Sealed proposals will be opened immediately thereafter by the City Engineer or designee. Bids submitted by fax machine shall not be deemed a "sealed bid" for purposes of this Project. Proposals received after this deadline will be returned to the bidder unopened. Proposals will be acted upon by the City Council at a meeting to be held in the Emma J. Harvat Hall at 7:00 P.M. on the 22nd day of January, 2012, or at a special meeting called for that purpose. There will be a pre -bid meeting on.Tuesday, January 8th at 10 a.m. in the Helling Lobby Conference Room in City Hall, at 410 East Washington Street, Iowa City, Iowa. The Project will involve the following: Provide and install a new Vortex Aquatic Structure product Splash Pad System from Outdoor Recreation Products at the Fairmeadows Park located at 2451 Miami Drive in Iowa City, Iowa. This work will include above and below ground mechanical, electrical and plumbing systems, a water containment and recirculating pump system, and a vandal resistant enclosure. There will be alternates for a parking lot, and sidewalks. The contractor will be responsible for all associated mechanical, structural, paving and electrical work. This project will be funded by Community Development Block Grant Funds through the US Department of Housing and Urban Development and SECTION V. SPECIAL CONDITIONS- SUPPLEMENT FOR ALL CDBG CONTRACTS AND AGREEMENTS are incorporated into the specifications. All work is to be done in strict compliance with the plans and specifications prepared by MMS Consultants Inc., of Iowa City, Iowa, which have heretofore been approved by the City Council, and are on file for public examination in the Office of the City Clerk. Each proposal shall be completed on a form furnished by the City and must be accompanied in a sealed envelope, separate from the one containing the proposal, by a bid bond executed by a corporation authorized to contract as a surety in the State of Iowa, in the sum of 10% of the bid. The bid security shall be made payable to the TREASURER OF THE CITY OF IOWA CITY, IOWA, and shall be forfeited to the City of Iowa City in the event the successful bidder fails to enter into a contract within ten (10) calendar days of the City Council's award of the contract and post bond satisfactory to the City ensuring the faithful performance of the contract and maintenance of said Project, if required, pursuant to the provisions of this notice and the other contract documents. Bid bonds of the lowest two or more bidders may be retained for a period of not to exceed fifteen (15) calendar days following award of the contract, or until rejection is made. Other bid bonds will be returned after the canvass and tabulation of bids is completed and reported to the City Council. The successful bidder will be required to furnish a bond in an amount equal to one hundred percent (100 %) of the contract price, said bond to be issued by a responsible surety approved by the City, and shall guarantee the prompt payment of all materials and labor, and also protect and save harmless the City from all claims and damages of any kind caused directly or indirectly by the operation of the contract, and shall also guarantee the maintenance of the improvement for a period of two (?) year(s), unless an extended warranty is stipulated by specification, from and after its completion and formal acceptance by the City Council. A separate and nonrefundable $15.00 shipping and handling fee will apply to plans that are sent through postal mail. Prospective bidders are advised that the City of Iowa City desires to employ minority contractors and subcontractors on City projects. A listing of minority contractors can be obtained from the Iowa Department of Economic Development at (515) 242 -4721 and the Iowa Department of Transportation Contracts Office at (515) 239 -1422. Bidders shall list on the Form of Proposal the names of persons, firms, companies or other parties with whom the bidder intends to subcontract. This list shall include the type of work and approximate subcontract amount(s). The Contractor awarded the contract shall submit a list on the Form of Agreement of the proposed subcontractors, together with quantities, unit prices and extended dollar amounts. By virtue of statutory authority, preference must be given to products and provisions grown and coal produced within the State of Iowa, and to Iowa domestic labor, to the extent lawfully required under Iowa Statutes. The Iowa reciprocal resident bidder preference law applies to this Project. Washington St. Iowa City, IA 52240 (319) 356 -5247 RESOLUTION NO. 13 -19 RESOLUTION DECLARING THE CITY OF IOWA CITY'S APPLICATION FOR RISE FUNDS FOR THE PROPOSED MOSS RIDGE ROAD FROM IOWA STATE HIGHWAY 1 TO MOSS RIDGE CAMPUS AT RAPID CREEK PRESERVE WHEREAS, the City of Iowa City, Iowa ( "City ") endorses the construction of the proposed Moss Ridge Road for dedicated public use heading west from a new signalized intersection with State Highway 1 approximately one - quarter mile north of Interstate 80 to serve the future Moss Ridge Campus at Rapid Creek Preserve; and WHEREAS, the City's adopted Comprehensive Plan recommends that the City attract additional commercial development adjacent to