The goal of the proposed zoning changes to protect stabilization of neighborhoods is supported by the association within those districts. The impact on the council decisions appears to impact numerous zones in Iowa City. Our recommendations refer to Section 1 of the ordinance amending Title 14, Article 1, Articles 2B and 2C and Article II amending Title 14, zoning Article 4A off - street parking and loading standards. Please refer to the attached document on proposed changes. The Home Builders Association urges you to study the impact on the proposed zoning changes. We believe it will have a significant impact on multi - family housing in the entire community. AN ORDINANCE AMENDING TITLE 14, ZONING, ARTICLES 2B AND 2C, AND PARAGRAPH 14- 4B -4A -7 TO ESTABLISH THREE AS THE MAXIMUM NUMBER OF BEDROOMS ALLOWED WITHIN A MULTI - FAMILY DWELLING UNIT IN THE MULTI - FAMILY ZONES AND IN COMMERCIAL ZONES THAT ALLOW MULTI - FAMILY DWELLING UNITS AND ESTABLISH GRADUATED RESIDENTIAL DENSITY FORMULAS FOR MULTI - FAMILY DWELLINGS BASED ON THE RELATIVE NUMBER OF BEDROOMS PER DWELLING UNIT IN MULTI- FAMILY ZONES AND IN COMMERCIAL ZONES THAT ALLOW MULTI - FAMILY DWELLING UNITS. A. Reduce University Impact Area to exclude the Central Business District. (That area generally defined as bordered by Burlington Street, Gilbert Street, Market Street and Madison Street). B. Table 211-3 Maximum Density Standards for Multi - Family Dwellings in Multi - Family Zones 1. Keep the bonus density for efficiency and one bedroom units. Agree with recommended changes. 2. Delete the 20% cap on 3 bedroom units in RM -12 zones. 3. Provided the University Impact Area excludes the Central Business District (described above in (A)), only increase the square footage requirements for 3 bedroom units in the University Impact Area. C. Table 2C -2(c) Maximum Density standards for Multi - Family Dwellings in Commercial Zones. 1. Delete the 20% cap on 3 bedroom units. 2. Only change to the square footage requirements should be to reduce the square footage requirement for Efficiency or 1- Bedroom Units in a CB -2 Zone to incentivize construction of 1- Bedroom Units. 3. For Efficiency or 1- Bedroom Units, the square footage requirement should be reduced rather than increased in the CN -1 and MU Zones. 4. However, for mixed commercial /residential buildings, the number of dwelling units and relative number of bedrooms allowed is based on the size of the lot and the zone as stated in Table 2C -2(c), located at the end of this Section. Following is staff's response to the questions that have been raised in public meetings, in the media, and in correspondence received: How will the proposed change to the definition of "household" affect existing rental properties? As with any change to zoning, existing legal uses are grandfathered. With regard to the proposed change to the definition of household, any existing rental property can continue to be rented to the same number of unrelated persons allowed under the current rental permit. More specifically, existing single family, two - family, and multi - family units located in the RM -20, RNS- 20, CO -1, RM -44, and PRM Zones may continue to be operate under the current maximum occupancy listed on the rental permit, even if the definition of household is changed. This is similar to the grandfather rights in those zones where the occupancy standard was changed in 2005 with the adoption of the new zoning code and again in 2008, when the occupancy standard changed in the Central Business Zones. All those existing units continue to be grandfathered at the maximum occupancy listed on each individual rental permit. Since the maximum occupancy for each unit is documented on the rental permit, this approach has worked well. How will the proposed changes to the residential density formulas for multi - family dwelling units affect existing multi - family properties? All existing legal uses will be grandfathered if the new standards are adopted. Only new multi- family buildings constructed in multi - family zones and in commercial zones after adoption will be affected. Will any of the proposed changes to the density formulas affect existing or future multi- family dwellings in Planned Developments? Multi- family dwellings constructed in planned developments zoned single family, such as the Peninsula, Mackinaw Village, Olde Towne Village, Saddlebrook, or any other existing or future planned development zoned single family (OPD -5, OPD -8, OPD -RS12) will not be affected by the changes to the residential density formulas, since these new formulas only apply in certain multi - family zones and certain commercial zones. Will any of the proposed changes affect single family dwellings or duplexes? As is currently the case, single family dwellings and duplexes can continue to be developed with no limit to the number of bedrooms. The new residential density formulas only apply to multi- family dwellings in certain multi - family zones and certain commercial zones. The change to the parking standards only applies to multi - family dwellings located in the University Impact Area; it will not apply to single family dwellings or duplexes. Are there other college towns that have adopted similar standards? Madison, Wisconsin; Bloomington, Indiana; Lawrence, Kansas; and East Lansing, Michigan all have adopted some form of graduated density formula based on the relative number of bedrooms per unit, rather than regulating solely on the number of dwelling units per acre. East Lansing, Michigan has graduated density