ITEM 3d(2) /a- --�`►C1 ITEM 3d(3) /a -- �7'L4 o Comment: Bids for this project were opened on Wednesday, September 12, 2012, and the following bids were received: Jasper Construction Services Newton, IA $ 410,295.00 All American Concrete West Liberty, IA $ 439,593.00 Streb Construction Iowa City, IA $ 472,034.85 Engineer's Estimate $ 437,000.00 Public Works and Engineering recommend award of the contract to Jasper Construction Services of Newton, Iowa. The City has been working with the Iowa Department of Transportation to include some repair work on Governor Street resulting in an increase to the estimated construction from $375,000 to $437,000. This additional work will be paid for by the Iowa Department of Transportation. The original project will be funded with General Obligation bond proceeds. CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE 2012 ROCHESTER AVENUE GROUND STORAGE RESERVOIR REHABILITATION PROJECT. Comment: The project has been completed by Preload, Inc. of Hauppauge, New York, in substantial accordance with the plans and specifications. Dubuque Street, which is proposed for redevelopment in to commercial and residential uses. This covenant is a necessary condition to the Board of Adjustment's special exception granted to the property owner so that the owner can satisfy its parking requirement in a municipal parking lot. Action: ITEM 5b REZONING APPROXIMATELY .034 ACRES LOCATED AT 518 BOW STREET AS AN IOWA CITY HISTORIC LANDMARK. (REZ12- 00014) [Discussion only at formal meeting] Comment: At its August 16 meeting, by a vote of 6 -0 (Weitzel absent), the Planning and Zoning Commission recommended approval of the proposed rezoning. Staff recommended approval in a report dated August 16. Action: 00 i v ITEM 5e CONSIDER AN ORDINANCE AMENDING TITLE 14, ZONING CODE, TO D� A DEFINITION FOR "DELAYED DEPOSIT SERVICE USES" AND REGULATE SAID USES AS PROVISIONAL USES IN THE COMMUNITY COMMERCIAL ZONE. (PAYDAY LENDING INSTITUTIONS) (PASS AND ADOPT) Comment: At its July 19 meeting, by a vote of 7 -0, the Planning and Zoning Commission recommended approval of the proposed amendments to the zoning code. If there is an indication that the Council will not accept the Commission's recommendation an opportunity for a joint meeting with the Council and the Commission is required. Staff recommended approval in a report dated July 19, 2012. The proposed amendments will place limitations on where payday lending uses may locate within the city. This ordinance has been revised subsequent to the first reading to clarify that institutions such as banks and credit unions will not be regulated as delayed deposit service uses. This is consistent with staffs intention and state law regulations of delayed deposit services under Chapter 533D. 410 September 18, 2012 Page 7 City of Iowa City ITEM 6. AMENDING THE FY2013 OPERATING BUDGET Comment: This public hearing is being held to receive comment on amending the FY2013 budget. a. PUBLIC HEARING Action: b. CONSIDER AN ORDINANCE AMENDING TITLE 8, ENTITLEra "POLICE REGULATIONS," CHAPTER 5, ENTITLED "MISCELLANEOUS OFFENSES," TO PROVIDE THAT "KEEPING A la �� DISORDERLY HOUSE" IS A MUNICIPAL INFRACTION AND TITLE 17, ENTITLED "BUILDING AND HOUSING," CHAPTER 5, ENTITLED "HOUSING CODE," TO ADD ANOTHER BASIS FOR A RENTAL PERMIT SANCTION. (SECOND CONSIDERATION) Comment: When the police respond to a complaint regarding noise or loud party, often no one will answer the door. The police cannot issue a criminal complaint because they are unable to identify who is present. This ordinance adds two more enforcement tools. First, it makes "disorderly house" a municipal infraction which will allow staff to issue a civil citation to all tenants. To clarify the nature of the violation that gives rise to a civil sanction (i.e., municipal infraction). No change is made to the current prohibition on disorderly houses for which the police issue criminal complaints. Second, this ordinance also provides that having a "disorderly house," even if a criminal charge or a municipal infraction is not filed, can be a basis for a rental sanction. CONSIDER A RESOLUTI�T MINING THE NECESSITY OF AND SET ING ZW' DATES OF A CONSULTATION AND PUBLIC HEARING ON A PROPOSED 1 a `fad AMENDMENT NO. 10 TO THE CITY- UNIVERSITY PROJECT I URBAN RENEWAL PLAN IN THE CITY OF IOWA CITY, IOWA Comment: The proposed resolution states that the Council has reasonable cause to believe that the proposed amendment to the City- University Project 1 urban renewal area meets eligibility criteria for inclusion in the urban renewal area under Iowa law. The resolution sets the date for a consultation between the taxing entities and notes proper notice and copies of the plan will be provided to such entities, and sets the public hearing on the proposed urban renewal plan for October 23, 2012. Dubuque Street, which is proposed for redevelopment in to commercial and residential uses. This covenant is a necessary condition to the Board of Adjustment's special exception granted to the property owner so that the owner can satisfy its parking requirement in a municipal parking lot. This Covenant cannot be released without the City's consent.
