HomeMy WebLinkAbout09-09-2003 ICPD SOG'S Iowa City Police Department 0 Standard Operating Guideline SOG #: Effective date: 03-04 08/19/03 Subject: Reference: Evidence, Evid. en~ ~' .~- Non-testimonial Evidence Collection, non-Testimomal Eviden~ Collection Section: Issue #: Investigations 1 Purpose: The purpose of this order is to identify procedures to be used when a person is not in custody and non-testimonial body specimens are to be collected. Definitions: Non - testimonial specimen collection - The collection of samples of a persons blood, saliva, hair, or othe¢ body specimens, for the purpose of examination in a criminal investigation. Procedures.' The Johnson County Ambulance Service has agreed to assist in the collection of non-testimonial body samples. The collection of such samples must be based on consent of the person from whom the specimen is to be collected OR pursuant to a subpoena or court order. As a service to Johnson County law enforcement agencies, upon request, paramedics will collect blood, saliva or hair samples. The following procedures are to be followed when having a member of the Johnson County Ambulance collect the requested specimen(s): Specimen collection for law enforcement · Contact the ambulance service requesting the on-duty Field Supervisor in order to arrange a time for the collection to take place. · Escort the individual to be tested to the ambulance service. If it is not appropriate or convenient for the collection to take place at the ambulance service, other arrangements may be made at the discretion of the Johnson County Ambulance Supervisor. The officer escorting the individual must remain with the individual at all times. · Provide the appropriate collection kit. These can be obtained from a CST. For blood, a standard blood kit will be used. · The officer will open the kit and hand the paramedic materials needed for collecting the sample. · The paramedic will obtain the sample and hand the collected sample back to the officer. · The officer will seal the sample in the collection kit and have the attending paramedic sign necessary documents. · The attending paramedic must document the collection of the evidence. They must be provided with the name and date of birth of the individual from whom the specimen was collected, and the name and badge number of the requesting officer. · The collected specimens will be submitted to evidence in accordance with Departmental Directives. If the person is in custody at the jail, investigators are to make arrangements with the regularly scheduled Physicians Assistant to collect the sample at the jail. If the person is in the hospital, arrangements can be made with hospital staff to collect the desired specimen(s). Pursuant to Iowa Code 321J.11, only a licensed physician, licensed physician assistant, medical technologist, or registered nurse, .. . may withdraw a specimen of blood for the purposed of determining alcohol concentration..., therefore, DO NOT use the Johnson County Ambulance Service for drawing blood pursuant to an OWl.