Interstate 80 and the new Moss Ridge Road will enable development on land that will be accessible to the interstate and Iowa highway networks; and WHEREAS, the City has identified an immediate, non - speculative opportunity for job retention and creation that is dependent upon the construction of Moss Ridge Road in 2013; and WHEREAS, the proposed road construction improvements will enhance the economic development of the community and surrounding area and add to the quality of life of citizens; and WHEREAS, increased commercial business creates additional jobs for residents and allows growth of the tax base and is consistent with the intent of the RISE program to fund projects which grow the Iowa tax base and facilitate job creation; and WHEREAS, the City needs the Revitalize Iowa's Sound Economy (RISE) funds to assist in the improvements needed for this project; and WHEREAS, the City will be responsible for adequately maintaining said roadway improvements that are not within Iowa Department of Transportation right -of -way; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT: 1. Background For the past two years, the City has been facilitating the expansion of the major employment center located north of Interstate 80 and west of North Dodge Street. The proposed Moss Ridge Campus office park consists of 150 acres of land intended for office /research park uses and approximately 14 acres (84,000 square feet) of support retail. This high visibility development along Interstate 80 has already generated interest from site selection consultants and area employers looking to relocate. The property is currently inaccessible, so a new roadway is necessary for development to occur. The Iowa Department of Transportation administers a grant program named Revitalize Iowa's Sound Economy (RISE) that funds road construction projects that create jobs. The proposed Moss Ridge Road is precisely the type of project that this grant program targets. The program funds up to 80 percent of eligible construction costs, so the City's share would depend on the award amount. Discussion of Solution We discussed this project with Iowa DOT staff and believe it would be a competitive grant application. The City could submit an application to the RISE program for 80 percent of the eligible road construction costs, which are estimated at $4,466,000. Based on the scoring criteria, we believe that if the project is funded, the grand award would be 20 to 50 percent of construction costs. Alternatively, the City could fund the project locally without grant money. Recommendation We recommend approving the enclosed resolution authorizing City staff to apply for grant funds from the Iowa DOT RISE Program. If awarded, the funds will be used to construct the proposed Moss Ridge Road westerly from State Highway 1 (North Dodge Street) to enable development of commercial office uses and support retail on the land northwest of the 1 -80 interchange with Highway 1. The total project cost is estimated to be $4,466,000 and staff will apply for a minimum of fifty percent of project costs ($2,233,000). WHEREAS, the City desires to construct an entrance roadway, Moss Ridge Road, from North Dodge Street/Highway 1 to the proposed Moss Ridge Campus at Rapid Creek Preserve located at the northwest corner of North Dodge Street/Highway 1 and Interstate 80. The project is generally planned to include roadway, North Dodge Street/Highway 1 improvements, sidewalk, sanitary sewer, water main, traffic signals, stormwater system, and detention basins. Improvements to North Dodge Street/Highway 1 are included as part of this project. The project scope is as defined per the Moss Ridge Road preliminary engineering phase. NOW THEREFORE, it is agreed by and between the parties hereto that the City does now contract with the Consultant to provide services as set forth herein. SCOPE OF SERVICES Consultant agrees to perform the following services for the City, and to do so in a timely and satisfactory manner. Survey and Base Mapping A. Design Survey The Consultant shall perform a topographic survey from the northern boundary of the Highway 1 preliminary phase survey limits to a point 1,100 feet north along the Highway 1 corridor. B. Base Map Preparation A base map to facilitate the roadway and stormwater design will be prepared from the northern boundary of the Highway 1 preliminary phase survey limits to a point 1,100 feet north along the Highway 1 corridor. The base map prepared will include existing topography features, right -of -way and easement lines, buried utilities based on field locates, and above ground surface features. Design & Construction Document Phase A. Design Complete design for all components of the Moss Ridge Road construction as described in Exhibit B and Exhibit C attached hereto. Design shall also include delineation of the Indiana Bat habitat required for removal, as identified by Stanley Consultants. B. Typical Pavement Sections The final design typical pavement sections will be developed for the project. These sections will include the pavement thickness, subgrade requirements, grading and compaction requirements. 