formulas for each of its multi - family zones and makes further distinctions between multi - family units occupied by unrelated persons and those occupied by families or functional families. In Madison, Wisconsin, in addition to graduated density formulas, multi - family dwellings are allowed as conditional uses that each must be approved by the Plan Commission (similar to our special exception process). There are a number of college towns that require 1 parking space per bedroom in their highest density multi- family zones located near the college campus. In addition, some also require a minimum amount of visitor parking. Many of these communities also have minimum open space requirements, maximum lot coverage standards, and larger required setbacks or building separation requirements that would also affect the maximum number of units and the occupancy on any given property. In comparison, Iowa City is on the low end of the spectrum with regard to standards that ensure a minimum amount of open space is achieved on each multi - family property — these are standards related to building setbacks, minimum lot size, maximum lot coverage, minimum usable open space, minimum building separation, and similar. How will the proposed changes affect property values? assessed values? Diversity of housing options and prices? Property values in an area are not based solely on the number of dwelling units allowed per acre. Rather they are based on a variety of inter - related factors: the residential density, the quality of the housing, the stability of the neighborhood, the general conditions in the neighborhood, nearby services and amenities, etc. High density neighborhoods that are planned and designed to achieve a high quality living environment will have higher property values, be more stable, and generate more property taxes than high density neighborhoods that are poorly designed and planned. If living conditions in a neighborhood deteriorate or if the housing mix changes to the point that it is only serving one demographic, it may reduce the marketability of the area to new businesses and employers that provide services, jobs, restaurants, retail, and recreational and cultural amenities that create a healthy and sustainable community. Zoning standards that favor only one type of multi - family housing — dorm -style apartments for short term college renters — will not only influence the types of businesses that will be willing to locate in downtown Iowa City, it may also reduce the ability to sustain neighborhood schools and other community institutions that rely on a stable population of more permanent residents, whether they are renters or owners. The graduated density formulas proposed are intended to make it financially feasible for developers to build a wider variety of unit sizes and types. This in turn will provide more affordable options for other populations besides undergraduate students to live near downtown Iowa City and the university campus. Hundreds of undergraduate student apartments have been built in the last ten years in and near downtown Iowa City, most of which are designed only to serve this demographic with dorm -style units containing 3 to 5 bedrooms, but with none of the support services and amenities provided in on- campus housing. The current density standards which were established in the 1970s were not designed in anticipation of these types of apartment units and therefore make no distinction between a 1- bedroom unit and a 5- bedroom unit with regard to the amount of lot area needed. Unlike multi - family properties in non - college towns or in outlying areas distant from the university campus, dwelling units close to the University campus are designed, priced, marketed and often leased on a per bedroom basis. As a number of other college towns have realized, it Page 3 makes sense to regulate the residential density on a per bedroom basis to reflect the unique market conditions near a large college campus. Density standards based on the number of bedrooms per acre rather than the number of dwelling units per acre will allow the market to respond more freely to the type and size of dwelling units demanded in the downtown market and will open up opportunities for other populations to compete for housing in these areas. One speaker cited low vacancy rates for apartments in the downtown area and argued that if there are no new opportunities provided for high density multi - family development, prices will continue to rise. While we agree with this basic economic principle, we do not agree that these zoning amendments will foreclose opportunities for multi - family development in and near downtown. Iowa City's residential density standards in our highest multi - family zones are consistent with or higher than other college communities we have surveyed. Given that our two highest density Central Business Zones do not have a limit on residential density is testament to the City's commitment to promoting walkable, mixed use urban neighborhoods. For example, a quick count of five recently completed multi - family buildings constructed in the CB -5 Zone reveal an average residential density of 78 units per acre. The new density formulas proposed for the RM -44, PRM, and CB -2 Zones will allow residential densities up to 100 units per acre, but will help achieve a broader mix of apartment sizes and types to support a mix of residents in the downtown area. In addition, the City is promoting new areas for residential development in Riverfront Crossings, which is a large