Mr. Stalkfleet, Full time employees of the University Heights Police Department are certified and licensed as Peace Officers with authority throughout the State of Iowa. Any municipal officer or Sheriff's Deputy has the legal authority to make an arrest anywhere in the State of Iowa. Individual agencies may have their own policies that limit how, what or when an officer can act on outside of their jurisdiction but the underlying authority is still there to enforce any criminal or traffic law. Your email to the City Council was forwarded to Chief Ron Fort with UHPD. If a UHPD officer was acting inappropriately he would be the person to council or discipline the officer. Lastly, the Johnson County Attorney typically lets me know when their office receives charges where the offense was committed in Iowa City but the arresting agency was other than the Iowa City Police Department. This doesn't happen very often but it can happen. If charges are inappropriate then I usually take that up with the agency head that's involved. With the stops that you've witnessed we don't know if the speed or other offense was first observed in University Heights with the subsequent stop occurring in Iowa City. If that's the case then I have no issue with the this particular practice. Thank you for bringing this matter to our attention. Several weeks ago I was running errands on a Saturday morning and noticed something that seemed unusual. I thought I would relate it to you so you could tell me if my perception is incorrect. On Mormon Trek Blvd. near the Walden Square Apts. in Iowa City, I saw a University Heights police car stopped behind a vehicle. I saw the officer with a piece of paper in his hand talking to the stopped motorist. As I continued my errands, I then saw the same officer 30 minutes later, again in the city limits of Iowa City, this time on the Highway 6 Bypass near the bridge by the city equipment building, having stopped yet another motorist. Now as a long time Iowa Citian, I know that the University Heights cops exist only to write speeding tickets. I doubt that the officer was helping give directions or letting someone know their brake lights were out (with just a warning). Their sole purpose is to write speeding tickets. Is it legal for a University Heights police officer to go into a neighboring community (Iowa City) and write speeding tickets? Have they depleted their usual hunting grounds and are now poaching another city's motorists for untapped prey? I imagine only innocent first -time visitors know they dare not go one mile over the speed limit on Melrose Avenue, so are the U Heights father and son cop team now funding their paychecks on the backs of Iowa Citians? I am a law abiding Iowa Citian who has never received a speeding ticket, but I really don't want these "officers" intruding into our city limits to fund their so called "police force ". I respect the Iowa City Police and think they can do their jobs without the help of University Heights. Thanks for your time and please let me know if the Iowa Citians need to be warned that U Heights' finest now has jurisdiction to write speeding tickets in Iowa City. On Monday, June 18, mulch for the gar- den was delivered by FasTrac supervised by Henri Harper. Community mem- bers Bob Oppliger, Jenny Jensen, Alex Bogs, and Alicia Trimble assisted in the spreading of the mulch. Planting continued throughout the rest of the week and will continue through this summer and fall with Farm to School program doing a special planting of fall crops on Aug 3. This year, the community using the garden will also expanded as the gar- den is now part of the Farm to School program aided by the Johnson County Master Gardeners, in addition to our partnership with FasTrac and the City of Iowa City. As always, any members of the community are welcome to tend the garden and bring their expertise to share with others. Splash Pad Coming to Fairmeadows Due to the re- appropriation of federal funds, a new splash pad has recently been approved by the city council for Fairmeadows Park. It is expected that work will begin yet this summer, although it will likely not be ready to use until spring. The splash pad will likely be similar in size to the cur- rent Wetherby Park splash pad, although a specific location within the park has not been determined. Roller Skating Planning Committee The Grant Wood Neighborhood Association has hosted the Friday Night Roller Skating at Grant Wood gym for the last three years, and they con- tinue to be very popular with many of the school - aged children in the area. There are been some comments and concerns expressed in the past few months, and the GWNA is exploring if there needs to be reconsideration of how the events are operated, and if the rules need to be revisited to ensure the ongoing enjoyment and participation by all in these events. The original berm, constructed by Baculis in 1993, would not have protected the mobile home park from the 2008 flood waters. Temporary measures employed by local residents are what provided a sufficient level of protection. Because these flood mitigation measures were not meant to be a permanent structure and did not have the necessary permits, the City requested Mr. Baculis remove the fill placed in 2008. Once the City received word funding for the project was awarded, the City stopped pursuing the violation. The West Side Levee Project does not include a floodwall. Rather, an earthen levee will be constructed approximately 1 1/2 feet higher than the existing berm. The new levee has also been designed to meet current US Army Corp of Engineers and FEMA design standards. The West Side Levee Project also includes storm water drainage improvements to handle interior drainage during high water events. Taking out the trees and