ITEM 4d(1) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN
AND THE CITY CLERK TO ATTEST APPROVAL OF MEDIACOM
a6a- COMMUNICATIONS CORPORATION'S 2012 UPDATING OF RATES
FOR BASIC CABLE SERVICES
Comment: This resolution will approve the Maximum Permitted Rates to
be charged by Mediacom Communications Corporation for basic cable
television service, equipment rentals, and installations in Iowa City as
determined by the standard FCC forms 1240 and 1205 for the period of
August 1, 2012 through July 31, 2013. Rates are reviewed annually
using a process dictated by FCC regulation. For this period, the
"maximum permitted rate,"for basic cable service, i.e. what can be
charged, was calculated to be $16.52. Mediacom established an
"operator selected rate," i.e., what the customer will actually be charged
for basic cable service, at $16.04. Proposed rates for cable equipment
installations and rentals remain well below the maximum permitted rate
for such services. Staff recommends approval of the resolution.
ITEM 4d(2) CONSIDER A MOTION TO APPROVE DISBURSEMENTS IN THE
AMOUNT OF $9,764,040.39 FOR THE PERIOD OF APRIL 1 THROUGH
APRIL 30, 2012, AS RECOMMENDED BY THE FINANCE DIRECTOR

REGARDING A MORTGAGE AND A PROMISSORY NOTE FOR THE
PROPERTY LOCATED AT 1115 ROCHESTER AVENUE, IOWA CITY,
IOWA.
Comment: The owner of the property located at 1115 Rochester Avenue
received assistance through the City of Iowa City's Housing Rehabilitation
Program. The loan has been paid off; thus the liens need to be released.
ITEM 4d(4) CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE
FY2011 ASPHALT RESURFACING PROJECT.
Comment: The project has been completed by LL Pelling Company of
North Liberty, Iowa, in substantial accordance with the plans and
specifications. The Engineer's Report and Performance and Payment
bonds are on file with the City Clerk.

GREEN COMPANY (H.R. GREEN) TO PROVIDE ENGINEERING
CONSULTANT SERVICES FOR THE IOWA RIVER WATER MAIN
CROSSINGS PROJECT.
Comment: This amendment authorizes HR Green to provide additional
engineering services for project design modifications and reduces their
bid phase responsibilities. The Consultant Agreement will be amended to
increase the Design Phase fee by $21,140.15 and reduce the Bidding
Phase fee by $7,381.75. The amendment cost will be funded with Water
revenues.
ITEM 4d(6) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN
AND THE CITY CLERK TO ATTEST LICENSE AGREEMENT
BETWEEN THE CITY OF IOWA CITY AND IOWA HEALTH SYSTEM
AND BROADBAND, INC., TO USE CERTAIN PUBLIC RIGHTS-OF-
WAY FOR THE INSTALLATION, OPERATION AND MAINTENANCE
OF A FIBER OPTIC NETWORK.
Comment: This agreement will allow Iowa Health System and Broadband,
Inc. to install, operate, and maintain a fiber optic network within City of
Iowa City public right-of-way. This fiber optic line placement is desired to
provide interconnection to existing Iowa Health System fiber network
facilities.

Comment: The developer has requested the tile and drainage easement
originally platted on Lot 99 of Village Green-Part 23 be released. The
developer has agreed to dedicate a drainage easement on Lot 105 of
Village Green-Part 24. The location of the new drainage easement will
function better due to the drainage pattern in this area.

Comment: The grant for the UniverCity Neighborhood Partnership
Program allows the City to purchase twenty-six rental units located in
designated neighborhoods surrounding the University, rehabilitate them
with up to $50,000 in grant funds, and then sell them to income-eligible
buyers. Under the UniverCity Neighborhood Partnership Program, the City
proposes to sell 648 South Lucas Street. The amount of the sale will be
$194,000 (this is what the City paid to purchase the home) plus the
"carrying costs," which are which are all costs incurred by the City to
acquire the home, maintain it and sell it, including abstracting and
recording fees, interest on the loan to purchase the home, mowing and
snow removal, utilities, real estate taxes, and any costs in excess of
$50,000 to repair and rehabilitate the home.

