ITEM 2d. Resolutions and Motions:
ITEM 2d(1) CONSIDER A RESOLUTION AUTHORIZING APPLICATIONS FOR
47— 3a 3 FUNDING ASSISTANCE FROM THE IOWA DEPARTMENT OF
TRANSPORTATION (IDOT) FOR DEVELOPMENT OF THE IOWA RIVER
TRAIL ALONG DUBUQUE STREET FROM FOSTER ROAD TO
WATERWORKS PRAIRIE PARK
Comment: This resolution will enable City staff to apply for grants totaling
up to $750,000 from three Iowa Department of Transportation funding
sources, namely the "State Recreation Trails Program ", "Federal
Recreation Trails Program" and the "Statewide Transportation
Enhancement Program ". If awarded funds from either program, such
funds will be used to develop a 10 -foot trail from Foster Road, along
Dubuque Street and over Interstate 80, to Waterworks Prairie Park. This
project would increase access to multiple recreation activities and
enhance the quality of life of residents and visitors of Iowa City.
ITEM 2d(2) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN
AND THE CITY CLERK TO ATTEST A TWO -MONTH EXTENSION OF
THE AGREEMENT WITH PUBLIC ACCESS TELEVISION, INC.
Comment: The agreement between the City and Public Access
Television, Inc. ( "PATV ") was to terminate on May 1, 2012 but was
amended to extend the term for two months to July 1, 2012. Because
City staff and PATV continue to negotiate the terms of a new agreement,
the parties have agreed to extend the agreement to September 1, 2012.
City staff and PATV need additional time to negotiate a new agreement,
and this resolution approves a second amendment to extend the current
contract to September 1, 2012.
ITEM 2d(3) CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE IOWA
�a- 3z5 CITY WWTP BLOWER REPLACEMENT PROJECT.
Comment: The project has been completed by Calacci Construction of
Iowa City, Iowa, in substantial accordance with the plans and
specifications. The Engineer's Report and Performance and Payment
bonds are on file with the City Clerk.
Project Estimated Cost: $ 280,000.00

ITEM 2d(4) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN

BETWEEN THE IOWA DEPARTMENT OF TRANSPORTATION AND
THE CITY OF IOWA CITY FOR HIGHWAY 6 AND SYCAMORE
STREET INTERSECTION IMPROVEMENTS [STPN -6- 7(84)-- 2J -52).
Comment: Cooperative agreement Number 2012 -16 -205 includes the
responsibility of the City of Iowa City to design, let, inspect, and
administer work related to pavement rehabilitation (3R) expenses
occurring at the intersection of U.S. Highway 6 and Sycamore Street.
The reimbursed improvements proposed with the project will include 4"
thick Hot Mix Asphalt (HMA) Overlay, 8' wide HMA shoulders, subdrain
tile, and other incidental costs related to these items. The work covered
under this agreement is 100% reimbursed by the Iowa DOT with a
pavement preservation (3R) fund. The estimated cost and
reimbursement toward the Highway 6 and Sycamore Street Improvement
Project will be $265,920.
ITEM 2d(5) CONSIDER A RESOLUTION APPROVING, AUTHORIZING AND
DIRECTING THE MAYOR TO SIGN AND THE CITY CLERK TO
ATTEST AMENDMENT #3 TO THE NOVEMBER 2, 2009 AGREEMENT
BY AND BETWEEN THE CITY OF IOWA CITY AND FOTH
INFRASTRUCTURE AND ENVIRONMENT, LLC TO PROVIDE
ENGINEERING CONSULTANT SERVICES FOR THE LOWER
MUSCATINE ROAD RECONSTRUCTION PROJECT (KIRKWOOD
AVE. TO 1ST AVE).
Comment: This amendment authorizes Foth Infrastructure and
Environment, LLC to provide additional engineering services for project
design modifications and project plan development, including revised
pavement options, staging and traffic control phasing, and other items
required for letting the project through the Iowa Department of
Transportation. The amendment cost is $25,600 and will be funded with
General Obligation Bond proceeds. Amendment #3 will bring the total
consultant services fees to $431,893. Estimated construction cost of the
Lower Muscatine Road Improvements from Kirkwood Avenue to 1st
Avenue Project is $6,500,000.
ITEM 2d(6) CONSIDER A RESOLUTION AUTHORIZING THE CITY MANAGER TO
ia� 3ag SIGN A GRANT AGREEMENT WITH THE ENVIRONMENTAL
PROTECTION AGENCY TO PLAN FOR THE MODIFICATION OF THE
BURLINGTON DAM MODIFICATION.
Comment: The Environmental Protection Agency (EPA) has awarded the
City a $60,000 grant to plan for the modification of the Burlington Street
dam. Modification will enhance the safety, increase the recreational use,
and help the environment. The local match is $9,000, which will largely
consist of staff time. This resolution authorizes the City Manager to accept
the grant.