112327 -1 -2- C. Final Plan and Profiles The final design and drafting of the plan and profiles will be prepared on base maps prepared for the project. D. Final Design Cross - Sections Prepare the final design of the individual cross - sections for the project. Cross - sections will be developed at a minimum of 50 -foot intervals with additional cross - sections included as necessary. Cross - sections will show the existing ground as well as final grading, foreslopes, backslopes, special subgrade treatment, and other pertinent information. E. Final Design Plans Layout plans and appropriately detailed design drawings showing the project and component parts shall consist of plans,, elevations, sections, and other drawings for bidding and construction purposes. Final design and drafting of plan and profile sheets will include complete detailed information for location of existing utilities, typical cross - sections, and individual cross - sections. Final plans shall meet all requirements of the RISE grant program. F. Final Storm Drainage Design Final design and drafting of the storm sewer system, storm sewer inlets, manholes, culverts, ditches, detention ponds reconstruction, and other storm drainage appurtenances on the project will be developed. The design of the storm sewer system will be based on current Iowa City design standards. Copy of design calculations shall be submitted to the City. G. Watermain and Sanitary Sewer Design Final design and drafting of the watermain and sanitary sewer systems. Copy of design calculations for the sanitary sewer shall be submitted to the City. H. Erosion Control Final design and drafting of temporary and permanent erosion control measures to be provided on the project during construction will be completed. A stormwater pollution prevention plan (SWPPP) and NPDES permit binder will be included with the project. Signing and Pavement Markings Final design and drafting of signage and pavement markings which are to be a permanent part of the project. Traffic Signals Final design and drafting of traffic signals. 112327 -1 -3- K. Final Design of Incidental Components Incidental design work necessary for the project concept such as sidewalk ramps, relocations, etc. not specifically stated herein necessary to construct a final completed project shall be the responsibility of the Consultant and no additional compensation shall be provided. L. Specifications The Iowa Department of Transportation (DOT) and the Statewide Urban Design Standards and Specifications (SUDAS) will be utilized as the technical specifications for the project. The City of Iowa City standard contract documents will also be utilized for this project. Supplemental specifications and special provisions required by the project will be prepared and incorporated with the standard documents. M. Final Quantities The final bid quantities will be determined and included with the project specifications bid form. N. Final Cost Opinion Following completion of the final design, an opinion of probable construction costs based on the final design will be prepared. O. Submittals, Reviews, and Revisions Submit plans, approximately 60% and 95% complete, to the City to facilitate plans /specification review and field examination. Participate in field examination and plan /specification review with the City. P. Final Plan and Specification Submittal Submit final plans, specifications, contract documents, and opinion of probable construction costs to the City and Iowa DOT for final approval. Q. Assemble Plan Documents Following final plan revisions, assemble title sheet, project quantities and reference sheet, location plan, pavement detail sheets, grading plan and profile sheets, typical section and tabulation sheets, and cross - section sheets. R. Utilities Submit plans to affected utility companies and communicate relocation needs. The Consultant will lead the coordination effort with utilities. The City will provide assistance as needed. S. RISE Grant Support Provide exhibits, cost opinions, and other such documents as required for RISE Grant application /contract. 112327 -1 -4- T. Easements / Right -of -Way Plats Prepare plats and legal descriptions for the right -of -way and easements as defined by the preliminary engineering phase. Certified plats shall be provided to the City by January 30, 2013. Permitting Environmental permitting shall be performed by the City (Stanley Consultants, Inc.). The Consultant shall prepare and submit applicable permit applications to the Iowa Department of Transportation. The Consultant_ shall prepare and submit watermain and sewer construction permit applications to the Iowa Department of Natural Resources (DNR). The Consultant shall prepare and submit a Stormwater Pollution Prevention Plan (SWPPP) to the Iowa DNR for NPDES permit. Geotechnical Geotechnical investigation and soils report shall be included. Bidding and Construction Phases The City will provide bidding and construction phase services. However, the Consultant will respond to questions during the bidding phase, prepare addenda as appropriate, and facilitate the preconstruction conference. Additional Services Construction Phase services: Construction staking, testing, and construction phase services may be added as additional services. 