Resolutions and Motions: ITEM 2d(1) CONSIDER A RESOLUTION APPROVING THE CITY STREET FINANCIAL REPORT FOR THE FISCAL YEAR ENDING JUNE 30, 2012. Comment: The Iowa Department of Transportation requires all municipalities to submit this report annually on or before September 30. ITEM 2d(2) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CONTRACT FOR AUDIT /a - 4b3 AND FOR THE FISCAL YEAR 2012 CITY OF IOWA CITY FINANCIAL STATEMENTS. Comment: Professional service contracts over $50,000 require approval by City Council. The FY2012 Eide Bailly contract for audit services is not to exceed $56,000. The contract does allow for the auditors to bill $2,200 for each major program in excess of that amount, if we have more than 3 major federal programs that need audit. In FY2011 the Eide Bailly audit fees totaled $57,700 and included 5 major federal programs that required auditing. We believe Eide Bailly's fee request is reasonable and recommend that the City Council approve the contract for audit services. ITEM 2d(3) CONSIDER A RESOLUTION AUTHORIZING THE PROCUREMENT OF /a j4- A 2013 PIERCE IMPEL PUC FIRE ENGINE Comment: This Resolution will approve the procurement of a new pumper fire engine and associated equipment. The procurement follows a Request for Proposal, in which 1 proposal was received and scored. The Pierce fire truck scored 93% of total points considered. The purchase will be for $606,208.25, which exceeds the $150,000.00 spending authority of the City Manager, and so requires Council approval. The unit being replaced will be sold after the new unit is placed in service. ITEM 2d(4) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A SIX -MONTH EXTENSION OF THE AGREEMENT WITH PUBLIC ACCESS TELEVISION, INC. Comment: The agreement between the City and Public Access Television, Inc. ( "PATV ") was to terminate on May 1, 2012 and has been amended twice to extend the term to September 1, 2012. Because City staff and PATV continue to negotiate the terms of a new agreement, PATV and City staff wish to extend the agreement for 6 months. This resolution approves a third amendment to extend the current contract to March 1, 2013. September 4, 2012 City of Iowa City Page ITEM 2d(5) CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE /oZ -1}ob COURT HILL PARK PUBLIC RESTROOM BUILDING PROJECT. Comment: The project has been completed by North Construction of Muscatine, Iowa, in substantial accordance with the plans and specifications. The Engineer's Report and Performance and Payment bonds are on file with the City Engineer. ❖ Project Estimated Cost: $ 78,000.00 ❖ Project Bid Received: $ 52,808.00 ❖ Project Actual Cost: $ 56,908.00 ITEM 2d(6) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO AN AGREEMENT WITH �a--,fo -7 FILMSCENE THAT ALLOWS THE SALE OF WINE AND BEER UNDER LIMITED CIRCUMSTANCES IN CITY PARK ON FIVE DAYS IN SEPTEMBER AND OCTOBER. Comment: FilmScene plans to show movies on four Friday evenings at the Riverside Festival Stage in City Park, as well as one Thursday if needed due to weather cancellation of a previous showing. Section 4 -5 -3 of the City Code allows for the sale and consumption of alcohol in a city park, on a right -of -way, or other public ground, excluding public buildings, pursuant to written agreement. Staff has approved the agreement, which is attached to the resolution, that allows FilmScene to sell beer and wine and for attendees to consume beer and wine on five specific days in September and October. The terms in the agreement are the same as those with Riverside Theatre. Item 9 will allow alcohol in certain City buildings, but does not apply to parks, and so this agreement is needed. ITEM 2d(7) CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE ia_ g CDBG DEMOLITIONS PROJECT - CONTRACT #6. Comment: The project has been completed by Kelly Demolition LLC of Mount Vernon, Iowa, in substantial accordance with the plans and specifications. The Engineer's Report and Performance and Payment bonds are on file with the City Engineer. ❖ Project Estimated Cost: $ 65,000.00 ❖ Project Bid Received: $ 42,100.01 ❖ Project Actual Cost: $ 42,100.01 ITEM 2d(8) CONSIDER A RESOLUTION ACCEPTING THE DEDICATION OF AND AUTHORIZING THE MAYOR TO ENTER INTO STORM WATER DETENTION FACILITY EASEMENT AGREEMENT PERTAINING TO LOT 39, SCOTT SIX INDUSTRIAL PARK AND AUDITOR'S PARCEL 2009029, IOWA CITY, IOWA. Comment: Superior Welding and Fabrication is proposing to add an additional building to their site and to expand their existing parking lot. The existing detention basin will need to be modified to increase its capacity in order to accommodate the additional runoff generated by the additional amount of impervious area. Therefore they are dedicating this easement to the City. Staff recommends acceptance of this dedication. 