Comment: The owners of the property received assistance through the
City of Iowa City with funds from the Iowa Economic Development
Authority for the Single Family New Construction Program /Homebuyer
Assistance. The balance of the loan has been paid off; thus the lien
needs to be released.
ITEM 2d(8) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN

AMOUNT OF $9,990,635.59 FOR THE PERIOD OF MAY 1 THROUGH
MAY 31, 2012, AS RECOMMENDED BY THE FINANCE DIRECTOR
SUBJECT TO AUDIT. DISBURSEMENTS ARE PUBLISHED AND
PERMANENTLY RETAINED IN THE CITY CLERK'S OFFICE IN
ACCORDANCE WITH STATE CODE.
ITEM 2d(10) CONSIDER A RESOLUTION APPROVING, AUTHORIZING AND
DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO
ATTEST AMENDMENT #1 TO THE APRIL 19, 2011, AGREEMENT
BETWEEN THE CITY OF IOWA CITY AND FOTH INFRASTRUCTURE
AND ENVIRONMENTAL, LLC FOR THE U.S. HIGHWAY 6 AND
SYCAMORE STREET INTERSECTION IMPROVEMENT PROJECT.
Comment: This amendment authorizes Foth Infrastructure and
Environmental, LLC of Cedar Rapids, Iowa to provide additional
engineering services for project bid set modifications and bid period
services during the rebidding of the U.S. Highway 6 and Sycamore Street
Intersection Improvement Project. The amendment cost is $8,800 and
will be funded with General Obligation bond proceeds. Amendment #1
will bring the total consultant services fees to $127,825. Estimated
construction cost for the U.S. Highway 6 and Sycamore Street
Intersection Improvement Project is $1,778,650.

ITEM 2e(2) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON'JULY
31, 2012 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND
ESTIMATE OF COST FOR THE CONSTRUCTION OF THE FY 2013
ASPHALT RESURFACING PROJECT, DIRECTING CITY CLERK TO
PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY
ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC
INSPECTION.
Comment: This annual project involves the asphalt resurfacing and
chipsealing of various streets throughout Iowa City. The estimated cost
for this project is $499,835 and will be funded with Road Use Tax
Proceeds, Wastewater Operations, and GO Bonds.

ITEM 4d CONSIDER A MOTION SETTING A PUBLIC HEARING FOR JULY 31 ON AN
ORDINANCE AMENDING CERTAIN PARAGRAPHS WITHIN TITLE 14,

Comment: At its July 21 meeting, by a vote of 6 -0 (Weitzel absent), the Planning
and Zoning Commission recommended approval of this amendment to the
zoning code. Staff recommended approval in a report dated June 15. This will
allow homes on blocks with three or fewer homes to be constructed closer to the
street right -of -way.

Comment: At its May 3 meeting, by a vote of 5-1 (Dyer absent, Thomas
opposed), the Planning and Zoning Commission recommended approval with
conditions as outlined in the staff memo plus conditions to ensure adequate off -
street parking. Staff recommended approval in a memo dated April 27, 2012. In
a staff report dated July 16, 2009, staff recommended deferral until there was a
plan for storm water management that met City standards to the satisfaction of
the City Engineer. The City Engineer indicated in a memo dated April 26, 2012
that the conceptual design for storm water management is acceptable, with final
design to be approved through the City's engineering review process at time of
platting. Approval of this rezoning will allow for a future subdivision of
approximately 18 attached single family dwelling units (townhouses). The public
hearing was continued and ordinance deferred from the June 19 meeting to
obtain a signed Conditional Zoning Agreement. Correspondence included in

ITEM 4f CONSIDER AN ORDINANCE VACATING AIR RIGHTS WITHIN THE PUBLIC
RIGHT -OF -WAY LOCATED ADJACENT TO THE PROPERTY AT 114 SOUTH
DUBUQUE STREET, IOWA CITY, IOWA. (VAC12- 00003) (SECOND
CONSIDERATION)
Comment: At its May 17 meeting, by a vote of 6 -1 (Thomas voting No), the
Planning and Zoning Commission recommended approval of this vacation. Staff
recommended approval in a report dated May 17. Approval will allow applicant
to acquire air rights starting at approximately 16 feet, 8 inches above grade for a 4'
x 44' section of public right -of -way in City Plaza that extends along the west
property line of the subject property and a 4' x 56' section of public right -of -way in
Blackhawk Park that extends along the north property line of the subject property.
If there is an indication that the Council will not accept the Commission's
recommendation an opportunity for a joint meeting with the Council and the
Commission is required.

ITEM 4g CONSIDER A RESOLUTION APPROVING THE FINAL PLAT OF WINDSOR
WEST PART TWO, IOWA CITY, IOWA. (SUB12- 00009)
Comment: City Council approved the preliminary plat for Windsor West Part Two
in January 2010. The final plat is in general compliance with the preliminary plat
and current subdivision regulations. Staff recommends approval of the final plat
subject to approval of legal papers and construction drawings. It is anticipated
that legal papers and construction drawings will be approved prior to the July 10
City Council meeting. Approval will allow the development of Windsor West Part
Two, a 34 -lot, 13.4 -acre residential subdivision located along Buckingham Lane,
south of Cumberland Lane, north of American Legion Road.

