Harvat Hall r �-.® CITY O F IOWA CITY 1P2 N. t% �--c MEMORANDUM Date: November 15, 2012 To: Tom Markus, City Manager From: Rick Fosse, Public Works Director Re: Taft Speedway Levee Project Flood Fighting Expenses At the October 23, 2012 council work session staff presented the findings of the HDR study and answered questions related to the upcoming decision on the Taft Speedway Levee Project. A question was asked regarding flood response expenses experienced in 2008 and the potential expenses of future responses. This memo is intended to answer those questions. The City spent approximately $1.35M for temporary flood protective measures city wide during the 2008 flood. Of this amount, approximately $597,000 was spent on protective measures for private property. Roughly $107,000 of this was focused on the Taft /ldyllwild /Parkview Church neighborhood. All of the estimates in this paragraph do not include the value of volunteer labor. With regard to future floods, if levee alternative 7A is constructed it would provide a protection level of three feet above the 1% chance flood. This level of protection would meet the minimum requirements of the CDBG grant, but it would not be adequate to protect against a flood of the magnitude that we experienced in 2008. However, a design feature of alternative 7A is that additional flood protection can be added to the top of the levee when more sever events are forecasted. The Johnson County Emergency Management Agency owns a "quick levee builder" machine that could be deployed for this purpose. The estimated cost to deploy the quick levee builder and place an additional three feet of temporary protection on top of the proposed levee is about $38,000. Once mobilized, the machine will require about 24 hours of continuous operation to complete the work under optimum conditions. Cc: Thomas M. Karr, City Clerk 1 r i �. ®44T ,III; h CITY OF IOWA CITY 1P3 MEMORANDUM DATE: NOVEMBER 15, 2012 TO: TOM MARKUS, CITY MANAGER 7 FROM: JULIE TALLMAN, DEVELOPMENT REGULATIONS SPECIALIST RE: FLOOD INSURANCE In preparation for the "Taft levee" discussion on November 27, the following information is being provided on the issue of flood insurance. Question: How does FEMA define "flood "? Answer: "Flood," in pertinent part, is defined in the federal regulations as (a) A general and temporary condition of partial or complete inundation of normally dry land areas from: (1) The overflow of inland or tidal waters. (2) The unusual and rapid accumulation or runoff of surface waters from any source. (3) Mudslides...." 44 C.F.R. §59.1 (2011). Structures that are prone to flooding also include those that are nowhere near a body of water, but are located on lower ground relative to surrounding properties or structures that are built on poorly draining soil. Question: What is meant by a "100 year flood" and "500 year flood "? Answer: • The 1% flood hazard area (aka 100 -year flood) is that land that has a calculated annual 1% likelihood of flooding. • The 0.2% flood hazard area (aka 500 -year flood) is that land that has a calculated , annual 0.2% (2/10 of 1 %) likelihood of flooding. FEMA uses a system to rank the likelihood of flooding, based on the spatial relationship between developed areas and bodies of water. Critical to understanding this program is remembering that a structure is in a floodplain if it is on land that is below the predicted elevation of the 1 % annual flood. In other words, a structure may be elevated on piers 10 feet above the ground and still be required to have flood insurance if the elevation of the ground below the structure is below the predicted elevation of the 1 % annual flood. Question: What is flood insurance? Answer: Flood insurance supplements homeowners insurance (or other property insurance) and provides coverage for damage from flooding. Most flood insurance policies are subsidized by the federal government through the National Flood Insurance Program (NFIP). Question: What is the National Flood Insurance Program (NFIP): Answer: The NFIP is a federal insurance program administered by FEMA that is available to homeowners, renters, and business owners if the community participates in the NFIP. Participating communities agree to adopt and enforce ordinances that meet or exceed FEMA requirements to.reduce the risk of flooding. The NFIP insurance policies are sold through private insurance companies or from the NFIP through an authorized agent. Question: Is Iowa City a participating community? Answer: Yes, Iowa City has been a participating community since 1977. Question: Can anyone buy NFIP insurance for a home or business located anywhere in Iowa City? Answer: Yes. Flood insurance premiums vary, depending on a variety of factors including whether structures are