DEWEY STREET BRICK RECONSTRUCTION
PROJECT
Sealed proposals will be received by the City
Clerk of the City of Iowa City, Iowa, until 2:30 P.M.
on the 12th day of September, 2012. Sealed
proposals will be opened immediately thereafter
by the City Engineer or designee. Bids submitted
by fax machine shall not be deemed a "sealed
bid" for purposes of this Project. Proposals
received after this deadline will be returned to the
bidder unopened. Proposals will be acted upon
by the City Council at a meeting to be held in the
Emma J. Harvat Hall at 7:00 P.M. on the 18th day
of September, 2012, or at special meeting called
for that purpose.
The Project will involve the following:
The reconstruction of 16,676 SF of Brick
Pavement Installation which includes a %"
bituminous setting bed and a 7" or 9" PCC
base, 1,271 SF of 7" or 9" PCC Pavement,
180 SF of 6" PCC Curb Ramp, 418 SF of 4"
PCC Sidewalk, 793 SF of 6" PCC Driveway,
13,365 LF of PCC Curb & Gutter, and other
work associated with brick street
reconstruction.
All work is to be done in strict compliance with
the plans and specifications prepared by the Iowa
City Engineer's Office, of Iowa City, Iowa, which
have heretofore been approved by the City
Council, and are on file for public examination in
the Office of the City Clerk.
Each proposal shall be completed on a form
furnished by the City and must be accompanied in
a sealed envelope, separate from the one
containing the proposal, by a bid bond executed
by a corporation authorized to contract as a surety
in the State of Iowa, in the sum of 10% of the bid.
The bid security shall be made payable to the
TREASURER OF THE CITY OF IOWA CITY,
IOWA, and shall be forfeited to the City of Iowa
City in the event the successful bidder fails to
enter into a contract within ten (10) calendar days
of the City Council's award of the contract and
post bond satisfactory to the City ensuring the
faithful performance of the contract and mainte-
nance of said Project, if required, pursuant to the
provisions of this notice and the other contract
documents. Bid bonds of the lowest two or more
bidders may be retained for a period of not to
exceed fifteen (15) calendar days following award
of the contract, or until rejection is made. Other
bid bonds will be returned after the canvass and
tabulation of bids is completed and reported to the
City Council.
The successful bidder will be required to furnish
a bond in an amount equal to one hundred
AF -1
percent (100 %) of the contract price, said bond to
be issued by a responsible surety approved by the
City, and shall guarantee the prompt payment of
all materials and labor, and also protect and save
harmless the City from all claims and damages of
any kind caused directly or indirectly by the
operation of the contract, and shall also guarantee
the maintenance of the improvement for a period
of five (5) year(s) from and after its completion
and formal acceptance by the City Council.
The following limitations shall apply to this
Project:
Specified Completion Date: November 16, 2012
Liquidated Damages: $250.00 per day
The plans, specifications and proposed contract
documents may be examined at the office of the
City Clerk. Copies of said plans and specifications
and form of proposal blanks may be secured at
the Office of the Iowa City Engineer, Iowa City,
Iowa, by bona fide bidders.
A $20.00 refundable fee is required for each set
of plans and specifications provided to bidders or
other interested persons. The fee shall be in the
form of a check, made payable to the
TREASURER OF THE CITY OF IOWA CITY,
IOWA.
Prospective bidders are advised that the City of
Iowa City desires to employ minority contractors
and subcontractors on City projects. A listing of
minority contractors can be obtained from the
Iowa Department of Inspections and Appeals at
(515) 281 -5796 and the Iowa Department of
Transportation Contracts Office at (515) 239-
1422.
Bidders shall list on the Form of Proposal the
names of persons, firms, companies or other
parties with whom the bidder intends to subcon-
tract. This list shall include the type of work and
approximate subcontract amount(s).
The Contractor awarded the contract shall
submit a list on the Form of Agreement of the
proposed subcontractors, together with quantities,
unit prices and extended dollar amounts.
By virtue of statutory authority, preference must
be given to products and provisions grown and
coal produced within the State of Iowa, and to
Iowa domestic labor, to the extent lawfully re-
quired under Iowa Statutes. The Iowa reciprocal
resident bidder preference law applies to this
Project.
The City reserves the right to reject any or all
proposals, and also reserves the right to waive
technicalities and irregularities.

