Resolutions and Motions: ITEM 4d(1) FAIRMEADOWS PARK SPLASH PAD PROJECT .. RESOLUTION AWARDING CONTRACT AND AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CONTRACT FOR CONSTRUCTION OF THE FAIRMEADOWS PARK SPLASH PAD PROJECT. Comment: Bids for this project will be taken on Thursday, January 17, 2013 at 2:00 p.m. Staff will review the bids and a recommendation for award will for presented to Council at the Council meeting on Tuesday, January 22nd. The estimated cost of the project is $297,117 and will be funded with CDBG funds. ITEM 4d(2) NATIONAL DEVELOPMENT COUNCIL AGREEMENT - RESOLUTION 3 AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST TO AN EXTENSION OF THE AGREEMENT BETWEEN THE CITY AND NATIONAL DEVELOPMENT COUNCIL REGARDING COMMUNITY AND ECONOMIC DEVELOPMENT ADVISEMENT Comment: On July 12, 2010, the City entered into a one -year agreement with National Development Council (NDC) to facilitate negotiations and pursue financing packages that will enable redevelopment of key areas including Towncrest and Riverfront Crossings. The agreement provides that it may be extended two years, and the City and NDC have entered into three previous extensions of 6- months each. This provides for a 12- month extension to January 2014 and deletes the provision that limits extensions beyond July 2013. All other terms, including the monthly fee of $6,000, remain the same. ITEM 4d(3) RISE FUNDS FOR THE PROPOSED MOSS RIDGE ROAD - RESOLUTION DECLARING THE CITY OF IOWA CITY'S / y APPLICATION FOR RISE FUNDS FOR THE PROPOSED MOSS RIDGE ROAD FROM IOWA STATE HIGHWAY 1 TO MOSS RIDGE CAMPUS AT RAPID CREEK PRESERVE Comment: This resolution will enable City staff to apply for grant funds from the Iowa Department of Transportation funding program named Revitalize Iowa's Sound Economy (RISE). If awarded funds, such funds will be used to construct the proposed Moss Ridge Road westerly from State Highway 1 (North Dodge Street) to enable development of commercial, office, retail, and residential properties in the Moss Ridge Campus, which is situated north of Interstate 80. The total project cost is estimated to be $4,466,000 and staff will apply for a minimum of fifty percent of project costs ($2,233,000). OF IOWA CITY, IOWA TO PROVIDE ENGINEERING CONSULTANT SERVICES FOR THE MOSS RIDGE ROAD PROJECT. Comment: This agreement authorizes Shive - Hattery to provide engineering services including the final design, bid documents and easements /right -of -way plats for the Moss Ridge Road Project. This project will include the construction of a street from Highway 1 to property west of NCS Pearson, N. Dodge Street /Highway 1 improvements, sidewalk, sanitary sewer, water main, traffic signals, stormwater system and stormwater detention facilities. The negotiated contract amount is not -to- exceed $298,000 and will be funded with General Obligation bond proceeds. Staff will apply for a RISE grant from the Iowa Department of Transportation. ITEM 4d(5) CEDAR RAPIDS POLICE RANGE USAGE AGREE MENT - RESOLUTION AUTHORIZING THE CITY OF IOWA TO ENTER INTO AN AGREEMENT WITH THE CITY OF AR RAPIDS TO 7 PROVIDE FUNDING TO EXPAND AND RADE THE CURRENT CRPD RANGE AND GUARANTEE C AIN USAGE RIGHTS WITH THAT FUNDING. -' yet Comment: The Iowa City,PoTice Department and other area law 'W enforcement agencies have attempted to locate property to build a local law enforcement range. After years of searching no suitable property has been located. The Iowa City Police Department has been using the CRPD ravage for several years without a formal agreement. With this form44'6reement certain rights will be guaranteed and ICPD will have accdss to a state of the art facility. Staff has recommended approval in a report dated December 20, 2012. These City- initiated rezonings are intended to bring the City's zoning map into compliance with the City's Comprehensive Plan and eliminate an obsolete zoning designation shown on the zoning map. Please note: As is the case with any rezoning, when the City Council sets a public hearing for a rezoning, there is a 60 -day moratorium on issuance of any permit for development activity that would be counter to or prohibited by the rezoning under consideration. The City Attorney's Office is preparing a memo that will provide additional information about this issue, which will be distributed prior to the Council meeting. Action: L �� D15 January 22, 2013 City of Iowa City Page 5 ITEM 6b CONDITIONALLY REZONING 1ST AVENUE NORTH OF ROCHESTER AVENUE - ORDINANCE REPEALING ORDINANCE NO. 12 -4507 AND CONDITIONALLY REZONING APPROXIMATELY 1.02 ACRES OF LAND LOCATED ON 1sT AVENUE NORTH OF ROCHESTER AVENUE FROM LOW DENSITY SINGLE FAMILY RESIDENTIAL(RS -5) TO LOW- DENSITY MULTI - FAMILY RESIDENTIAL (RM -12). (REZ12- 00025) [Discussion only at formal meeting] Comment: Passage of this ordinance will repeal a previous ordinance that contained an erroneous legal description and will provide a new version with the correct legal description. The conditional zoning agreement associated with this rezoning contains the correct legal description so does not need to be corrected, but will need to be re- executed by the Mayor after passage of the new rezoning ordinance. 