Intent: The Central Business Service Zone (CB-2) is intended to allow for the orderly expansion of the Central Business District of Iowa City, to serve as a transition between the intense land uses located in the Central Business District and adjoining areas and to enhance the pedestrian orientation of the Central Business District by providing suitable, peripheral locations for auto-oriented commercial and service uses. This Zone is intended to accommodate mixed land uses and requires lesser intensity of use than that permitted in the CB-10 Zone 5 . B. Permitted Uses: 1. Permitted uses of the CB-10 Zone 6. 2. Auto- and truck-oriented uses. 3. Hotels, motels and convention facilities. 4. Transient housing. (1978 Code §36-20; amd. 1994 Code) C. Provisional Uses: 1. Dwellings located above or below the ground floor of a structure in which the ground floor is occupied exclusively by another principal use or uses permitted in this Zone, provided there is a minimum lot area of eight hundred seventy five (875) square feet per dwelling unit. A maximum of three (3) roomers may reside in each dwelling unit. (Ord. 95- 3670, 2-14-1995) 2. Elder apartment housing with a minimum lot area of three hundred (300) square feet per dwelling unit, and subject to the requirements of 8rtjçleL of this Chapter. (Ord. 97-3787, 6- 3-1997) 3. Adult daycare, subject to the requirements of Article L of this Chapter. (Ord. 95-3705, 12- 19-1995) 4. Childcare centers, subject to the requirements of 8rtiçleL of this Chapter. Utility substation facilities within existing buildings, provided the substation facility is completely enclosed and there is no indication from the exterior of the building of the substation facility, and the principal use of the building is a use permitted in this Zone. Intent: The Residential/Office Zone (RIO) is intended to provide a transition from intensive commercial and employment centers to less intensive residential districts and to stabilize the residential areas located in these transitional areas. The RIO Zone permits a mix of uses, including low intensity commercial office uses and residential uses. This mix of uses requires special consideration of building and site design. B. Permitted Uses: 1. Permitted uses of the CO-1 Zone 101 . 2. Bed and breakfast homestays and inns. C. Provisional Uses: 1. Dwellings located above or below the ground floor of a structure where another principal use permitted in this Zone exclusively occupies the ground floor. The dwellings shall be developed in accordance with the dimensional requirements of the RM-20 Zone 102 . 2. Dwellings located on the ground floor shall be permitted in buildings constructed prior to January 1, 1993, subject to the dimensional requirements of the RM-20 Zone 103 , except for the minimum lot width which shall be thirty feet (30'). 3. A maximum of two (2) roomers shall be permitted in each dwelling unit, provided single- family dwellings and duplexes furnish additional off-street parking spaces at the ratio of one-half (1/2) space per roomer. 4. Family care facilities. 5. Rooming houses, provided the total floor area shall not exceed three hundred thirty (330) square feet for each two thousand seven hundred twenty five (2,725) square feet of lot area, and there shall be at least one hundred (100) square feet of floor area for each roomer. 6. Accessory apartments, subject to the requirements of 8rtÜ:~leL of this Chapter. (1978 Code §36-16.1; 1994 Code) 7. Elder family homes, subject to the requirements of Article L of this Chapter. 8. Restaurants not including drive-in facilities. 7. Schools, generalized private instruction. 8. Schools, specialized private instruction, subject to the provisions of subsection G2 of this Section. 9. Transient housing, provided there is at least seven hundred fifty (750) square feet of lot area for each permanent resident and two hundred (200) square feet for each temporary resident. Religious institutions which existed on August 7, 1962, shall be exempt from and may expand without compliance with the dimensional requirements or the off-street parking requirements. 2. Any listed use may be established by special exception in buildings registered on the National Register of Historic Places, subject only to the requirements imposed by the Board of Adjustment and to the issuance of a certificate of appropriateness by the Historic Preservation Commission, or its successor, according to the procedures of Section 14-4C-4 of this Title. Because continued use and occupancy of historic structures contributes to maintenance of the City's historic, aesthetic and cultural heritage, the Board may, to the extent it finds necessary under the circumstances, waive any zoning requirements which would limit or prevent a use or the occupancy of a historic structure allowed under the provisions of this Section. H. Design Provisions: 1. The following design provisions are intended to help ensure that redevelopment occurs in a manner compatible with the existing character of the area, to help ensure that this Zone develops as a compact urban area, to integrate parking facilities into the design of developments, to provide a safe and attractive area for pedestrian traffic, to enhance crime prevention by increasing opportunities for surveillance of the street from the interiors of buildings, to restrict fortress-like facades at the street level, to avoid a monotonous http://66.113.195.234/IA/lowa%20City/17006004000012000.htm 10/11/2004 14-6D-12: RESIDENTIAL/OFFICE ZONE (RIO): Page 4 of 5 environment and to ensure the stabilization of the area is enhanced through excellence in design. 