So it's Council then that would appoint the individual to either term. Hayek/ Okay. Karr/ So you have the option of appointing him to fill his current full -term, or the available unexpired. Payne / And he ... the applicant already filled another partial term, correct? Karr/ Correct! Payne / And on the Airport Commission, how many years can you be on it? Can you be on it lots of partial terms? Karr/ We ... the, our boards and commissions do not have term limits, per se. We have ... Council has a policy that when a person has filled one unexpired, they are typically then, uh, appointed to a full term, unless there are some extenuating circumstances. Champion/ But we do have a gender balance problem. I hate to assign him again to another unexpired term. Karr/ But I think that gender ... we've advertised it for more than 90 days. And then I think the other one we have is uh, Housing, Community Development. Karr/ That's correct. Throgmorton/ What a great set of candidates! Champion/ Yes! They were all terrific! Throgmorton/ Whoever we chose I would strongly encourage the other two to apply for subsequent vacancies. Hayek/ Well, does anybody have a... someone to advocate for? Champion/ Well, I really did like, uh, Jim Jacobson. And I also really did like Megan; I can't pronounce this last name. Hayek/ Schwam. Champion/ Schwam. Payne/ I thought Megan's qualify ... I thought she had good qualifications. Champion/ She does. Payne/ Not ... not that the other ones didn't too, but she had ... her background was more geared towards this commission, I thought. Champion/ Yes. I ... I agree with you, and that's one reason I really liked her application, but sometimes it's good to have somebody who hasn't been involved in it to be on the ... on the commission. Hayek/ Okay, I believe that's all, uh, in terms of Council appointments. Let's move on to Planning and Zoning items. Mr. Davidson. Planning and Zoning: ITEM 5c AMENDING TITLE 14, ZONING, ARTICLE 4E, NONCONFORMING SITUATIONS, REGARDING THE REGULATION OF NON- CONFORMING DEVELOPMENT. Davidson/ Good evening, Mr. Mayor, and Members of the City Council. I'm Jeff Davidson, Director of Planning and Community Development. And we are taking advantage of... not quite as full agenda as normal to, uh, take care of some Planning and Zoning items at your work session. Uh, the first one ... is Item 5c, and it pertains to how we deal, uh, with situations involving non - conforming developments. And urn ... this is something that's been brewing for a little while and it... in 2005 and 2010 we tried to implement some things to deal with it, and Karen Howard in her, um, memorandum to you, uh, provided you some of the background and the history of some of the things that have been done in the past. Basically the non - conforming situations are created when we change zoning regulations, as you would expect to happen, uh, over time, which results in uses that were legally established at the time, becoming non - conforming. And it has created issues for us when ... um ... uses ... uh, either ... lapse for a period of a year, or change in use, which then triggers some need for them to be brought into compliance with the new regulations, and it...it is the manner in which we do this that ... that is the issue for you to discuss and take action on. Urn ... we hope, of course, that over time... properties are brought into compliance with the new regulations. Uh, this most easily occurs in an existing built -up area, when a property completely redevelops. Because when it completely redevelops, uh, it's brought into compliance with the ... the current regulations, and it ... there are This represents only a reasonably accurate transcription of the Iowa City City Council work session of March 6, 2012. March 6, 2012 Iowa City City Council Work Session Page 4 sometimes issues when a property, for example, you can think of on south Riverside Drive. There are properties that have redeveloped significantly and been brought into compliance that are next to properties that have been in a ... in a use for years and years and years, and you can see very clearly when you look at them side by side the ones that are in compliance versus the ones that are not, and when the one that's not in compliance changes in use... obviously there's some desire to bring it to some degree into compliance, but not have that be so onerous that it becomes a disincentive for it to ... to, uh, be...be redeveloped, because we ... we obviously want to encourage that and not have properties remaining, um, vacant or something like that. So, what we are suggesting are some new thresholds for dealing with how we require properties to be brought into compliance, and by the way, the ... the kinds of things that we're talking about are listed, uh, Karen provided just the ... the pages from the zoning ordinance, and if ... right after the last page of her memo, you can see standards that must be met, and you can see it ... it's typically dealing