3 September 4, 2012 City of Iowa City Page 4 ITEM 2e. (REZ12- 00014) Comment: At its August 16 meeting, by a vote of 6 -0 (Weitzel absent), the Planning and Zoning Commission recommended approval of the proposed rezoning. Staff recommended approval in a report dated August 16. The proposed rezoning will provide historic preservation protections and associated zoning flexibilities to the building at 518 Bowery Street. (PAYDAY LENDING INSTITUTIONS) (SECOND CONSIDERATION) Comment: At its July 19 meeting, by a vote of 7 -0, the Planning and Zoning Commission recommended approval of the proposed amendments to the zoning code. If there is an indication that the Council will not accept the Commission's recommendation an opportunity for a joint meeting with the Council and the Commission is required. Staff recommended approval in a report dated July 19, 2012. The proposed amendments will place limitations on where payday lending uses may locate within the city. This ordinance has been revised subsequent to the first reading to clarify that institutions such as banks and credit unions will not be regulated as delayed deposit service uses. This is consistent with staffs intention and state law regulations of delayed deposit services under Chapter 533D. (CZ12- 00001) Comment: At its August 16 meeting, by a vote of 6- 0(Weitzel absent), the Planning and Zoning Commission recommended approval of the proposed County rezoning. Staff recommended approval in a report dated August 16. Approval of the rezoning will allow the applicant to tear down the existing house on the property and build a new one. ITEM 5. PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE PUBLIC WORKS - FUEL FACILITY PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH NOTICE TO BIDDERS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project involves construction of a new fuel facility at the Public Works Complex, located on S. Gilbert Street between Napoleon Lane and McCollister Boulevard. The new fuel facility consists of three (3) fuel islands, a canopy, security cameras, underground storage tanks, and a precast concrete building with a warm storage room, restroom facilities and a future bulk water station. The package includes sitework, utility extension, general building construction and mechanical, electrical and special plumbing /piping systems. Comment: This project will include constructing a new groundwater under drain lift station as part of the reconstruction of the landfill FY09 Cell at the Iowa City Landfill and Recycling Center. The landfill FY09 Cell was damaged by the fire and needs to be repaired to continue landfill operations. The total estimated construction cost is $120,000 and will be funded by Landfill Revenues. a. Comment: This project involves the reconstruction of the Normandy Drive area and establishes a landscape plan as an extension of City Park for the entire area bought out by CBDG and FEMA funding. CONSIDER AN ORDINANCE AMENDING TITLE 8, ENTITLED "POLICE REGULATIONS," CHAPTER 5, ENTITLED "MISCELLANEOUS OFFENSES," TO PROVIDE THAT "KEEPING A DISORDERLY HOUSE" IS A MUNICIPAL INFRACTION AND TITLE 17, ENTITLED 'BUILDING AND HOUSING," CHAPTER 5, ENTITLED "HOUSING CODE," TO ADD ANOTHER BASIS FOR A RENTAL PERMIT SANCTION. (FIRST CONSIDERATION) 8 Comment: When the police respond to a complaint regarding noise or loud party, often no one will answer the door. The police cannot issue a criminal complaint because they are unable to identify who is present. This ordinance adds two more enforcement tools. First, it makes "disorderly house" a municipal infraction which will allow staff to issue a civil citation to all tenants. To clarify the nature of the violation that gives rise to a civil sanction (i.e., municipal infraction), the ordinance that received first consideration on August 21 has been amended and the amended ordinance is set for first consideration. No change is made to