RESOLUTION NO. 12 -418
RESOLUTION AWARDING CONTRACT AND AUTHORIZING THE MAYOR TO
SIGN AND THE CITY CLERK TO ATTEST A CONTRACT FOR
CONSTRUCTION OF THE DEWEY STREET BRICK RECONSTRUCTION
PROJECT.
WHEREAS, Jasper Construction Services of Newton, Inc., Iowa has submitted the lowest
responsible bid of $410,295.00 for construction of the above -named project; and
WHEREAS, funds for this project are available in the Brick Street Reconstruction account # 3849.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT:
The contract for the construction of the above -named project is hereby awarded to Jasper
Construction Services, Inc., subject to the condition that awardee secure adequate
performance and payment bond, insurance certificates, and contract compliance program
statements.
2. The Mayor is hereby authorized to sign and the City Clerk to attest the contract for
construction of the above -named project, subject to the condition that awardee secure
adequate performance and payment bond, insurance certificates, and contract compliance
program statements.
3. The City Engineer is authorized to execute change orders as they may become necessary
in the construction of the above -named project.

RESOLUTION ACCEPTING THE WORK FOR THE 2012 ROCHESTER AVENUE
GROUND STORAGE RESERVOIR REHABILITATION PROJECT
WHEREAS, the Engineering Division has recommended that the work for construction of the
2012 Rochester Avenue Ground Storage Reservoir Rehabilitation Project, as included in a
contract between the City of Iowa City and Preload, Inc. of Hauppauge, New York, dated July 27,
2012, be accepted; and
WHEREAS, the Engineer's Report and the performance and payment bond have been filed in the
City Engineer's office; and
WHEREAS, funds for this project are available in the Rochester Ave Ground Storage Reservoir
Repair account # 3298; and
WHEREAS, the final contract price is $56,411.10.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA

completed in accordance with the plans and specifications of the City of Iowa City:

Second Addtion, as constructed by Maxwell Construction, Inc. of Iowa City, Iowa.
Paving improvements for Brookwood Pointe Second Addtion, as constructed by Metro
Pavers, Inc. of Iowa City, Iowa.
WHEREAS, the maintenance bonds have been filed in the City Clerk's office; and
WHEREAS, the City of Iowa City has notified those contractors listed previously of the date on
which it will consider acceptance of the aforementioned public improvements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA

RESOLUTION NO. 12 -423
RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO
ATTEST A PARKING COVENANT FOR 114 SOUTH DUBUQUE STREET, IOWA
CITY, IOWA
WHEREAS, Central Park, L.L.C., ( "Owner ") owns real estate located at 114 S. Dubuque Street,
Iowa City, Iowa, which it desires to redevelop; and
WHEREAS, the Board of Adjustment granted Central Park. L.L.C. a special exception to allow
certain parking requirements of the proposed development to be satisfied by acquiring fourteen
(14) parking permits for the Dubuque Street municipal parking facility, or in another municipal lot
as determined by the Director of Parking and Transportation Services; and
WHEREAS, a condition of this special exception is that the Owner place a parking covenant on
the property, which covenant cannot be released without the City's consent.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
1. The Mayor is hereby authorized to execute and the City Clerk to attest the attached
Parking Covenant for 114 S. Dubuque Street, Iowa City, Iowa.
2. The City Clerk is hereby directed to certify a copy of this resolution and record it and the
attached Covenant in the office of the Johnson County Recorder at Owner's expense.