located in the 1%, 0.2 %, or outside of the 0.2% floodplain. As you would expect, premiums are highest in the 1 % floodplain. Question: Must an owner buy NFIP insurance for a home or business in Iowa City? Answer: Federal law requires flood insurance if: a) there is a mortgage on the structure that is held by a federally regulated, supervised, or insured financial institution or the lender is a federal agency; and b) the structure is located on land that is within a 1 % "special flood hazard area (SFHA)." In this memo, we will use the term "floodplain" rather than "special flood hazard area." A lending institution may require the purchase of flood insurance even if it is not required by federal law. Lenders vary in whether they require insurance adequate to cover the outstanding balance on the mortgage or the entire value of the structure. A lender may also elect to require flood insurance for structures in the 0.2% floodplain. Question: When federal law requires flood insurance, what must be covered? Answer: At a minimum, the structure must be covered. The minimum amount of coverage is the lesser of: a) the outstanding principal balance on the mortgage; b) the maximum amount of coverage available under NFIP (see Table, below); or c) the total insurable value of the structure. Contents coverage is optional. Answer: FEMA ultimately determines the floodplain, which is shown on a map that FEMA publishes, the flood insurance rate map (or FIRM). The process of mapping floodplains begins with engineering studies conducted by private contractors, and then goes through an extensive quality- control procedure by contractors employed by FEMA before the floodplain map is published as the Flood Insurance Rate Map, or FIRM. 2 Question: Is any or all of the Parkview Terrace subdivision in a floodplain? Answer: Nearly all of Parkview Terrace is in either the 1 % or 0.2% floodplain. Only those properties in the extreme south cul -de -sacs (Granada Court and Park Place) are outside of either floodplain. Those homes closest to the river on Park, Normandy and the north side of Eastmoor are within both the 1 % and 0.2% floodplains. Between Eastmoor and Granada Court and Park Place, the homes are within the 0.2% floodplain. Question: Are the homes along Taft Speedway in a floodplain? Answer: Yes. All the homes along Taft Speedway are within the 1 % and 0.2% floodplain. Question: Are any or all of the Idyllwild condominium units in a floodplain? Answer: All of Idyllwild is in a floodplain. Some of Idyllwild is in the 1 %, and some is in the 0.2% floodplain. The land underneath the buildings was raised so most of the condominium units are built up on soil that is above the 1 % flood elevation. The history of Idyllwild is important to consider, as it shows the impact of changing flood conditions and flood mapping over time. Construction began in Idyllwild in 1992, with fill material brought in so that not only the condominiums, but the actual ground around each building would be above the 1 % flood elevation. This would allow each condominium building to be removed from the 1 % floodplain by using a tool called Letter of Map Revision Based on Fill (LOMR -F). As each building was constructed, each building received a LOMR -F and mandatory flood insurance was no longer a requirement because of the level of protection provided by elevating the ground. Adding fill to the floodplain was allowed in 1992 and continues to be allowed under the City ordinance and FEMA regulations. After the 1993 flood, the base flood elevation (BFE) of the Iowa River was increased by one foot due to studies conducted by Shive - Hattery, and the new BFEs became effective when a revised FIRM was issued in 2002. Condominiums constructed after the FIRM of 2002 were constructed on ground that was raised above the revised 1% BFE. LOMR -Fs continued to be issued. In some instances, new purchasers of condominium units were told by their lenders that they needed flood insurance but upon providing proof of the LOMR -F (or by getting a LOMA — see next question) the requirement for flood insurance was removed. After the 1 % flood elevation was increased by a foot, three buildings (two on Camborne Circle and one on Pentire Circle) were no longer on land that was above the BFE. The LOMR -Fs for these three buildings were rescinded after the flood of 2008, meaning that the structures are now within the 1 % floodplain. There are still three buildings left to be constructed according to the approved development plan for Idyllwild. These three buildings are subject to Iowa City's current floodplain regulations which require that, new buildings be elevated to one foot above the 0.2% flood elevation. Question: Can a property owner challenge the lending institution's determination that flood insurance must be purchased? 