Thank you Brian Fink 44 Coll Court Iowa City 6/29/12 To the Members of the Iowa City City Council: The purpose of this communication is to provide comment and opinion regarding the consideration of an ordinance to conditionally rezone a 4.29 -acre property located on Walden Road, west of Mormon Trek Boulevard, from Medium Density Single Family Residential (RS -8) to High Density Single Family Residential (RS -12) as applied for by Southgate Development Company (REZ09- 00003). It is commonly agreed that retained groundwater problems and poor drainage affect residential properties adjacent to the applicant's parcel. It is also common knowledge that the pipeline easement portion of the property is a sensitive area and poses restrictions on the design and engineering of an effective water disposal system. Perhaps your knowledge of the issue may be only as deep as what is found in the documents presented in your information packet. Before voting on this ordinance we ask you to revisit this issue and consider under finer detail the long -term drainage issues faced by the adjoining property owners along the western border and the potential impact of Southgate's proposed storm water management concept. We would like to target the validity of Southgate's proposed design for the storm water management system given the sensitive nature of the area which the water will be directed. We doubt that the open drainage swale concept can fully contain the water being directed from the development without adding to the retained groundwater that plagues this area. Keep in mind that the proposed storm water solution takes the runoff from acres of the development and essentially creates a brand new creek to funnel water directly through an area with chronic insufficient drainage. From our point of view, having resided for over 13 years on property that borders the pipeline easement, we have experienced enough weather cycles to know that any additional water that escapes the swale by seepage into the water table will exacerbate water problems in this sensitive area. If you don't see this as a red flag please stop and think about it. Language does exist in the conditional zoning agreement to the effect that no further harm is to be experienced by adjacent property owners, however the statement in its current form remains a gray area that does not provide a definition of the nature of the problems, what the baseline measurements are and what constitutes exacerbation of the problems. We propose that the city initiate an engineering assessment of the conditions on adjoining properties affected by drainage issues. This would be to provide data for establishing baseline conditions and for defining criteria on what type of conditions qualify as exacerbating an existing problem. The city is allowed to impose reasonable conditions over and above the existing regulations and we feel as though a public need exists in this case. Such an example may be imposing greater than minimum design standards by requiring a liner in the bottom of the swale. You have seen the planning and zoning commission's report and favorable vote on the applicant's request to rezone. You've read the city engineer's memo stating his approval of the storm water drainage solution, and you may feel comfortable with his assessment. However, if you vote to approve the conditional zoning agreement you are stating your complete confidence in the proposed storm water disposal concept. Likewise, if you vote to approve the conditional zoning agreement you are stating your complete confidence that there will be no worsening of the ground saturation problems experienced by the adjacent property owners. On the surface everything seems to be in place and the ball seems to be rolling on this application but we suggest a pause in the action. Please give some thought to the points outlined in this letter so as to handle the storm water management issue carefully and completely.