with screening of parking areas, for example in 2005 we implemented regulations requiring screening, uh, of a parking area that ... that basically comes up to the right -of -way. Um... so screening of parking. Bicycle parking, uh, tree requirements, um, design layout landscaping, and tree requirements in parking areas; pedestrian circulation standards — I've been part of the development of...of those regulations as we've tried to do better in parking lots and situations like that, of making them not inhospitable for pedestrians to get from a vehicle to the front of the building, or somebody who's walking, to get from the sidewalk to the front of the building, through the parking lot. Outdoor lighting standards, access management — access management being the number of driveways; uh, in our older areas you might see a relatively small property located on an arterial street with two or three driveways. Uh, that's a traffic safety issues, one that really motivates us to try and reduce the number of those driveways, and ... and improve the traffic safety. So, what we are suggesting is that a couple of thresholds be, uh, implemented, and ... and I know there was, uh, a question that one of you had, and I appreciate it being forwarded earlier. Where'd we come up with these ... these thresholds. Uh, and ... and we looked at some model ordinances from other communities and discussed those with the Planning and Zoning Commission, and that's basically where the ... the thresholds come from. What we are suggesting are ... are essentially two thresholds. If the cost of a proposed building alteration, for example, a use is going to change from a retail store to a medical office. Okay? There will be a building permit filed, uh, in HIS that will have a value of it, and if that value is ... exceeds $25,000, that would be one of the thresholds that would require some compliance of... of bringing it up to, bringing the property up to the new standards. The other threshold is if it's below $25,000 the ... the value of the improvements are below $25,000, but the value is 35% or greater than the assist... assessed value of the entire site, that would be the other trigger. So, $25,000 in improvements or less than that but 35% or more of the assessed value of the site. You would then be required to bring the property into compliance, up to a point not to exceed 10% of the value of the... so if the, let's say it was $25,000 was the cost of the proposed improvements, you'd be required to spend up to $2,500 bringing the site into compliance. So that over time we make some progress towards bringing a site into compliance, but somebody's not required to spend $100,000 which you could spend in some of these cases that we've seen, uh, bringing a parking lot into, uh, compliance. So that is what's being suggested, recommended to you by the Planning and Zoning This represents only a reasonably accurate transcription of the Iowa City City Council work session of March 6, 2012. March 6, 2012 Iowa City City Council Work Session Page 5 Commission, and then we would use those basically as the thresholds for bringing properties into compliance. Rick? Dobyns/ So, Jeff, in this scenario, uh, you spend $2,500 and really to come up to compliance... the compliance would be like $30,000. So at $2,500 you spend it, you're done, you're compliant, or is that a per year ... is there a... Davidson/ You bring up ... you bring up a good point that I ... I'd meant to mention, Rick, and that is that we will always encourage people to bring their properties into full compliance, regardless of the cost. But, when there is resistance to doing that, that's when the threshold will ... will go into effect. Dobyns/ So you spend $2,500 and we can of course petition and ... and whine, but the law is they're done. Davidson/ You're done! That's correct, and if (several talking) and if it's, excuse me, and if it's under $25,000 or you don't meet that 35% threshold, you don't have to do anything. You're not required to do anything. You will be encouraged, but not required. Mims/ But, if I understood Rick's question right, they're not necessarily in compliance, I mean, if two years later they did something else that triggered it... Davidson/ Exactly! Then you (both talking) Mims/ ... same boat, having to spend more money. Dobyns/ ... or whatever. Mims/ ... or whatever again! Davidson/ Perhaps over a ten -year period, this property, this theoretical property we're talking about, over ... might have three improvements done to it, and by the third one be in full compliance! Mims/ Right! Okay. Davidson/ Hypothetically. Payne/ I ... I have two questions. Um... does every time you do something, do the prior improvements, are they included in the dollar amount... Davidson/ No. You would start over each time (both talking). You would start over each time. Payne/ Okay. And, minor modifications, why does the City staff approve which ones they have to do, basically in this order, I through 