Washington Street ITEM NO.1 CALL TO ORDER and ROLL CALL ITEM NO. 2 CONSIDER MOTION TO ADJOURN TO EXECUTIVE SESSION based on Section 21.5(1)(a) of the Code of Iowa to review or discuss records which are required or authorized by state or federal law to be kept confidential or to be kept confidential as a condition for that government body's possession or continued receipt of federal funds, and 22.7(11) personal information in confidential personnel records of public bodies including but not limited to cities, boards of supervisors and school districts, and 22 -7(5) police officer investigative reports, except where disclosure is authorized elsewhere in the Code; and 22.7(18) Communications not required by law, rule or procedure that are made to a government body or to any of its employees by identified persons outside of government, to the extent that the government body receiving those communications from such persons outside of government could reasonably believe that those persons would be discouraged from making them to that government body if they were available for general public examination. MEMBERS PRESENT: Kingsley Botchway, Melissa Jensen and Royceann Porter MEMBERS ABSENT: Donald King STAFF PRESENT: Staff Marian Karr and Catherine Pugh STAFF ABSENT: None OTHERS PRESENT: Captain Jim Steffen and Officer David Schwindt of the ICPD. RECOMMENDATIONS TO COUNCIL None CONSENT CALENDAR Motion by Jensen and seconded by Porter to adopt the consent calendar as presented or amended. Minutes of the meeting on 07/10/12 ICPD REVISED Use of Force Report — February 2012 Motion carried, 410, King absent. OLD BUSINESS Draft #1 of FY12 PCRB Annual Report — Karr noted one typo that had been corrected. There were no questions or comments from the Board. Motion by Porter and seconded by Jensen to adopt the FY12 Annual Report as amended. Motion Carried, 4/0, King absent. Complaint statistics — After discussion the Board agreed to maintain the practice of not to keeping any complaint statistics for the following reasons: The unique officer identifier number used in the complaints, if kept by staff, is public information. There is some concern that the officer identity could be figured out. The Board does not have any power to discipline the officer. When the Board reviews a complaint, they are supposed to look at each incident and the facts separately to come to a conclusion. A list of statistics could influence their view on a specific complaint. If an officer works in an area where they have more contact with the public or where certain times of the day may be busier, the potential to have a complaint filed would be greater. Each Board member, if they choose to do so, already has the ability to keep statistics. August 14, 2012 Page 2 BOARD INFORMATION None. STAFF INFORMATION Karr informed the Board that Jensen and Porter had re- applied and have been re- appointed for another term to the Board and also that Botchway had been appointed to the Ad Hoc Diversity Committee. PUBLIC DISCUSSION Schwindt questioned the level of review noted on the annual report. Board members verified the levels were correct. Porter announced a community event for parents and students being held at The Spot on Thursday, August 3&, dinner is at 6pm and the meeting will start at 7pm. The discussion will be "Knowing the 4 -1 -1 on the 5 -0 ". Porter asked if anyone would be willing to come with complaint forms and explain the PCRB complaint process. Botchway said he would be available to come. DEPARTMENT MEMOIM2 -27 TO: Chief Hargadine FROM: Captain Jim Steffen RR: March — April 2012 Use of Force Review DATE: August 28, 2012 The "Use of Force Review Committee" met on July tad, 2012. It was composed of Captain Steffen, Officer Jenny Clarahan and Sgt. D. Brotherton. For the review of submitted reports in March, 17 Officers were involved in 13 separate incidents requiring use of force involving 10 individuals. In April, 19 Officers were involved in 8 separate incidents requiring use of force involving 7 individuals. In four incidents officers used their sidearm to destroy an injured animal. All issues or concerns were identified and addressed at previous levels of review. Officers are reminded that the "Out with subject' is not to be used in the Type of Incident box. A specific reason is needed. Of the incidents reviewed over the two month period, a Taser was discharged on three occasions, and on one occasion a Taser was displayed which resulted in compliance without deployment. There was one pursuit, which resulted in a minor accident in which both the officer and suspect received minor injuries. Of the 21 incidents reviewed, 6 suspects and 5 Officers sustained superficial injuries as a result of the use of force. Please contact me if you have any questions.
