Comment: Due to a revision of the final cost of this project, this resolution rescinds the previous acceptance on January 24, 2012 (Resolution #12- 25) and recommends acceptance of the project with this revised final cost. The project has been completed by All American Concrete of West Liberty, Iowa, in substantial accordance with the plans and specifications. The Engineer's Report and Performance and Payment bonds are on file with the City Clerk. ❖ Project Estimated Cost: $ 747,369.00 ❖ Project Bid Received: $ 702,575.26 ❖ Project Actual Cost: $ 745,751.05 ITEM 4d(8) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO /a'aolo EXECUTE AND THE CITY CLERK TO ATTEST TO A SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA CITY AND UNIVERSITY OF IOWA COMMUNITY CREDIT UNION, IOWA CITY, IOWA FOR PROPERTY LOCATED AT 1706 FLATIRON AVENUE, IOWA CITY, IOWA. Comment: The City provided the owner with rehabilitation assistance, which is secured by a mortgage. The owner is refinancing to obtain a lower rate, and the lender is requesting that the City subordinate its mortgage to the new mortgage. DISBURSEMENTS ARE PUBLISHED AND PERMANENTLY RETAINED IN THE CITY CLERK'S OFFICE IN ACCORDANCE WITH STATE CODE. ITEM 4e. Setting Public Hearings: ITEM 4e(1) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON MAY 15, 2012 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND _ /a —aa ESTIMATE OF COST FOR THE CONSTRUCTION OF THE ROBERT A. LEE RECREATION CENTER IMPROVEMENTS - EAST ENTRY REMODELING PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project modifies and updates the east entry of the Robert A. Lee Recreation Center. This includes replacing the ramp, railing, and relocating the stairs, as well as extending the dock area. The existing structural slab is updated with the addition of concrete pavers, a light pole, and benches. Existing canopy lighting will be replaced and repopulated. The patio is extended by the addition of a lower patio to include light poles and concrete planters. ADA parking is relocated and improved. The existing driving path adjacent to the entry will become one directional to facilitate safety. Additional parking stripes and a curb will be implemented in this update. The estimated construction cost is $128,400 and will be funded with General Obligation bond proceeds. ITEM 4e(2) CONSIDER A RESOLUTION OF INTENT TO CONSIDER THE PROPOSED CONVEYANCE OF A PORTION OF MELROSE PLACE /9- ao 8 RIGHT -OF -WAY TO THE UNIVERSITY OF IOWA AND SETTING A PUBLIC HEARING ON SAID PROPOSAL FOR MAY 15, 2012. Comment: The University has requested that they City vacate and convey to it that portion of Melrose Place adjacent to University -owned property in order to facilitate the construction of a surface parking lot. Council is considering the vacation of the subject right -of -way. In the event that such vacation is approved, Staff recommends that the City convey such vacated right -of -way to the University, subject to several conditions, including the retention of an access easement over the parking lot to mitigate traffic congestion at the intersection of Melrose Place and Hawkins Drive, which would direct much of the traffic to a new, more easterly access point along Melrose Avenue. Because the University is a public entity and because they will be providing certain public amenities, such as the access easement, sidewalks, and utility improvements , this conveyance is proposed to be for $0. Council will discuss items # 6b & 6f only at the formal meeting). ITEM 6a VACATING .27 -ACRES OF STREET RIGHT -OF -WAY ADJACENT TO LOTS 1- 8 MELROSE PLACE. (VAC12- 00001) Comment: At its April 5 meeting, by a vote of 5 -1 (Eastham voting no, Freerks absent), the Planning and Zoning Commission recommended approval of this vacation. Staff recommended approval in a report dated April 5. Approval will allow the City to vacate a portion of the Melrose Place public- right -of -way to be incorporated into a surface parking area for the University of Iowa Hospital. The City will retain necessary easements over the vacated right -of -way and vehicle access will be maintained for the remaining residential properties located along Melrose Place. Correspondence included in Council packet.