9. Payne/ And it not go to Board of Adjustments? Davidson/ Why doesn't it (both talking) Payne/ ...not having many public input then on what the public thinks is important... Davidson/ That's correct. That's correct; there would not be public input. It would be handled administratively. The why of that, do you know, Eleanor? Dilkes/ Although I think there would be an appeal to the Board of Adjustment, from the building official's decision. Payne/ So you... Dilkes/ So you could get to the Board of Adjustment. Payne/ Okay. So probably it's just administratively quicker to have the ... the staff do it. Davidson/ Right, and ... and the ... the ones that I have been familiar with, Michelle, or I've been apprised of, uh, you know, the applicant has been delighted that they haven't had to spend a much larger amount and were ... were very willing to spend the ... the smaller amount to bring it up. Payne/ The only ... the only thing that triggered mine is, you know, outdoor lighting standards is number 9, but the whole neighborhood might think that that's the worst thing on the property is the way the lights shine into ... into their... Davidson/ Right. And you know, depending on a particular circumstance, the building official might take that up as a higher priority if there was a problem situation that had been, you know, manifested itself that we were well aware of, uh, I mean, sometimes those even get dealt with, you know, as a... a, you know, some kind of an issue that, aside from an improvement being made to the property, but yeah. The ... the, uh, and Michelle pointed out something that I should have also pointed out, and that ... it would be basically taken in the order that you see here of importance, that's... that's what's been identified as the process that we would follow, moving down the list. Mims/ But ... but there is language in there, Michelle, in that paragraph c that says generally follow the order (both talking) so it does give staff some flexibility if there were an issue. Payne/ Yep. Dobyns/ This is unusual, it gives wide precedent to the City staff and the owner to decide what to do. March 6, 2012 Iowa City City Council Work Session Page 7 Davidson/ Yeah, although there... there's some, you know, we already handle these adminis... administratively when we're trying to ... we've been trying to work out solutions with people at making some progress. This kind of formalizes the process, Rick. It's not (both talking) process. Dobyns/ Would this stimulate a lot of...renovation in the community? Davidson/ Well, we ... I guess we hope not having this in place ... hasn't been a deterrent to renovation. Dobyns/ But we'll find out. Davidson/ We'll find out. Yeah. Hayek/ This, uh, this, uh, complaints regarding change of use, um ... rank among the biggest, or at least most frequent complaints we get from the building and development community. Um, can you talk briefly about input, if any, we received through the process from that constituency? Davidson/ Well, I think... Hayek/ ...I mean, I know this went through standard P &Z and all of that. Davidson/ ...yeah, and...and of course a lot of this happens in HIS, not in the Planning Department, but the ones that I've been apprised of, typically when we hear from HIS (laughter) that there's a problem situation, they have been parking lot screening standards. So I think having that at the top of the list is very appropriate (both talking) terms of the nature of the problems (both talking) Hayek/ ...this proposal, what ... what input did we get, if any, on this proposal as it went through the legislative process? I mean, did... Davidson/ Um... Hayek/ And we may not have! I mean, you know... Davidson/ I'm sorry, Matt, I ... I'll tell you what, I will get an answer to that question and, at the formal meeting I'll let you know. Hayek/ Okay. Davidson/ Cause I'm not certain. Hayek/ And ... and I'm only curious because you know the ... the 25,000, 35 %, 10% figures are, uh, they seem defensible and logical. March 6, 2012 Iowa City City Council Work Session Page 8 gauge of that would be the input we received from those affected by the proposal, and that's... that's the genesis of my question, so... Davidson/ Let me get an answer for you by the formal meeting. Hayek/ Thanks, Jeff! Mims/ Yeah, and this... Davidson/ Any other questions? Mims/ ...yeah, and I would just say, you know, this issue is something that I have heard a lot from people about, not even just developers but just, you know, people who own an office building and are making a change. One tenant moves out and another moves in and all of a sudden they see themselves previously with huge costs and ... and I think it was ... causing some properties to go unrenovated, because they felt that the costs of bringing them into compliance was just too ... too high, and they just couldn't see the financial justification. So I think this is a huge improvement but I would ... I would piggyback on Matt's comments. I think ... I would encourage staff as we're doing these kinds of things to, um, really proactively reach out to ... to the community to get some input and I understand it's going through like P &Z and stuff, but, um, really... Davidson/ It's been through the legislative process, so I assume that there's been some input. I just need to find out (mumbled) Throgmorton/ I support the action too, uh, Matt, I think it's a good step. Hayek/ Okay. Davidson/ Anything else? On this... Hayek/ By the way, Council, you mentioned, uh, you know, emailing you with questions, uh, on the specifics of...of the proposal. Just as reminder, it's always ... it's very helpful if you have questions, uh, to get `em to staff in advance of these meetings so that they have a chance to track down information, respond to you directly, or bring it up at the meeting, um, so that's... that's just a good example (both talking) Davidson/ ...we really appreciate that, and I ... and I encourage you to do that to the City Manager's office and then they can determine where it needs to go. Shall we move on, Mr. Mayor? Hayek/ Yes, sir, please! ITEM 5e CONSIDER A RESOLUTION APPROVING THE FINAL PLAT OF MACKINAW VILLAGE PART 4, IOWA CITY, IOWA. (SUB11- 00018) This represents only a reasonably accurate transcription of the Iowa City City Council work session of March 6, 2012. March 6, 2012 Iowa City City Council Work Session Page 9 Davidson/ Okay, let's move on to the ... we have two plats then. Uh, the first one ... is, um, Mackinaw Village, uh, what is being requested is final plat approval. The applicant is Prime Ventures of Iowa, uh, North Liberty, Iowa. Uh, this is a 16 -lot single - family residential subdivision. Uh, it would complete Sugarloaf Circle, uh, north of Foster Road. The size of the property is 3.84 acres. And it is currently undeveloped. Here's the location map ... if I can grab the mouse here. Uh, so just to orient you, here's Foster Road, uh, the existing, uh ... platted and built ... built-out, uh, portions of Mackinaw. Uh, here's Interstate 80. Uh, there's a large outlot, outlot B in this area, which is basin... basically, um, a sensitive areas outlot, uh, that ... that would remain undeveloped. Uh, and then the plat you see here, uh, 16 lots. Um, the developer is being allowed to continue... this street is stubbed right now, about right there, and so the developer is being allowed to continue with the old design standards, subdivision standards in terms of street width and sidewalk width. You'll recall the sidewalk width is now 5 -feet. This was established with 4 -feet, so they'll be allowed to continue, uh, 4 -feet. Uh, a couple of these lots do not meet the dimensional requirements for this zone, and so there is a, uh, caveat as part of the sensitive areas development plan that they have to have the garages set back just so that it creates a better streetscape, uh, and that's... that's been part of previous additions. That ... that was part of these lots, as well, um, that have already been platted and developed. Uh, there is a ... uh, walkway, I believe it's between lots 89 and 90, uh, right here that will connect, uh, the subdivision, uh, the cul -de -sac, excuse me, to the sidewalk along Foster Road. And I don't think... Dickens/ There won't be anything to the west ... west of that then, there's (both talking) ITEM 5f CONSIDER A RESOLUTION APPROVING THE FINAL PLAT OF BROOKWOOD POINTE SECOND ADDITION, IOWA CITY, IOWA. (SUB12 -0002) Davidson/ ... see the river, the river is right here, uh, Coralville River Landing is in this area, and this'll ... this is all sensitive areas. There's some really significant cliffs. If you remember (both talking) Irving Weber stuff about him diving off the cliffs. That's this area right here, into the river. Uh, so we do hope at some point to bring, urn ... well, you can't see it here, but basically the ... the trail, uh, from that's already constructed further south, we'll bring that up here, uh, and connect with the trail that goes underneath, uh, I -80, which I think is right in this vicinity right here. We'll connect with that at some point in the future, but otherwise this is a, uh, sensitive areas outlot that would not be further developed. Any questions about ... this plat? Okay, the other plat we have then is Brookwood Pointe, Second Addition. Uh, the location map here ... uh, Sycamore Street, Lakeside Drive... Wetherby Drive, Wetherby Park is right here. And, I ... put in a, this is the preliminary plat, just to give you an idea of the ... this is Part One, which is already constructed, and right here is Part Two, but you ... I just wanted to give you an idea. Russell Drive comes down and connects to the rest of the streets to the north here, so there will be internal connection to the subdivisions to the north, as well as the access point here, uh, on Sycamore Street. Just to give you... and of course, uh, this street here, uh, Covered Wagon, uh, will extend over into Sandhill subdivision and