3 Answer: Yes. A Letter of Map Amendment (LOMA) is an official determination that the FIRM does not accurately portray ground elevations around a particular structure. A LOMA may only be used when a structure has not been elevated by fill (or was constructed before Iowa City became part of the NFIP in 1977). The LOMA process requires that the property owner complete an application and a licensed surveyor provide two elevations: 1) the elevation of the 1 % BFE; and 2) the elevation of the grade around the building at its lowest point (lowest adjacent grade or LAG). If the LAG is at or above the elevation of the BFE, FEMA will issue a LOMA and the mandatory insurance requirement is no longer applicable. As described in the Idyllwild example, a Letter of Map Revision Based on Fill (LOMR -F) is an official determination that the ground has been elevated and properly compacted such that the map is effectively revised. It is different from the LOMA because a LOMR -F may actually lead to a change in the map's appearance, visible on the next revised map. The standards for completing an application for a LOMR -F are more rigorous than the standards that apply to the LOMA application. Question: Is NFIP available to a condominium owners association, such as Idyllwild Condominium Homeowners Association, for the common elements? Answer: Yes. The individual unit owners may purchase insurance for the unit itself and the contents, and the association may purchase insurance for the common elements. Question: Was NFIP available to the Idyllwild unit owners and to the homeowners association in 2008 prior to the flood? Answer: Yes. Question: How are rates calculated? Answer: FEMA sets the rates, and the premium rates are based on a variety of factors including the amount of coverage, the type of building, the age of the building, the flood zone, the elevation of the building as compared to the base flood elevation, and the amount of the deductible. Premiums are automatically reduced for buildings in Iowa City, because we participate in the Community Rating System (CRS). Question: What is the Community Rating System (CRS)? Answer: CRS is a voluntary incentive program that recognizes and encourages community floodplain management activities that exceed the minimum NFIP requirements. Communities that participate in the CRS receive automatic premium discounts on flood insurance. Iowa City became a CRS Class 8 Community as of November 2011. Premiums for buildings in the 1 % SFHA are discounted 10 percent. Premiums for buildings outside of the 1 % SFHA are discounted 5 percent. Our application is currently under consideration for Class 7 or 6, which would reduce premiums by 15% and 5% (Class 7) or 20% and 10% (Class 6). Question: What would be the annual premium cost for $150,000 in coverage for a house in SFHA? Answer: We consulted with AW Welt Ambrisco, the City's insurance agent. There is no easy way to answer that question. As stated earlier, rates depending on many variables including the 4 type of building, age of the building, the flood zone, the elevation of the building as compared to the base flood elevation, and the amount of deductible. Property owners should contact their insurance agent for an accurate estimate of the cost. Question: Does the Iowa City City Code require a property owner to purchase flood insurance? Answer: No. The City's Floodplain Management Standards, which were adopted by ordinance on November 16, 2010 and are codified at Section 14 -5J of the City Code, govern the construction of new structures and enlargement/conversion /altering of existing structures. These standards "[a]ssure that eligibility is maintained for property owners to purchase flood insurance through the national flood insurance program," (i.e., that Iowa City remains a "participating community). Iowa 52240-1826 (3 19) 356 -5000 (319) 356 -5009 FAX www.icgov.org Residents of Court Street between Muscatine Avenue & Summit Street Re: Traffic calming on Court Street Dear Resident: As part of the traffic calming evaluation process requested by Court Street residents, we recently surveyed neighborhood households to determine the level of support for the installation of traffic calming on Court Street between Muscatine Avenue and Summit Street. The proposed design was for curb bump -outs, also known as chokers, to be installed on the north side of court Street to narrow the travel lanes and slow traffic. Survey results indicate that 46% (16) of responding households support the installation of traffic chokers on Court Street while 54% (19) are not in favor of the proposal. The survey response rate was 65 %. The City Council adopted criteria for the traffic calming program requires