bald eagles, etc. is just wrong. There has been no chance for any public input about this issue and even though Mr. Reichart has tried to explain the city's position, I am not satisfied that a compromise solution cannot be reached. I just had an extended cxonversation with Jason, but his answers are unacceptable. Baculis did have the necessary permits in 1993 and the berm he built was one of the few success stories of the 2008 disaster. May I have the opportunity to speak with you or the council about this? If not, my only option will be to appeal to the citizens, via letters to the PC and Gazette. Waste of public funds and a terrible injustice to the park residents, wildlife and trees. THe existing berm is solid, and they should be able to tie into it on both ends. Where is the common sense in all of this? However, some essential questions remain, and those are: 1) Why take out the trees? Can't the berm be built around them, quite easily in fact? These trees enhance the beauty of the riverbank, provide perches for bald eagles and many other species too numerous to mention. I can see environmentalists and birders having a huge problem with that sort of wanton destruction. 2) Will the berm be covered with grass, or some sort of ugly gravel (which is what I have heard)? 3) I am assuming the destruction /construction process will be noisy, dirty, and most obtrusive to the park and it's residents. Can you provide assurance that this will not occur? I had initially heard that this would be a wall with a bike path on top. I am glad to be assured by you that neither of these are true, correct? This entire project has received little or no media attention, probably due to the upriver project in the Taft/Idlewood area, where the concerns of the much more affluent voices speak louder than those of mobile home residents. I await your responses to these questions. I am ready to further pursue these issues , to protect myself and my neighbors from any kind of reckless behavior on the part of our civic leaders. We are presenting this petition to you today and ask that you bring this topic to your attention in work session and council meetings in the coming weeks. We would like to encourage a discussion about the feasibility of an ordinance in Iowa City that would allow chicken keeping and hope that you will consider making this adjustment in our community. As KT LaBadie mentioned in public comment at a recent council meeting, advocates involved with I -CLUCK would like the opportunity to be involved in this process and can offer many suggestions towards the drafting of an appropriate ordinance for Iowa City. For your reference, I have attached the Facts and Questions document again, which states solutions to many of the concerns that we have heard regarding chickens in town. Please take the time to browse through this information, as I believe it makes clear many of the misunderstandings about modern chicken keeping and the ordinances that protect cities, chickens, and community members. Also attached is the current Cedar Rapids urban chicken ordinance created by a focus group of planners, animal control personnel, and community members. This is an example of a well composed ordinance that is working extremely well in our neighboring community. Along with it, is the permit application used by that city. Will legalizing backyard chickens increase Iowa City's program costs? Will it burden city staff? Backyard chicken keeping can have a negligible impact on current city budgets. A properly shaped ordinance is required to reduce or eliminate unnecessary costs. For example: • Allowing only 6 or less hens (not roosters) will eliminate or reduce noise and sanitation issues. • Issuing a set amount of permits (25 for example) during the first year would prevent city staff from being overburdened by backyard chicken keeping. Additionally, a set number of permits the first year would allow the city to gather actual data on the impacts of backyard chicken keeping. Then a decision about backyard chicken keeping can be made based on facts. • Requiring abuilding permit and inspection for chicken coops is not necessary, and would only burden city staff. Currently in Iowa City, building permits are only required for storage sheds with a floor area larger than 144 square feet, or fences higher than 6 feet. Most chicken coops would not fall under those requirements. • As part of the permitting process, chicken keepers should be responsible for finding a home for roosters, should they end up with one. Taking a rooster to the animal shelter could be grounds for having your permit revoked permanently. Will urban chicken coops be an eye -sore in the community? What about the animal shelter? It is unclear where the new facility will be and when it will be back within city limits. What impact will this have on the already overburdened animal shelter? A properly formed ordinance and only allowing a set number of permits the first year will greatly reduce or eliminate impacts. Whenever the shelter situation is resolved, or after the initial year, the city can evaluate the impacts of chickens and issue more permits as seems appropriatelfeasible. Requiring a chicken keeping permit and attendance at a local chicken keeping class will reduce the amount of people who decide to get chickens on a whim. This will require chicken keepers to plan ahead for chickens and be educated on how to care for them, thereby reducing the burden of unwanted chickens at the shelter. Citizens have expressed interest in fostering unwanted chickens to keep them out of the shelter (similar to what happens for cats and dogs at the shelter). (a) The maximum number of chickens allowed is six (6) per tract of land regardless of how many dwelling units are on the tract. Permits will be granted only for tracts of land located in residential districts as identified on the current Official Zoning Map on file with the City of Cedar Rapids. 