provide good, and then you can see we've also got a ... a connection to the south here. March 6, 2012 Iowa City City Council Work Session Page 10 uh, street, uh, continuity here with the proposed ... and there's the ... the final plat. Uh, let's see, it is 20 lots. Uh, 22 acres in size, urn ... the Conditional Zoning requirements for the preliminary plat, uh, included a contribution, uh, a per -acre contribution towards the improvement of Sycamore Street, at the time of final plat approval, so that'll be a fee for the developer. Um, storm water management facilities (mumbled) uh, there is ... been an easement left right ... here, uh, to connect the sanitary sewer, uh, from this subdivision to Sandhill Estates, and there is a landscape buffer required ... uh, along the lots along, uh, Sycamore Street here. So those were the Conditional Zoning requirements. Uh, otherwise, uh, there's the usual, uh, sanitary sewer and water main tap on fees. And, this is recommended for approval by the Planning and Zoning Commission. Any comments? Throgmorton/ I'd like to ask, basically ask a question, Jeff, unless ... go ahead, Michelle. Payne/ My only question is is do you remember when Planning and Zoning approved this? Because it went to City Council on June 1, 2010. I'm just wondering, Eleanor, I think I might have already voted on this on Planning and Zoning in 2010. Should I not vote on it? Dilkes/ You ... you might as well not. I think there'll be enough votes. (laughter) Dobyns/ Jeff, you were mentioning it's going to be, uh, it's going to go over to Sandhill Estates, which I think is farther west, um, so is that going to be an extension of Langenberg Avenue or... Davidson/ Um, Langenberg ... yeah, this actually is connected by ... if I can find it here. By Covered Wagon (mumbled) here, um, I think Langenberg is further ... let's see, we don't have a ... Langenberg's further south (several talking). Dobyns/ ...it's going to route itself over to Sandhill's... Davidson/ Right, and then of course, uh... Dobyns/ ...which currently doesn't exist, but... Davidson/ Right, well, Langenberg ... part of Langenberg exists in Sandhill Estates. Dobyns/ Yeah. Davidson/ Yeah. Dobyns/ But it's going to be okay. I, one minor observation, when I was studying the final plat map, uh, maybe I'm visually impaired or whatever, but I found it very hard to find the borders of the subdivision, the addition itself. Eventually I did, uh, but it took some work, and that's okay, I did some work, but... Davidson/ Yeah, here's what I had to do, Jim. Throgmorton/ There ya go! ITEM 3b(6) Planning and Zoning Commission —December 15, 2011 Champion/ 3b or... Payne/ `B" as in boy. It's a Planning and Zoning Commission, December 15th meeting minutes. Hayek/ Uh -huh. Payne/ There were seven members present, but all the votes say 6 -0. Is that a typo? Karr/ That would be ... I'd have to check. Those minutes come to me prepared. So, um, we'd have to check. Payne/ I.. Karr/ One of them is a typo. Payne/ It happens to be the last meeting I was at, so I read them (laughter) so, um ... Throgmorton/ Well, since we're right at the start of the agenda, right, I ... I have a question about Item 3e(1), setting a public hearing concerning fees, stormwater fees basically. I ... I don't quite understand why that's included in the Consent Calendar. I don't ... why... why would it be a separate item? Karr/ We typically set public hearings on the Consent Calendar, and then hold `em on the regular. Throgmorton/ I thought we had, there were moments when we set public hearings later on. So... I find it very easy, um, I think my biggest difficulty was I started with the computer immediately when I came on Council, and it was just, I think I remember Michelle asking, now wait a minute, how many different things are there, I mean, you start figuring out, okay, there's the information packet, there's the agenda, there's the agenda packet, there's the work session, I mean, so once you figure out what those documents are, I have found using my computer very easy. I just decided ... I didn't want any more paper in my house than I had to have. I've got too much already. Dobyns/ But that's a MacBook, and Michelle has an iPad too... Karr/ That's why, part of the experiment as ... as Susan outlined, is what we've learned from individual Council Members, and that's part of the reason that our recommendation is not all of you to do one thing, because all of you may not be comfortable doing it, and that probably would not be the key to success. What we want you all to do is to think in terms of what you're comfortable with, and if it's an iPad, if it's a laptop, if it's, um, you know, and we can work with you on that, but what we committed to you was to tell you the advantages and disadvantages of City -owned equipment and not. The staff certainly has looked at iPads because we believe they're the most convenient. They're lighter weight. Uh, easily trans... transportable, urn ... that's what we're