2. Prior to receiving a building permit for any development, a developer must submit a site plan which complies with the requirements of Chapter 5. Article H of this Title, Site Plan Review. Prior to submitting a request for site plan review, the developer shall participate in a pre-application conference with the Director of Planning and Community Development to discuss the application of the design provisions to the subject property. The following design guidelines will be applied during the site plan review process, in addition to the design standards set forth in Chapter 5. Article H of this Title. Alternative design solutions may be approved if it is demonstrated that the alternatives meet the intent of this Section. Decisions may be appealed to the Board of Adjustment. a. All utilities and meters shall be located on side or rear elevations of buildings and shall be screened from public streets. b. Dumpster and recycling bin locations shall be screened, shall not be visible from public streets and shall not be located in a right of way. c. Access to individual dwelling units shall be from enclosed lobbies or corridors except at grade level. d. Stairways between residential floors shall be enclosed within the building. e. Bicycle parking facilities shall be located so as not to impede pedestrian or vehicular traffic. f. Varied roof lines and/or heights shall be used to reduce the appearance of the mass of buildings which exceed two (2) stories in height. g. Techniques, such as varied setbacks, bay windows, balconies and changes in material, color and texture, shall be used to articulate facades ahd side wall elevations. Where rear walls are visible from a public street, similar techniques shall be used. h. Durable materials, such as masonry, shall be used on the street level and are encouraged for upper stories. Masonry does not include concrete block and undressed poured concrete. i. All parking spaces shall be located. either behind a building and screened from view or within the exterior walls of a building. Features, such as masonry walls, earthen berms or evergreen trees and shrubbery, shall be used for screening. j. Driveways between a street and parking area shall be minimized in number and width and shall be designed to minimize hazards to pedestrians. Where possible, vehicular access to individual lots shall be via an alley. k. A landscaped buffer area at least five feet (5') in width shall be provided between any parking area and adjacent property line or street right-of-way line. I. This ten foot (10') area shall be used for walkways and landscaping consisting of at least fifty percent (50%) vegetative coverage. m. If driveways and garages enter onto an alley, building or portions thereof, said driveways shall be set back an adequate distance to assure proper sight distance. n. Where parking spaces are located so that the headlights of vehicles shine onto a wall containing ground level windows, a landscaped screen shall be provided between the parking area and the building. o. Areas of blank walls on the street level frontage of a building shall be minimized. At least forty percent (40%) of the length of the street level frontage shall be windows or doorways (not including garage entrances). At a minimum, every twelve feet (12') in length of wall shall be articulated by a window, doorway, setback, artwork or change in building material. p. Loading/unloading facilities shall be located to the rear of a building and shall have access from an alley. q. The location and size of proposed signs shall be integrated into the design of the overall development. r. The outer edge of a balcony shall not be closer than five feet (5') from a side lot line. Recommended: New balustrades and handrails · Installing turned balusters in balustrades that have an actual diameter of 2 inches or greater, or square spindles that are 1-1/2 inches or greater in width. · Installing top and foot rails that are at least 2 inches in thickness. These can be made with 3/4- inch and 5/4-inch lumber glued together, · On buildings where a spindled balustrade would be most consistent with the architectural style, spacing spindles so that the balustrade is at least 40% solid, Spindles must be spaced so that no gap between the spindles exceeds 4 inches as required by the building code. This is for child safety. · Providing handrails on porch steps as required by the building code. Handrails should match the historic balustrade height on the porch unless