11. CLIENT RESPONSIBILITIES City agrees to provide the following: A. Participation at design review meetings and review of schematic design concepts. B. Traffic Impact Study and Environmental permitting. To discriminate against any individual in terms, conditions, or privileges of employment because of their race, color, religion, sex, national origin, disability, age, marital status, gender identity, or sexual orientation. B. Should the City terminate this Agreement, the Consultant shall be paid for all work and services performed up to the time of termination. However, such sums shall not be greater than the "not -to- exceed" amount listed in Section V. The City may terminate this Agreement upon seven (7) calendar days' written notice to the Consultant. C. This Agreement shall be binding upon the successors and assigns of the parties hereto, provided that no assignment shall be without the written consent of all Parties to said Agreement. D. It is understood and agreed that the retention of the Consultant by the City for the purpose of the Project shall be as an independent contractor and shall be exclusive, but the Consultant shall have the right to employ such assistance as may be required for the performance of the Project. E. It is agreed by the City that all records and files pertaining to information needed by the Consultant for the project shall be available by said City upon reasonable request to the Consultant. The City agrees to furnish all reasonable assistance in the use of these records and files. 112327 -1 F. It is further agreed that no Party to this Agreement shall perform contrary to any state, federal, or local law or any of the ordinances of the City of Iowa City, Iowa. G. At the request of the City, the Consultant shall attend meetings of the City Council relative to the work set forth in this Agreement. Any requests made by the City shall be given with reasonable notice to the Consultant to assure attendance. H. The Consultant agrees to furnish, upon termination of this Agreement and upon demand by the City, copies of all basic notes and sketches, charts, computations, and any other data prepared or obtained by the Consultant pursuant to this Agreement without cost, and without restrictions or limitation as to the use relative to specific projects covered under this Agreement. In such event, the Consultant shall not be liable for the City's use of such documents on other projects. The Consultant agrees to furnish all reports, specifications, and drawings, with the seal of a professional engineer affixed thereto or such seal as required by Iowa law. J. The City agrees to tender the Consultant all fees in a timely manner, excepting, however, that failure of the Consultant to satisfactorily perform in accordance with this Agreement shall constitute grounds for the City to withhold payment of the amount sufficient to properly complete the Project in accordance with this Agreement. K. Should any section of this Agreement be found invalid, it is agreed that the remaining portion shall be deemed severable from the invalid portion and continue in full force and effect. L. Original contract drawings shall become the property of the City. The Consultant shall be allowed to keep mylar reproducible copies for the Consultant's own filing use. M. Fees paid for securing approval of authorities having jurisdiction over the Project will be paid by the City. N. Upon signing this agreement, Consultant acknowledged that Section 362.5 of the Iowa Code prohibits a City officer or employee from having an interest in a contract with the City, and certifies that no employee or officer of the City, which includes members of the City Council and City boards and commissions, has an interest, either direct or indirect, in this agreement, that does not fall within the exceptions to said statutory provision enumerated in Section 362.5. O. The Consultant agrees at all times material to this Agreement to have and maintain professional liability insurance covering the Consultant's liability for the Consultant's negligent acts, errors and omissions to the City in the sum of $1,000,000. 112327 -1 -7- V. However, because the property is currently landlocked, a public street will need to be extended from Highway 1 to the property west of Pearson in order to develop per the Comprehensive Plan. History /Background: Shive - Hattery has completed the preliminary design for the project. It is now necessary to complete the final design, and prepare bid documents and easement /right of way plats for the Moss Ridge Road Project. Discussion of Solutions: An agreement has been negotiated with Shive - Hattery, Inc. to provide these engineering services. Financial Impact: The not -to- exceed fee for these engineering services is $298,000. Funding will be via general obligation bonds. There is another item on this council meeting's agenda which authorizes staff to apply for a State of Iowa RISE grant to cover a portion of the costs associated with this project. History/Background: The Johnson County area law enforcement agencies have been looking for a location to build a shooting range for a number of years. Any time a potential property was located, concerns were expressed by neighboring properties making the property not feasible. The