looking at, but also as Susan has ... has shared with you is there's an advantage Susan has ... has discovered in having them side by side in looking at them, and if you're so inclined, I would suggest we just schedule a time and we just literally set aside a block of time, so we just look at the use of the packets and how to proceed. But we didn't want to invest in ... in a product that might not work for all of you. Um, and realizing that each of you ... yeah. And so we ... I've also got an iPad in my office, um, that we can take a look at, and we're also well aware that there'll be training involved. Mims/ So with what you've done so far from a staff perspective, you are comfortable that you have things set up that they are very ... they're easily deliverable and workable on a PC or on an iPad or... Now that they're electronic packets, you're getting calls more often, sooner than you pick up the literally `hard copies.' So this ... well, not days, but ... (laughter) this literally allows you by subscribing the ability to get it at the same time the constituents and the media does. You have one community that's indicated an interest, and in that particular case, they have, uh, tie - barred their donation to a million dollar contribution by our Foundation. So ... that in itself is going to raise some, you know, concerns in how we structure agreements to make that work. We think the Foundation is capable of raising a million dollars, um ... but there's the potential for a risk shift back to the City. The reason we kind of think that that's a doable approach is if we had pursued getting everybody trying to give upfront commitments, uh, then those commitments may serve as a... inhibitor to getting the donations raised through the Foundation. So ... we kind of slipped the argument a little bit and said that if you ... if you, um, want to contribute, based on a certain level of funding, we would consider that as a, you know, as a, um, proposal from each of the communities, which I think puts some pressure back then on the Foundation to raise the funds. Champion/ So actually they could limit the amount they're willing to give to the capital, but... Markus/ For the, uh, construction of the facility. Champion/ Right, so I mean, always ... you could always subtract, I mean, we don't really know what it's going to cost. It hasn't been designed yet. Markus/ That's correct. Markus / What's complicating this to some degree is the process that we are thinking we understand in terms of FEMA, and whether they will allow some ratcheting back after we get the bids, or whether they're going to insist on an approved project of a certain size. So we're trying to get those types of issues resolved, which you've heard other agencies discussions with FEMA. We suspect that it's not going to be all that conclusive when we finally get the information back. The other thing I'll tell you ... is that the, the way this was designed, we're supposed to actually have this thing constructed by now. So we're in the process of pursuing an extension to that schedule. We didn't get ... get past certain thresholds until last summer. The likelihood of getting everybody on board and making this all work by this summer was pretty remote. So we, um, we're in the process of applying for an extension of time to make this work. Which ... may give us time then to secure commitments from ... from the other jurisdictions. I would point out that there are, if Johnson County, Iowa City, Coralville, and North Liberty all participated, you'd be talking about 94% of the animal intake in the entire county. My expectation is that, um, people are going to have some trouble, other jurisdictions. You saw Coralville's letter, I take it. You've read that. Other jurisdictions may have some difficulty with the capital contribution. My take is, we have to be as insistent on the capital contribution as we do on the operational contribution. And then there's the other thing and ... and tell me if I'm going too long with this, but I call it the `twisted argument.' And the twisted argument is that, potentially people in other jurisdictions will find a jurisdiction that participates and manage to have an animal show up there rather than in their jurisdiction. In fact, one of the jurisdictions that discussed contributing to this, uh, at least one comment I'm told was made at the official meeting that, well, eventually that animal will wonder into Iowa City anyway, uh, some of you may have heard that. Um ... I think that's... that's... that's a potential. But I find it very difficult for us to make a conscientious decision to burden our taxpayers for services that really are the responsibility of jurisdictions outside of our borders. So... Hayek/ Okay. Markus/ I've been pretty consistent in that argument all along, and I don't intend to change that particular philosophy so ... just so you know, that's kind of where we're at right now. I attended an Emergency Management of Johnson