PARKING COVENANT
WHEREAS, Central Park, L.L.C. ( "Owner ") owns real estate
locally known as 114 South Dubuque Street, Iowa City, Iowa, and
legally described as follows:
The south 40 feet of Lot 4 in Block 65, in
Iowa City, Iowa, according to the recorded
plat thereof; also commencing at a point 40
feet north of the southeast corner of said
Lot 4 in Block 65, in Iowa City, Iowa,
thence west 10 feet, thence north 4 feet,
thence east 10 feet, thence south 4 feet to
the place of beginning. (the "Property ")
and
WHEREAS, Owner desires to construct a mixed -use building on
the Property; and
WHEREAS, in order to construct that mixed -use building,
Owner is required to provide for parking pursuant to the
ordinances of the City of Iowa City; and
WHEREAS, insufficient physical space exists upon the
Property to provide that parking; and
WHEREAS, the ordinances of the City of Iowa City allow for
that parking to be provided off -site or in public facilities;
and
WHEREAS, Marc B. Moen, acting on behalf of Owner, submitted
to the City of Iowa City an Application for Special Exception
(EXC12- 00003); and
WHEREAS, at a

City of Iowa City granted the Special

WHEREAS, at its meeting on July 11, 2012, the Board of
Adjustment of the City of Iowa City approved an amendment to the
Special Exception to allow all fourteen required parking spaces
to be provided in said Dubuque Street Parking Facility in order
to satisfy the minimum parking requirements for the proposed
mixed -use building; and
WHEREAS, the terms of that Special Exception need to be
incorporated into a Covenant running with the Property;
NOW, THEREFORE, Owner imposes upon the Property the
following Covenant for so long as the Property is used in the
manner described in the Application for Special Exception and as
allowed by the Board of Adjustment:
1. Owner shall satisfy all fourteen of the parking spaces
required for development of the Property by acquiring
permits from the City of Iowa City in the Dubuque Street
Parking Facility, or such other public parking facility
as the City may from time to time deem appropriate.
2. Owner shall compensate the City for those spaces at the
then prevailing rental fee for those permits, upon the
same terms and conditions as those permits would be
offered to the general public. The terms and conditions
of the lease of those spaces shall be set by the Director
of Transportation Services of the City of Iowa City.
3. The off -site parking shall be made available by Owner
only to residents with a primary address at the proposed
mixed -use building to be constructed on the Property, and
at a cost no greater than the lease rate determined by
the Director of Transportation Services of the City of
Iowa City at the time of leasing.

4. Owner shall provide to the City's Director of
Transportation the name, address, and license plate
number of all such permit holders.
5. Permits pursuant to this Covenant will only be granted to
residents with a primary address at the proposed mixed -
use building to be constructed on the Property.
6. This Covenant shall run with the land and bind Owner and
Owner's successors in interest until modified by mutual
agreement of the then owner and the City of Iowa City.
7. Owner shall record this Covenant in the office of the
Recorder of Johnson County, Iowa, at Owner's expense.

Introduction:
The proposed project involves the reconstruction of Lower Muscatine Road from Kirkwood
Avenue to 1st Avenue, incorporating complete streets design. The existing four -lane section
from DeForest Avenue to 1st Avenue will be converted to a three -lane section that includes a
continuous center left turn lane. The existing two -lane section from Kirkwood Avenue to
DeForest Avenue will remain a two -lane section from Kirkwood Avenue to Sycamore Street, and
expand to a three -lane section beyond Sycamore Street. An eight -foot sidewalk will also be
installed on the northeast side of Lower Muscatine Road. Sycamore Street will be realigned to
create a more perpendicular intersection with Lower Muscatine Road, and provide access to
Kirkwood Community College and MidAmerican Energy. The intersections along Lower
Muscatine Road at Mall Drive and 1st Avenue will continue to be signalized, while an additional
traffic signal will be added at the Sycamore Street intersection. City utility improvements to be
included as part of this project are a new storm sewer system, a new roadway lighting system, a
section of new sanitary sewer, and upgrades to the water main.
History /Background:
As Kirkwood Community College has continued to expand their Iowa City campus, it has
created additional demands to the surrounding transportation network, and Lower Muscatine
Road in particular. In addition, Lower Muscatine Road includes minimal storm sewer facilities,
deteriorating pavement, and does not meet current design standards. Based on these issues,
traffic congestion and the safety of drivers, bicyclists and pedestrians have become increasing
concerns throughout the corridor.
Discussion of Solutions:
Design for this project has progressed for several years, including several public meetings and
ongoing public input. Throughout the design process, the basic design criteria have remained,
such as two -lane and three -lane cross - sections throughout the residential and commercial
sections of the project, respectively. However, design considerations were made for individual
properties, and the project as a whole, based on feedback from the public. Based on this
feedback, the project evolved to include additional details, such as bus turnouts, to help improve
the project and surrounding areas.
The project had previously been bid in April of 2012, with bids coming in approximately 35%
over the construction estimate. Following the rejection of the bids, the project plans, budget and
schedule were reevaluated to determine why the bids were higher than estimated, and how to
bring the project more in line with the budget if it were rebid. The process resulted in a
combination of reducing restrictions on the project staging and schedule, reducing the amount
of work included in the project, and increasing the project budget.
Financial Impact:
The estimated construction cost for this project is $7,193,000 and will be funded with Federal
Surface Transportation Program (STP) proceeds, Water revenues, Wastewater revenues,
General Obligation bond proceeds and a contribution from Kirkwood Community College.