�� ITEM 6d CONSIDER AN ORDINANCE AMENDING TITLE 14, ZO ING, ARTICLE 5A, Action: 7 OFF - STREET PARKING AND LOADING STANDARDS, TO INCREASE THE NUMBER OF REQUIRED PARKING SPACES FOR CERTAIN MULTI - FAMILY DWELLING UNITS WHEN LOCATED WITHIN A DESIGNATED UNIVERSITY IMPACT AREA (UTA). (SECOND CONSIDERATION) Comment: At their March 15 meeting, by a vote of 6 -0 ( Koppes absent), the Planning and Zoning Commission recommended approval. Staff recommended approval in memoranda dated February 24 and March 9. Approval will increase the number of required parking spaces so that at least 1 parking space is provided for each bedroom for multi - family dwelling units located in a designated impact area close to the University of Iowa campus where parking congestion and the resulting illegal parking is a concern. Approval will effectively limit the number of unrelated persons that may reside in a dwelling to a maximum of three within the stated zones, which is consistent with the maximum allowed currently in all other zones within the city. Protest petitions did not meet the minimum 20% area threshold necessary to require a super- majority vote to approve the amendment. If there is an indication that the Council will not accept the Commission's recommendation an opportunity for a joint meeting with the Council and the Commission is required. 1 May 1, 2012 City of Iowa City Page ITEM 6f CONSIDER AN ORDINANCE DESIGNATING 1.25 -ACRES OF LAND 7 & LOCATED AT 108 MCLEAN STREET AS AN IOWA CITY HISTORIC LANDMARK (REZ12- 00004) (PASS AND ADOPT) ITEM 6g a ITEM 6h /a­arl Comment: At its March 9 meeting, by a vote of 8 -0 (Downing, Thomann and Wagner absent) the Historic Preservation Commission recommends approval of the designation of 108 McLean Street as a Historic Landmark. At its March 15 meeting by a vote of 6 -0 the Planning & Zoning Commission recommended approval. Staff recommended approval in a memorandum dated March 9. Approval will provide for review of exterior changes to the property by the Historic Preservation Commission and provide zoning incentives to help encourage the continued use and preservation of the building. If there is an indication that the Council will not accept the Commission's recommendation an opportunity for a joint meeting with the Council and the Commission is required. Action: 8 1 v 2h �/-o CONSIDER AN ORDINANCE AMENDING TITLE 14, ZONING, SUBSECTION 14- 2C -8Q, BONUS PROVISIONS, ADDING A FLOOR AREA BONUS FOR CONSTRUCTING CLASS A OFFICE SPACE ON UPPER FLOORS WITHIN A MULTI -STORY BUILDING IN A CENTRAL BUSINESS (CB -10) ZONE. (SECOND CONSIDERATION) Comment: At its February 16 meeting, by a vote of 7 -0, the Planning and Zoning Commission recommended approval of this zoning code amendment. Staff recommended approval in a report dated February 16. Approval will allow larger and potentially taller buildings within the downtown provided that they include Class A office space. Due to a change to the ordinance staff recommended going back to.first consideration on April1 7 and requests expedited action at this time. Action: CONSIDER A RESOLUTION APPROVING THE FINAL PLAT OF PENINSULA NEIGHBORHOOD THIRD ADDITION, IOWA CITY, IOWA. (SUB12 -0004) Comment: The preliminary plat was approved by the City Council on April 3rd. Staff recommends approval of the final plat subject to approval of legal papers and construction drawings. It is anticipated that legal papers and construction drawings will be approved prior to the May 1 City Council meeting. Approval will allow the development of The Peninsula Neighborhood Third Addition a 24 -lot, 9.31 -acre residential subdivision located on Walker Circle and Willenbrock Circle. •I _i %. (SUB12 -0005) Comment: The preliminary plat was approved by the City Council on April 3rd. Staff recommends approval of the final plat subject to approval of legal papers and construction drawings. It is