area that extends from Burlington Street south to Highway 6 and includes land on both sides of the Iowa River. The recently adopted sub -area plan for only a 9 -block portion of Riverfront Crossings illustrates a potential yield of nearly 1000 new multi - family units. We are also researching standards for "private dormitories," which could be included as a use allowed by special exception in appropriate locations adjacent to campus. These would be high density student dorm rooms and apartments that include the types of amenities and support and supervisory services found in public dormitories. It has been argued by some that the assessed values of existing properties will fall because of the new occupancy and density standards? Assessed values are based on the current land value (which is generalized for an area) and the value of the existing uses, improvements and structures on the property. Since all the existing occupancies and unit densities are grandfathered, the new standards should not affect existing assessed values or the amount of property taxes collected. In the final analysis, there are a number of questions that need to be considered: • Are Iowa City's current standards resulting in safe, healthy, and affordable living conditions for students? for singles? couples? retirees? families? • Are our current standards resulting in a variety of housing options in the downtown area that will help support a diversity of businesses in the central business district? • Are our current standards resulting in the high quality, urban living environments that will attract new residents, businesses and employers that will help to support property values and increase the tax base over the long term? Staff recommends the proposed changes to occupancy, density, and parking standards as a first step in addressing recent concerns about the stability and long term economic health of downtown Iowa City and the surrounding residential neighborhoods. r ��!_,. ®4,t CITY OF IOWA CITY -W-, 01 1k �� MEMORANDUM I - Date: February 24, 2012 To: Planning and Zoning Commission From: Karen Howard, Associate Planner Re: Proposed Zoning Code Amendments related to Neighborhood Stabilization Introduction: In November of 2011 the City Council directed staff to review the High Density Multi - Family (RM -44) zoning designation. The Council asked if the zone should be eliminated. The question arose as a result of concerns expressed by neighborhoods pertaining to large parties, excessive noise, vandalism and spillover parking. Due to these concerns, there has been focused neighborhood opposition to recent infill developments proposed within central neighborhoods close to downtown and the University of Iowa campus. In January, after considerable public concern about redevelopment in the Central Business Service (CB -2) zone in the 500 block of Washington Street, the Council directed staff to broaden the review of the RM -44 zone to include other zoning districts. We were asked to consider issues that affect the strategic plan priority of neighborhood stabilization including parking requirements, building height and scale, open space, dwelling unit density and occupancy (essentially the number of bedrooms per unit). History/Background: The most significant concern has been the proliferation of apartment buildings with large numbers of bedrooms (3, 4 and 5 bedrooms) per unit. Such properties often function as unsupervised dormitories attracting large numbers of college students, but without the amenities and supervision usually present with on- campus housing. A review of nuisance complaints and crime reports reveals a high number of complaints in higher density housing areas near campus. Significantly fewer complaints occur for older buildings containing 1- and 2- bedroom apartments. In the 1970's when the dwelling unit densities per acre that currently apply in the zoning code were established, most apartments being built contained 2- bedroom units. However since the mid- 1990's the majority of apartments being built near campus and downtown have been 4- and 5- bedroom units, resulting in a doubling of the density of bedrooms per acre than what was anticipated when the density standards were originally adopted. This change is likely in response to a significant increase in enrollment at the University over this time period without a commensurate increase in the number of on- campus dormitory units, which has increased the number of undergraduate students searching for off- campus housing. With these current market pressures, the density formulas adopted in the 1970's that require the same amount of lot area per unit regardless of whether the units are 1- bedroom or 5- bedroom units, have created a significant market incentive to build units with the largest number of bedrooms possible and created a disincentive to build smaller units. In other words, rather than allowing the market to respond freely to the relative demand for apartments of different sizes, the zoning rules are incentivizing 3 -, 4- and 5- bedroom dormitory- style apartments that are only attractive to one market segment — undergraduate college students. In addition, if there are singles, couples, retirees, older students, or families that are searching for an affordable apartment, it is financially difficult for them to compete in a market where up to 5 unrelated undergraduate students can pool their resources and outbid them for most of the apartments units being offered in the market (In neighborhoods close to the University campus rents