otherwise specified by the building code, The handrail must have a continuous member that can be easily gripped. The handrail should either match the porch balustrade or be made of round steel pipe. · Sloping the top and foot rails slightly to allow water to be shed from these surfaces and help prevent deterioration of these members. Disallowed: New balustrades and handrails · Using unpainted treated wood for elements that would have been painted in the historic application. · Using wrought iron elements unless they were part of the historic design. Staff Comments: 7.0 IOWA CITY GUIDELINES FOR DEMOLITION Recommended: · . Removing additions or alterations that are not historic and that significantly detract from the building's historic character. · Removing non historic buildings and structures that detract from the historic character of a district. Such buildings should be replaced with buildings that are more compatible with the district. · Removing portions of a building that are structurally unsound and are a safety hazard. Disallowed: · Demolishing any primary building on a contributing property within a conservation or historic district, or any Iowa City Historic Landmark. · Removing any historic architectural feature, such as a porch, chimney, bay winåow, dormer, brackets or decorative trim, that is significant to the architectural character and style of the building, 5.0 IOWA CITY GUIDELINES FOR ADDITIONS 5.1 EXDansion of Buildina FootDrint Recommended: Desian · Preserving significant historic materials and features of the original structure such as decorative windows, brackets, porches, and trim. · Designing an addition so that it does not diminish the character of the historic structure. · Distinguishing between the historic structure and the new addition. This may be accomplished easily by offsetting the walls of the addition from the walls of the original structure. · Matching key horizontal "lines" on the existing building, such as water table, eave height, window head height and band boards, in order to provide continuity between the addition and the historic structure. · Using a palette of materials that is similar to that used on the historic structure. · Placing building additions at the rear of a property, if possible. Additions at or near the front of an existing building must be set back at least 18 inches from the front plane of the historic building, and must be differentiated by a change in the roofline or other means. Foundations · Constructing an addition foundation that appears similar to the historic foundation in color, texture, unit size, and joint profile. Mass and Roofline · Constructing additions that are consistent with the massing and roofline of the historic building, This requires that the wall areas and corners, as well as the roof pitches and spans are all consistent with the existing building and have a proportion that is similar to that of the existing building. · Constructing the roof overhang, soffits and eaves of the addition so that they match the roof overhang, soffits and eaves of the existing building. When the eaves of an addition intersect the eaves of the existing building, care should be taken to assure that the two eaves align properly. The trim details of a new eave should match the eave details of the existing building. SidinQ · Applying siding to a new addition that appears similar in size, shape, texture, and material to the existing siding on the historic building. Masonrv · When using masonry on an addition, using new masonry that appears similar in color, texture, unit size, and joint profile to the historic masonry. Exception: Historic District Noncontributing Conservation Districts All properties New foundations · For additions to foundations, concrete or textured concrete block may be used in place of masonry units that appear similar to the original masonry. · For additions to foundations, it is acceptable to match the color of the original foundation by using paint or masonry stain rather than matching the material and appearance of the original foundation material. Wood · Window trim, door trim, fascia and frieze boards, and corner and band boards on additions must be similar to those on the historic building. Modern window types, such as casement windows, may be used in additions provided they have overall proportions comparable to those found on the historic building, and a similar divided-light pattern. The windows must be trimmed to match the historic windows in the building. The windows may be installed side-by-side, but they must have a mullion between them if mullions were used between windows on the historic building. Transom-like or half-round fixed glass units may be used if they create a traditional-looking window arrangement consistent with the historic building style. Gutters and downspouts . Additions need not have built-in gutters unless the new gutters align with the built-in gutters of the existing building. For instance, a one-story addition need not have built-in gutters if it is attached to a two-story wall. SECRETARY OF THE INTERIOR'S STANDARDS Definition: Rehabilitation is the process of returning a property to a state of utility, through repair or alteration, which makes possible an efficient contemporary use while preserving those portions' and features of the property which are significant to its historic, architectural, and cultural value. 