1. CONSIDER AN ORDINANCE (FIRST CONSIDERATION) Action: ITEM 6c COMPREHENSIVE PLAN DOWNTOWN AND RIVERFRONT CROSSINGS PLAN - AMENDING THE COMPREHENSIVE PLAN TO INCLUDE THE DOWNTOWN AND RIVERFRONT CROSSINGS PLAN. Comment: At its December 7, 2012 meeting, by a vote of 6 -0 (Martin absent), the Planning and Zoning Commission recommended approval of the Downtown and Riverfront Crossings Plan as an element of the Comprehensive Plan. The Downtown and Riverfront Crossings Plan will provide guidance for preservation, redevelopment and urban design for the core area of the city. It also contains proposals for public infrastructure, parkland and open space. This public hearing was continued and resolution deferred from the January 8 Council meeting. City Council action is needed at the January 22, 2013 meeting in order to comply with a deadline to receive State grant funds for the project. 1. PUBLIC HEARING Action: 2. RESOLUTION APPROVING THE PRELIMINARY PLAT OF ROBERTS DAIRY ADDITION, IOWA CITY, IOWA. (SUB12- 00012) Comment: At its December 6 meeting, by a vote of 6 -0 (Martin Absent), the Planning and Zoning Commission recommended approval. Staff recommended approval in a report dated November 15. Approval will allow the development of a 3 -lot, commercial subdivision on approximately 8.21 -acres of land located at the northeast corner of the intersection of Prairie du Chien Road and Dodge Street. Action: ITEM 7. AMENDING DOWNTOWN URBAN RENEWAL PLAN TO ALLOW DEVELOPMENT AGREEMENT FOR FIELDHOUSE BAR REDEVELOPMENT J3 �� PROJECT - RESOLUTION TO AMEND CITY - UNIVERSITY URBAN RENEWAL PLAN TO ADD A PROPOSED URBAN RENEWAL PROJECT REHABILITATING A VACANT BUILDING FOR OFFICE AND COMMERCIAL USE TO BE UNDERTAKEN WITHIN THE AREA. Comment: The City Council Economic Development Committee recommended Council consideration of a proposed urban renewal project requesting TIF financing at their Nov. 19, 2012 meeting, and minutes distributed in the November 29 Information Packet. In order for Council to consider the project, the respective Urban Renewal Plan must first be amended to include it. Passing this resolution would amend the plan to enable future Council consideration of the project. a. PUBLIC HEARING Action: b. CONSIDER A RESOLUTION Action: CMG January 22, 2013 ITEM 8 r - 2.3 ITEM 9. 13 -a City of Iowa City Page 9 Prfr LANDFILL FY09 CELL RECONSTRUCTION PROJECT — PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE LANDFILL FY09 CELL RECONSTRUCTION PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH NOTICE TO BIDDERS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project will reconstruct the landfill FY09 Cell that was damaged by fire. The cell will be constructed in accordance with all State and Federal regulations. Project plans and specifications will include a base bid utilizing tire derived aggregate with added fire safeguards, and an alternate bid utilizing conventional aggregate. The estimated construction cost of the base is $1,670,000. The project will be funded with Landfill revenues. A revised staff memo is included in Council packet. a. PUBLIC HEARING b. CONSIDER A RESOLUTION$ Action: UNIVERCITY SALE — 828 EAST MARKET - AUTHORIZING CONVEYANCE OF A SINGLE FAMILY HOME LOCATED AT 828 EAST MARKET STREET. Comment: In the UniverCity Neighborhood Partnership Program, the City purchases rental units located in designated neighborhoods surrounding the University, rehabilitates them, and then sells them to income - eligible buyers. Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 828 East Market Street. The amount of the sale will be $105,000 (this is what the City paid to purchase the home) plus "carrying costs" of approximately $3,800. "Carrying costs" are all costs incurred by the City to acquire the home, maintain it and sell it, including abstracting and recording fees, interest on the loan to purchase the home, mowing and snow removal, utilities, real estate taxes, and any costs in excess of $40,000 to repair and rehabilitate the home. a. INFORMATION TABLES ON CITY PLAZA - CONSIDER AN ORDINANCE AMENDING TITLE 10 OF THE CITY CODE, ENTITLED "PUBLIC WAYS AND °1-f5 /15 PROPERTY," CHAPTER 5, ENTITLED "CITY PLAZA," TO ALLOW THE CITY MANAGER TO DETERMINE THE LOCATION OF THE INFORMATION TABLES ON CITY PLAZA. (PASS AND ADOPT) Comment: The City Code allows the City Manager to grant a permit for placement of "information tables" on City Plaza, aka the ped mall, to provide noncommercial information to the general public. (FIRST CONSIDERATION) Comment: These amendments will substitute the new State I -PACT program for TIPS training required for all bar staff in entertainment venues, and eliminate the midnight curfew for 19 and 20 year olds in entertainment venues on show nights. Our entertainment venues took part in the development of the present law, but the change in law regarding the I -PACT program makes a change appropriate, and the venues have found that their businesses are being hurt by the midnight curfew for their 19 and 20 year old patrons more than they expected.