for large apartments typically range from $400 -600 per bedroom per month; $2000 and up for a 5- bedroom apartment). This is problematic not only because there is Page 2 a relative lack of smaller units being built that would be more affordable and attractive to non - student populations, but also because if enrollment at the University tapers off or decreases in the future, the large dorm -style apartments may be unmarketable to other populations. There has been an effort on the part of the City and the University of Iowa to promote programs and policies that help to create a stable, healthy, and livable environment within central neighborhoods that will be attractive and affordable to both student and non - student residents. New nuisance policies were adopted several years ago to help curtail nuisance issues and over - occupancy and to educate young students on their rights and responsibilities. The UniverCity Partnership program is another successful ongoing effort between the City of Iowa City and the University of Iowa to purchase homes within central neighborhoods, invest in rehabilitation of the structures and make these available to income - qualified individuals and families wanting to live close to the amenities and employment opportunities in downtown Iowa City. Despite these ongoing efforts, it has become apparent that more needs to be done. One of the goals adopted in the Central District Plan is to "work to achieve a healthy balance of rental and owner - occupied housing in the district's older neighborhoods to promote long -term investment, affordable housing opportunities, and preservation of historic homes and neighborhoods. One of the specific objectives listed under this goal is to "examine existing zoning rules to ensure that they support housing goals and neighborhood stabilization efforts." Discussion of Solutions: To that end, we have researched zoning techniques used in cities that have large universities including Ames, Madison, Lawrence, Lincoln, and East Lansing. These cities have addressed concerns related to apartments that are designed for the student market. Based on this research, staff has identified techniques that we believe will help address the concerns as they apply to Iowa City. Establishment of a University Impact Area (UTA) would apply to neighborhoods close to the University of Iowa Campus (See attached Map). Properties within the UTA would be subject to standards designed to allow continued development of multi - family housing, including student housing, but with controls and requirements that will help to prevent some of the negative effects associated with large concentrations of dormitory-style apartments. In addition, we are proposing to reformulate the density and occupancy standards to eliminate the incentives created by our current zoning standards to build large apartments and the relative disincentives to build smaller units. While we are still researching and analyzing a number of different strategies for enhanced enforcement, and to re- examine standards for building height, scale and lot coverage, and to address the relative lack of open space in central neighborhoods, we have prepared three zoning code amendments for your immediate consideration. maximum of three: Currently, in a majority of the zones across the city, including all single family zones, the low density multi - family zone, and almost all commercial zones, including the Central Business zones, the maximum number of unrelated persons that may reside within one dwelling unit is three. Limiting the number of bedrooms per apartment to 3 would help assure that as demographics and student enrollment change over time, the design and layout of apartments will be attractive and rentable to populations in addition to students. Students are able to live in 1 -, 2 -, and 3- bedroom apartments, but 4 and 5 bedrooms are generally not attractive to any tenants other than students. Eliminating the possibility of additional 4- and 5- bedroom apartments will help to address the negative effects that such high densities have on the community as well as help assure that a form of housing with limited market is not overbuilt. Impact Area (UTA): In all multi - family and commercial zones the parking requirement for large apartments is lower on a per bedroom basis than it is for smaller apartments. For Page 3 example, in all zones except the PRM Zone, CB -5 and CB -10 Zones, efficiency, 1- bedroom, and 2- bedroom apartments all require 1 parking space per bedroom. However, for apartments than contain 3 bedrooms, the parking requirement is only 2 spaces, 4- bedroom apartments require 3, and 5- bedroom apartments require 4. In the PRM Zone, the multi- family zone typically located closest to the University campus, and also the City's highest density multi - family zone, 3- bedroom apartments only require 2 parking spaces, while 4- and 5- bedroom apartments only require 3. This provides another incentive to build 3- bedroom units over smaller units. In addition, in central neighborhoods close to downtown and the University campus where there is a higher demand for both on- and off - street parking, this may be contributing toward parking congestion, illegal parking, and parking spillover into adjacent neighborhoods. It should be noted that the proposed amendments to increase the parking requirement for 3- bedroom units would only apply within the UTA. It would not apply to 3- bedroom apartments in outlying neighborhoods. Further, if the other proposed amendments to dis -allow new 