ITEM 4h CONSIDER A RESOLUTION APPROVING THE FINAL PLAT OF PENINSULA
333 NEIGHBORHOOD 5T" ADDITION. (SUB12- 00005)
Comment: On April 3rd the City Council approved the amendments to Planned
Development Overlay (OPD) plan and preliminary plat for The Peninsula
Neighborhood, 5th Addition. Staff recommends approval of the final plat subject to
approval of legal papers and construction drawings. It is anticipated that legal
papers and construction drawings will be approved prior to the July y ounce
meeting. Approval will allow the development of an 8 -lot (16 units), 2.02 -acre
residential subdivision located on Foster Road.

ITEM 5. PLANS, SPECIFICATIONS, FORM OF CONTRACT AND ESTIMATE OF COST
FOR THE RENOVATION OF FIELDS 1, 2, 3, and 4 AT THE NAPOLEON
PARK GIRLS SOFTBALL COMPLEX, ESTABLISHING AMOUNT OF BID
SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO
PUBLISH NOTICE TO BIDDERS, AND FIXING TIME AND PLACE FOR
RECEIPT OF BIDS.
Comment: This project includes improvements to Napoleon Park Softball fields
to include additional grading, increase playability, promote better drainage and
increase the safety of players. This project will be done after the season this
year, done during prime planting opportunity and ready for play next year. The
estimated cost of the project is $180,000 and is to be funded with GO Bonds.

Comment: This project involves improvements to S. Dubuque Street and Wright
Street between Prentiss Street and the Iowa Interstate Railroad. Such
improvements include new storm sewer along S. Dubuque Street and Wright
Street, water main along S. Dubuque Street, and an HMA overlay to both S.
Dubuque Street and Wright Street. The estimated cost of the project is $355,000
and is to be funded with Stormwater and Water revenue proceeds, and Road
Use Tax (Pavement Rehabilitation).

Comment: Iowa City Code Title 9- 3 -6(c) defines school speed zone limits on
"Benton Street" between Benton Drive to Hudson Avenue. This reference should
be removed as Roosevelt Elementary has closed as of June 2012. A reference
to "Kennedy Parkway" between Camp Cardinal Boulevard and Camp Cardinal
Place should be added which will allow the implementation of a 20 MPH school
speed zone for Borlaug Elementary which will open in August of 2012.

CITY CLERK TO ATTEST A CHAPTER 28E AGREEMENT BETWEEN THE
ia� 33� CITY OF IOWA CITY, IOWA AND THE CITY OF CORALVILLE, IOWA FOR
THE PROVISION OF ANIMAL CARE SERVICES.
Comment: The City presently has a 28E Agreement with Coralville for the
provision of animal care services, and in planning for the new shelter facility,
staff from both cities have negotiated a new agreement to go into effect on July 1,
2013. There are no substantive changes. The fee continues to be based on the
City's budget multiplied by the percentage of "Coralville" animals in the shelter.
The Coralville City Council approved this 28E Agreement on June 26. If Council
approves this, the same 28E Agreement will be offered to the University of Iowa,
University Heights, and Johnson County, the jurisdictions that have indicated they
wish to continue to receive animal care services from the City. This following
agenda item is a proposed agreement for Coralville to contribute to the
construction of the new shelter.

ITEM 12. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE
CITY CLERK TO ATTEST AN ANIMAL SHELTER FACILITY CAPITAL
CONTRIBUTION AGREEMENT BETWEEN THE CITY OF IOWA CITY, IOWA
AND THE CITY OF CORALVILLE, IOWA.
Comment: As set forth in Resolution No. 12 -155, the City has agreed to build a
new animal shelter facility that exceeds the needs of its citizens and addresses the
needs of a neighboring jurisdiction on the condition that the jurisdiction contribute
its proportional share of the construction costs. This agreement, which the
Coralville City Council approved on June 26, provides that Coralville will pay its
proportional share of the costs of the new shelter. The preceding agenda item is a
proposed 28E Agreement for sheltering services, which is a prerequisite of this
agreement. If Council approves this, the same agreement will be offered to the
University of Iowa, University Heights, and Johnson County.

TO ATTEST A CONTRACT FOR CAR SHARING SERVICES FOR THE
TRANSPORTATION SERVICES DEPARTMENT.
Comment: The RFP for this project was issued by the University of Iowa, acting
as the lead agency, and proposals were received on August 30, 2011. Two
proposals were received and the Transportation Services Department
recommends award of the contract to Zipcar Inc. The Transportation Services
Department will have no financial obligations outside of commitments of staff
time for marketing assistance and parking spaces for the car sharing vehicles.