that a 60% majority of households be in favor of the traffic calming project to proceed; therefore the proposed traffic calming will not be installed. As always, if you feel traffic speeds are of concern, you can also request targeted police enforcement and use of the radar speed trailer by calling the routine police business line at 356- 5275. CALL TO ORDER: The meeting was called to order by Chappell at 6:30 p.m. APPROVAL OF THE SEPTEMBER 20, 2012 MINUTES: Drum moved to approve the minutes. Clamon seconded. A vote was taken and the motion carried 6 -0. PUBLIC COMMENT FOR ITEMS NOT ON THE AGENDA: None. STAFF /COMMISSION COMMENT: None. PUBLIC MEETING: Annual Review of the 2011 -2015 Consolidated Plan (a.k.a. CITY STEPS) Hightshoe stated the current 5 -year Plan is for FY2011 -2015. The City hired a consultant in 2009 to evaluate needs and solicit community input to develop priorities that would govern how the City spent their federal funds during this time period. HCDC and the City Council reviewed and approved this Plan; however each year HCDC reviews the plan to make sure the priorities HOUSING AND COMMUNITY DEVELOPMENT COMMISSION October 18, 2012 PAGE 2 of 7 identified have not changed for the upcoming year. Staff will start preparing for the next CITY STEPS Plan (2016 -2020) in 2014. She said each year they have an annual review to get feedback from the community to see if the priorities are still the same. If any changes are necessary, a recommendation for an amendment is sent to the City Council for consideration after a 30 day public comment period. She referred to a listing of all priorities in the current Plan (in the Commission's packet). The comments received at the Mercer Neighborhood Association as well as the written comments from Habitat (in packet) were provided. Staff emailed the Johnson County Local Homeless Coordinating Board, which consists of over 20 organizations in Johnson County that provide services to homeless, at risk, and low to moderate income populations, to encourage them to submit written comments about the needs in the community or the priorities identified in CITY STEPS as well as to invite them to the HCDC meeting to provide feedback. Chappell asked if sometimes the applicants suggest an identified need that is different than what staff identifies in the staff report. Hightshoe said yes, that can happen. Many agencies serve a broad range of needs. In CITY STEPS there are identified HUD priorities; however HUD does not provide a definition for each priority. Staff makes a judgment call based on what need /priority the project best meets based on the application and the HUD provided category in CITY STEPS. They can differ. (For example an agency might provide child care services, which is a high priority in CITY STEPS, but the application is for costs to provide a seminar on tenant/landlord counseling (low priority) for parents. Staff would state this application /project meets a low priority in CITY STEPS, despite the applicant indicating it's a high priority as the agency provides child care services.) Chappell said in the allocation process you are allocated different points based on priority level: low, medium, or high. When reviewing these priorities the Commission gave them more of a spread so that not all categories were high priorities. Jacobson asked about changing the ratings. Chappell explained that if staff provides a different priority level than the applicant indicates, the Commission member can indicate the priority level they feel is the correct one on their ranking sheet, regardless if it matches the staff or applicant identified one. Chappell invited public discussion. Kristie Doser with Domestic Violence Intervention Program said she wanted to explain how services are performed and how sheltering is going to change in the upcoming years. She said the Attorney General has been the conduit for state and federal funding for domestic violence programs in Iowa for many years. She said there have been cuts in the program totaling over 1.7 million dollars in the recent past. Due to these cuts and the possibility of more, the Attorney General is looking at regionalization of services for victims of domestic violence, which will have an impact on housing issues in Iowa City. Under the proposal, DVIP will be part of the southeast region serving 14 counties. Only one or two shelters will be funded in this region, this will mean the probable closure of the other four shelters. DVIP anticipates being one of the shelters that will be funded. People needing shelter from other counties will have limited choices. Chappell said when the Commission changed some of the priorities; they realized they had a majority of high priorities. He said the way it works is that they