4- and 5- bedroom apartments are not recommended for approval, the Commission should consider increasing the parking requirement for any new 4- and 5- bedroom units in the UTA to 1 parking space per bedroom. allowed within a multi - family dwelling unit to three: The attached zoning amendments include new tables that list graduated density formulas for the multi - family zones and for commercial zones that allow multi - family units. These are summarized below: • In the RM -44, PRM, and CB -2 Zones these new formulas would in effect allow twice as many 1- bedroom apartments as would be allowed under the current density formulas, but would increase the lot area needed for 3- bedroom units, so that approximately the same amount of lot area would be needed per bedroom regardless of the size of the units. • In the medium density multi - family zones (RM -20 & RNS -20), additional lot area would be needed for 3- bedroom units. For 1- and 2- bedroom units the density standard would remain the same. Given that these zoning designations are fairly prevalent in the central and often more historic neighborhoods and in areas that were previously down -zoned from higher zoning designations no longer in existence, we would not recommend a density bonus for 1- bedroom units. In these more historic areas, it might serve as an incentive to tear down existing buildings that already contain 1- bedroom units in order to construct larger buildings that might be out -of- scale with surrounding homes and further deteriorate the residential character of these older neighborhoods. • There would be no change in the RM -12, CO -1, and CC -2 Zones. These zones already have a relatively modest residential density that is more compatible with single family areas and with mixed central neighborhoods where stabilization is a goal. • The CN -1 and MU Zone density standard would be changed to match the standard in the CO -1 and CC -2 Zones. The Neighborhood Commercial Zone is typically located directly adjacent to lower density residential areas. The Mixed Use Zone is a relatively new zoning designation that replaced the Residential Office Zone. It is intended to allow a mix of lower density residential uses and small -scale commercial uses that are compatible with each other and with nearby lower density residential areas. It also provides the opportunity for residents to run a business out of their home or re -use an older home for a small -scale or start-up business. Staff finds that the current residential density formula that would allow up to 24 multi - family dwellings per acre would create an incentive to consolidate properties and build larger -scape apartment complexes that would be counter to the intent of these zones. Therefore, staff recommends that the density standard be lowered to match what is allowed in the RM -12, CO -1, and CC -2 Zones. o In the CB -10 and CB -5 Zones where there is no limit on the residential density other than the limit on floor area (FAR) and limit on building height, staff recommends Page 4 establishing a limit on the percentage of 3- bedroom multi - family units. This will provide some impetus for building 1- and 2- bedroom units that would broaden the mix of apartment sizes in the central business district and provide opportunities for both student and non - student households to live downtown. o It should be noted that these new standards would not apply to single family, single family attached dwelling units (townhouses) or two- family (duplex) units, nor would they apply to multi - family dwellings located in planned developments where the underlying zoning is single family (OPD -5, OPD -8, OPD- RS12). This provision would only apply to multi - family uses in multi - family zones and commercial zones where multi - family uses are allowed. Recommendation: Staff recommends amending the zoning code as indicated on the following pages. Staff finds that these changes are consistent with zoning practices used in other college towns to create better living environments in high density multi - family areas and mixed neighborhoods close to campus. There were some comments made that "oh, we all know that development will still continue, we are just changing the size of the bedrooms being put in the buildings." Well I put some numbers together to try to give you a better grasp of the extent of the density reduction that these proposals will result in for any development: Table 1 is a corner lot 80'x150' analyzed for 3 different zones (RNS -20, RM -44, and PRM), showing the most economical use of the lot under the current code vs. the proposed code (assuming all three changes that are being proposed are approved). I've also heard discussions from the staff a4,qut this process not being a downzoning, as these proposals are actually increasing the -pumblr of units you can put on a property. There is a big difference between number of unit';;; number o" bedrooms. This can be very misleading as the number of people that you cao Ne in-a building, is being greatly reduced as is shown in these tables. I ask that you take some time to verify these numbers, or even ask staff to verify them, as a 30- 50% reduction in density is a very big deal to property owners. What to these numbers mean to developers? This will effectively kill the majority of development. I don't think that was your intent as a council to do so, as I know that one of your goals as a council is to encourage development. Staff maintains that this will not impeded development, but I know that it will. Take the project that I was proposing on the corner of Burlington and Governor Street for example. This is the first example shown in Table #1 in the RNS -20 zone. The building that I was going to build would have had 23 bedrooms and would have been assessed at $1.5 million. The 12 bedroom building, that I would be able to build if you pass these proposals, would be assessed at $780 thousand dollars. After factoring in the differing construction cost to build each building, as the smaller building would cost less to build, my net loss as a property owner, is $500,000 for this one property. If I am only allowed to build 12 bedrooms on this site, the cost to build a new building would cost more than what it would be worth by over $100,000. 