Urban Renewal Area
Introduction
A Resolution of Necessity is the first step to establish or amend an Urban Renewal
Area. This Resolution of Necessity for amendment #10 to the City- University Project I
Urban Renewal Area sets the dates of a consultation to be held with other taxing
jurisdictions in the county and for a Public Hearing on the plan.
While the draft plan for the amended City- University Project I Urban Renewal Area will
be on file with the City Clerk. Council's decision on Sept. 18 is simply whether to adopt
the Resolution of Necessity.
History /background
The original City- University Project I Urban Renewal Area was established in 1969 and
has been amended nine times since to accomplish various urban renewal objectives. A
substantial portion of the land located in the proposed amendment is part of the
Riverfront Crossings area east of the river and would add approximately 300 acres to
the area.
Discussion of Solution
The amended area will allow for an orderly expansion of the City's downtown /central
core and provide opportunities for the redevelopment of the Riverfront Crossings area.
In addition to supporting development of mixed -use, transit - oriented neighborhoods, the
amended area will also return some flood -prone properties to parkland, wetlands and
trails. Amending the area will create the ability to use tax increment financing to assist
in building the required infrastructure and /or in providing incentives for new
development. Coupled with the newly completed Downtown & Riverfront Crossings
Master Plan, the area will now have a design plan and the financial opportunities made
possible through the use of TIF to expand the tax base with redevelopment of blighted,
flood prone and /or underutilized areas.
Recommendations
Staff recommends approving the Resolution of Necessity to enable a consultation with
the other taxing entities and to set a Public Hearing for the plan on October 23, 2012.

Section 1. That one or more blight and economic development areas, as defined in

concerning a proposed City- University Project I Urban Renewal Plan, Amendment No. 10, a

The proposed Amendment No. 10 includes the use of taxes resulting from a division of
revenue under section 403.19 for a public building that is exempt from taxation and contains an

the affected taxing entities, the estimated impact on the provision of services by each of the
affected taxing entities in the proposed Urban Renewal Area, and the duration of any bond
issuance included in said Plan.
The designated representative of any affected taxing entity may make written
recommendations for modification to the proposed division of revenue no later than seven days
following the date of the consultation. Wendy Ford, Economic Development Coordinator, as the
designated representative of the City of Iowa City, shall submit a written response to the
affected taxing entity, no later than seven days prior to the public hearing on the proposed City -
University Project I Urban Renewal Plan, Amendment No. 10, addressing any recommendations
made by that entity for modification to the proposed division of revenue.

The City of Iowa City, Iowa is the local agency which, if such Plan is approved, shall
undertake the urban renewal activities described in such Plan.
The general scope of the urban renewal activities under consideration in the Plan is to
assist qualified industries and businesses in the Urban Renewal Area through various public
purpose and special financing activities outlined in the Plan. To accomplish the objectives of
the Plan, and to encourage the further development of the Urban Renewal Area, the plan
provides that such special financing activities may include, but not be limited to, the making of