range in Cedar Rapids is the one currently being utilized by most of the Johnson County agencies. CRPD approached the Johnson County law enforcement agencies requesting help with funding to upgrade and expand their current facility. The agency heads for area law enforcement agreed to not pursue building a local range and explore the Cedar Rapids option. Discussion of Solutions: The Iowa City Police Department would like to allocate funding to be utilized at the Cedar Rapids Police Department range. The Johnson County Law Enforcement agency heads have decided that it would be in the best interest of those agencies to continue to utilize the CRPD range for firearm training. CRPD is starting to expand and upgrade the range at its current location and is seeking assistance to cover the cost of these improvements. Those agencies that agree to help with the cost will be provided a MOU which will include guaranteed range dates, priority in picking the training dates, a key to the facility, on site storage and either waiver or reduction in usage fees. Other benefits include free tuition to the Cedar Rapids Police Academy. Financial Impact: Iowa City would utilize funds from the federal 2009 and 2012 Byrne JAG, approved for range equipment, and asset forfeiture funds for a total contribution of $100,000.00 towards the project. A breakdown of funding is as follows; 2012 Byrne JAG $16,726.00 + 2009 Byrne JAG $31,927.00 + Asset forfeiture funding $51,347.00. We are offering Life Memberships to the public for $4000. We would like to extend this offer to the ICPD. 112 officers at $4000 is $448,000. This would give all the officers Free range time Monday -Friday 9 -5. Peak range time 5 -9 and weekends would be at 1/2 price $10 /hr for personal use. They would receive a "Buddy- Pass" every month to bring a friend to shoot in the lane with them at no cost. Any other time they bring someone with them it is at half price $5 /hr. They will have call ahead placement. They will have 10% off everything in the retail portion of the facility ($500K in inventory). FFL Transfers and Gun Rentals are 50% off, and hearing and eye rentals free. PURPOSE: The purpose of this Memorandum of Agreement (MOA) between the City of Iowa City, Iowa ( "Iowa City ") and the City of Cedar Rapids, Iowa ( "Cedar Rapids "), hereinafter collectively referred to as the "parties ", is to define the terms and conditions regarding Iowa City's use of the Cedar Rapids Police Department's shooting range located at 2727 Old River Road SW, Cedar Rapids, Iowa 52404, (hereinafter "the shooting range" or "the Premises "). 2. BACKGROUND: The Iowa City Police Department has requested permission to use the Premises, which is owned by the City of Cedar Rapids, to conduct firearms training for its officers, employees and/or appointees. Subject to the availability of funding Iowa City shall provide Cedar Rapids $100,000 between July 1, 2012 and June 30, 2014 as set forth hereinbelow: a) Forty-eight thousand six hundred fifty -three dollars ($48,653.00) will be used for the construction of a turning target system and any other equipment needs. b) Fifty -one thousand three hundred forty -seven dollars ($51,347.00) will be used for the construction of the remaining range projects and improvements, as shown on Exhibit A, attached hereto and by this reference incorporated herein. Should there be any funds not spent as described above, Cedar Rapids will spend those funds for projects and improvements which could be moved to a new location, should the shooting range be relocated during the term of this MOA. c) One year after the signing of this MOA, the parties will meet and agree upon maintenance fees to be paid to the City of Cedar Rapids to cover the ongoing costs of equipment repairs and replacement. Iowa City will pay a reasonable share of such costs as may be agreed upon by the parties. Any agreement will become an addendum, not a replacement, to this MOA. d) Cedar Rapids covenants that it will use all money received from Iowa City pursuant to this MOA as set forth in this MOA. 3. AUTHORITY: Both parties warrant that they have each taken all requisite steps to authorizing the execution of this MOA on their behalf. 4. IOWA CITY USE OF CEDAR RAPIDS SHOOTING RANGE: Iowa City shall have the right to use the Cedar Rapids shooting range as follows: Iowa City may use the shooting range for a minimum of 4 times per year, and on an as- needed basis, without charge, subject to the CRPD having priority use. a) Iowa City shall provide ammunition for its employees for their use of the facility. Iowa City shall store no firearms or ammunition at the shooting range. b) Iowa City covenants that it employees shall familiarize themselves with and shall abide by the rules and regulations of the use of the shooting range. c) Iowa City's use of the shooting range shall be limited to use by its certified peace officers and for necessary law enforcement training only. d) Iowa City shall present Cedar Rapids with proposed times and dates for use of the shooting range at least 30 days in advance of use. All Iowa City use will be subject to Cedar Rapids' approval which shall not be unreasonably denied. e) Cedar Rapids shall furnish Iowa City with one key to the