1 don't know very many people that will be willing to do any development to lose money. This is exactly why I can guarantee to you that these proposals will effectively kill the majority of development. If you would like me to go further into these number 1 would be glad to provide you additional information, but 1 think I will be over your time limit if I keep rambling. Secondly, if you look at the board of regents' webpage, they project continued enrollment increases of 1% to 2% for the years to come. What I think will happen from these changes is that development will severely slow down, and as demand for housing continues to go up, rents will be forced to go up (simple supply and demand economics). As rents go up, all the 3 bedroom houses in the neighborhoods a little ways from downtown, that you are trying to stabilize, will begin to make sense again for investors to begin converting into 3 bedroom rentals again. We will be right back where we were in 2005 before the first attempt to downzone was implemented. This is exactly the opposite effect of what I believe you want to incur with these changes. The next issue you need to consider with these changes are the tax consequences. As I'm sure the council is aware, the conversion of Coops last year will reduce the collected taxes next year by $700k (that was the number I got from the assessor's office). There is potential for this number to be 3-4 times this amount if all properties that could convert do. This amount will need to be paid by someone and it will have to be spread over all the taxable parcels ip town. There are 4 projects in the downtown area, with plans submitted to the buildini&depa�nent which will be eliminated or greatly reduced in size if these proposals pass. I cated^g $200k /yr. loss in taxable income from these 4 projects alone. This is one of the-dJ��rs youTO increase your taxable base in a very large way, as the effects of these changes over the next 5 to 10 years will add up to a large amount of money. I don't want to be up here just telling you reasons on why these proposals will not be in the best interest of the city, without giving you some options that I think will be a better solution to stabilizing the neighborhoods. I propose that you draw up maps of the neighborhoods that you want to stabilize and protect, similar to the current conservation district maps in the code book, and enact these changes to those areas, and those areas alone. The way these changes are written now, they go into effect city wide and will have a negative economic impact on many owners that are no way close to the neighborhoods that you are trying to protect. Also, additional incentives should be put into place to allow for more 1 and 2 bedrooms to help make up for the 30 -50% reduction of density and loss of property values. This would allow for some development to continue in these zones instead of just stopping all development in these neighborhood areas. So please consider some of these other proposals you have heard here tonight, and don't just vote yes, because you feel that something needs to be done. Let's get it right, this time, so that future councils don't' have to deal with these same issues in 5 to 10 years. Thank you for your time. After The proposed amendments I would be able to construct 12 — 3 Bedroom, 2 bath Condominiums at an approximate cost of $1,750,000. 2. 13 — 3 Bedroom, 2 bath condominiums at an approximate cost of $1,950,000. After The proposed amendments I would be able to construct 8 — 3 Bedroom, 2 bath and 1 - 2 Bedroom, 2 bath condominiums at an approximate cost of $1,350,000. Project items I and 2 are reduced by over 30% due to the parking proposal of 1 space per each bedroom. None of these project costs take into consideration any demolition costs or debt amounts currently owed on the property. All projects present the maximum number of bedrooms in each case, before and after the proposals. Both of these projects are in the RM -44 zone which currently requires 1000 square feet for each constructed unit. The proposed amendments will require 500 square feet for a 1 bedroom unit, 1000 square feet for a 2 bedroom unit and 1500 square feet for a 3 bedroom unit. These projects are located in the area bordered by Gilbert, Burlington and Dodge Streets and the railroad. This area is 100% rented residences. 3. 