County meeting and two things from that meeting. Um, currently Johnson County has no 28E agreement with Iowa County for hazmat cleanup. And we passed a motion to notify Iowa County that any requests for hazmat cleanup in Iowa County must come from Des Moines so there's a way to pay for it. Um, the other thing is, um ... we ... um ... voted to change ... that the siren will go off, not only when there's a tornado but also when there is a severe thunderstorm warning with winds of 75 miles per hour or greater, and one -inch, uh, golf ball sized hail. Um, and I have some information maybe that we could put on our web site to let people know about this and what it means, because obviously the tornado siren, the emergency siren will go off more often that way. So I'll give that to Marian for ... to put on the web site. Dickens/ I just have one thing that I'll bring up during Council time at the (mumbled) it's just a, uh, fundraiser that will be taking place, the Iowa City Hospice, under the Community Big Top, so I'll say a little bit more of that at the end. Joint Meeting (05): Hayek/ Items for the joint meeting, IP5. This is typically a ... a way for us, if we want issues to be addressed between governments, we can put them on the agenda and asked that they be addressed by, you know, whether it's something we want to roll out or we want somebody else to explain in these meetings. It can create moments of great friction, uh, sometimes, but they can sometimes also lead to good discussion. Um ... just laying it out there! (laughter) Uh ... we don't have to provide anything, um ... so... Karr/ We just don't have another meeting before the agenda goes out, so this was our time to do that. Hayek/ Yeah. I mean, some of the issues we're dealing with are presently in process, whether it's the Animal Shelter or other stuff. So ... I think we want to keep our eye on ... on some of the School District's work, um ... with enrollment, etc. I don't think right now is an appropriate time for us to get into that conversation because they're on the front -end of it, but ... just flag that for everybody. Okay! Pending work session topics. Pending Work Session Topics: Throgmorton/ I would like to bring one up, Matt, um... several weeks ago we received a letter, I think it was a letter. May be ... may have been an email from Annie Tucker, concerning the PCRB, Police Citizens Review Board, uh, its procedures, its name, and I don't know, maybe at least one other topic. Uh, I think we should, uh, discuss that, her suggestions, especially in light of the PCRB's minutes in this particular packet, uh, concerning Complaint #1102. It looked to me, as I was reading it, that it's timely to do that, if in fact we chose to do it, but you might be able to tell me whether it's timely. Looked to me like the PCRB has completed its work on that complaint. Dilkes/ Well, I ... I think we need to distinguish between whether you're talking about the complaint, or you're talking about um, suggestions that have been made for revising the ordinance. Throgmorton/ What ... what I had in mind, I'll be very brief about this, is focusing on the suggestions that she made in her memo or whatever it was concerning the name, the procedures, and I think there was at least one other topic she brought up. It was stimulated by this particular complaint, but we don't need to focus on the complaint. Hayek/ My thought is, I met with Annie Tucker a week ago, and she made a similar case, and I encouraged her to ... to do more research, and ... and to submit something, um, that ... that looks at what other ... other communities do, what's ... what specifically she thinks some of the problems we're facing are. I don't know if right now I'm interested in ... in going down that path, but uh, you know, Annie makes some fair points, and I encouraged her to continue the research. So that's where I stand right now. Karr/ If I may also, when you noted the minutes of the PCRB, they also noted that many of those items should be brought forth at their forum that's schedule in May, and I think there'll be another opportunity for Annie to do more research, or citizens, um, and/or further discussion on some of those very issues. So it might be helpful to wait til the forum is completed, and hear what is brought forth and what ideas are exchanged as a result of it, as well. Mims/ I think that's a really good idea, Marian, because as I was looking at that and they were talking about the forum and ... and hopefully, you know, getting that well advertised to people, I ... I would agree that I think we need to relook at it. I want to be careful that we're not ... we have to keep things totally separate. We have to look just at the PCRB, the ordinance that sets it and how it's run, etc. Um, but I think waiting til the forum is done, um, and a little more time has passed, give Annie a little chance ... chance to do a little more research, and then maybe look at it come summertime (mumbled) Hayek/ Okay.
