Comment: The City provided the owner with rehabilitation assistance,
which is secured by a mortgage. The owner is refinancing to obtain a
lower rate, and the lender is requesting that the City subordinate its
mortgage to the new mortgage. The property has sufficient equity to
cover the City's lien position.

LEE RECREATION CENTER IMPROVEMENTS - EAST ENTRY
REMODELING PROJECT, DIRECTING CITY CLERK TO PUBLISH
NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER
TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION.
Comment: This project modifies and updates the east entry of the Robert
A. Lee Recreation Center. This includes replacing the ramp, railing, and
relocating the stairs, as well as extending the dock area. The existing
structural slab is updated with the addition of concrete pavers, a light
pole, and benches. Existing canopy lighting will be replaced and
repopulated. The patio is extended by the addition of a lower patio to
include light poles and concrete planters. ADA parking is relocated and
improved. The existing driving path adjacent to the entry will become one
directional to facilitate safety. Additional parking stripes and a curb will be
implemented in this update. The estimated construction cost is $128,400
and will be funded with General Obligation bond proceeds.
ITEM 4e(2) CONSIDER A RESOLUTION OF INTENT TO CONSIDER THE
PROPOSED CONVEYANCE OF A PORTION OF MELROSE PLACE

PUBLIC HEARING ON SAID PROPOSAL FOR MAY 15, 2012.
Comment: The University has requested that they City vacate and convey
to it that portion of Melrose Place adjacent to University -owned property in
order to facilitate the construction of a surface parking lot. Council is
considering the vacation of the subject right -of -way. In the event that such
vacation is approved, Staff recommends that the City convey such vacated
right -of -way to the University, subject to several conditions, including the
retention of an access easement over the parking lot to mitigate traffic
congestion at the intersection of Melrose Place and Hawkins Drive, which
would direct much of the traffic to a new, more easterly access point along
Melrose Avenue. Because the University is a public entity and because
they will be providing certain public amenities, such as the access
easement, sidewalks, and utility improvements , this conveyance is
proposed to be for $0.

Comment: At its March 9 meeting, by a vote of 8 -0 (Downing, Thomann and
Wagner absent) the Historic Preservation Commission recommends approval of
the designation of 108 McLean Street as a Historic Landmark. At its March 15
meeting by a vote of 6 -0 the Planning & Zoning Commission recommended
approval. Staff recommended approval in a memorandum dated March 9.
Approval will provide for review of exterior changes to the property by the Historic
Preservation Commission and provide zoning incentives to help encourage the
continued use and preservation of the building. If there is an indication that the
Council will not accept the Commission's recommendation an opportunity for a

Comment: At its February 16 meeting, by a vote of 7 -0, the Planning and Zoning
Commission recommended approval of this zoning code amendment. Staff
recommended approval in a report dated February 16. Approval will allow larger
and potentially taller buildings within the downtown provided that they include
Class A office space. Due to a change to the ordinance staff recommended going
back to.first consideration on April1 7 and requests expedited action at this time.

Comment: Parish Apartments, L.L.C., owner of 108 McLean Street, is in the
process of converting this property into apartments and improving the parking
area. Parking area will drain on to a City- owned, vacated alley behind this property,
thus requiring that the property owner obtain an easement to install and maintain
concrete drainage flumes from the City. The City has offered to sell the easement
for $562.

ITEM 9. PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF
COST FOR THE CONSTRUCTION OF THE FIRE AND POLICE DEPARTMENT
INTERIOR REMODELING PROJECT 2012, ESTABLISHING AMOUNT OF BID
SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO
PUBLISH NOTICE TO BIDDERS, AND FIXING TIME AND PLACE FOR
RECEIPT OF BIDS.
Comment: The project will involve updating and remodeling individual areas
under a single contract in the Fire and Police Departments. The renovations in
the Fire Department will be modernizing the Fire Station No. 1 kitchen and an
office in the administration area. In the Police Department the projects include
updating the break room, the station master area, the single stall restrooms and
a lower level crime lab. The project will involve removing and replacing cabinets,
countertops, fixtures, flooring, acoustical ceiling tile and lighting. The contractor
will be responsible for all associated mechanical, structural and electrical work.
The estimated construction cost $278,900 and will be funded General Obligation
bond proceeds.