10 — 4 Bedroom, 2 bath condominiums at an approximate cost of $1,700,000. After The proposed amendments I would be able to build 6 — 3 Bedroom, 2 bath and I — 2 Bedroom, 2 bath condominiums at an approximate cost of $1,025,000. Project item 3 is reduced by approximately 40% due to the reduction of the non - related occupancy limit from 4 to 3. Project item 3 is then reduced again by the lot square footage increase in the RNS -20 zone from the current requirement of 1800 square feet per unit to the proposed requirement of 2700 square feet for a 3 bedroom unit (I and 2 bedroom units are required to have 1800 square feet, each, under the new proposal). A neighboring project built within the last 5 years has 9 — 4 bedroom units and a 1 bedroom unit with less total lot square footage than project item 3. This project will be very doubtful at ever being developed since the current structures have a combined 26 bedrooms and the maximum number of bedrooms with any combination of 1, 2 or 3 bedroom units, under the proposed amendments, is 20 total bedrooms. If you calculate the difference in all three projects from before and after the proposed amendments that equates to a $2,025,000 loss in tax base. If project 3 is not developed the loss in tax base is then $3,050,000. None of these projects currently require any review from the Planning and Zoning Commission or the Board of Adjustment. These are in compliance with the current zoning code requirements. The multi- family residential zones require a minimum amount of lot square footage per unit, thus limiting your lot to a finite number of units. Currently, 1000 square feet per unit is required in the RM -44 zone and 1800 square feet per unit is required in the RNS- 20 zone. Currently, you could build 3 bedroom units in each of these zones by fulfilling the aforementioned lot square footage requirements. The proposed amendments require 1000 square feet in the RM -44 zone to build a 2 bedroom unit and 1500 square feet to build a 3 bedroom unit (500 square feet to build a 1 bedroom). In the RNS -20 zone a 2 bedroom unit requires 1800 square feet and a 3 bedroom unit requires 2700 square feet. The proposed graduated lot square footage requirements reduce the bedrooms by 1 bedroom per unit if you choose to develop the same number of units on your finite lot. (Otherwise to build 3 bedroom units you must reduce the total number of 3 bedroom units by at least 1/3). Assuming that 1 non - related individual uses each bedroom results in these proposed amendments having the effect of reducing the non - related occupants to 2 per unit. This proposal is more restrictive than any other zone that you have previously limited to 3 non - related individuals by changing the definition of the word "household." The property owner's in these zones are therefore being treated unfairly compared to property owner's in other zones that you have limited to 3 non - related individuals. Assuming the requirement for parking is to keep automobiles off of the streets, what development will occur in the future will have minimal effect on the streets currently lined with cars. It would be more effective to not allow street parking on selected streets in the University Impact Area than require more parking from new multi- family developments. Not allowing on street parking on selected streets would require drivers to lease private parking, utilize public parking ramps or not bring their vehicles to town. This would have a greater overall effect by patronizing public parking ramps, increased utilization of public transit, increasing safety, making streets more bicycle- friendly and allowing easier access during snow emergencies and street cleaning. There were some comments made that "oh, we all know that development will still continue, we are just changing the size of the bedrooms being put in the buildings." Well I put some numbers together to try to give you a better grasp of the extent of the density reduction that these proposals will result in for any development: Table 1 is a corner lot 80'x150' analyzed for 3 different zones (RNS -20, RM-44, and PRM), showing the most economical use of the lot under the current code vs. the proposed code (assuming all three changes that are being proposed are approved). Table 1: 80'x150' corner lot 12000 s.f. As you can see the RNS 20 zone has a 48% reduction in density, and the RM44 and PRM zones have a 32% and 35% reduction in density as well. also looked at a few other lot sizes that have different parking space abilities, to try to get a better feel for how this would affect all development. I've also heard discussions from the staff a�,qut this process not being a downzoning, as these proposals are actually increasing thio�_humbar of units you can put on a property. There is a big difference between number of units number b`�'M bedrooms. This can be very misleading as the number of people that you ca6bave inn--a building, is being greatly reduced as is shown in these tables. r® F,- �+ J=x J W -J I ask that you take some time to verify these numbers, or even ask staff to verify them, as a 30- 50% reduction in density is a very big deal to property owners. What to these numbers mean to developers? This will effectively kill the majority of development. I don't think that was your intent as a council to do so, as I know that one of your goals as a council is to encourage development. Staff maintains that this will not impeded development, but I know that it will. Take the project that I was proposing on the corner of Burlington and Governor Street for example. This is the first example shown in Table #1 in the RNS -20 zone. The building that I was going to build would have had 23 bedrooms and would have been assessed at $1.5 million. The 12 bedroom building, that I would be able to build if you pass these proposals, would be assessed at $780 thousand dollars. After factoring in the differing construction cost to build each building, as the smaller building would cost less to build, my net loss as a property owner, is $500,000 for this one property. If 1 am only allowed to build 12 bedrooms on this site, the cost to build a new building would cost more than what it would be worth by over $100,000. 