23A.05 Non - commercial use only. A permit shall not allow the permittee to engage in chicken breeding or fertilizer production for commercial purposes. 23A.06 Enclosures. (a) Chickens must be kept in an enclosure or fenced area at all times. Chickens shall be secured within a henhouse or chicken tractor during non - daylight hours. (b) Enclosures must be kept in a clean, dry, odor -free, neat and sanitary condition at all times. (c) Henhouses, chicken tractors and chicken pens must provide adequate ventilation and adequate sun and shade and must be impermeable to rodents, wild birds and predators, including dogs and cats. (d) Henhouses and chicken tractors. 1. Henhouses and chicken tractors shall be designed to provide safe and healthy living conditions for the chickens with a minimum of four (4) square feet per bird while minimizing adverse impacts to other residents in the neighborhood. a. A henhouse or chicken tractor shall be enclosed on all sides and shall have a roof and doors. Access doors must be able to be shut and locked at night. Opening windows and vents must be covered with predator and bird proof wire of less than one (1) inch openings. b. Odors from chickens, chicken manure or other chicken related substances shall not be perceptible beyond the boundaries of the permitted tract of land. b. Noise from chickens shall not be loud enough beyond the boundaries of the permitted tract of land at the property boundaries to disturb persons of reasonable sensitivity. 23A.08 Predators, rodents, insects and parasites. The Permittee shall take necessary action to reduce the attraction of predators and rodents and the potential infestation of insects and parasites. Chickens found to be infested with insects and parasites that may result in unhealthy conditions to human habitation may be removed by a Cedar Rapids Animal Control Officer. 23A.09 Feed and water. Chickens shall be provided with access to feed and \clean water at all times. The feed and water shall be unavailable to rodents, wild birds and predators. 23A.10 Waste storage and removal. All stored manure shall be covered by a fully enclosed structure with a roof or lid over the entire structure. No more than three (3) cubic feet of manure shall be stored on the permitted tract of land. All other manure not used for composting or fertilizing shall be removed. The henhouse, chicken tractor, chicken pen and surrounding area must be kept free from trash and accumulated droppings. Uneaten feed shall be removed in a timely manner. 23A.11 Chickens at large. v : a.. The Permittee shall not allow the Permittee's chickens to roam off the permitted tract of land. No dog or cat or other domesticated animal which kills a chicken off the permitted tract of land will, for that reason alone, not be c c considered a dangerous or aggressive animal or the city's responsibility to CD enforce its animal control provisions. -f - The Permittee shall place and keep leg bands on all of his chickens showing the permit number. t f3A.12 Unlawful acts. a. It shall be unlawful for any owner, renter or leaseholder of property to allow chickens to be kept on the property in violation of the provisions of this article. c. No person shall keep chickens inside a single family dwelling unit, multi family dwelling unit(s) or rental unit. d. No person shall slaughter any chickens within the city of Cedar Rapids. 4 e. No person shall keep a rooster. f. No person shall keep chickens on a vacant or uninhabited tract of land. 23A.13 Nuisances. Any violation of the terms of this Chapter that constitutes a health hazard or that interferes with the use or enjoyment of neighboring property is a nuisance and may be abated under the general nuisance abatement provisions of Cedar Rapids Municipal Code Chapter 22." The threat to humans from tick -borne disease is much, much greater than any hypothetical threat to health that might come from chickens. I would much prefer to keep two chickens in my yard than to feel compelled to slather my children with chemical insect repellants every time they go outside. The Iowa City Urban Chicken Ordinance should: • Require a permit from the city • Limit the number of chickens a resident can keep to 6 female hens (no male roosters) • Require chickens to be kept in a safe, properly cleaned enclosure at all times Dedicated citizens will help the city with the following matters and any others that arise: • The Cedar Rapids ordinance has been successfully functioning for a year and would work well for Iowa City: http: / /www. cedar- rapids.org/ ,government/ departments / animal - control /pages /urbanchickens.aspx. • If necessary, a year -long trial period with a dozen residents could be put in place to work out issues and increase education. • A process for adopting abandon chickens can be put in place to ensure Animal Control is not impacted. On a personal note, I would like to keep chickens because they will help me increase the resiliency of my property and neighborhood. The chickens will: • Reduce landfill waste by turning kitchen scraps and plant debris into compost • Eat harmful insects such as Japanese beetles • Weed and fertilize new garden beds for food and flowers • Provide eggs for me and my neighbors Some view urban chickens as a regressive —a sign that a city is becoming more chaotic and unrefined. People who keep chickens, however, also passionately work in many other ways to increase the health and vibrancy of our community. These people know how to create resilient communities and understand how chickens contribute. This is not just a hobby; it is part of a nationwide movement toward sustainability.