$160,000 (this is what the City paid to purchase the home) plus the
"carrying costs," which are all costs incurred by the City to acquire the
home, maintain it and sell it, including abstracting and recording fees,
interest on the loan to purchase the home, mowing and snow removal,
utilities, real estate taxes, and any costs in excess of $50,000 to repair

buyers. Under the UniverCity Neighborhood Partnership Program, the City
proposes to sell 702 Giblin Drive. The amount of the sale will be $129,500
(this is what the City paid to purchase the home) plus the "carrying costs,"
which are all costs incurred by the City to acquire the home, maintain it
and sell it, including abstracting and recording fees, interest on the loan to
purchase the home, mowing and snow removal, utilities, real estate
taxes, and any costs in excess of $50,000 to repair and rehabilitate the

MUSCATINE AVENUE WATER MAIN IMPROVEMENTS PROJECT,

AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON
FILE FOR PUBLIC INSPECTION.
Comment: This project will include installing Dl water main along the
south side of Muscatine Avenue from Arthur Street to Scott Boulevard.
The project also includes installation of new water services, removal and
replacement of pavement, driveway, and sidewalk, and other associated
improvements. The estimated construction cost is $936,946 and will be
funded with Water revenues.
ITEM 4e(5) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON JUNE
19, 2012 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND
ESTIMATE OF COST FOR THE CONSTRUCTION OF THE HIGHWAY 1

Comment: This project involves the construction of a 10-foot wide trail
along the north side of Highway 1 from Sunset Street to Orchard Street
and an 8-foot wide trail along the west side of Orchard Street. This
project will also include 4-foot wide sidewalks along the east side of Miller
Avenue and the west side of Hudson Avenue, and Highway 1 crossings
at the Wal-Mart entrance, Miller Street and Orchard Street. The
estimated cost of the project is $1,100,000 and will be funded with
General Obligation bond proceeds.

Comment: This project involves construction of a building on the Public
Works Complex, located on South Gilbert Street between Napoleon Lane
and McCollister Boulevard for heated, winter vehicle storage. The
building will be a pre-fabricated steel or wood frame structure with four (4)
overhead doors and a poured concrete floor. The project will include a
sanitary sewer connection for floor drains, water service and electric heat.
The estimated cost of the project is $178,250 and will be funded with
General e r�Obligation Bonds.

Comment: This project is being re-bid and contains the same improvements as proposed in the
original let project. The project includes safety and capacity improvements to the intersection of

reconstruction, asphalt overlay through the intersection, 8' wide sidewalk installation, and
installation of a new traffic signal system. The estimated cost of the project is $1,778,650.
Funding sources will include $200,000 in a USTEP grant from the State of Iowa, Iowa DOT 3R
funds, Water revenues, General Obligation bond proceeds.

ITEM 6a CONSIDER A MOTION SETTING A PUBLIC HEARING FOR JUNE 19 ON AN
ORDINANCE VACATING AIR RIGHTS WITHIN THE PUBLIC RIGHT-OF-WAY
LOCATED ADJACENT TO THE PROPERTY AT 114 SOUTH DUBUQUE
STREET, IOWA CITY, IOWA. (VAC12-00003)
Comment: At its May 17 meeting, by a vote of 6-1 (Thomas voting No), the
Planning and Zoning Commission recommended approval of this vacation. Staff
recommended approval in a report dated May 17. Approval will allow applicant
to acquire air rights starting at approximately 16 feet, 8 inches above grade for a 4'
x 44' section of public right-of-way in City Plaza that extends along the west
property line of the subject property and a 4' x 56' section of public right-of-way in
Blackhawk Park that extends along the north property line of the subject property.
If there is an indication that the Council will not accept the Commission's
recommendation an opportunity for a joint meeting with the Council and the
Commission is required.