range. Iowa City shall not make any copies of this key. Cedar Rapids will provide an on -site storage area to Iowa City for range and shooting supplies. f) Cedar Rapids will waive the tuition fee for Iowa City students of the Cedar Rapids Police Department's Basic Police Academy Class during the term of this MOA. 5. LIABILITY: Iowa City shall defend indemnify and hold Cedar Rapids and its officers and employees harmless from any and all liability, claims, damages, or causes of action of any kind arising out Iowa City's use of the shooting range made possible by this MOA. Iowa City shall repair or replace any damage to any real or personal property of Cedar Rapids which occurs during Iowa City's use. Nothing herein shall be construed as supplanting any applicable statute, rule, or regulation or as waiving any applicable immunity. 6. POINTS OF CONTACT: The parties will designate points of contact (POC) for purposes of this MOA. The POCs will address and resolve all issues related to this agreement. The parties agree to coordinate safety issues, jurisdictional matters, and other issues through their designated POC. 7. SETTLEMENT OF DISPUTES: a) Every effort will be made to resolve disagreements arising under or relating to this MOA through consultation between the parties. b) Issues or problems arising under the MOA that cannot be resolved by POCs may be raised by any party, through appropriate channels, to the ICPD Chief of Police and CRPD's Chief of Police, for resolution. 8. GRANT OF LICENSE: Iowa City may use, subject to all the terms and conditions stated or referenced herein, the Premises, including available parking areas. During the term of this MOA, the Iowa City shall abide by any and all administrative, operational, and safety rules and regulations established by the Cedar Rapids Police Department during the use of the Premises by Iowa City. 9. AMENDMENT, TERMINATION, ENTRY INTO FORCE, AND DURATION a) All activities of the parties under this MOA will be carried out in accordance with the terms and conditions of this MOA. b) Any party may terminate this MOA upon 30 days written notification to the other parties. Such notice will be the subject of immediate consultation by the parties to decide upon the appropriate course of action. In the event of such termination, the following rules apply: 1. The terminating party will continue participation, financial or otherwise, up to the effective date of termination. 2. Should this MOA be terminated by the City of Cedar Rapids prior to the end of the designated term, Cedar Rapids will reimburse Iowa City for the portion of the residual value of the improvements that were constructed with Iowa City's funds. The residual value shall be calculated by the funding provided reduced by straight line depreciation over 25 years starting when the Iowa City first provides the funding described hereinabove, : Reimbursement will not exceed the amount of funding provided by Iowa City. 10. TERM. This term of this MOA, which consists of 11 sections, will begin upon signature by Cedar Rapids and will remain in effect for twenty -five (25) calendar years, unless terminated as provided for hereinabove. It may be extended by mutual written consent of the parties' authorized representatives. 11. COMPLETE AGREEMENT. This MOA is the complete and exclusive statement of agreement between the parties with respect to use of the Cedar Rapids shooting range located at 2727 Old River Road SW, Cedar Rapids, Iowa 52303. This MOA supersedes all written and oral proposals and other communications between the parties. All activities of the parties under this MOA will be carried out in accordance with the terms and conditions of this MOA. This MOA is not intended to and does not inure to the benefit of or create a cause of action by any third parties. WHEREAS, the Iowa City Comprehensive Plan serves as a land use and planning policy guide setting forth a vision, goals and objectives for future development or redevelopment throughout the city, and policies for preserving valuable assets already present within established neighborhoods and provides notification to the public regarding intended uses of land; and WHEREAS, the goals and objectives included in the Downtown and Riverfront Crossings Plan were developed with significant public input gathered through a series of public workshops and focus group sessions that took place over the course of several months; and WHEREAS, the Downtown and Riverfront Crossings Plan establishes a set of planning principles, goals and objectives, and plan maps that relate specifically to the history and existing conditions of the area and establishes a vision for the future of the neighborhoods and commercial areas within the core of the city; and WHEREAS, the Downtown and Riverfront Crossings Plan will serve as a framework to guide future public and private investment in a manner that will benefit citizens living or working in the core of the city as well as citizens in Iowa City as a whole; and WHEREAS, the Planning and Zoning Commission has reviewed the Downtown and Riverfront Crossings District Plan and has recommended that it be included as an integral part of the Iowa City Comprehensive Plan. WHEREAS, the UniverCity