ISSUANCE OF NOT TO EXCEED $6,000,000 WATER REVENUE REFUNDING
BONDS, SERIES 2012C.
Comment: This public hearing is being held to receive comment regarding the
issuance of up to $6,000,000 Water Revenue Refunding Bonds and authorizes
the City Clerk to publish the notice of hearing. Bond proceeds will be used to pay
costs to refund the 2002 Water Revenue Bonds dated November 1, 2002. By
refunding the 2002 bond issue early, the City will save approximately $422,000.

ITEM 17. CONSIDER AN ORDINANCE AMENDING TITLE 2 OF THE CITY CODE,
ENTITLED "HUMAN RIGHTS," CHAPTER 4, ENTITLED "ENFORCEMENT,"
TO PROVIDE THAT THE HUMAN RIGHTS OFFICE MAKE THE PROBABLE
CAUSE DETERMINATION. (SECOND CONSIDERATION)
Comment: Presently the Human Rights Office investigates a complaint and
makes a recommendation of probable cause to the City Attorney, who makes the
probable cause determination. Over the past approximately 12 years, staff can
recall only 3 occasions where the City Attorney came to a different conclusion
than the Human Rights Office. This second layer of administrative review is not
legally required and delays the process. Additionally, the Human Rights Office
staff interviews the parties and witnesses and is better able to determine
credibility, which is often critical in making a probable cause determination. The
City Attorney will continue to make the "litigation worthy" determination, which is
the decision whether to bring a case with a probable cause finding to hearing.
The Human Rights Commission passed a motion accepting this change at its
March 20 meeting.

CUPCAKES IOWA CITY, L.L.C. FROM IOWA CITY'S COMMUNITY
' DEVELOPMENT BLOCK GRANT — ECONOMIC DEVELOPMENT FUND AND
AUTHORIZING THE CITY MANAGER TO ACT AS CHIEF ADMINISTRATIVE
OFFICER AND SUBMIT ALL NECESSARY DOCUMENTATION TO THE U.S.
DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT.
Comment: On April 10, 2012 the City Council Economic Development Committee
recommended $35,000 in funding for this project from the CDBG Economic
Development Fund. The Council Economic Development Committee
recommended that these funds be as a loan at 0% interest for a maximum term
of 7 years. Due to the quality of the business plan, prior experience in the baking
industry and a history of paying loan obligations, the committee recommended
funding this new business even though the loan will not be fully secured. The
loan will be partially secured by a lien on the owner's personal vehicle and a lien
on all business assets. Said project will create seven full time equivalent
positions for low -to- moderate income persons.

ROCKY SHORE DRIVE PUMP STATION AND FLOODGATE PROJECT.

Comment: The City of Iowa City must acquire right -of -way, fee title, permanent
easements and /or temporary construction easement to construct the Rocky
Shore Drive Pump Station and Floodgate Project. This project is part of Iowa
City's flood mitigation strategy and is intended to reduce impacts of future floods
on nearby properties and critical infrastructure along Highway 6 that were flooded
in 1993 and 2008. It will involve the installation of permanent, automatic pumps
to an existing stormwater structure located near the intersection of Rocky Shore
Drive and Highway 6. The project will also include the installation of a floodwall
and flood gate system across the Rocky Shore Drive north of the railroad viaduct.
The project will be funded with an Iowa Economic Development Authority (IDEA)
Community Development Block Grant (CDBG).

Comment: The Iowa City Police Department, in partnership with the Johnson
County Sheriff's Office, is making application for the 2012 Edward Byrne Memorial
Justice Assistance Grant (JAG) program administered by the U.S. Department of
Justice. The Departments were notified that they were eligible for a total of
$32,164.00. In accordance with past practice and the application process, the
parties have agreed to split the award 52% for Iowa City ($16,726) and 48% to
Johnson County ($15,438), and that the City of Iowa City will take responsibility
for the application and management of this grant under the terms of the interlocal
agreement.