discuss high priorities first, fund at a level they choose, review medium priorities, fund them at the level they choose and then consider projects with low priorities. There is no obligation to fund a high priority, simply HOUSING AND COMMUNITY DEVELOPMENT COMMISSION October 18, 2012 PAGE 3 of 7 because it is high. There may be several reasons not to fund a high priority such as capacity, what current projects they have going, proposed timeline, budget, etc. The commission has funded several medium and low priorities. Doser said she appreciates that DVIP has been funded in the past and she believes that maintaining emergency shelter is still a high priority. She said DVIP will be applying for funds. Public member suggested that if you have an income stressed family then you have to build something they can afford. He suggested to give extra points for locations that are near services like grocery stores and bus lines. Chappell said that's a good idea. He asked the Commission if they had any changes they wanted to make to CITY STEPS. Public member asked if it's considered a black mark on the City if HUD monitors the City and finds that the Commission funded low priority items. Hightshoe said to date HUD's biggest concern has been if the City said they were going to do so many units then failed to do so. The City has to explain or provide justification why we didn't produce as many housing units or community development projects as indicated in our five year goals and annual action plans. Chappell said HUD might say something if they started funding only low priority projects. Hart recommended that they look into bumping up the priorities for DVIP and Habitat even though she knows there are several high priorities. Hightshoe stated the City can't bump up the priority for the agency, but the need served by'the agency such as homeless facilities, battered and abused spouses (services) and production of new owner units. Hightshoe stated she doesn't remember the background as to why homeless shelters were ranked as medium, possibly due to the fact that the City just funded the new Shelter House facility, however CITY STEPS does reference that the need for production of new owner units was being addressed by the addition of CDBG Disaster Recovery funds under the Single Family New Homes program. For this reason, CDBG and HOME funds would be directed to other housing activities. Zimmermann Smith said she is aware that there will be funding cut backs for DVIP but because they are going to a regional system there are going to be a lot of other communities that will be served by agencies in the Iowa City area. She encouraged the Commission not to make a decision on priority level now as it would be good to know what those other communities /counties will contribute so that Iowa City is not paying for most of the services /facility needs when it will be a regional shelter. Chappell said the Commission has been interpreting Habitat's applications to fall either under "persons and families at risk for homelessness" or "occupied housing units." Hightshoe stated in the annual action plan categories, it must be reported under "production of new owner unit" as a CDBG /HOME housing activity, a low priority in CITY STEPS. Priorities can be changed, the HUD category can't. Hart moved to recommend amending the priority level in CITY STEPS from low to high for the production of new owner units. Clamon seconded the motion. HOUSING AND COMMUNITY DEVELOPMENT COMMISSION October 18, 2012 PAGE 4 of 7 Hart said her thought was that Habitat served persons at a lower income level than other programs for homeownership and the need should be adjusted. Chappell said he thought Habitat makes a decent case for changing but not an overwhelming case at this point to change. A vote was taken and motion failed 2-4 with Clamon and Hart in support. Hart moved to recommend amending CITY STEPS to change 03Q — Abused and Neglected Children Facilities and 05G — Battered and Abused Spouses (services) from medium to high priorities. The motion died for lack of a second. Hightshoe explained that CITY STEPS priorities for public services will be important as they will guide Aid to Agency funding, more so than in the past. Agencies will not be applying for these funds under the CDBG process as not enough funds for both. The City Council set -aside has $105,000 (caps at 15% of the CDBG entitlement) for Aid to Agencies. Update on FYI Projects —CDBG Projects That Have Not Entered a Formal Agreement with the City of Iowa City of Iowa City Hightshoe said all of the CDBG agreements have been entered. Discuss Community Mental Health Center's Request for Project Revision Hightshoe stated Community Mental Health Center requests a change in their project. John