at the Johnson County Fairgrounds and will provide storage for vehicles and equipment of the Streets Division. Previously, one building has been rented for this purpose, however, due to the development of the Terry Trueblood Recreation Area and the removal of a metal building, it is necessary to obtain additional space to fill that void. The yearly cost for the rentals is $20,000. Action: ITEM 15. CONSIDER AN ORDINANCE AMENDING TITLE 10 OF THE CITY CODE, ENTITLED USE OF PUBLIC WAYS AND PROPERTY," CHAPTER 3, ENTITLED, "COMMERCIAL USE OF SIDEWALKS," SECTION 3, ENTITLED "USE FOR SIDEWALK CAFES," TO ALLOW PLANTERS IN LIEU OF FENCING. (FIRST CONSIDERATION) Comment: Temporary fencing is allowed during the first year a sidewalk cafe is open to allow an establishment to determine if an investment in anchored fencing is financially feasible. Thereafter, anchored fencing is required to delineate the cafe. This ordinance creates an alternative to fencing by allowing planters to delineate a sidewalk cafe. CONSIDER AN ORDINANCE AMENDING TITLE 9, ENTITLED "MOTOR VEHICLES AND TRAFFIC," CHAPTER 4, ENTITLED "PARKING REGULATIONS," SECTION 1, ENTITLED "PARKING PROHIBITED IN SPECIFIED PLACES," TO PROHIBIT PARKING ADJACENT TO A CURB EXTENSION. (SECOND CONSIDERATION) COMMENT: This ordinance makes it illegal for a commercial vehicle to park adjacent to a curb extension, also known as a bump -out, bulb -out, and neckdowns. They are extensions of the sidewalk found generally at intersections. An example of a curb extension is in front of Panchero's restaurant at 32 S. Clinton Street. Section 9- 4- 11A(11) allows a commercial vehicle to stop and park in a lane of traffic if another parking space is not open within 150 feet. Section 9- 4 -1A(4) prohibits parking within 15 feet of an intersection, but often the curb extensions go beyond 15 feet from the intersection. The combination of the curb extension and commercial parking in the lane of traffic (i.e., double parking) backs up traffic and creates other safety concerns. This is especially problematic during night time hours with taxi cabs. Staff requests expedited action to allow distribution of the information with annual taxi decals. Action: /7 f lit ; ITEM 17. Comment: The Transportation Services Department currently has two full -time Customer Service Representative positions and one full -time Parking Clerk position. An evaluation of the duties performed by the Parking Clerk showed that the duties were equal to the duties performed by the Customer Service Representatives. As a result of this the Transportation Services Department recommends reclassifying the Parking Clerk position to that of a Customer Service Representative position.