Comment: At its May 3 meeting, by a vote of 5-1(Dyer absent, Thomas
opposed), the Planning and Zoning Commission recommended approval
with conditions as outlined in the staff memo plus conditions to ensure
adequate off-street parking. Staff recommended approval in a memo
dated April 27, 2012. In a staff report dated July 16, 2009, staff
recommended deferral until there was a plan for storm water management
that met City standards to the satisfaction of the City Engineer. The City
Engineer indicated in a memo dated April 26, 2012 that the conceptual
design for storm water management is acceptable, with final design to be
approved through the City's engineering review process at time of platting.
Approval of this rezoning will allow for a future subdivision of
approximately 18 attached single family dwelling units (townhouses).

Comment: The City has received an application to subdivide the property west of
the NCS Pearson property to provide for the expansion of the major employment
center that surrounds the Interstate 80 interchange at Highway 1. When the City
Council approved the amended Large Scale Non-Residential Development Plan
(LSNRD) in 1985, it conditioned its approval on the terms of an agreement
between the City and NCS Pearson. One of those terms is that at such time as
access becomes necessary as determined by the City Council the parties agree
to negotiate street access across NCS Pearson to provide access from Iowa
Highway 1 to properties west of NCS Pearson. The proposed resolution will
determine that access is necessary in order to assure orderly development in this
area.

Comment: MidAmerican Energy Company has asked for a utility easement across the
property at 2001 Lower Muscatine Road and an electrical and gas easement across
the property at 1807 Lower Muscatine Road. These easements provide areas for
MidAmerican Energy Company to install utility facilities underground in preparation for
the City's Lower Muscatine Road Reconstruction Project (Kirkwood Avenue to 1st
Avenue). These easements are valued at a total of $2,500. Staff, however,
recommends conveying these easement rights without compensation, as the
consideration for these rights was factored into the agreement between the City and
MidAmerican for acquisition of certain property rights from MidAmerican in conjunction
with the Lower Muscatine Road Reconstruction Project (Kirkwood Avenue to 1st

GOVERNOR STREET.
Comment: The grant for the UniverCity Neighborhood Partnership Program allows
the City to purchase twenty-six rental units located in designated neighborhoods
surrounding the University, rehabilitate them with up to $50,000 in grant funds, and
then sell them to income-eligible buyers. Under the UniverCity Neighborhood
Partnership Program, the City proposes to sell 332 South Governor Street. The
amount of the sale will be $169,000 (this is what the City paid to purchase the home)
plus "carrying costs" of approximately $16,500. "Carrying costs" are all the costs
incurred by the City to acquire the home, maintain it and sell it, including abstracting
and recording fees, interest on the loan to purchase the home, mowing and snow
removal, utilities, real estate taxes, and any costs in excess of$50,000 to repair and
rehabilitate the home.

mortgage from a local bank in the amount of$110,250. The City will provide a second

Comment: In 2003 the City Council adopted RES. #03-140 creating a membership
fee for The Center in response to a decrease in County funding. Although not part of
Res. #03-140, The Center has had a fee-based parking permit program which has
not been self-sustaining. Earlier this year, The Center's Steering Council organized
meetings with the general membership to proactively identify measures to secure
The Center's financial future. Two of their recommendations were to increase
parking fees to make the program self-sustaining and to increase membership fees
with rates reflecting the level of operational support provided by place of residence.
The parking and membership fee recommendations were presented to the Senior
Center Commission where they were considered and approved on March 15 and
April 26 respectively. Preliminary minutes from the April 26 minutes are in the May
10 information packet (IP17); and approved minutes of the March 15 meeting are in
the May 15 agenda packet (3b(5)). Correspondence is included in Council packet.

/Quality of Life Block Grant in FY13, County funding has been steadily declining and
no longer represents an equitable proportion of non-Iowa City residents of Johnson
County. As in the past, funds received will be used to support operations, such as
community outreach programming, Senior Center Television, and the senior nutrition
and home delivered meal programs serving older adults throughout the county. The

Inspection Services Department for FY13. The United States Congress has reduced
the amount of funding provided to Housing Authorities to operate their programs;
and, the costs associated with Housing Authority operations continue to rise. The
elimination of one full-time Housing Program Assistant will save the Housing
Authority approximately $55,000 for Fiscal Year 2013. Staff recommends amending
the budgeted positions in the Housing Authority Division of the Housing and
Inspections Services Department by eliminating one full-time Housing Program