Neighborhood Partnership Program is a joint effort between the University of Iowa and the City to encourage home ownership and reinvestment in designated neighborhoods surrounding the University of Iowa; and WHEREAS, the City purchases rental units located in designated neighborhoods surrounding the University of Iowa, rehabilitates them, and then sells them to income - eligible buyers; and WHEREAS, the City purchased and rehabilitated a single family home located at 828 East Market Street, Iowa City; and WHEREAS, the City has received an offer to purchase 828 East Market Street for the principal sum of $105,000 (the amount the City paid to acquire the home), plus the "carrying costs" of approximately $3,800, which are all costs incurred by the City to acquire the home, maintain it and sell it, including abstracting and recording fees, interest on the loan to purchase the home, mowing and snow removal, utilities, real estate taxes, and any costs in excess of $40,000 to repair and rehabilitate the home; and WHEREAS, this sale would provide affordable housing in a designated area surrounding the University of Iowa; and WHEREAS, on January 8, 2013, the City Council adopted a Resolution proposing to convey its interest in 828 East Market Street, authorizing public notice of the proposed conveyance, and setting the date and time for the public hearing; and WHEREAS, following the public hearing on the proposed conveyance, the City Council finds that the conveyance is in the public interest. Washington St., Iowa City, IA 52240 (319) 356 -5010 12 RESOLUTION NO. 13-29 RESOLUTION ENDORSING THE IOWA CITY COMMUNITY SCHOOL DISTRICT REVENUE PURPOSE STATEMENT AND SUPPORTING A POLICY TO ADDRESS SOCIOECONOMIC AND ENROLLMENT IMBALANCE IN THE DISTRICT WHEREAS, the Iowa City Community School District (ICCSD) Board of Education has voted to submit a Revenue Purpose Statement to the voters on February 5, 2013; and WHEREAS, the Revenue Purpose Statement stated expenditure purpose is: To provide funds to build and furnish a new school building or buildings; to build and furnish addition(s) to school buildings in the District; to remodel, repair, expand, and improve the school buildings in the District; to purchase and improve grounds; to furnish and equip district facilities; and WHEREAS, in Resolution No. 12 -534 passed on December 18, 2012, the City Council recommended a shared vision for the City and the ICCSD premised on the City's Strategic Plan that places a high priority on neighborhood stabilization and encourages income diversified neighborhoods throughout the community; and WHEREAS, approval of the Revenue Purpose Statement will aid the City and the ICCSD in achieving a shared vision; and WHEREAS, the ICCSD Board is considering a policy to address socioeconomic and enrollment imbalances that exist throughout the district; and WHEREAS, such a policy would complement the Revenue Purpose Statement by guiding capital resources in a manner that will ensure targets are met and equitable learning environments and educational opportunities for all students in the ICCSD are achieved; and WHEREAS, the City of Iowa City is committed to ongoing efforts to strengthen neighborhoods through strategic infrastructure investments, reinvestment in neighborhood parks, innovative programs that invest in the community's housing stock, sound urban planning and transportation policies, and continued usage of the affordable housing location model that ensures new subsidized rental housing is not located in areas with existing concentrations of such uses; and WHEREAS, approval of the Revenue Purpose Statement and a complementary policy that targets greater socioeconomic and enrollment balance will dovetail with these City efforts to strengthen neighborhoods and assist in achieving the shared objectives with the ICCSD. Although it is not perfect, I think that it is a step towards addressing a real problem of economic disparity in this community, At the same time, I believe that you have an obligation to the community and the school board to review and correct the City of Iowa City's housing policy, as so much of the problem which the school district is trying to fix has directly been caused by the city. The city needs to very promptly reduce the amount and concentration of low income housing which its policies has caused. It's not fair to the school board to have to solely deal with the effects of the city's policy failures -it is also your responsibility to correct what you created. I am sending a copy of this email to the ICCSD Board so that a discussion of what the city can do hopefully occurs when you have further communication with the board. I think that the Revenue Purpose Statement is a related but distinct issue. Quite frankly, myself and many others are undecided on this issue. The manner in which council addresses the housing issue will be a factor in how many vote on the Revenue Purpose Statement. Thank you for your attention to this matter. It does not seem possible to accomplish this and, if it is not possible, the policy should not be passed until this is explained to the public. For example, if the only way to meet the requirements is to swap Wickham for Twain, this should be made clear.