Shaw was present to discuss. John Shaw, the architect for the Community Mental Health Center, said the bids came in considerably over what they had estimated. He said there is a lot of construction in Iowa City right now and this is a small project. He said smaller firms that might go after a job like this are not set up to do Davis Bacon and the other sort of paperwork that's required. He said they had a single bid that was high, possibly because they were the sole bidders. He said he met with the members of the Community Mental Health Fundraising Committee this morning. He said he went with an outline of what he planned to do, but there was a lot of discussion and things have now shifted. He says he is asking this Commission to give Community Mental Health permission to put together a plan to use the grant money they were awarded for accessibility for the building with the understanding that anything they put together will be contingent upon approval by this Commission. The elevator option was too expensive so the committee is considering options to increase accessibility without an elevator. Shaw explained that the initial discussion was to take that concrete ramp down and provide new stairs up to the first floor on the west side of the building. He said the next step was to provide two counseling rooms in the lower level and create a main entrance on that level on the south side. He said part of the discussion this morning was that they didn't want to lose that ramp even if it isn't code compliant. He said he is going to investigate the feasibility of re- working that ramp with a topping and making it ADA compliant. He said they still propose taking the top deck off and making two counseling rooms in the basement. He said it was very important to the staff of Community Mental Health that the ramp stays as they have to get up to that upper level. Zimmerman Smith asked if an elevator was possible with their new plans or if an elevator is still plausible. Shaw said everyone who was at the meeting this morning said an elevator is really what needs to be done. He said that idea may not be completely off the table yet. HOUSING AND COMMUNITY DEVELOPMENT COMMISSION October 18, 2012 PAGE 5 of 7 Jacobson asked how good this solution is for going forward and is it going to have the same impact that an elevator would. Shaw said it is not going to have the same impact as the elevator because that would be a relatively permanent solution. He said redoing the ramp and stairs could be at least a ten year solution, and the majority of the funds they will be spending will be providing the counseling rooms downstairs. Chappell says he doesn't have enough information to make a decision. He asked that anyone who feels that they will not approve something that doesn't include the elevator to speak now. If no comment he encouraged the Center to come back as soon as possible with how they want to proceed and the Commission will have to make a decision on whether they are willing to make that change. Hightshoe said there will be enough time if they vote on this at the next meeting. Zimmerman Smith said she would like to see either an elevator or a solution that really takes care of the same issues the elevator was supposed to address. Chappell said they need to find a way to address the accessibility issues and any changes Shaw makes will have to go through Historic Preservation. From his perspective, a future request to fund an elevator is probably out by the commission. Jacobson asked if Shaw can spend enough money in five months as Hightshoe's main concern was if they could spend a considerable sum by the end of the fiscal year. Shaw said at this point, he does have the elevator situation worked out. He said if it's reworking that ramp and doing rooms downstairs then the scope of that solution is reasonable to fit into five months. Hightshoe stated due to their Workout Plan with HUD, if the project can't proceed we will have to consider what projects can immediately spend out funds so that we are not in danger of losing funds in FY14 due to failure to hit HUD's next timeliness measure on May 2. Hightshoe said their fallback is possibly the Crisis Center, Housing Rehabilitation and other existing CDBG projects. There was no one on the Commission who was disinclined to consider anything than the elevator. Hightshoe asked Shaw to come back with plans and a timeline on November 15. Monitoring Reports FY12 The Housing Fellowship —CHDO Operating (Drum) He said he talked with MaryAnn Dennis; the money was used for operating expenses. They are still in business. He said as per their strategic plan they have expanded their office space and are building eight new homes in Iowa City and 14 in North Liberty as LIHTC projects.
