Resolutions and Motions: ITEM 4d(1) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST APPROVAL OF MEDIACOM a6a- COMMUNICATIONS CORPORATION'S 2012 UPDATING OF RATES FOR BASIC CABLE SERVICES Comment: This resolution will approve the Maximum Permitted Rates to be charged by Mediacom Communications Corporation for basic cable television service, equipment rentals, and installations in Iowa City as determined by the standard FCC forms 1240 and 1205 for the period of August 1, 2012 through July 31, 2013. Rates are reviewed annually using a process dictated by FCC regulation. For this period, the "maximum permitted rate,"for basic cable service, i.e. what can be charged, was calculated to be $16.52. Mediacom established an "operator selected rate," i.e., what the customer will actually be charged for basic cable service, at $16.04. Proposed rates for cable equipment installations and rentals remain well below the maximum permitted rate for such services. Staff recommends approval of the resolution. ITEM 4d(2) CONSIDER A MOTION TO APPROVE DISBURSEMENTS IN THE AMOUNT OF $9,764,040.39 FOR THE PERIOD OF APRIL 1 THROUGH APRIL 30, 2012, AS RECOMMENDED BY THE FINANCE DIRECTOR SUBJECT TO AUDIT. DISBURSEMENTS ARE PUBLISHED AND PERMANENTLY RETAINED IN THE CITY CLERK'S OFFICE IN ACCORDANCE WITH STATE CODE. June 5,2012 City of Iowa City Page 3 ITEM 4d(3) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN ia1�3 AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIEN '� REGARDING A MORTGAGE AND A PROMISSORY NOTE FOR THE PROPERTY LOCATED AT 1115 ROCHESTER AVENUE, IOWA CITY, IOWA. Comment: The owner of the property located at 1115 Rochester Avenue received assistance through the City of Iowa City's Housing Rehabilitation Program. The loan has been paid off; thus the liens need to be released. ITEM 4d(4) CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE FY2011 ASPHALT RESURFACING PROJECT. Comment: The project has been completed by LL Pelling Company of North Liberty, Iowa, in substantial accordance with the plans and specifications. The Engineer's Report and Performance and Payment bonds are on file with the City Clerk. ❖ Project Estimated Cost: $ 2,270,280.80 ❖ Project Bid Received: $ 2,199,318.22 ❖ Project Actual Cost: $ 1,911,338.76 ITEM 4d(5) CONSIDER A RESOLUTION APPROVING, AUTHORIZING AND �a- ay5 DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO • ATTEST AMENDMENT #1 TO THE OCTOBER 6, 2009 AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND HOWARD R GREEN COMPANY (H.R. GREEN) TO PROVIDE ENGINEERING CONSULTANT SERVICES FOR THE IOWA RIVER WATER MAIN CROSSINGS PROJECT. Comment: This amendment authorizes HR Green to provide additional engineering services for project design modifications and reduces their bid phase responsibilities. The Consultant Agreement will be amended to increase the Design Phase fee by $21,140.15 and reduce the Bidding Phase fee by $7,381.75. The amendment cost will be funded with Water revenues. ITEM 4d(6) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST LICENSE AGREEMENT BETWEEN THE CITY OF IOWA CITY AND IOWA HEALTH SYSTEM AND BROADBAND, INC., TO USE CERTAIN PUBLIC RIGHTS-OF- WAY FOR THE INSTALLATION, OPERATION AND MAINTENANCE OF A FIBER OPTIC NETWORK. Comment: This agreement will allow Iowa Health System and Broadband, Inc. to install, operate, and maintain a fiber optic network within City of Iowa City public right-of-way. This fiber optic line placement is desired to provide interconnection to existing Iowa Health System fiber network facilities. June 5,2012 City of Iowa City Page 4 ITEM 4d(7) CONSIDER A RESOLUTION APPROVING THE RELEASE OF A TILE /41- .241 AND DRAINAGE EASEMENT AND THE ESTABLISHMENT OF A MINIMUM LOW OPENING ON LOT 99 OF VILLAGE GREEN-PART 23 AND THE DEDICATION OF A REPLACEMENT DRAINAGE EASEMENT ON LOT 105 OF VILLAGE GREEN-PART 24. Comment: The developer has requested the tile and drainage easement originally platted on Lot 99 of Village Green-Part 23 be released. The developer has agreed to dedicate a drainage easement on Lot 105 of Village Green-Part 24. The location of the new drainage easement will function better due to the drainage pattern in this area. ITEM 4e. Setting Public Hearings: ITEM 4e(1) CONSIDER A RESOLUTION SETTING PUBLIC HEARING FOR JUNE 19, 2012, ON A PROPOSAL TO CONVEY A SINGLE FAMILY HOME .16%. LOCATED AT 648 SOUTH LUCAS STREET. Comment: The grant for the UniverCity Neighborhood Partnership Program allows the City to purchase twenty-six rental units located in designated neighborhoods surrounding the University, rehabilitate them with up to $50,000 in grant funds, and then sell them to income-eligible buyers. Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 648 South Lucas Street. The amount of the sale will be $194,000 (this is what the City paid to purchase the home) plus the "carrying costs," which are which are all costs incurred by the City to acquire the home, maintain it and sell it, including abstracting and recording fees, interest on the loan to purchase the home, mowing and snow removal, utilities, real estate taxes, and any costs in excess of $50,000 to repair and rehabilitate the home. Comment: The grant for the UniverCity Neighborhood Partnership Program allows the City to purchase twenty-six rental units located in designated neighborhoods surrounding the University, rehabilitate them with up to $50,000 in grant funds, and then sell them to income-eligible buyers. Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 437 South Governor Street. The amount of the sale will be $160,000 (this is what the City paid to purchase the home) plus the "carrying costs," which are all costs incurred by the City to acquire the home, maintain it and sell it, including abstracting and recording fees, interest on the loan to purchase the home, mowing and snow removal, utilities, real estate taxes, and any costs in excess of $50,000 to repair and rehabilitate the home. Comment: The grant for the UniverCity Neighborhood Partnership Program allows the City to purchase twenty-six rental units located in designated neighborhoods surrounding the University, rehabilitate them with up to $50,000 in grant funds, and then sell them to income-eligible buyers. Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 702 Giblin Drive. The amount of the sale will be $129,500 (this is what the City paid to purchase the home) plus the "carrying costs," which are all costs incurred by the City to acquire the home, maintain it and sell it, including abstracting and recording fees, interest on the loan to purchase the home, mowing and snow removal, utilities, real estate taxes, and any costs in excess of $50,000 to repair and rehabilitate the home. ITEM 4e(4) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON /01- 617) JUNE19, 2012 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE 2012 MUSCATINE AVENUE WATER MAIN IMPROVEMENTS PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project will include installing Dl water main along the south side of Muscatine Avenue from Arthur Street to Scott Boulevard. The project also includes installation of new water services, removal and replacement of pavement, driveway, and sidewalk, and other associated improvements. The estimated construction cost is $936,946 and will be funded with Water revenues. ITEM 4e(5) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON JUNE 19, 2012 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE HIGHWAY 1 "fl a78 TRAIL PROJECT - ORCHARD STREET TO SUNSET STREET, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project involves the construction of a 10-foot wide trail along the north side of Highway 1 from Sunset Street to Orchard Street and an 8-foot wide trail along the west side of Orchard Street. This project will also include 4-foot wide sidewalks along the east side of Miller Avenue and the west side of Hudson Avenue, and Highway 1 crossings at the Wal-Mart entrance, Miller Street and Orchard Street. The estimated cost of the project is $1,100,000 and will be funded with General Obligation bond proceeds. June 5,2012 City of Iowa City Page 6 ITEM 4e(6) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON JUNE 19, 2012 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND /a- J73 ESTIMATE OF COST FOR THE CONSTRUCTION OF THE PUBLIC WORKS COMPLEX - WARM STORAGE BUILDING PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project involves construction of a building on the Public Works Complex, located on South Gilbert Street between Napoleon Lane and McCollister Boulevard for heated, winter vehicle storage. The building will be a pre-fabricated steel or wood frame structure with four (4) overhead doors and a poured concrete floor. The project will include a sanitary sewer connection for floor drains, water service and electric heat. ITEM 6a CONSIDER A MOTION SETTING A PUBLIC HEARING FOR JUNE 19 ON AN ORDINANCE VACATING AIR RIGHTS WITHIN THE PUBLIC RIGHT-OF-WAY LOCATED ADJACENT TO THE PROPERTY AT 114 SOUTH DUBUQUE STREET, IOWA CITY, IOWA. (VAC12-00003) Comment: At its May 17 meeting, by a vote of 6-1 (Thomas voting No), the Planning and Zoning Commission recommended approval of this vacation. Staff recommended approval in a report dated May 17. Approval will allow applicant to acquire air rights starting at approximately 16 feet, 8 inches above grade for a 4' x 44' section of public right-of-way in City Plaza that extends along the west property line of the subject property and a 4' x 56' section of public right-of-way in Blackhawk Park that extends along the north property line of the subject property. Staff recommended approval in a memo dated April 27, 2012. In a staff report dated July 16, 2009, staff recommended deferral until there was a plan for storm water management that met City standards to the satisfaction of the City Engineer. The City Engineer indicated in a memo dated April 26, 2012 that the conceptual design for storm water management is acceptable, with final design to be approved through the City's engineering review process at time of platting. Approval of this rezoning will allow for a future subdivision of approximately 18 attached single family dwelling units (townhouses). (CU12-00001) Comment: At its May 17 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the temporary use permit. Staff recommended approval in a memo dated May 4. Action: 7 - a�� r June 5,2012 City of Iowa City Page 9 ITEM 6f CONSIDER A RESOLUTION DETERMINING THE NEED FOR STREET ACCESS ACROSS PROPERTY OWNED BY NCS PEARSON, INC AT 2510 -01710 NORTH DODGE STREET TO PROVIDE FOR THE ORDERLY GROWTH OF THE CITY TO THE WEST. Comment: The City has received an application to subdivide the property west of the NCS Pearson property to provide for the expansion of the major employment center that surrounds the Interstate 80 interchange at Highway 1. When the City Council approved the amended Large Scale Non-Residential Development Plan (LSNRD) in 1985, it conditioned its approval on the terms of an agreement between the City and NCS Pearson.