9. New additions, exterior alterations, or related new construction shall not destroy historic materials that characterize the property. The new work shall be differentiated from the old and shall be compatible with the massing, size, scale, and architectural features to protect the historic integrity of the property and its environment. Staff Comments: Demolition The first issue in considering this application is to determine if demolition of the existing sleeping porch complies with the guidelines and the Secretary of the Interior's Standards for Rehabilitation, Is the sleeping porch significant to the architectural character and style of the building? Another consideration is if the addition is necessary for the property to retain its utility. This sleeping porch has been modified with the addition of aluminum storm windows and masonite siding. It does not have brackets or other features that are characteristic of the house and does show signs of deterioration. Given the construction of the sleeping porch, it is not well suited to adaptation as a heated space, particularly bathrooms. Nonetheless, it is original to the house and is a feature that is typical to houses of this period. If the Commission feels that this is a characteristic architectural feature, this application should be denied. Addition: If the Commission determines that the sleeping porch may be demolished, staff does not feel that the existing application complies with the guidelines in terms of windows, siding, mass and roofline. Staff has prepared some options for the Commission and applicant to consider, Option A: This option uses essentially the same floor plan as that proposed, but makes it somewhat narrower, changes the roofline, windows and siding materials. Staff recommends that the windows be of a similar size and proportion as the original windows (2'-8" x 5'-0"). The original house does not have divided lights as the applicant has illustrated on his proposed. The windows must be 1/1 double-hung sashes constructed of wood or metal-clad wood, The windows should be aligned vertically. Where possible (on the west elevation) additional windows should be added to prevent having a long expanse of uninterrupted wall. The roof, eaves and massing of the addition should be similar to the existing house or sleeping porch. For the proposed floor plan, staff recommends a roof design that is similar to the exiting house. Regardless of the addition design, vinyl is prohibited as a siding material and wood or fiber-cement board must be used. Option B: A second option is to construct an addition that is similar to the existing sleeping porch. For this approach, a narrower addition would be appropriate. This would require that the first and second floor windows on the south side of the east elevation be moved south a few feet in order to make the bathrooms accessible from the south bedrooms, In this case, staff would recommend that the rear façade of the existing house be resided with wood or fiber-cement board since it will be difficult to patch the old window openings with matching asbestos. Because the purpose of the addition is to add bathrooms, it would not be possible to add the expanse of window openings to simulate the appearance of the sleeping porch, However, it would be easier to construct and shingle the low-pitched hip roof than a gable roof with the same roof pitch as the house. Option C: Since the fenestration can not simulate the look of a sleeping porch, a third alternative is to construction the narrower addition, but add a gable roof that is similar to the house roof. For all the options the windows must be wood or metal-clad wood without divided-lights, all windows must be trimmed to match the original and the siding must be fiber-cement board or wood with an exposure to match the original wood siding on the house. Deck: Staff feels that the construction of the deck balustrade does not comply. The balustrade should a have a top and bottom rails with square spindles between. Attached is a drawing illustrating a balustrade that does comply with the guidelines. Summary As noted above, staff feels that the proposal as presented does not comply with the guidelines and standards. The shed roof is not compatible with the existing gable roof or the sleeping porch roof. Vinyl siding and windows are prohibited, simulated muntin bars should not be used, and the windows should be of a similar size and proportion as the existing house. If it is determined that the screened porch may be demolished, staff feels that any of the three options presented would comply with the guidelines and standards. Staffs feels that new drawings that thoroughly illustrate the proposal should be submitted.