the current prohibition on disorderly houses for which the police issue criminal complaints. Second, this ordinance also provides that having a "disorderly house," even if a criminal charge or a municipal infraction is not filed, can be a basis for a rental sanction. CONSIDER AN ORDINANCE AMENDING TITLE 4, ALCOHOLIC BEVERAGES, CHAPTER 5, PROHIBITIONS AND RESTRICTIONS, SECTION 3, CONSUMPTION OR POSSESSION IN PUBLIC PLACES AND CITY BUILDINGS, SUBSECTION B TO ALLOW FOR POSSESSION AND CONSUMPTION IN CERTAIN PARK BUILDINGS, PURSUANT TO ADMINISTRATIVE RULE; AND SUBSECTION C TO ALLOW FOR ALCOHOL POSSESSION AND CONSUMPTION IN CITY BUILDINGS PURSUANT TO ADMINISTRATIVE RULE. (PASS AND ADOPT) Comment: City staff wishes to allow alcohol in limited circumstances in some City buildings to accommodate private parties and fundraising events hosted by the Iowa City Public Library Friends Foundation, the Friends of the Center, and others. This will also allow alcohol to be sold or served, pursuant to administrative rule, in space leased by the City to private enterprise. Staff believes that legal and responsible use can be encouraged through the use of administrative rules. �p S Action: J l exJ �� 0) -4 /9 ITEM 10. CONSIDER AN ORDINANCE AMENDING TITLE 10, ENTITLED USE OF PUBLIC WAYS AND PROPERTY," CHAPTER 3, ENTITLED, "COMMERCIAL USE OF SIDEWALKS," SECTION 3, ENTITLED "USE FOR SIDEWALK t a- - CAFES," TO REGULATE SIDEWALK CAFES PRIMARILY BY POLICY AND ADMINISTRATIVE RULES. (PASS AND ADOPT) Comment: This ordinance deletes most of the requirements of sidewalk cafes from the City Code. Staff recommends placing these provisions in administrative policies approved by Council resolution and rules established by the City Manager. Doing so will allow more flexibility in regulating the sidewalk cafes and allow staff to respond more quickly to business owners' requests. Persons desiring to benefit from the proposed changes have requested expedited action to allow enactment prior to the football season. CONSIDER A RESOLUTION ADOPTING A POLICY FOR USE OF PUBLIC RIGHT -OF -WAY FOR SIDEWALK CAFES AND RESCINDING RESOLUTION NO. 07 -227. Comment: The prior agenda item is an ordinance providing that sidewalk cafes will be regulated primarily through an administrative policy. Attached to this resolution is the Sidewalk Cafe Policy which, with two exceptions, consists almost entirely of the prior ordinance and the current resolution on fees. One exception is the regulations governing cafes in the street. The second exception allows for cafes in planters outside of City Plaza. The fee resolution is rescinded and made part of the new policy so there is only one resolution governing cafes. This resolution was deferred from the August 21 meeting and should be considered only if item # 10 is adopted. CONSIDER A RESOLUTION AUTHORIZING THE AWARD OF A CONTRACT TO TYLER TECHNOLOGIES, INC., FOR FINANCIAL, HUMAN RESOURCES, _ /a- JIL/Z PAYROLL AND UTILITY CUSTOMER INFORMATION SOFTWARE. ITEM 13. 1 Comment: This resolution will approve a contract with Tyler Technologies for a package of software, including modules for financial, human resources, payroll, and utility customer information. The award follows an RFP process, reference checks, site visits, demos, additional due diligence, and contract negotiation. The overall contract amount of $832,165 exceeds the authority of the City Manager, and so requires Council approval. 6ere, Action: o b / CONSIDEIUA RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CHAPTER 28E AGREEMENT BETWEEN THE CITY OF IOWA CITY AND JOHNSON COUNTY IOWA FOR THE PROVISION OF ANIMAL CARE SERVICES. 10 Comment: This is the operating agreement for animal care services, which is on the agenda for the Board of Supervisors meeting on August 30. It is substantially the same agreement that Coralville, University Heights, and the University of Iowa have executed with the City. Comment: As set forth in Resolution No. 12 -155, the City has agreed to build a new animal shelter facility that exceeds the needs of its citizens and addresses the needs of a neighboring jurisdiction on the condition that the jurisdiction contribute its proportional share of the construction costs. This agreement, which is on the Board of Supervisors agenda on August 30, provides that the County will pay its proportional share of the costs of the new shelter.