anticipated that legal papers and construction drawings will be approved prior to the May 1 City Council meeting. Approval will allow the development of The Peninsula Neighborhood Fourth Addition an 18 -lot, 8.06 -acre residential subdivision located on Foster Road. 54(e�44&� Action: ITEM 7. CONVEYANCE OF A CONCRETE FLUME DRAINAGE EASEMENT IN THE VACATED ALLEY ADJACENT TO LOTS 10 AND 11, MANVILLE HEIGHTS ADDITION, IOWA CITY, IOWA. Comment: Parish Apartments, L.L.C., owner of 108 McLean Street, is in the process of converting this property into apartments and improving the parking area. Parking area will drain on to a City- owned, vacated alley behind this property, thus requiring that the property owner obtain an easement to install and maintain concrete drainage flumes from the City. THE SALE TO ROBERT AND DORIS SWARTZENDRUBER OF AUDITOR'S PARCEL 2011092, CONSISTING OF APPROXIMATELY .99 ACRES, a ^ 3� LOCATED IMMEDIATELY SOUTH OF THEIR HOME, ADJACENT TO THE IOWA CITY LANDFILL, AND AUTHORIZING CONVEYANCE IN ACCORDANCE HEREWITH. Comment: Will convey .99 acres of property immediately to the South of the Swartzendruber home to the Swartzendrubers to accommodate their septic field. Landfill operations will not be harmed by the conveyance. The purchase price will be the same amount the City paid to acquire the same property a. PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE FIRE AND POLICE DEPARTMENT INTERIOR REMODELING PROJECT 2012, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH NOTICE TO BIDDERS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: The project will involve updating and remodeling individual areas under a single contract in the Fire and Police Departments. The renovations in the Fire Department will be modernizing the Fire Station No. 1 kitchen and an office in the administration area. In the Police Department the projects include updating the break room, the station master area, the single stall restrooms and a lower level crime lab. The project will involve removing and replacing cabinets, countertops, fixtures, flooring, acoustical ceiling tile and lighting. The contractor will be responsible for all associated mechanical, structural and electrical work. The estimated construction cost $278,900 and will be funded General Obligation bond proceeds. a. INSTITUTING PROCEEDINGS TO TAKE ADDITIONAL ACTION FOR THE ISSUANCE OF NOT TO EXCEED $6,000,000 WATER REVENUE REFUNDING BONDS, SERIES 2012C. Comment: This public hearing is being held to receive comment regarding the issuance of up to $6,000,000 Water Revenue Refunding Bonds and authorizes the City Clerk to publish the notice of hearing. Bond proceeds will be used to pay costs to refund the 2002 Water Revenue Bonds dated November 1, 2002. By refunding the 2002 bond issue early, the City will save approximately $422,000. a. Comment: See above item. Action: ITEM 12. INSTITUTING PROCEEDINGS TO TAKE ADDITIONAL ACTION FOR THE ISSUANCE OF NOT TO EXCEED $7,950,000 GENERAL OBLIGATION BONDS, SERIES 2012. Comment: This public hearing is being held to receive public comment regarding the issuance of up to $7,950,000 General Obligation Bonds (for an Essential Corporate Purpose) and authorizes the City Clerk to publish the notice of hearing. (SECOND CONSIDERATION) Comment: Presently the Human Rights Office investigates a complaint and makes a recommendation of probable cause to the City Attorney, who makes the probable cause determination. Over the past approximately 12 years, staff can recall only 3 occasions where the City Attorney came to a different conclusion than the Human Rights Office. This second layer of administrative review is not legally required and delays the process. Additionally, the Human Rights Office staff interviews the parties and witnesses and is better able to determine credibility, which is often critical in making a probable cause determination. The City Attorney will continue to make the "litigation worthy" determination, which is the decision whether to bring a case with a probable cause finding to hearing.