1 don't know very many people that will be willing to do any development to lose money. This is exactly why I can guarantee to you that these proposals will effectively kill the majority of development. If you would like me to go further into these number I would be glad to provide you additional information, but 1 think I will be over your time limit if I keep rambling. Secondly, if you look at the board of regents' webpage, they project continued enrollment increases of 1% to 2% for the years to come. What I think will happen from these changes is that development will severely slow down, and as demand for housing continues to go up, rents will be forced to go up (simple supply and demand economics). As rents go up, all the 3 bedroom houses in the neighborhoods a little ways from downtown, that you are trying to stabilize, will begin to make sense again for investors to begin converting into 3 bedroom rentals again. We will be right back where we were in 2005 before the first attempt to downzone was implemented. This is exactly the opposite effect of what I believe you want to incur with these changes. The next issue you need to consider with these changes are the tax consequences. As I'm sure the council is aware, the conversion of Coops last year will reduce the collected taxes next year by $700k (that was the number I got from the assessor's office). There is potential for this number to be 3 -4 times this amount if all properties that could convert do. This amount will need to be paid by someone and it will have to be spread over all the taxable parcels ir<.town. CD r..3 There are 4 projects in the downtown area, with plans submitted to the building,depanent; which will be eliminated or greatly reduced in size if these proposals pass. I cafca]tedf�_ $200k /yr. loss in taxable income from these 4 projects alone. This is one of the-tAfaos fo? your o increase your taxable base in a very large way, as the effects of these changes over the next 5 to 10 years will add up to a large amount of money. I don't want to be up here just telling you reasons on why these proposals will not be in the best interest of the city, without giving you some options that I think will be a better solution to stabilizing the neighborhoods. I propose that you draw up maps of the neighborhoods that you want to stabilize and protect, similar to the current conservation district maps in the code book, and enact these changes to those areas, and those areas alone. The way these changes are written now, they go into effect city wide and will have a negative economic impact on many owners that are no way close to the neighborhoods that you are trying to protect. Also, additional incentives should be put into place to allow for more 1 and 2 bedrooms to help make up for the 30 -50% reduction of density and loss of property values. This would allow for some development to continue in these zones instead of just stopping all development in these neighborhood areas. So please consider some of these other proposals you have heard here tonight, and don't just vote yes, because you feel that something needs to be done. History /background: This is an annual application filed with Iowa DOT listing capital and operating expenses that we wish to see funded by IDOT and FTA. The projects contained in the application have been programmed by Iowa City Transit for Federal Transit Administration (FTA) Section 5307, 5309, 5310, 5316 and /or 5317 funds in FY2013. The projects will be included in the FY2013 Iowa DOT Consolidated Transit Funding Application that MPOJC is completing and in the FY2013- 2016 MPOJC Transportation Improvement Program (TIP). Iowa City Transit may not seek funding for all of the projects; however, each project needs to be listed in order to be eligible for funding. Discussion of Solution: Following is a summary of the funds being applied for: State Transit Assistance Program: approximately $396,848 — These are formula funds awarded to the MPO and then distributed between Iowa City Transit, Coralville Transit and the University of Iowa — Cambus. Federal operating assistance for transit: $1,101,703 — These are funds awarded from FTA to provide operational assistance to the transit agency. From federal funds for transit in non - urbanized areas and/or for transit serving primarily elderly persons and person with disabilities: $88,838 — These funds are awarded to Iowa City and committed to para- transit services that are contracted through a 28E Agreement with Johnson County SEATS State-wide federal capital assistance for transit: $19,762,180 — These funds include all of the capital projects that Iowa City Transit wishes to see funded. This sum includes replacement and relocation of the transit facility and the replacement of several buses. A local match of 17% - 20% is commonly required for the award of these funds. Federal funds from the Job Access /Reverse Commute program: $133,448 — These funds have been committed toward the operating costs of route additions and expansions for the Manville Heights, North Dodge and Cross Park routes. These projects commonly require a 50% local match which is currently accounted for in our operational budget. Federal funds from the New Freedoms program: $36,000 — These funds are being applied for to continue the Volunteer Transportation Program which began in FY2012.
